    Gurugram: A 19-year-old Delhi-based girl student was allegedly raped several times over a year by her Instagram friend, who also threatened to kill her, police said on Thursday.

    The victim, who had first met the man when she was underage, moved to police after he started blackmailing her into sleeping with his friends.

    According to the complaint she filed on Wednesday, she had met one Abhishek, a Gurugram resident, in July 2020 through Instagram. She met him first in a park in Gurugram.

    “In September 2021 we met again in MGF mall from where he took me to a guest house in DLF Phase-2 area where he raped me,” said the BA first year student.

    From thereon, the accused would often call her and submit her to have sex with him. According to the complainant, the accused raped her several times in a hotel in Manesar, police said.

    “He started blackmailing me and once again raped me in September last year,” she said.

    Following her complaint, an FIR was registered against the accused, Abhishek, under Section 6 of POCSO Sct as the victim was minor in 2020, and Section 506 (criminal intimidation) of the IPC at DLF Phase 2 Police Station on Wednesday.

    A senior police officer said that after a medical examination, the victim was produced in a city court for her testimony under section 164 of CrPC.

    “We are conducting raids to nab the accused and he will be arrested soon,” the officer added.

    New Delhi: The Delhi BJP staged a protest here demanding Delhi Deputy Chief Minister Manish Sisodia’s resignation in a snooping case.

    Although the BJP wanted to stage the protest outside the Aam Aadmi Party (AAP) headquarters, they were stopped by a heavy police contingent.

    Delhi BJP chief Virendra Sachdeva, MPs Parvesh Verma and Manoj Tiwari, former Union Minister Vijay Goel participated in the protest along with other party leaders and workers.

    The BJP protesters were adamant that they will march to reach the AAP headquarters. Some protesters also climbed over police barricades but were stopped.

    The protest came a day after the Union Ministry of Home Affairs gave sanction to prosecute Sisodia under the Prevention of Corruption Act in connection with the alleged ‘Feedback Unit (FBU) snooping case’.

    In view of the development, Congress leaders and workers started sloganeering outside the IGI Airport in the national capital.

    The Congress has alleged that this was an attempt to disrupt the plenary similar to the were ED raids in Chhattisgarh on Monday.

    New Delhi: Delhi’s Consumer Disputes Redressal Commission on Wednesday issued notice to delivery company Dunzo for alleged sexual harassment by its delivery partner, who showed up drunk at a woman’s address at midnight and later even threatened her over WhatsApp to withdrew her complaint.

    A bench of Raj Kumar Chauhan and Dr Rajendra Dhar issued the notice to Dunzo following a complaint seeking Rs 50 lakh damages for negligent hiring and alleged sexual harassment by a delivery partner.

    Complainant, Rahella Khan was represented by lawyers Abhishek Yadav and Ankita Wadhwa.

    In her complaint, Khan had stated that she had placed an order and a Dunzo delivery partner had showed up in a drunk condition at her address at midnight and abused her. However, after two days, the delivery partner sent a text to withdraw her complaint over WhatsApp.

    Khan also alleged that the man then harassed her and sent her murder and rape threats. He even used extremely profane language. The man even sent her photo some girls which he claimed to have murdered while warning her that she would be next.

    Khan had even sent a legal notice to Dunzo, which, in response, blamed her for contacting delivery partner directly.

    Not getting any response or action from Dunzo, Khan had filed a police complaint on which an FIR was also registered.

    City’s Saket court has also sought investigation report from the police, however, Khan, later moved the district consumer forum for damages on the grounds of sexual harassment, negligent hiring, false advertising, misrepresentation by the company application with regard to the time of the delivery, failure of the company to meet reasonable consumer safety expectation and overall negligence, among others.

    New Delhi: The body of an 11-year-old girl, who had gone missing on February 9, was found in a secluded area in outer Delhi’s Ghevra area, an official said on Wednesday.

    The police said that they have arrested the accused who has been identified as Rohit alias Vinod (21), a resident of Paschim Vihar.

    According to the police, a case of kidnapping was registered on February 10 based on the statement of a woman, a resident of Rajdhani Park in Nangloi, who said that her 11-year-old daughter did not return home from school on February 9.

