    Delhi police refuse permission to Congres for observing ‘satyagraha’

    New Delhi: The Delhi Police has denied permission to the Congress for holding ‘satyagraha’ at Rajghat to protest against Rahul Gandhi’s disqualification from the Lok Sabha, officials said on Sunday.

    In a letter, the Delhi Police said the request was rejected due to law and order and traffic reasons and prohibitory orders under Section 144 CrPC imposed in and around Rajghat.

    A senior police officer told PTI that while permission for holding the satyagraha has been denied, adequate security arrangements have been put in place.

    The Congress has announced plans to hold a day-long satyagraha in front of Gandhi statues at all states and district headquarters on Sunday to protest against Gandhi’s disqualification.

    Gandhi was disqualified from the Lok Sabha on Friday, a day after a court in Gujarat’s Surat convicted him in a 2019 defamation case. The disqualification will bar Gandhi (52), a four-time MP, from contesting polls for eight years unless a higher court stays his conviction.

    New Delhi: A court on Saturday adjourned till April 5 the hearing on the bail plea of AAP leader Manish Sisodia, who has been arrested by the ED in a money laundering case linked to alleged irregularities in implementing the now-scrapped excise policy in Delhi.

    Special Judge MK Nagpal adjourned the hearing after Sisodia’s counsel sought more time to prepare a detailed response to ED’s submission on the bail plea.

    Sisodia moved the bail plea on Tuesday and the court sought the Enforcement Directorate’s response by March 25.

    On Wednesday, after seven days of questioning by the ED, the court sent him to 14-day judicial custody.

    On Friday, the court reserved its order on a separate bail plea moved by Sisodia in the excise policy case lodged by the Central Bureau of Investigation.

    Special Judge Nagapal said the court will pronounce its order on the bail plea in the CBI case on March 31.

    The ED arrested the former Delhi deputy chief minister on March 9 at Tihar jail, where he was lodged in connection with the case being probed by the CBI.

    The CBI arrested him on February 26.

    New Delhi: In yet another flashpoint between the two, Delhi LG VK Saxena has asked the AAP government to reconstitute the Labour Welfare Board appointing suitable members or communicate opinion on the matter so that it could be referred to the President, sources said.

    No immediate reaction could be had from the AAP on the matter.

    The LG and AAP government have had many rows in the past several months including the one over probes ordered by Saxena on complaints of corruption and the issue of sending teachers for training to Finland.

    The labour welfare body remains without an executive board even after two years due to an impasse over eligibility criteria for appointment of the members.

    “The LG has asked for the Board to be constituted with members who have domain expertise in labour welfare or send the file to him for expressing difference of opinion,” sources at LG office said.

    The AAP government sat on a file meant for re-constitution of the Delhi Labour Welfare Board (DLWB) for more than 14 months, between June, 2021 and September, 2022 and finally sent the proposal with names for approval of the Lt Governor on September 12, 2022, they claimed.

    The names proposed by the then labour minister, Manish Sisodia, and approved by Chief Minister Arvind Kejriwal were not as per the criteria for selection of such members, sources at LG Office said.

    The members nominated to the Board, instead of being domain experts in labour welfare, were picked from among vaccination camp organisers, RWA presidents and individuals distributing food during Covid pandemic, they claimed.

    The Lt Governor returned the file to the Chief Minister on November 21, 2022, with observations advising the Labour department to submit a panel of names for appointment after a thorough background check on their suitability and experience in related fields.

    “Members of this Board perform important functions of welfare of labourers and therefore, it is important that such members must possess sufficient experience in the field of labour welfare.

    “Such nominated members must demonstrate skill and expertise which reveal their capabilities to contribute to the cause of labour welfare,” the LG had observed.

    In the proposed list, most of the nominees, especially nine of the 17 do not have appropriate experience or domain knowledge to effectively contribute for welfare activities and also it is difficult to ascertain if nominations of others are commensurate with the spirit of the law, the LG said in a note.

    He had also suggested creation of a search committee for appointment of the members.

