Delhi police notice to Rahul Gandhi for details on ‘sexual harassment’ of women

    [ad_1]

New Delhi: A team of Delhi Police led by senior police officials on Sunday reached the residence of Congress MP Rahul Gandhi to record his statement in connection with his Bharat Jodo Yatra speech in Srinagar in which he had mentioned about the sexual harassment of some women.

Sources said that senior police officials had served the notice to Gandhi in this respect.

The source said that Gandhi himself received the notice.

Following the meet, Congress leader Rahul Gandhi assured the Delhi police that he will share the information about the claims that he had made during his Bharat Jodo Yatra speech in Srinagar, and also said that he needed some time for this.

“We have met Rahul Gandhi, he has said that he needs time to give his statement. Gandhi said that the Yatra was so long and he needed to recollect who had connected him and his team. After receiving details he has assured to share them with us,” said a police official who did not wish to be named.

A Delhi police team led by Special Commissioner of Police, Law and Order, Dr Sagar Preet Hooda and Deputy Commissioner of Police (DCP), New Delhi Pranav Tayal had reached Gandhi’s residence at Tughlak lane early this morning to serve him notice.

The Delhi police also had a questionnaire ready, which they wanted to give to him, in case he wants to reply in a written format.

Gandhi had mentioned about the victims of sexual harassment in his Bharat Jodo Yatra speech in January in Srinagar.

The Delhi Police took cognisance of his account of the Yatra that he interacted with some women who were raped.

The Delhi Police had visited him twice and waited for hours to get the details about the victims of sexual abuse who had approached him to seek security.

Congress protest after notice to Rahul Gandhi:

The national capital on Sunday witnessed a massive drama with the Congress workers taking to the streets after the Delhi police served a notice to their party leader Rahul Gandhi over his speech made during Bharat Jodo Yatra in Srinagar.

A few of them were detained by the Police for posing a threat to the law and order of the city.

Soon after the Police served a notice to former Congress president Rahul Gandhi for his speech made in connection with alleged sexual assault on women, during his Bharat Jodo Yatra in Kashmir, a number of party workers gathered outside his residence in Tughlak lane area to stage a protest.

The protestors were raising slogans against the Delhi Police and Centre.

Sensing the gravity of the matter, extra police force which was deployed in the morning, detained the protestors.

Delhi Police has said that they only want to take action against the culprits who sexually assaulted the women.

Rahul Gandhi had, during his speech, said that a few women met him and alleged that they were sexually assaulted.

  • 2020 Delhi riots: Court orders framing of arson, attempt to murder charges against 19

2020 Delhi riots: Court orders framing of arson, attempt to murder charges against 19

    [ad_1]

New Delhi: A Sessions court here has ordered framing of charges against Faisal Farooq, the owner of Rajdhani school, and 18 others for their alleged involvement in a case of arson, attempt to murder and criminal conspiracy during the 2020 northeast Delhi riots.

The court was hearing a case where a riotous mob, on the purported instigation of Farooq, allegedly torched DRP School and adjoining properties near Shiv Vihar Tiraha on February 24, 2020. The 18 accused persons were reportedly part of the riotous mob.

According to the prosecution, the mob was using Rajdhani School as its base for the purpose of throwing petrol bombs and stones at the properties of a particular community and also robbed valuable items from the school.

“I find that (all) accused persons are liable to be tried for offences punishable under sections 120 B (criminal conspiracy) of the Indian Penal Code read with sections 147 (rioting ) 148 (rioting, armed with a deadly weapon) 302 (murder) 153A (punishment for promoting enmity between different groups on the ground of religion, race, place of birth, residence, language, etc.), 395 (dacoity)…of the IPC,” Additional Sessions Judge Pulastya Pramachala said in an order passed on Friday.

Charges are to be framed against them also under sections 427 (punishment for committing mischief and thereby causing loss or damage to the amount of Rs fifty or upwards), 435 (Mischief by fire or explosive substance with intent to cause damage to an amount of 100 rupees or upwards), 436 (mischief by fire or explosive substance with intent to destroy house, etc.) and 450 (house-trespass in order to the committing of any offence punishable with imprisonment for life) of the IPC, the judge said.

All accused except for Farooq were also liable to be tried under sections 147, 148,153 A, 395,427, 435, 436, 450, 307 (attempt to murder) of the IPC read with sections 120 B, 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) and 188 ( disobedience to order duly promulgated by public servant) of the IPC, the judge added.

