AAP moves SC seeking time-bound mayoral polls in Delhi

    [ad_1]

New Delhi: The Aam Aadmi Party has moved the Supreme Court over the repeated adjournments of mayoral polls in Delhi.

In its suit, the AAP has demanded time-bound urgent mayoral elections and has also sought the prohibition on voting by aldermen as per law.

“People of Delhi gave majority to the Aam Aadmi Party in the MCD but BJP is not allowing us to form a government in the MCD. Aam Aadmi Party has moved the Supreme Court through its Leader of the House and Mayor candidate (Shelly Oberoi). We have placed two major demands in the Supreme Court, the first is to elect the Mayor in a time-bound manner and form the government in the MCD. Second, as aldermen do not have the right to vote under Article 243R of the Constitution and Section 3 of the DMC Act, they should be prohibited from casting votes,” said AAP leader Saurabh Bhardwaj.

Noting that the BJP’s MCD tenure ended in March 2022 itself, he said that “they have no moral right to capture and illegally control the MCD for so long”.

The MCD was put under the Central government on the pretext of unification and delimitation works, he said.

“Now the people of Delhi have given a majority to the Aam Aadmi Party in the MCD and elected 134 councillors of the AAP. Despite that, the BJP is not allowing the Aam Aadmi Party government to be formed in the MCD due to its conspiracy and dirty politics. Despite many efforts, they are not allowing the election of the Mayor and the formation of the government to take place,” he said.

“The court should complete this process as soon as possible. Because the Bharatiya Janata Party and the Central Government will not allow to complete this process. The Aldermen, in principle and in law, are unelected nominees and do not have the right to vote under Article 243R of the Constitution and Section 3 of the DMC Act. But the BJP wants to get them to vote by committing hooliganism. The Supreme Court should also give strict orders in this matter to the Central Government and the administration of MCD in this regard.”

The Mayoral election was first scheduled for January 6, but the House was adjourned following scuffle between the councillors of the BJP and the AAP. Then a session was convened on January 24 to elect the Mayor and Deputy Mayor and members of the Standing Committee.

However, after all the 250 newly-elected MCD councillors and 10 nominated members (aldermen) took their oath, the House was again adjourned until the next date after a ruckus created by the councillors of AAP and BJP.

The results of the MCD elections were declared on December 7, wherein out of the 250 seats, the AAP got majority by winning 134 seats, followed by BJP (104), Congress (nine) and Independents (three).

A combined parade was organised by Delhi Jail, Delhi Police and paramilitary forces in the lawns of the prisons headquarters here.

Also three economically weaker inmates are being released with the help of financial assistance from NGOs and six inmates are being released on the basis of government remission under the ‘Azadi ka Amrit Mahotsav’ programme,” the statement said.

The D-G also highlighted that due to decline in COVID-19 cases, the physical ‘mulakat’ has been started again in all jails leading to daily meeting of around 2,000 inmates with their families/relatives. In addition, around 300 inmates are benefiting daily through e-mulakat, it stated.

A skill development programme has been initiated for inmates by the Ministry of Housing and Urban Affairs under the Deendayal Antyodaya Yojna-National Urban Livelihoods Mission (DAY-NULM) by which approximately 1,020 inmates will be benefited, it said.

The Delhi Prisons has received a trophy from the National Crime Record Bureau (NCRB) for its good practices and implementation of Inter-operable Criminal Justice System (ICJS). In the India International Trade Fair-2022 also, the department had made a mark by exhibiting various products manufactured in jails at the stalls which were highly liked by the visitors, the D-G stated in the statement.

Baniwal also emphasised for participation of inmates in various corrective measures initiated by the department and promised many new initiatives to be taken up for reformation, rehabilitation and reintegration of the inmates in near future.

He honoured 10 officers/officials with ‘DG Disc’ and 10 officials with ‘appreciation letter’ for their excellent work and remarkable contribution in Delhi Prisons, it said.

2020 Delhi riots: Court frames charges against two accused

    [ad_1]

New Delhi: A Delhi court has framed charges for various offences, including rioting, against two accused for an alleged attack at the Modern Public Senior Secondary School on Brijpuri main road, during the 2020 riots.

The court was dealing with a case involving Shamim Ahmed, Mohd Kafil, and Faizan, accused of vandalism and arson on February 25, 2020.

Faizan, who is the third accused, was declared “proclaimed offender” as he is absconding.