    “Based on electronic surveillance and a suspected telephone number, the police conducted raids in Punjab and Madhya Pradesh. The accused Rohit was apprehended on Tuesday,” said Harendra K. Singh, Deputy Commissioner of Police (Outer Delhi).

    On interrogation, the accused disclosed that he had met the girl on February 9 and befriended her.

    “Rohit abducted the girl and killed her at a secluded place in Ghevra area. He took a police team to the spot where the decomposed body of the girl was found,” the DCP said.

    The autopsy was conducted on Wednesday after which the body was handed over to the family for last rites.

    “The court has sent Rohit to police custody for further investigation. The motive behind the crime is being ascertained,” Singh said.

    “The post-mortem report will confirm if there was any sexual assault,” the DCP added.

    New Delhi: The Delhi High Court on Tuesday asked the Centre to file its reply, within six weeks, on a PIL challenging provisions of Protection of Children from Sexual Offences (Pocso) Act, 2012, requiring compulsory reporting of sexual offences against minors.

    A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, dealing with lawyer Harsh Vibhore Singhal’s matter, issued notice on the petition and listed the case for pleadings to be complete before the Joint Registrar in July.

    Singhal has sought “judicial invalidation” of various sections of the POCSO Act, as these violate minors’ right to give informed consent for not reporting the matter and are against Article 21 of the Constitution.

    “… the law is well settled that neither law, nor police nor any court can force a sexual assault survivor to report an offence by filing an FIR and no police or court can force any minor in consensual sex to report her sexual activity. Thus, the impugned sections requiring mandatory reporting are untenable, arbitrary and unconstitutional and deserve to be set aside,” the petition contends.

    The petitioner argued that these provisions deprive minors and grown-up women of seeking prenatal, reproductive, and sexual healthcare.

    “…consensual sexual acts by under 18 minors fall squarely within the penumbra of the right to privacy which has also been recognised by a nine-judge SC bench in Puttaswamy v. Union of India”, the petitioner stated.

    The bench was urged by Singhal to declare the challenged provisions “unconstitutional”.

    New Delhi: The Delhi High Court on Tuesday sought the stand of the National Investigation Agency (NIA) on a plea seeking quashing of its probe against the banned Popular Front of India (PFI) in connection with an alleged criminal conspiracy to carry out terror activities in the country.

    Justice Jasmeet Singh issued notice on the petition by arrested PFI leader Oma Salam and asked the agency to file its response.

    While the judge remarked during the hearing that “there is no question of stay” in the matter, the counsel for the petitioner said he was “not pressing it” either.

    The counsel for the petitioner argued he was assailing the NIA case on “legal grounds” as the probe was not as per the NIA Act.

    He contended that the offences being probed by the NIA have to be first registered by the state government, which has not been done in the present case.

    The petitioner’s counsel also said no report under section 173 Criminal Procedure Code should be filed by the NIA in the case on completion of the investigation.

    The case, registered in April last year, pertains to an alleged criminal conspiracy hatched by people associated with the PFI to raise funds from within India and abroad for committing acts of terror in various parts of the country.

    The NIA has alleged that the accused were conducting training camps to indoctrinate and train their cadres to carry out terrorist activities.

    A large number of alleged PFI activists were detained or arrested in several states during the massive raids preceding the nationwide ban imposed on it on September 28, 2022.

    In near-simultaneous raids across the country as part of a multi-agency operation spearheaded by the NIA, several PFI activists were detained or arrested in 11 states for allegedly supporting terror activities in the country.

    The arrests were made in states and Union Territories, including Kerala, Maharashtra, Karnataka, Tamil Nadu, Assam, Uttar Pradesh, Andhra Pradesh, Madhya Pradesh, Puducherry, Delhi and Rajasthan.

    The government banned the PFI and several of its associate organisations for five years under the stringent anti-terror law UAPA, accusing them of having links with global terror groups like the ISIS.

    The matter will be heard next on July 11.

