Nitish reaches Delhi to meet opposition leaders, starts with Lalu Prasad

    [ad_1]

Patna: Bihar Chief Minister Nitish Kumar, who reached New Delhi on Tuesday to discuss the current political situation with opposition leaders, met RJD national President Lalu Prasad Yadav at the official residence of his daughter and Rajya Sabha member Misa Bharti.

JD-U national President Lalan Singh and Bihar Minister Sanjay Jha were also present at the meeting.

Nitish Kumar is on a three-day tour to New Delhi to meet opposition leaders of the country including Congress leader Sonia Gandhi, party President Mallikarjun Kharge and other leaders and prepare a plan for the Lok Sabha election.

    MS Education Academy

After the formation of Mahagathbandhan government in Bihar, he had urged Congress top leadership to take initiative in this matter as quickly as possible.

Nitish Kumar himself claimed last week that he had a telephonic conversation with Kharge, who had reportedly invited Nitish Kumar for a meeting to discuss the future plan of action in Bihar.

Bihar is crucial for the Narendra Modi government as it has 40 Lok Sabha seats. As the BJP is not ruling in the state, it would not be easy for it to succeed here.

The Bihar Chief Minister had also said that he will go to Delhi after the state Assembly’s Budget session, which concluded last week.

Nitish Kumar has been advocating opposition unity ever since he formed the government in Bihar with the Mahagathbandhan. During his visit to the national capital in September last year, he had met Sonia Gandhi, Rahul Gandhi, Sharad Pawar, Arvind Kejriwal, D. Raja, Sitaram Yechuri and Akhilesh Yadav, a majority of whom he is likely to meet this time as well.

Bullish on India, Tim Cook to unveil Apple retail stores in Mumbai, Delhi

    [ad_1]

New Delhi: As Apple firms up its plans to put India on its global manufacturing and retail map, the company’s CEO Tim Cook will be in India next week to inaugurate Apple’s brick-and-mortar stores in Mumbai and Delhi.

Reliable sources told IANS that Cook will inaugurate Apple’s own branded retail stores — at Jio World Drive Mall in Mumbai and at Select CityWalk mall in Saket, Delhi — that will be the first for the tech giant which has doubled down on its India growth plans.

Apple set another all-time revenue record for the India market in the quarter that ended December 31, 2022.

    MS Education Academy

In the analysts’ call after posting its quarterly results, Cook said, “India is a hugely exciting market for us and a major focus.

“We brought the online store there in 2020. We will soon bring Apple Retail there,” Cook had announced.

“I’m very bullish on India,” he added.

According to the India Cellular and Electronics Association (ICEA), Apple’s ‘Make in India’ smartphone now constitutes 50 per cent of total exports.

Reports surfaced earlier this year that Cook-led Apple will quickly shift some of its China manufacturing to India and Vietnam in the next 2-3 years.

India is likely to produce 45-50 per cent of Apple’s iPhones by 2027, at par with China, where 80-85 per cent of iPhones were produced in 2022, according to estimates.

India accounted for 10-15 per cent of iPhones’ overall production capacity at the end of 2022.

Apple became the first smartphone player in India to have exported $1 billion worth iPhones in the month of December.

It currently manufactures iPhones 12, 13, 14 and 14 Plus in the country.

As Apple gears up to throw open the gates of its first branded retail store in India this month, its physical stores have left an indelible impression on millions worldwide.

For millions of Indians, visiting an Apple Store in the country will be a delightful experience. Those who have a constant yearning to be ‘delighted’ at Apple Stores at world-famous tourist spots, India will soon be on the Apple’s retail global map.

  • Delhi HC upholds ban on gutka, pan masala for public health reasons

Delhi HC upholds ban on gutka, pan masala for public health reasons

    [ad_1]

New Delhi: The Delhi High Court has upheld a ban on the manufacture, storage, and sale of gutka, pan masala, flavoured tobacco, and similar products in the city, citing their direct and harmful impact on public health.

The ban was initially imposed by the food safety commissioner, but was later quashed by the high court in September 2022.

The Centre and Delhi governments appealed against the decision and a bench headed by Chief Justice Satish Chandra Sharma has now set aside the earlier decision and upheld the ban.

    MS Education Academy

The court rejected objections raised by entities in the tobacco business against the ban, stating that there was no justification for the quashing of the notifications.

The court has declared that there was no justification for the previous decision to quash the notifications, and has rejected objections from tobacco business entities against the ban that was in place from 2015 until 2021.