    In its reply, the Delhi government submitted the file back on January 7, 2023, asking the LG to either agree to the names suggested by it or invoke difference of opinion as prescribed under Article 239AA(4) and Rule 49 and 50 of the Transaction of Business Rules, claimed the sources.

    The LG office again returned the file to the Chief Minister’s office, on February 9, 2023, noting that in case the Chief Minister had different views on the issue, the matter may be referred to the Council of Ministers for its consideration.

    He also expressed disagreement with the Labour Minister’s view, approved by the CM, that in the absence of any prescribed qualification for the members, the proposal of the government must be agreed upon.

    The file was again submitted to the LG on February 22 this year, with the observation that as per amended Rule 49 of ToBR the issue was discussed by the LG with the Labour minister within a statutory time limit of 15 days.

    “Thus, this case is legally time barred for Hon’ble LG to express any difference of opinion,” read the CM’s note .

    The file has once again been returned to the CMO for the matter to be brought before the Council of Ministers, if the CM and the Labour minister do not agree with the LG over the issue, sources added.

    Jalandhar: Delhi Chief Minister Arvind Kejriwal on Saturday said the Bhagwant Mann government in Punjab will not hesitate in taking tough decisions to maintain law and order as he asserted that those who were trying to spoil the atmosphere in the state are on the run.

    Kejriwal’s remarks come in the wake of Punjab police action against radical preacher Amritpal Singh and elements of an outfit, headed by him, named ‘Waris Punjab De.’

    AAP supremo Kejriwal along with Punjab Chief Minister Bhagwant Mann was in Jalandhar, where the crackdown on the Khalistan sympathizer began on Saturday, to lay the foundation stone of Sri Guru Ravidas Bani Adhyan Centre at Dera Sachkhand Ballan here.

    Addressing the gathering, Kejriwal said whoever tries to disturb peace in Punjab will not be spared. “In the past few days, you saw how some people tried to disturb peace in Punjab,” he said.

    “We do not have to allow the atmosphere to be spoiled at any cost,” he said, adding, “We have to maintain peace, law, and order in Punjab.”

    Kejriwal said the Mann government took tough decisions to maintain peace in the state.

    “Sometimes, tough decisions have to be taken. But if our AAP government in Punjab under the leadership of Bhagwant Mann will have to take tough decisions then we will not hesitate from taking them,” he added.

    “Mann saab took tough decisions, but without a bullet being fired and blood being shed peace is maintained in entire Punjab today,” he said.

    Amritpal Singh has been on the run after the police crackdown began. Several images and videos have shown him taking multiple vehicles to dodge police. The Punjab government has slapped the strictest National Security Act against him and some of his associates.

    While the fugitive’s whereabouts are still unknown, Punjab police say efforts are on to nab him.

    New Delhi: A 38-year-old web designer was arrested for allegedly creating fake websites and duping people in the name of Patanjali Yogpeeth, an official said on Saturday.

    The accused has been identified as Rahul Kumar, a resident of Laxmi Nagar in Delhi.

    According to police, a complaint was received at Dwarka Cyber police station where the victim alleged that he was searching for treatment of his wife on internet and found a mobile number.

    Thereafter, he contacted on that number and one Dr Sachin Agrawal asked him to deposit Rs 50,000 in a bank account. However, after that, complainant couldn’t contact again on that number.

    “The complainant again searched number on Google and found another mobile number and the alleged person asked to deposit Rs 45,600 in another bank account. When complainant again contacted him, he again demanded Rs 56,800 from the complainant, but this time, he didn’t pay,” said M Harsha Vardhan, the Deputy Commissioner of Police (Dwarka).

    During the investigation, the details of the beneficiary bank account were obtained and call detail records of the alleged number was obtained and analysed.

    “On March 21, on the basis of technical analysis and surveillance, the team raided the house of accused Rahul and apprehended him from the Laxmi Nagar area.

    “During interrogation, Rahul confessed that he was doing work of fake website designing. Rahul said that he, along with, co-accused Sumit used to dupe people in the name of some service which never gets delivered.