“Faisal Farooq is also liable to be tried for offence punishable under sections 147, 148, 307, 395, 427, 435, 436, 450 of the IPC read with 120 B of the IPC, and for the offence punishable under sections 153A and 505 (statements conducing to public mischief) of the IPC,” the judge said.

ASJ Pramachala also put on trial Mohd. Ansar under the provisions of the Arms Act.

Regarding the identification of the accused persons as members of the riotous mob, the judge said the rule of prudence can be applied only after trial, at the time of assessment of the evidence on the parameters of credibility.

Rejecting the arguments for the discharge of the accused, such as call details record (CDR) locations and the delay in registration of FIR and recording statement of witnesses, the judge said, “I have considered all these contentions, but I do not find the discharge of any accused being made out on the basis of these contentions, in view of the evidence of identification of all the accused persons as part of the riotous mob.”

ASJ Pramachala said while CDR locations were not the basic premise of the prosecution’s case and were used as additional evidence, the absence of the test identification parade (TIP) could not be claimed as a ground for discharge.

The judge also rejected the plea of delay for seeking discharge, saying “It is well known that riots had shaken Delhi and so even police agency could have been under tremendous pressure on account of riots and the consequent flow of complaints and by that time already Covid 19 virus had knocked the door of our society and was on continuous rise, leading to nationwide lockdown .”

The court said the credibility of any witness can be looked into only after conducting the trial and there was evidence of arson on the day of the alleged incident.

Regarding the alleged conspiracy, the court said, “In the present case, the description of evidence shows the deliberation among Farooq and other accused persons, which was subsequently followed by an attack on DRP School and other nearby properties of Hindus.”

It said prior to the attack, a large number of people of a particular community had assembled at Farooq’s school, which was followed by continuous instances of pelting of stones and petrol at nearby properties and DRP School, and this reflected “preparations made on the basis of a meeting of mind among the accused persons to indulge into a particular act as alleged in this case.”

Noting the complaint and statements of witnesses, the court said it was “beyond doubt that an unlawful assembly was formed with a common object to attack upon the properties belonging to persons from the Hindu community.”

Regarding the offence of attempt to murder, the court noted the statement of a witness, according to which the mob was exhorting to kill people of a particular community and that accused Mohd. Ansar fired at him.

It said, “The acts of accused Farooq showed that he had a meeting of mind with other members of the mob for facilitating an attack against the properties of Hindus and DRP School. He also made a provocative statement against Hindus, which had the effect of encouraging hatred between the community of Hindus and Muslims.”

Dayalpur police station had registered an FIR against Faisal Farooq, Shahrukh Malik, Shahnawaz, Rashid, Mohd. Faisal, Mohd. Sohaib, Shahrukh, Azad, Ashraf Ali, Parvez, Aarif, Sirajuddin, Faizan, Irshad, Anis Qureshi, Mohd. Parvez, Mohd. Illyas, Mohd. Furkan, and Mohd. Ansar.

Delhi excise policy case: ED likley to confront Sisodia with his PA today

    [ad_1]

New Delhi: Aam Aadmi Party leader and former Deputy Chief Minister Manish Sisodia’s personal assistant (PA), Devender Sharma is likely to join the probe of the Enforcement Directorate (ED) in connection with the Delhi excise policy scam case on Saturday.

Sharma is likely to be at the probe agency office by 11 a.m.

There are possibilities that Sharma might be confronted with Sisodia. He was summoned on Friday by the ED.

The ED has already got five days more custody of Sisodia in the case. The ED had earlier told the court that during interrogation former Secretary C. Arvind, Excise Secretary Arava Gopi Krishna and Sanjay Goyal were confronted together.

The ED, while seeking more custodial remand of Sisodia, said that C Arvind had to be confronted again. Apart from him, the ED wants to confront witness Dinesh Arora and accused Amit Arora.

The ED has said that they have recovered huge cloud data which they were looking into. Apart from this, the agency also had to get details about the cell phones of all the accused which went missing.

The ED has as of now filed two charge sheets in the matter — a charge sheet and a supplementary charge sheet. They are all set to file a second supplementary charge sheet in the case.

ED summons YSRC MP Magunta Sreenivasulu Reddy in Delhi excise case

    [ad_1]

New Delhi: The Enforcement Directorate (ED) on Friday issued a summon to Ongole YSR Congress (YSRC) MP Magunta Sreenivasulu Reddy, to appear before them on March 18, in connection with the Delhi excise policy scam.

