2020 Delhi riots: Court rejects anticipatory bail of accused, probe ordered

    [ad_1]

New Delhi: A court here has rejected the anticipatory bail of an accused in a case pertaining to the 2020 northeast Delhi riots and directed the Delhi Police to conduct a proper investigation into the case.

The court was hearing the pre-arrest bail plea of Sunder against whom Bhajanpura police station had registered a case for various offences, including for rioting and arson.

“The report (by the investigating officer) shows that till the time of moving this application, the applicant remained untraceable by the police. Moreover, his name has been taken by several eyewitnesses and he is also reported to be appearing in the video footage and in these circumstances, I do not find the applicant entitled to pre-arrest bail,” Additional Sessions Judge Pulastya Pramachala said in an order passed on Wednesday.

The court rejected the argument of Sunder’s advocate that the applicant was granted bail in two other cases registered at the same police station, saying it could not be a “guiding factor” to decide the bail application in the present case.

“At the same time, I am not very much satisfied with the kind of investigation done in the case, wherein no attempt has been made to recover any looted materials. Hence, the matter is referred to the station house officer (SHO) to ensure that a proper investigation is done in this case…IO shall hand over a copy of this order to SHO for compliance,” the court said.

The court noted the IO’s reply, according to which Sunder had joined the investigation on March 6 and allegedly in his disclosure statement, he confessed to having looted and vandalised several stores, including mobile phone shops.

“But surprisingly neither anything has been said about an attempt made to recover the looted articles, nor the requirement of further investigation or interrogation of the applicant and on the contrary, IO reports that custodial interrogation is not required,” the court said noting the reply.

The court also noted that the IO said nothing has been done to recover the looted articles.

  • Delhi BJP to protest at Jantar Mantar on March 21, lay siege to Assembly on March 23

Delhi BJP to protest at Jantar Mantar on March 21, lay siege to Assembly on March 23

    [ad_1]

New Delhi: The BJP has decided to intensify its agitation to put pressure on Delhi Chief Minister Arvind Kejriwal, whom it alleged was the mastermind of the liquor scam, to resign.

The BJP believes that Kejriwal should resign on the basis of morality, and if he does not do so, the BJP will force him to resign.

Leader of Opposition in Delhi Assembly, Ramvir Singh Bidhuri, and Delhi BJP General Secretary Kuljeet Chahal disclosed the party’s strategy at a press conference here.

They said that the ED has been told by Delhi government officials that Kejriwal had directed them to implement the liquor policy, following which the latter has no right to continue as the Chief Minister.

For the last 15 days, the BJP is protesting in Delhi demanding the Chief Minister’s resignation.

Now after new revelations have come to the fore, BJP has decided to intensify the protest from March 16.

From March 16, the BJP will go door-to-door and distribute leaflets, in which full details of the irregularities, corruption and loot of Delhi’s government treasury used to implement the excise policy will be given to the people.

In support of this demand, the BJP will protest in the state Assembly during the upcoming session and all the ministers of Delhi will be ‘gheraoed’.

Bidhuri said that the arrest of former Delhi Deputy Chief Minister Manish Sisodia is not enough to expose the excise policy scam, but Kejriwal is the real mastermind of the scam.

BJP leaders said that Kejriwal calls for honesty in politics but he has done maximum corruption in politics. Therefore, his resignation is the only solution and BJP will continue the protest till Kejriwal does not resign.

  • How Eric Garcetti avoided a career-ending humiliation and made it to New Delhi

How Eric Garcetti avoided a career-ending humiliation and made it to New Delhi

    [ad_1]

    senate india ambassador 45304

That’s because it was. Garcetti’s future in big-league elected politics would have dimmed considerably had he failed to get to New Delhi. The 52-year-old Democrat spent months trying to beat back accusations that he knew about allegations that a top aide had sexually harassed and assaulted fellow office members and others. On Wednesday, Garcetti was able to advance with the help of seven Republicans, winning Senate confirmation in a 52-42 vote.

Much of the public posturing around the vote focused on seating a top diplomat in a key geopolitical nation.