    “Rahul used to design fake websites in the name of other leading companies like Patanjali, among others, and place the numbers there, provided by co-accused Sumit who is resident of Rajgir, Bihar and also receives calls of public persons,” said the DCP.

    “Sumit used to ask the victims to deposit amount in different bank accounts and then both accused used to divide the cheating amount between them. They mostly used to do fraud in the name of Patanjali Yogpeeth, Haridwar,” said the DCP.

    New Delhi: The Delhi High Court on Friday issued summons to BharatPe’s former Managing Director Ashneer Grover in connection with a case filed by fintech company’s co-founder Shashvat Nakrani over claims of unpaid shares.

    Representing Nakrani, senior advocate Neeraj Kishan Kaul contended that in case filed by co-founder Bhavik Koladiya on the same lines, the court has issued summons and has asked Grover to not create any third-party rights in respect of the shares in BharatPe.

    The High Court had, on January 18, told Grover to file an undertaking in a week’s time and restraining him from creating any third-party rights over the shares.

    Appearing before the bench of Justice Sachin Datta, Kaul said that it is Grover’s stand that he has paid for the shares in cash.

    The court noted that the case was filed about five years after the shares were stated to have been transferred while Kaul argued for an interim relief.

    Lawyer Giriraj Subramanium, Grover’s counsel, was questioned by Judge Datta if he was prepared to make a statement that no third-party rights would be created over the shares.

    To this, Subramanium said that he has instructions not to make such a statement.

    Justice Datta then listed the case for the next hearing on March 28, on the issue of interim relief sought by Nakrani.

    “Plaintiff has been heard at some length in the interim relief application. Counsel for the defendant says they don’t want to file a response to the application. List on Tuesday for further arguments,” the court ordered.

    The judge also issued notice on Nakrani’s application seeking to file some documents in a sealed cover.

    Koladiya’s suit seeking to reclaim trasferred shares remains pending before another bench of the High Court.

    In the Koladiya’s case, when the court had earlier asked Grover to not create any third-party rights over the shares, he had informed the court that subject to further directions from the court, he will not make any third-party interest in the 16,110 shares that Koladiya transferred to him and in any rights that accrue to him as a consequence thereof.

    A single-bench judge Justice Prateek Jalan had ordered that Grover will be bound by his statement and directed him to file the undertaking.

    The court had also served summonses on Grover and the fintech company, giving the former four weeks to respond to the application for an ad interim injunction and two weeks for a rejoinder to the same.

    The bench had noted: “D1 (Grover) is bound to the aforesaid statement and is directed to file an undertaking to this effect within one week from today. Reply to application in four weeks, rejoinder in two weeks thereafter.”

    Nakrani and Koladiya founded the fintech company in 2017. In 2018, Grover joined the company as the third co-founder.

    New Delhi: Delhi Chief Minister Arvind Kejriwal on Friday referred to Lieutenant Governor V K Saxena as a “guest” who “knows nothing about Delhi”, while asking him to work with the AAP dispensation for the development of the national capital.

    Kejriwal also attacked Saxena for obstructing various initiatives of his government, but asserted that despite all the hurdles, the government was doing good work.

    “Teachers’ Finland training got delayed, who benefitted from this? No one. Delhi Dialogue and Development Commission vice-chairman Jasmine Shah’s office was sealed and is locked since last six months. Who benefitted from this? No one. The budget got delayed because of him. But the same budget was passed without any changes later. The L-G is now planning to withdraw electricity subsidy,” the chief minister said in the Delhi Assembly.

    He also said that excellent work has been done in the education sector in the city.

    “We just did the work of a facilitator. The hard work was done by the teachers. This spirit in them came from the training they got abroad. Some principals had to go abroad in December and March which was stopped by the Lieutenant Governor (L-G). Who benefited from this?” he asked.

    The AAP supremo further asked L-G Saxena to cooperate with the AAP government and work together for the development of Delhi.