    New Delhi: The Delhi High Court on Monday was informed by Shahrukh Pathan, who had aimed a pistol at a policeman during the 2020 northeast Delhi riots, that the conclusion of the trial has been delayed for a long time now and that for more than a year now, only two witnesses have been examined out of 40.

    A single-judge bench of Justice Dinesh Kumar Sharma was dealing with Pathan’s bail plea, which he moved last year in January in a case related to rioting and causing injuries to police personnel; charges against him have already been framed in this case.

    Simultaneously, he is facing charges in another case in connection with aiming a pistol.

    A trial court had rejected his bail plea in December 2021.

    Pathan’s counsel Advocate Khalid Akhtar submitted: “There is a huge delay in the conclusion of the trial. Only two witnesses have been examined so far out of about 40. Until now, only two witnesses have been examined. I have been attacked in jail too,” he said.

    Akhtar, while urging the court for an early hearing, submitted: “The bail application has been pending for 14 months now. I filed the bail application here in January 2022.”

    The judge then listed the matter for the next hearing on May 2 and directed both Pathan and Delhi Police to file brief written submissions.

    A single-judge bench of Amit Sharma on February 9 had asked Pathan to file an application before the trial court for an early hearing of his plea alleging that he was assaulted by jail officials.

    Justice Sharma, who was dealing with a similar petition moved by Pathan, had said that since a plea has already been moved before the trial court, it is only just if an application is filed before the concerned court.

    His counsel Akhtar had contended that the trial court, which listed the matter for the next hearing on February 28, has not passed any order or direction that relevant CCTV footage be preserved or produced.

    Akhtar had said: “There was no order to the effect that some adequate safety measures be provided to him.”

    To this, Justice Sharma had orally said that the prerequisite is that Pathan moves an application before the concerned court, and if it does not work out, the court will grant him the liberty.

    “You move an application for an early hearing before the trial court. If nothing happens, we will see. We will give you the liberty,” he had said.

    Pathan had withdrawn his plea post getting liberty from the HC to move to the trial court for an early hearing of his pending plea.

    Though Pathan is an accused in various cases registered during the riots, the petition was moved in the case of aiming a pistol at Head Constable Deepak Dahiya on February 24, 2020. Social media was abuzz with his pictures.

    The First Information Report (FIR) in this case was registered under various Sections of the Indian Penal Code and Section 27 of the Arms Act. In December 2021, the trial court framed charges against Pathan and other accused in the FIR.

    On January 30, a court discharged a man accused of selling a pistol to Pathan.

    “The case against accused Babu Wasim is essentially based on surmises and conjectures rather than actual material or evidence and there is no ground to presume that the accused committed an offence under Section 25 Arms Act. He is accordingly discharged for the said offence,” Additional Sessions Judge Amitabh Rawat had said.

    Pathan had disclosed that he had purchased a pistol and 20 rounds from Babu Wasim by paying Rs 35,000 in December 2019, the prosecution had said.

    New Delhi: Unidentified miscreants arrived at the All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi’s residence in the national capital and allegedly pelted stones at it, damaging windows on Sunday evening, the police said.
    Following the incident, AIMIM Chief approached the police and lodged a complaint.

    In his complaint, Owaisi alleged that stones were pelted at his Delhi residence by some unknown miscreants.

    The incident happened at the Delhi residence of the AIMIM chief at Ashoka Road area at around 05.30pm.

    Following information, a team of Delhi police led by an Additional DCP visited his residence and collected evidence from the spot.

    Owaisi in his complaint to Parliament Street Police Station, alleged that a group of miscreants pelted stones at his residence, and damaged windows.

    “I reached my residence at 11:30 pm. Upon returning I found the glass of the windows broken and stones/rocks lying around. My domestic help informed that a group of miscreants threw stones at around at the residence around 5:30 pm,” Owaisi alleged.

    The AIMIM chief also said that this is the fourth such attack at his residence.

    “This is the fourth time such an attack has taken place. The area surrounding my house has enough CCTV cameras, and the same may be accessed, and the culprits should be apprehended immediately. It is conceived that such acts of vandalism are happening in such a high-security zone,” the letter further stated.

    “Immediate action must be taken, and the culprits should be arrested at the earliest,” he added in the letter.
