    New Delhi: The Delhi High Court on Tuesday stayed the proceedings before the trial court in a defamation case lodged by Delhi BJP spokesperson Tajinder Pal Singh Bagga against journalist Swati Chaturvedi.

    Justice Rajnish Bhatnagar issued notice on the petition by Chaturvedi challenging the summons issued by the trial court to her on the defamation complaint and asked Bagga to file his response to the plea in two weeks.

    “Till then, trial proceedings are stayed,” said the judge.

    The counsel appearing for the petitioner contended that no case for defamation was made out from the material on record and the complainant has not even brought forth witnesses before the trial court to substantiate his claim that his reputation was lowered due to the actions of Chaturvedi.

    The defamation case arises from a tweet Chaturvedi allegedly posted in 2017 in which she claimed Bagga had not only beaten up a lawyer once but was also arrested in a sexual harassment matter.

    Bagga’s counsel had told the trial court that the tweet was made after he was appointed a BJP spokesperson.

    The counsel for the complainant defended the summoning order and said the petition lacked merit and the issue of lowering of reputation was a question of fact to be decided during the trial.

    It was also said that there is no necessity under the law to examine any witness on the issue of loss of reputation at this stage.

    The counsel, who opposed stay on trial court proceedings, also said the allegation pertaining to the sexual harassment case was absolutely incorrect and the matter relating to beating up a lawyer was sub-judice.

    The petitioner’s lawyer said Bagga himself acknowledged the incident where he beat up another lawyer and the victim of the sexual harassment case in question had also earlier tweeted about it.

    A magisterial court order had directed Chaturvedi to appear before it in the case filed by Bagga in May 2018.

    The matter will be heard next on July 18.

    SRINAGAR: A female student from Kashmir suffered injuries after allegedly being attacked by an auto-driver near Friends Colony New Delhi on Tuesday morning, reliable sources said.

    They told news agency GNS that a medical student (name withheld) currently undergoing internship, was attacked with some sharp object by an auto-driver after an argument ensued over fare. The female student, they said, suffered abdominal injuries in the incident and was evacuated to a nearby health facility for treatment.

    “Before the police could reach the spot, the alleged auto-driver managed to escape”, they said.

    When contacted, a senior police officer at Friends Colony Police Station, New Delhi told GNS that they have registered a case into the incident. “A manhunt has been launched soon after the reporting of the incident to nab the culprit”, the police officer said. (GNS)

    New Delhi: The Delhi High Court on Tuesday granted transit pre-arrest bail to lawyer and Uttar Pradesh BJP spokesperson Prashant Kumar Umrao till March 20.

    Umrao moved the High Court on Monday seeking transit pre-arrest bail after the TN Police lodged an FIR against him for allegedly disseminating false information claiming attacks on migrant workers from Bihar in the southern state.

    TN’s Thoothukudi Central Police Station registered the FIR against Umrao under various sections of the Indian Penal Code (IPC) such as provocation with intent to cause riot, provoking breach of peace and statement leading to public mischief, promoting enmity and hatred.

    A single-judge bench of Justice Jasmeet Singh was hearing Umrao’s plea and on the latter asking 12 weeks’ anticipatory bail, the judge refused saying that “it can’t be such a luxury”. The applicant also urged for a six-week bail period.

    Appearing for the TN Police, Senior Advocate Sanjay Hegde opposed his bail application saying that he has a history of making tweets that incite violence.

    “He has a continual record of making such tweets and then deleting it without even a clarification,” he argued.

    On Umrao being the standing counsel for Goa, Hegde further said: “He is a man of some standing. Freedom of speech does not mean you light fire to a crowded theatre.”

    The judge said that the court will only see that he gets a proper redressal. “I will only ensure that he gets access to justice,” Justice Singh said.

    Umrao’s counsel advocate Kushal Kumar said that he will require reasonable time to reach the territorial jurisdictional court.

    Hegde argued that charges in the case are serious and that direct flights to Trivandrum and one stopover flights to Tuticorin are available and the applicant should have approached the territorial court.

    While granting bail, Justice Singh imposed conditions saying that Umrao will have to share his contact number with Hegde and his google location with the TN Police.

    Umrao’s petition, however, said that because he is a member of a different political party, he is a victim of political rivalry.