    “He (L-G) has come from Gujarat. He is our guest. He knows nothing about Delhi. I do not think he would be knowing even the names of Delhi roads. But we do not want fights. We want to work together. I would like to ask the L-G to cooperate with our government and work for the development of the city,” Kejriwal said.

    He added that the Aam Aadmi Party (AAP) government can “pitch in” if the L-G “needs help” to manage the law and order situation in the city.

    “We need to do a lot of work and we all can do it together. Why can’t the L-G take our help to manage law and order? It is not India-Pakistan war. When the CM and L-G start working together, it will actually be a double engine government,” he said.

    Saxena had addressed the Delhi Assembly on the first day of the Budget Session in which he had appreciated the work of the AAP government.

    Talking about Saxena’s address, Kejriwal said, “L-G sahab said my government has done a lot of work in education and health. You saw how his (L-G) chest swelled with pride. I want to tell him we will give more such chances to make you feel proud — if you do not interfere in our work.”

    New Delhi: The Delhi Commission for Women (DCW) has issued a notice to the Municipal Corporation of Delhi (MCD) and Deputy Commissioner of Police (East) in connection with the gangrape of a 10-year-old girl by an MCD-run school peon and his associates in east Delhi.

    The DCW has sought the detailed action taken by MCD and Delhi Police.

    On Thursday, in a statement the MCD said that the incident of sexual assault with a class 5 student of Shahadara zone took place on March 14.

    “The student was absent on the next day of the annual examination. The class teacher contacted her mother who informed about the sexual assault with her by the school attendant. The school principal tried to convince the girl’s parents to come to the school to file a complaint against the accused, but they were reluctant,” the MCD added.

    “A committee of two school inspectors, including a female inspector, inquired into the matter and submitted its report. On the basis of Committee findings, Ajay Kumar, the school attendant, has been placed under suspension with immediate effect,” it said.

    The 54-year-old peon, identified as Ajay, a native of Jaunpur in Uttar Pradesh, has been arrested, the police said, adding the police are trying to nab the remaining accused.

    Ajay has been working in the MCD-run school as a peon for the last 10 years.

    According to police, on Wednesday, the principal of a school, along with fellow teachers, reported a sexual assault on one of her students.

    The incident allegedly took place on March 14.

    “As per the complaint, the accused took her from the school to an unknown place, sedated her with some substances and raped her along with his associates. The victim was sent to LBS hospital where her medical examination and counselling was done,” Deputy Commissioner of Police (DCP), Amrutha Guguloth said.

    A case under sections 363 (kidnapping), 328 (administering stupefying drug with intent to cause hurt, etc), 376D (gang rape), 506 (criminal
    intimidation) and Section 6 of Posco Act was registered in Ghazipur police station, and Ajay was arrested,” the DCP added.

    Washington: World Bank presidential nominee Ajay Banga has tested positive for COVID-19 during routine testing in New Delhi where he was travelling on the last leg of his world tour, and is currently quarantining in isolation, the Department of Treasury said Thursday.

    India is witnessing a spike in influenza and coronavirus cases in the past two weeks. The country has recorded 1,134 new coronavirus cases, while the active cases increased to 7,026, according to Union Health Ministry data updated on Wednesday.

    Banga’s New Delhi visit (March 23 and March 24) is the final stop on his three-week global tour that began in Africa before progressing to Europe, Latin America and Asia.

    “During routine testing, Ajay Banga tested positive for COVID-19 but remains asymptomatic. In adherence with local guidelines, he is quarantining in isolation,” the Department of Treasury said Thursday afternoon.

    While in India, 63-year-old Banga was scheduled to meet Prime Minister Narendra Modi as well as the Minister of Finance Nirmala Sitharaman and the Minister of External Affairs Subrahmanyam Jaishankar, the Treasury said in a previous statement.

    India endorsed Banga’s candidacy soon after his nomination was announced.

    Since then, a diverse coalition of governments has expressed their support for Banga, including Bangladesh, C te d’Ivoire, Colombia, Egypt, France, Germany, Ghana, Italy, Japan, Kenya, Saudi Arabia, the Republic of Korea, and the United Kingdom.