The court said their common objective was to cause damage to properties as the school’s computer laboratory, library and several other goods were destroyed and the damages estimated up to Rs 1.25 crore as per the complaint.

On the basis of the statements of the witnesses, the court observed that there was enough material to the charges for what the accused persons have done.

However, the accused were discharged of charges of criminal conspiracy.

The court said: “Since the allegations of conspiracy are based on presumption, rather than any concrete evidence, I do not find it sufficient to presume that the accused persons acted out of pre-hatched conspiracy.”

BBC docu screening: 70 students protesting detention of 4 activists in Delhi detained, says SFI

    [ad_1]

New Delhi: Delhi Police has detained over 70 students who were gathered at Jamia Millia Islamia to protest against the detention of four activists over the proposed screening of a BBC documentary on Prime Minister Narendra Modi, the Students’ Federation of India said.

There was no immediate response from the police.

Heavy deployment of police personnel was seen outside the campus where the students were gathered. Personnel from the Rapid Action Force were deployed at the gate.

Pritish Menon, secretary of the Students’ Federation of India’s (SFI) Delhi state committee, said the police detained the protestors who had gathered there.

“We were about to begin the demonstration but they were detained before that. They were taken to the police station,” Menon told PTI.

The Left-backed SFI’s Jamia unit has released a poster informing that the documentary would be screened at the MCRC lawn gate 8 at 6 pm.

Delhi Police on Wednesday said they detained four students after the SFI announced its plan to screen the controversial documentary on the campus.

The university administration said the screening would not be allowed and that they were taking all measures to prevent people and organisations with a “vested interest to destroy the peaceful academic atmosphere of the university”.

The varsity administration also issued a statement, saying no permission had been sought for the screening of the documentary and it would not be allowed.

“It has come to the knowledge of the university administration that some students belonging to a political organisation have circulated a poster about screening of a controversial documentary film on the university campus today,” it said in the statement.

The university had earlier issued a memorandum/circular reiterating that no meeting/gathering of students or screening of any film shall be allowed on the campus without permission from the competent authority.

It said strict disciplinary action shall be taken against organisers in case of any violation.

“The university is taking all possible measures to prevent people/organisations having a vested interest to destroy the peaceful academic atmosphere of the university,” it said.

The SFI’s attempt to screen the documentary at the Jamia campus comes a day after a similar event was organised at Jawaharlal Nehru University during which students claimed that power and Internet were suspended and stones hurled at them.

Republic Day: Over 6,000 policemen deployed in New Delhi

    [ad_1]

New Delhi: Delhi Police have deployed over 6,000 police personnel in and around the New Delhi district amid adequate security arrangements for the safe conduct of the Republic Day parade, an official said on Tuesday.

Deputy Commissioner of Police, New Delhi, Pranav Tayal said that the police have made arrangements for around 70,000 people and the total deployment will be more than 6,000 police personnel.

Both static and mobile Quick Response Teams will remain alert to handle any untoward situation, he said,

“We have intensified the anti-terror measures in coordination with other agencies. Teams of National Security Guard will also be deployed,” the DCP said.

The city is already under a heavy security cover after intelligence agencies received inputs of a possible terror attack in the run-up to the Republic Day. Vehicles are being thoroughly checked at all the entry and exit points of Delhi.

“Delhi has always remained a target for anti-social elements. Threat perception is very high during such occasions. There are threat inputs and we have strengthened our security apparatus,” the DCP said.

The police have also installed 150 new CCTV cameras with some even having a feature of face recognition to keep an eye over the movement of every unsocial element.

This time the police have also introduced a new security feature in the entry pass of the Republic Day parade. “Every pass or ticket has a QR code. The entry will only be given when that code is scanned and the person carrying it is identified and verified,” the DCP said.

He said that no person without a pass or a ticket will be allowed to gain entry at the Kartavya Path.

The Delhi Police on Monday banned the flying of sub-conventional aerial vehicles over the national capital for security and safety reasons.

Delhi Police Commissioner Sanjay Arora issued the order, prohibiting the flying of aerial vehicles such as para-gliders, para-motors, hang-gliders, UAVs, UASs, microlight aircraft, remotely-piloted aircraft, hot air balloons, small-sized powered aircraft, quadcopters or even by para-jumping from aircraft till February 15.

Cattle scam: ED hopeful as Delhi court rejects Anubrata’s bail plea

    [ad_1]

Kolkata: The Enforcement Directorate (ED) probing the multi-crore cattle smuggling scam in West Bengal is now hopeful of taking Trinamool Congress strongman and the party’s Birbhum district president Anubrata Mondal to Delhi for questioning after the Rouse Avenue Court in the national capital rejected the latter’s bail plea on Tuesday.