    The petition read: “The applicant intends to avail his legal remedies under Section 438 of the CrPC before the courts at Tamil Nadu having jurisdiction in the subject FIR, however, he is having grave apprehension that before he could avail such legal remedies, he would be arrested by the Tamil Nadu Police in connection with the FIR.”

    Umrao has alleged that his name has popped up after he tweeted something based on news covered by different national news agencies and that FIR has been wrongly registered against him.

    He had tweeted that “12 migrants from Bihar were hung to death in Tamil Nadu for speaking in Hindi” and shared a photo of Bihar deputy chief minister Tejashwi Yadav with TN Chief Minister M.K. Stalin saying that even after the migrants were attacked, Yadav attended the birthday celebrations of Stalin. The tweet has since been deleted.

    Delhi: In the latest development in connection with the Delhi excise policy scam, the Enforcement Directorate (ED) on Tuesday arrested Arun Pillai. This is the 11th arrest made by the ED in the case.

    Pillai was representing the South Group, which allegedly gave kickbacks of Rs 100 crore to the AAP leaders that were allegedly used in the Goa elections.

    The South Group was represented by Abhishek Boinpally, Arun Pillai and Buchi Babu. Boinpalli facilitated the transfer of Rs 100 crore kickback in connivance and conspiracy with Vijay Nair (Aam Aadmi Party’s communication in-charge) and his associate, Dinesh Arora.

    A land parcel worth Rs 2.25 crore in Vattinagulapalle, Hyderabad, owned by Pillai was recently attached by the ED.

    Pillai will be produced before Rouse Avenue District Courts later in the day. The ED is likely to seek his two weeks custodial remand.

    On March 2, liquor businessman Amandeep Dhal, the director of Brindco Sales Pvt Ltd was arrested by the ED. His questioning led to the arrest of Pillai, said sources.

    Dhal allegedly played a major role in the formulation, conspiracy and kickbacks paid by the south group. He had got a draft copy of the liquor policy before it was released. Dhal allegedly shared the draft copy with Binoy Babu. The ED has also alleged that he made arrangements of meeting between South Grop persons and Vijay Nair.

    The ED has claimed in the supplementary charge sheet that Vijay Nair, on behalf of leaders of the AAP received kickbacks to the tune of Rs 100 crore from the South Group, whose prominent faces are Magunta Srinivasulu Reddy, Raghav Magunta, Sarath Reddy and K. Kavitha, the daughter of Telangana Chief Minister K, Chandrasekhar Rao.

    Delhi: The Rouse Avenue Court on Monday granted bail to Hyderabad-based chartered accountant Butchibabu Gorantla, arrested by the Central Bureau of Investigation (CBI) in connection with the alleged Delhi liquor policy scam.

    Butchibabu Gorantla is the former auditor of Telangana Chief Minister K Chandrashekar Rao’s daughter MLC K Kavitha whose name surfaced in the case.

    Special Judge MK Nagpal on Monday granted bail to Butchibabu and asked him to surrender his Passport.

    The same court on Monday also sent former Deputy Chief Minister of Delhi Manish Sisodia to judicial remand till March 20, in the alleged Delhi liquor policy scam.

    The court also imposed a condition while granting bail that the accused shall not tamper with evidence and influence witnesses.

    Recently Rouse Avenue Court granted permission to Enforcement Directorate (ED) to quiz Butchibabu Gorantla in judicial custody. ED had moved an application and sought permission to quiz him and also to record his statement in the money laundering case pertaining to the Excise Policy.

    CBI arrested Butchibabu in the Delhi excise policy case on February 8.

    After his arrest, CBI informed in a statement that the accused CA was arrested for his alleged role in formulating and implementing the Delhi Excise Policy and causing wrongful gain to Hyderabad-based wholesale and retail licensees and their beneficial owners.

    Recently ED in its chargesheet stated that the Prevention of Money Laundering Act (PMLA) investigation done so far revealed that, the Delhi Excise Policy, 2021-22 was created by the top leaders of the Aam Aadmi Party (AAP) to continuously generate and channel illegal funds to themselves.

    ED further stated that the extent of involvement and abatement done by AAP leaders of the criminal activities undertaken by the accused covered in the subject Prosecution Complaint further substantiates their design and scheme of the scam.