For Garcetti and his team — but also to an extent the White House — it was also about survival. Get Eric to India so he can try to put this behind him. It’s why Garcetti returned time and again to Washington, privately ducking into Senate offices and spending so many days in the Capitol while he was still mayor that people close to him started referring to it as a satellite City Hall. (West Wing Playbook spotted Garcetti at the White House between meetings with senior officials twice in the last 20 months).

It’s why Garcetti’s parents, Gil and Suki, spent $90,000 of their own money on lobbyists for him through the end of last year. It’s also why he enlisted scores of staffers to sign petitions, letters and make calls to senators attesting to his character. And it’s why Biden’s top legislative affairs staffers, Louisa Terrell and Reema Dodin, along with Garcetti, scrambled into the final hours to secure a few more votes.

“I’ve had the best job one could ever imagine in politics and if I never had a political job tomorrow, I would die happy,” Garcetti told West Wing Playbook after the vote. At one point, he fielded a congratulatory call from Sen. Catherine Cortez Masto (D-Nev.). “What hurts is untruths and attacks against your reputation. … Your reputation is everything. That’s all you have. And you better defend it. And people who believe in you better defend it. And they did.”

The issue that nearly tanked his nomination should have been obvious to Garcetti, but its radioactivity wasn’t at first. At his initial Senate hearing, Garcetti fielded just one throw-away question on whether he knew at the time about sexual harassment allegations against a top confidant, Rick Jacobs. Garcetti testified under oath that he did not and would have acted swiftly if he had.

But the campaign against him was so relentless and formidable that it surprised even Garcetti. Former aides, led by Naomi Seligman, worked around the clock for much of the past 20 months. They pointed to court testimony and their own experiences with Jacobs and Garcetti to contend there was no way the mayor didn’t know, and that he oversaw an office culture that silenced victims. They met with nearly a third of the Senate, winning conservative allies like Sen. Chuck Grassley (R-Iowa), but ultimately being disappointed by others, namely Democrats who have spoken out over their careers about harassment and sexual assault.

“Yes, we need an ambassador to India,” Seligman said after the vote. “But having the right person is more important than having a person right now. We all knew who Eric Garcetti is. This vote didn’t change that.”

Garcetti maintained his lack of knowledge about Jacobs and pointed to the people from his office staff and around him who for years have said the same. “There were so many things that were so easy to rebut once people spend the time and don’t just listen to me, but listen to the first-hand witnesses that were there,” Garcetti said. He suggested that his detractors used the Jacobs controversy to humiliate him.

“Other accusations or beefs that people have, I’ve never closed off that those should be adjudicated someplace else,” he said. “But don’t try to pull me in just because I have a public name or title.”

A loyal and early ally for the president, Garcetti was diplomatic about how long senators took to hold their floor vote. Once the nomination stalled, he was fine with waiting till after the midterms. He had influential allies willing to be patient too, including Sen. Cory Booker (D-N.J.) and Commerce Secretary Gina Raimondo, longtime friends who made calls and whipped votes.

“I can’t tell you how many senators said I talked to X, Y and Z who went to college with you, the person who married you, the person who heads up an organization who’s known you for 20 years, who’s traveled with you for two or three weeks. Those sorts of things meant a lot to people,” Garcetti said.

As for his political future, he doesn’t deny rumors about eyeing a possible statewide run in California, perhaps for governor when Gavin Newsom steps down. Possibilities like that, after all, may now be there when he returns.

“I know every politician has secret plans. My only focus is on this job. I want to serve this country and do the best that I can at this moment,” he said. “I’ll always come back to L.A., but I have no idea whether I’ll ever run for anything or not.”

Delhi Police files chargesheet against Flipkart for selling acid

    [ad_1]

New Delhi: The Delhi Police has filed a chargesheet against e-commerce firm Flipkart and its delivery firm Instakart under the Poison Act for selling acid on its website, which was used by three individuals to throw at a 17-year-old girl in December 2022.

The chargesheet has also been filed against three accused who used the acid to attack the girl who was on her way to school. The incident took place in Dwarka’s Mohan Garden area on December 14, 2022.

Speaking with IANS, M. Harsha Vardhan, DCP (Dwarka) said that the chargesheet was filed against Sachin Arora, Harshit Aggarwal a.k.a. Honey and Virender Singh a.k.a. Sonu and two private firms under section 326-A, and 34 120-B of the IPC read with section 4 of Poison Act.