    During his global listening tour, Banga met with senior government officials, stakeholders, business leaders, entrepreneurs, and civil society.

    Along the way, he has built continuous momentum for his candidacy, gaining the support of advocates, academics, development experts, executives, Nobel Laureates, and former government officials.

    If elected to serve, Banga will draw from his experience living and working in emerging markets and his expertise in forging public-private partnerships to mobilise investments and action to confront longstanding challenges.

    That includes his efforts at Mastercard to successfully bring 500 million previously unbanked people into the digital economy, as well as its support for 50 million small businesses.

    New Delhi logged 84 coronavirus cases with a positivity rate of 5.08 per cent on Wednesday, according to data shared by the health department.

    The city has seen an increase in the number of fresh Covid infections over the last few days, amid a sharp rise in H3N2 influenza cases in the country.

    New Delhi: A court here on Thursday framed charges for several offences, including abduction and murder, against AAP leader Tahir Hussain and 10 others in connection with the alleged murder of Intelligence Bureau officer Ankit Sharma during the 2020 northeast Delhi riots.

    Additional Sessions Judge Pulastya Pramachala was hearing the case registered at the Dayalpur Police Station against 11 accused, including Hussain, on the complaint lodged by the officer’s father.

    Sharma’s body was recovered from Khajuri Khas drain near the Chand Bagh pulia.

    “I find that accused persons namely Mohd Tahir Hussain, Haseen, Nazim, Kasim, Sameer Khan, Anas, Firoz, Javed, Gulfam, Shoib Alam and Muntajim are liable to be tried for an offence punishable under section 120 B (criminal conspiracy) IPC read with sections 147 (rioting ) 148 (rioting, armed with a deadly weapon) and 153A (punishment for promoting enmity between groups on the ground of religion etc) and 302 (murder) of the IPC,” the judge said.

    They are also liable to be tried under sections for kidnapping and wrongful confinement, the judge added.

    All accused, except Muntajim, were put on trial for the offences under sections 153 A of the IPC read with 120B and 149 IPC, the judge said, adding, Haseen and Nazim are also liable to be tried for the offence under the provision of the Arms Act.

    According to Special Public Prosecutor Madhukar Pandey, a witness had captured a video of the throwing of a dead body in the drain and the call detail records (CDR) of all accused, except accused Anas, Nazim and Kasim, proved their presence in and around the spot of the incident, which corroborated the prosecution’s case against the accused.

    “All accused indulged in targeting Hindus and their acts were apparently prejudicial to the harmony between communities of Muslims and Hindus. They disturbed the public tranquillity as well,” the judge said.

    The judge said the act of a group of more than one person from a mob can make everyone liable.

    Pramachal said that in the present case, it was not necessary for all members of mob to play some overt act in the killing of Ankit Sharma and according to the evidence before the court, the mob was acting in a “well-prepared manner to attack Hindus and their properties, which signified the existence of prior meeting of their mind.”

    Tahir Hussain also played the “role of instigator to kill Hindus” and also exhorted this mob “not to spare Hindus,” the judge said.

    “He (Hussain) instigated the mob when Ankit came forward towards this mob and the conspiracy need not be specifically to kill Ankit. When the accused persons were acting in pursuance to conspiracy and common object to kill Hindus, it covered the killing of Ankit as well for the reasons that Ankit was killed because he was Hindu,” the judge said.

    The judge said the mob continuously indulged in the firing of gunshots, pelting of stones and petrol bombs “towards Hindus and houses of Hindus.”

    “These acts of the mob make it clear that their objective was to harm Hindus in their body and property to the maximum possible extent. It is also clearly shown that this mob consciously wanted to even kill Hindus,” the judge said.

    The ASJ also said that at the present stage of the trial, the court cannot raise any presumption against the veracity of the statements of the witnesses because of the delay in recording their statements.

    The rule of prudence can be applied only after trial, at the time of assessment of the evidence on the parameters of credibility, he added.