    The policy promoted cartel formations through back door awarded an exorbitant wholesale profit margin of 12 per cent and a huge retail profit margin of 185 per cent and incentivized other illegal activities on account of criminal conspiracy by the top leaders of AAP to extract kickbacks from the businesses, stated the ED.

    Vijay Nair, on behalf of AAP leaders, has received kickbacks to the tune of Rs 100 crore from a group, for convenience, we may call it the South Group (as termed in the statements of various persons recorded during the investigation, whose prominent persons are Magunta Srinivasulu Reddy, Raghav Magunta, Sarath Reddy and K Kavitha).

    The South Group was represented by Abhishek Boinpally, Arun Pillai and Butchibabu. Abhishek Boinpalli facilitated the transfer of Rs 100 crore kickback in connivance and conspiracy with Vijay Nair and his associate Dinesh Arora, claimed the ED.

    The ED and the CBI had, last year registered cases alleging that irregularities were committed while modifying Delhi’s Excise Policy, undue favours were extended to licence holders, the licence fee was waived or reduced and the L-1 licence was extended without the competent authority’s approval.

    The beneficiaries diverted “illegal” gains to the accused officials and made false entries in their books of account to evade detection.

    As alleged, the Excise Department had decided to refund the Earnest Money Deposit of about Rs 30 crore to a successful tenderer against the set rules.

    Even though there was no enabling provision, a waiver on tendered licence fees was allowed from December 28, 2021, to January 27, 2022, due to Covid-19, which allegedly caused a loss of Rs 144.36 crore to the exchequer, which has been instituted on a reference from the Union Home Ministry following a recommendation from Delhi Lieutenant Governor Vinai Kumar Saxena.

    The CBI inquiry was recommended on the findings of the Delhi chief secretary’s report filed in July showing prima facie violations of the GNCTD Act 1991, Transaction of Business Rules (ToBR)-1993, Delhi Excise Act-2009, and Delhi Excise Rules-2010, officials had said.

    New Delhi: Delhi Police will record statements of witnesses, including passengers and crew members, on the American Airlines flight on which an inebriated Indian student allegedly urinated while asleep in his seat and soiled a male co-passenger, officials said on Monday.

    The alleged incident occurred on flight AA292 from New York, which landed at Delhi airport at 9.50 pm on Saturday.

    Based on a complaint from the airline, a case was registered and, as part of their ongoing investigation, investigators will record statements of the witnesses, including the passengers and the crew members, on the flight, a senior Delhi Police official said.

    The airline also submitted a complaint to Delhi Police, addressing the T-3, IGI Airport, SHO.

    “….Upon aircraft arrival, purser informed that passenger was heavily intoxicated, was not adhering to crew instructions on board. He was repeatedly arguing with operating crew, was not willing to be seated and continuously endangering safety of crew and aircraft and after disturbing safety of fellow passengers, finally urinated on (the other) passenger…,” the complaint stated.

    The airline mentioned that it had cancelled the student’s return ticket and barred him from future travel on its flights.

    In a statement on Sunday, the airline had said that the flight was “met by local enforcement upon arrival in Delhi due to a disruptive customer” but did not provide specific details about the incident.

    Delhi airport DCP Devesh Kumar Mahla had said a complaint of urination on a co-passenger was received from American Airlines against one person, who is a student in the US. The accused is a resident of Defence Colony in the national capital.

    “We have registered a case under sections 510 (misconduct in public by a drunken person) and 294 (punishment for obscene acts or words in public) of the Indian Penal Code and sections 22 and 23 of the Civil Aviation Act. The accused joined the probe along with his father. He was released after interrogation. He has not been arrested in the case yet as further investigation in the matter is still underway,” he said.

    The male victim was not keen on reporting the matter to the police after the student apologised to him as it might put his career in jeopardy, according to a source.

    However, the airline took the matter seriously and reported it to the Air Traffic Control at the airport.

    New Delhi: A Delhi court on Monday extended the judicial custody of Sahil Gehlot, the main accused in the Nikki Yadav murder case, and five others by 14 days.

    Additional Chief Metropolitan Magistrate, Dwarka courts, Samiksha Gupta extended their judicial custody till March 20.

    The magistrate also allowed family of co-accused Ashish and Lokesh to meet them in the courtroom.

    Appearing for Lokesh, advocate Anirudh Yadav moved an application seeking the marking of the case diary and showed displeasure over manipulation in it.

    The judge listed his application for hearing on March 13.