There are possibilities that ED might be confronting Sreenivasulu Reddy with Hyderabad-based businessman Arun Ramachandra Pillai arrested for money laundering in the excise case. The MP’s son, Magunta Raghava Reddy, was earlier arrested in the scam.

The ED has claimed in the supplementary charge sheet that Vijay Nair, on behalf of leaders of AAP received kickbacks to the tune of Rs 100 crore from South Group, whose prominent persons are Magunta Srinivasulu Reddy, Raghav Magunta, Sarath Reddy and K Kavitha, the daughter of Telangana Chief Minister K Chandrasekhar Rao.

The ED had arrested Punjab-based businessman Gautam Malhotra and one Rajesh Joshi, an aide of Vijay Nair. It was alleged that Joshi got money from Nair for Goa election. This money was proceeds of crime generated through Excise policy scam. Their interrogation led to the arrest of Magunta Raghava Reddy.

Now, the ED is further probing the matter.

Seven men, including Delhi Policeman, thrash meat vendors, urinate on them

    [ad_1]

Delhi: Two meat vendors were allegedly beaten up and robbed by seven men, including three Delhi Police personnel, in east Delhi’s Shahdara, a senior officer said.

The incident took place in Anand Vihar area on March 7 when the two meat vendors were travelling in their car and hit a scooter.

The accused, alleged to be ‘gau rakshaks’, urinated on the victims’ faces and threatened to kill them, the police said on Thursday.

Reportedly, a case was registered four days later, even though the victims had approached the police immediately.

All the seven men involved in the incident were booked and the three policemen, one of them an assistant sub-inspector, were suspended, the police said.

Nawab, who supplies meat to the Ghazipur slaughterhouse and a resident of Mustafabad, was headed home in his car with his cousin Shoaib when he hit a scooter near Anand Vihar. They were carrying meat in the car, according to the FIR.

The scooter driver demanded Rs 4,000 in damages from them. Just then a PCR van arrived there and one of the policemen took Rs 2,500 from the meat suppliers and gave it to the scooter driver, the FIR stated.

The policeman then demanded Rs 15,000 from the meat suppliers and threatened to take them to the police station if they did not pay up, it said.

The victims alleged the policemen in the PCR van called four other people and took them to an isolated spot. Nawab and Shoaib were confined and thrashed by the accused, who also tried to cut their hands with a knife. The accused also urinated on their faces and threatened to kill them, it added.

The policemen also accused them of slaughtering cows and threatened to dump their bodies in a drain after killing them.

The policemen allegedly extorted Rs 25,500 from the victims. The victims were “injected” with some narcotic and made to sign a few “blank papers” by the policemen, the FIR stated.

The victims sustained injuries on their limbs and back, and were taken to the GTB Hospital, the police said.

A case was filed on March 10 against the accused on charges of extortion and voluntarily causing hurt, they said.

A senior police officer said they are verifying the allegations of the complainant.

However, as per preliminary inquiry, departmental action has been initiated against the three policemen, who have been suspended till inquiry, the officer said.

  • Delhi Assembly: BJP to bring no-confidence motion against Kejriwal, AAP to attack Centre, LG

Delhi Assembly: BJP to bring no-confidence motion against Kejriwal, AAP to attack Centre, LG

    [ad_1]

New Delhi: The budget session of the Delhi Assembly, starting Friday, is likely to witness heated exchanges between the treasury and opposition benches, with the ruling AAP targeting LG V K Saxena and the Centre over the arrest of Manish Sisodia and the BJP bringing a no-confidence motion against the Arvind Kejriwal government.

The session will start with an address by the lieutenant governor (LG) and the budget will be presented on March 21, officials said.

A senior Aam Aadmi Party (AAP) leader said that the session will have discussions on the arrest of former deputy chief minister Sisodia and how the lieutenant governor was interfering in the works of the elected government.

“The party will also raise the issue of the LG being involved in an incident with noted social activist Medha Patkar in 2002. We will also raise the issue of misuse of CBI and ED by the BJP-ruled Centre and the LG’s interference in government functioning,” he said.

Another senior functionary of the AAP said, “The misuse of CBI and ED by the Centre is the biggest issue. The world’s best education minister, Manish Sisodia, has been put behind bars in a false case. This is the biggest issue of Delhi.”