The chargesheet was filed before a Dwarka court judge.

All the three accused are currently in judicial custody.

The Delhi Police is banking on electronic and forensic evidence to collect more information on the matter.

In the forensic report, the acid was found to be ‘Nitric Acid’.

The Delhi Police has mentioned in the chargesheet that the accused also told them that they wanted to buy Nitric Acid, which proves the prosecution (police) story.

After the incident, Delhi Police had sent notice to Flipkart and Instakart, and had asked them regarding compliance of regulations related to the sale of acid.

Sources said that in their reply, they had accepted that it was sold without having proper license.

A 17-year-old girl was attacked by two bike-borne masked assailants in Mohan Garden on December 14 last year when she was on her way to school.

The accused hurled acid at the victim. She had suffered severe burn injuries in the incident.

Later, all the three accused were held.

It was learnt that Sachin and the victim were friends but after their friendship ended, Sachin wanted to teach the girl “a lesson”. Sachin bought the acid and made the payment through an e-wallet.

  • Delhi HC lists plea of AAP’s Jasmine Shah for March 29

Delhi HC lists plea of AAP’s Jasmine Shah for March 29

    [ad_1]

New Delhi: The Delhi High Court on Wednesday posted Aam Aadmi Party (AAP) politician Jasmine Shah’s plea challenging Lt Governor Vinai Kumar Saxena’s decision to restrict him from “discharging his duties” as the Vice Chairman of the Dialogue and Development Commission of Delhi (DDCD), for the next hearing on March 29.

The LG had also restricted Shah from using any privilege and facilities associated with the office.

Additional Solicitor General Sanjay Jain sought an adjournment in the matter as he had to argue in a death reference matter before the apex court. He stated that it was part heard and the whole day will go in submissions as it is related to Lajpat Nagar bomb blast case.

Senior advocate Rajiv Nayar, appearing for Shah contended that he has argued at length in the matter, and there is no interim order.

The court then adjourned the matter.

On February 9, Nayar had argued that the entire power lies within the Legislative Assembly and power of appointment and removal is only with the Chief Minister.

Referring to the Transaction of Business (Amendment) Rules, he had said: “The course of action of the rules should be followed by the LG with reference to Chief Minister or its counsel.”

The High Court, on December 13, held that in the absence of consensus between Chief Minister Arvind Kejriwal and LG Saxena on removal of Shah as Chairman of DDCD, the matter has been referred to the President.

The court was also informed that in the exercise of powers under Article 239AA, the LG has ordered that Shah will not be allowed into the DDCD office till the President takes a call on the issue.

The LG had said that until the President returns a decision on the matter, it would be prudent for the parties to take no further action.

On November 28, the HC sought a response from the LG after Shah moved the HC challenging L-G’s actions.

Saxena on November 18, had asked CM Kejriwal to restrict Shah from “discharging his duties” as the Vice Chairman of the DDCD and from using any privilege and facilities associated with the office.

A single-judge bench of Justice Prathiba M. Singh had said that it will examine the LG’s response, before deciding whether he could have passed an order like that.

The judge had said she cannot deal with the issues without having affidavits on record and asked the respondents to file affidavits before the next date of the hearing. It had also sought responses from the Director (Planning) Govt of NCT of Delhi and the local sub-divisional magistrate (SDM).

Shah’s office was sealed late on November 17, by the SDM, Civil Lines. ASG Jain, appearing for the LG, had told the court that there are “larger issues” involved in the case.

However, the Delhi government counsel had told the Court that Saxena’s request to remove Shah had not been accepted. The Planning Department has also been ordered to cancel its order closing Shah’s office and withdrawing facilities granted to him.

The LG’s actions followed after Bharatiya Janata Party MP Parvesh Singh Verma filed a complaint alleging Shah was acting as the official spokesperson of AAP for political gains, in violation of established procedures.

The LG had also asked the CM to sack Shah for allegedly “misusing his office for political purposes”. Shah had said the LG’s action is “without jurisdiction, completely illegal, and unconstitutional”. The AAP politician then moved the High Court to challenge the L-G’s actions.