However, sources said that ED will have to wait for a decision of the Delhi High Court on this count.

“Mondal had adopted the path of approaching multiple courts to stop us from taking him to Delhi for questioning. Accordingly, his counsels moved bail pleas in both Rouse Avenue Court and Delhi High Court. Now with the Rouse Avenue Court rejecting his bail petition, the first hurdle is clear. We will now have to wait for the Delhi High Court’s decision on this count,” said a legal associate of the central agency.

Mondal’s bodyguard Sehgal Hossain, who was also arrested in connection with the cattle smuggling scam, is currently under judicial custody at Delhi’s Tihar Jail. Sources said that the reason why the ED is so keen to take Mondal to the national capital is to place him face-to-face with Hossain and question the two together.

The hearing in the matter was scheduled at Delhi High Court on Monday. However, it did not happen because of the absence of the judge concerned and the next date of hearing has been scheduled on February 2.

Delhi HC asks police if same 2020 riots hate speech cases pending before SC

    [ad_1]

New Delhi: The Delhi High Court on Tuesday asked Delhi Police to inform whether the 2020 riots hate speeches cases it is dealing with are subject matter of the proceedings pending before the Supreme Court.

“If these hate speeches are also under consideration in the proceedings pending before the Supreme Court, would it be advisable for us to proceed with it?” a division bench of Justice Siddharth Mridul and Justice Talwant Singh said.

The bench was dealing with a bunch of petitions seeking FIRs against leaders like Union Minister Anurag Thakur, BJP leader Kapil Mishra and others for alleged hate speeches during riots.

The Supreme Court, on December 17, 2021 had asked the High Court to decide expeditiously, preferably within three months, on one of the petitions seeking FIR and investigation against politicians.

Furthermore, the court asked senior advocate Colin Gonsalves, who was representing one of the petitioners, Shaikh Mujtaba, regarding any instances in which the High Court had ordered that a retired judge launch a fact-finding investigation.

“Supreme Court has done so but has the High Court ever directed it? Supreme Court has powers under Article 142 which the High Court doesn’t exercise,” it held.

About the pendency of proceedings the bench said that none of these parties that are now impleaded were parties when these matters were first listed.

“That delay was occasioned not because of the court. They were not parties. That’s the point,” the court said.

“Today again we are told that there is only one petition before us and now the batch is clubbed again. The idea is to make sure that in this clutter, we don’t lose the plot. We want to know whether these hate speeches are subject matter before Supreme Court,” the court said.

On July 13, 2022, the HC had allowed the applications seeking impleadment of various political leaders like Thakur, Mishra and Parvesh Sahib Singh Verma, Congress leaders Rahul Gandhi and Sonia Gandhi, AAP’s Manish Sisodia and AIMIM’s Asaduddin Owaisi among others in the pleas.

The court listed the matter for the next hearing on February 2.

Conman case: Delhi court exempts Jacqueline from personal appearance for one day

    [ad_1]

New Delhi: A Delhi court on Monday granted one-day exemption from personal appearance to actor Jacqueline Fernandez in a Rs 200 money laundering case involving alleged conman Sukesh Chandrasekhar.

Additional Sessions Judge, Patiala House courts, Shailender Malik was supposed to hear the arguments on framing charges in the matter, but has adjourned this matter for February 15.

The court on January 16 issued notice to Enforcement Directorate (ED) seeking the agency to respond to an application moved to court by Jacqueline seeking permission to fly to Dubai post January 27 for professional work.

As she had made a request for urgent hearing, the court had, hence, listed the matter for next hearing on January 25.

Jacqueline, even in December last year, had moved a plea seeking to travel abroad to visit her ill mother in Bahrain. Howbeit, she withdrew it as the court wasn’t willing to allow her to travel abroad.

Chandrashekhar is accused of extorting money from politicians, celebrities and businessmen, and allegedly duped pharma company Ranbaxy’s former owner Shivinder Mohan Singh’s wife Aditi Singh of Rs 200 crore.

Chandrashekhar has allegedly sent super expensive gifts to Jacqueline, while he also booked a chartered flight for her from Mumbai to Chennai during his bail period.

Moreover, according to ED, it is suspected that alleged conman had sent huge chunks of money extorted from Singh to the actor.