Leader of Opposition in the Assembly Ramvir Singh Bidhuri said in a statement that the BJP will bring a no-confidence motion against the Arvind Kejriwal government over its involvement in “corruption”.

The BJP MLAs, in a joint statement, said that they will corner the Kejriwal government as its two ministers were behind bars and it was facing allegations of “scams” involving liquor policy, classroom construction, electricity subsidy, and snooping by its Feedback Unit.

“In such a situation, this government has no moral or constitutional right to be in office and a no-confidence motion is being brought against the government,” it said.

Bidhuri said the budget session has been called only for five days, out of which the provision of question hour has been kept only on two days.

“This is like attacking the rights of the legislators and this government is continuously robbing the rights of the legislators,” he alleged.

The BJP will demand that the session be extended by at least 10 days, he said.

The BJP MLAs have given notices to discuss the serious problems of Delhi in the Assembly and they want that all issues should be discussed so that the truth can come before the public, he said.

Issues such as corruption, air pollution, drinking water crisis, collapse of the transport system, non-opening of new schools and colleges, lack of teachers, irregularities in mohalla clinics, and the Yamuna pollution will be raised by the opposition MLAs, he said.

Delhi minister Saurabh Bharadwaj said the session will focus on making Delhi a modern, clean and development-oriented city.

“There will be more focus on providing funds for sanitation, cleaning garbage mountains, making world class infrastructure in Delhi, making it development oriented in terms of good transport, making well connected network and bringing more electric buses.”

The annual budget for 2023-24 will be presented by Kailash Gahlot who assumed the charge as finance minister after the arrest of Sisodia by the CBI in connection with an alleged liquor policy scam.

Delhi: BJP, VHP protest after temple demolished as part of DDA anti-encroachment drive

    [ad_1]

New Delhi: The Delhi Development Authority (DDA) demolished a temple in the Rajender Nagar area on Thursday as part of its anti-encroachment drive, triggering a protest by the BJP and the Vishva Hindu Parishad.

An official of the DDA said, “For demolition of religious structures, the nod of the religious committee (formed by the government) is required. We sought the committee’s approval and following its go-ahead, the demolition was carried out.”

A senior police officer said that adequate security arrangements were made for the demolition exercise in the Rajender Nagar area of central Delhi.

“The demolition drive was carried out Thursday morning. Forty per cent of the structure was demolished and the process was conducted peacefully,” the police officer said.

Several BJP and Vishva Hindu Parishad (VHP) leaders and workers staged a sit-in at the temple in protest against the demolition exercise.

Former Delhi BJP president Adesh Gupta alleged that the Arvind Kejriwal government was targeting temples in the city.

“We are protesting the action by DDA and I appeal to people to gather here and oppose the effort to demolish the temple,” Gupta said.

  • Penguin moves Delhi HC against trial court injunction on Rana Kapoor book

Penguin moves Delhi HC against trial court injunction on Rana Kapoor book

    [ad_1]

New Delhi: The Delhi High Court on Thursday issued notice to former Yes Bank Managing Director Rana Kapoor on an appeal by publishing house Penguin Random House India against a trial court order asking them to refrain from publishing and distributing a book on him.

A single-judge bench of Justice Manoj Kumar Ohri directed Kapoor to file his reply and listed the matter for the next hearing on July 24.

The case stems from a Rs 466 crore Yes Bank scam.

Journalist Furquan Moharkan published a book titled “The Banker Who Crushed His Diamonds: The Yes Bank Story” in February 2021.

Kapoor has, however, opposed it sayimg that the book makes false allegations against him which are extremely prejudicial to the ongoing investigation.

The trial court passed the ex-parte ad interim injunction order against Moharkan’s publication and distribution of the book on December 22, 2021, and the same was confirmed on January 28, 2023.

Book publisher Penguin, in its appeal before the High Court, contended that the trial court failed to appreciate the fact that Kapoor approached the court 11 months after the publication of the book.

The argument further claimed that Kapoor was aware of the book’s planned release as early as June 2020, when the author approached his daughter to get their version of the story and she answered through her lawyer, warning him not to publish.

It further added that by not providing a discussion on merits or assigning proper reasons, especially on why the entire book is being injuncted, the trial court went beyond the Supreme Court’s judgements and it amounts to a blanket censorship, and a violation of free speech rights.