    On February 20, Gupta had sent five co-accused to 14 days of judicial custody and two days later, Chief Metropolitan Magistrate Archana Beniwal sent Gehlot to 12-day judicial custody.

    Four fresh charges were invoked by police under different Sections of the Indian Penal Code (IPC).

    Gehlot’s counsel D.S. Kumar had said that while the FIR was initially registered under Sections 302 (murder) and 201 (causing disappearance of evidence of offence, or giving false information to screen offender) of the IPC, police have now invoked Sections 120 B (criminal conspiracy), 34 (common intention), 202 (intentional omission to give information of offence by person bound to inform), and 212 (harbouring offender).

    Gehlot had allegedly strangled 23-year-old Yadav near Kashmiri Gate on February 10 and married another woman on the same day.

    Yadav’s body was found in a fridge at a dhaba, owned by Gehlot, in Mitraon village on the outskirts of Delhi on February 14.

    Gehlot’s father Virender Singh; cousins Naveen (a constable in Delhi Police) and Ashish; and friends Lokesh and Amar are accused of hatching a conspiracy to get rid of Yadav, so he could go ahead with his wedding with another woman.

    According to a senior police official, Gehlot was interrogated at length during police custody and disclosed that Yadav was trying to stop him from marrying someone else as they had already solemnised their marriage in 2020.

    “She was pleading with him not to go ahead with the marriage fixed by his family with another girl on February 10. However, Gehlot along with his father, two cousins, and two friends hatched the conspiracy and planned to remove the deceased from their way,” the official had said.

    “He executed the plan and murdered her and informed other co-accused persons about it on the same day and then all of them went ahead with the marriage ceremony.”

    New Delhi: A Delhi court on Monday sent Aam Aadmi Party leader and former Deputy Chief Minister Manish Sisodia to judicial custody till March 20 in the alleged liquor policy case being probed by the Central Bureau of Investigation (CBI).

    Special Judge M.K. Nagpal of Rouse Avenue Courts was hearing the case, who had, on March 4, also extended Sisodia’s CBI custody for two days and listed his bail plea for March 10.

    The counsel appearing for the central agency said that at this stage, they are not seeking further CBI remand but in the next 15 days they might seek it.

    More details are awaited.

    In the last two days, the CBI questioned him with key witnesses — former excise commissioner Arva Gopi Krishna and former excise department secretary C Arvind — in this case, who recorded their statements in front of a magistrate.

    The AAP leader, while addressing the court, had earlier said that the CBI was asking the same questions again and again and it is mental harassment.

    “They are not using third degree. But sitting for eight to nine hours and answering the same questions again and again, that too is mental harassment,” he told the court.

    The court had also directed the CBI to conduct his medical exams at regular intervals.

    The agency arrested Sisodia on February 26 after eight hours of questioning.

    New Delhi: The Delhi High Court has stayed an order of the National Green Tribunal permitting pruning of trees in the city’s Vasant Vihar area.

    Justice Najmi Waziri issued notices to the city authorities, including the Delhi government and the tree officer concerned, on a petition challenging the NGT order and said that further pruning in the area shall be kept in abeyance.

    Senior counsel for the petitioners contended that pruning in the present case was illegal as it could be done only with strict permission of the tree officer and not on general guidelines and that extensive damage has been caused to trees in the area, which has set back the greenery by a decade.

    “A more detailed assessment of the activity done by the RWA (resident welfare association) needs to be carried out. Further pruning in the area concerned has to be stopped right away…further pruning in the area shall be kept in abeyance,” said Justice Waziri in a recent order.

    The court appointed lawyer Aditya N Prasad as amicus curiae and asked him to assess the situation at site and assist it in the matter.

    The court also called for a fresh affidavit by the tree officer and said he can issue further orders in the matter if necessary.

    The petitioners, Dr Sanjeev Bagai and others, said that under the Delhi Preservation of Trees Act, 1994, the essential part of the preservation is that a tree should not be damaged in a manner which would impede its growth or otherwise severely affect its re-growth and regeneration.

    It was stated that any woody plant which has a height of 30 cm and a trunk diameter of not less than 5 cm is considered a “tree” and is to be protected under the Act.

    In the present case, it was argued, quite a few trees have been lopped off and approximately 800 trees have been pruned in violation of the law.

    The matter would be heard next on March 10.