“We find ourselves unable to sustain the impugned judgment rendered by the learned Judge. These appeals shall consequently stand allowed. We find no merit in the challenge raised (against the ban). It shall, in consequence, stand dismissed,” said the bench, also comprising Justice Yashwant Varma.

“It becomes necessary to observe that the writ petitioners (manufacturers of tobacco related products, etc) did not dispute that both cigarettes as well as smokeless tobacco have a direct and pernicious impact on public health. Once it was found and conceded that both categories of tobacco constituted substances which had a direct impact on public health, the impugned notifications clearly did not warrant being quashed,” observed the court.

In its 176-page judgment, the court noted that the Supreme Court has already urged governments to ban the manufacture and sale of gutka and pan masala, and the previous single judge’s decision could not have deemed this not applicable in the current case.

Regarding the objection raised by tobacco businesses that the ban was discriminatory because it only applied to smokeless tobacco and not cigarettes, the court rejected this and stated that the ban was implemented because of the “larger number of users of smokeless tobacco” and that food safety authorities were authorised to impose such prohibitions.

The court also mentioned that Article 14 could not be used to argue that since a specific type of tobacco had not been banned, there should be no prohibition on other similarly harmful products. It noted that there were 163.7 million smokeless tobacco users in the country compared to 68.9 million smokers.

The court also mentioned that products such as pan masala, chewing tobacco, and gutka were not exempted from the definition of “food” under Section 3(1)(j) of the FSSA.

The court noted that the petitioners had operated under the mistaken belief that the notifications aimed to ban or prohibit tobacco, when in reality, they sought to prohibit the addition of tobacco or tobacco products to food products.

  • Vivek Agnihotri appears in Delhi HC, tenders apology, gets discharged

Vivek Agnihotri appears in Delhi HC, tenders apology, gets discharged

    [ad_1]

New Delhi: Filmmaker Vivek Agnihotri appeared before the Delhi High Court on Monday and tendered an unconditional apology in connection with a criminal contempt case over his alleged remarks against a judge of the court.

Accepting his apology, a bench of Justices Siddharth Mridul and Vikas Mahajan discharged Agnihotri of the contempt charge and cautioned him to remain careful in the future.

The high court recalled the criminal contempt notice issued to him and noted that an affidavit filed by Agnihotri also reflected the regret and remorse unconditionally expressed by him to the court.

    MS Education Academy

“In view of the circumstances that Vivek Agnihotri stated that he has utmost respect for the institution of judiciary and did not intend to wilfully offend the majesty of this court, the notice to show cause issued to him is hereby recalled. Vivek Agnihotri stands discharged as the alleged contemnor,” the bench said.

“Mr. Agnihotri we will be cautioning you to be careful in future,” the bench told the filmmaker who appeared before the court in pursuance of its earlier direction.

In 2018, the filmmaker had put out tweets alleging bias against Justice S Muralidhar, who was then a judge of the Delhi High Court and is currently the chief justice of the Orissa High Court, as he had released rights activist Gautam Navlakha from house arrest in the Bhima-Koregaon violence case.

Subsequently, contempt of court proceedings were initiated against Agnihotri and others by the high court.

On December 6 last year, the court asked the filmmaker to “show remorse in person” after he tendered an unconditional apology through an affidavit.

“We are asking him (Agnihotri) to remain present because he is the alleged contemnor. Does he have any difficulty in appearing before this court? He has to be present and show remorse in person,” the court had said.

The lawyer appearing for another alleged contemnor, Anand Ranganathan, assured the court that he would remain present before it on May 24, the next date of hearing in the case.

During the hearing, Justice Mridul said courts do not punish for contempt to secure their dignity as the dignity of courts does not come from what people have to say about judiciary but from the duties the courts discharge.

Referring to a previous judgement of the Supreme Court in a contempt case, the bench said, “Our dignity is founded on a stronger foundation and not on what somebody says about us. There are times when you have to give quietus to things.” The high court said it had kept the matter pending only to make it clear that “you can’t make things irresponsibly”.

It noted that Agnihotri has reiterated his remorse and tendered an unconditional apology for the alleged offensive statement made on Twitter.

“Twitter is a great source of misery,” the bench orally observed.

It also said every citizen of the country must know that they should be careful and added, “we invite just and fair criticism…” Senior advocate Arvind Nigam, who is assisting the court in the matter as an amicus curiae, had earlier informed that Ranganathan has made a tweet in relation to the contempt proceedings that he would go down fighting.

The court had initiated the contempt proceedings in the present case on its own after receiving a letter from senior advocate Rajshekhar Rao. Rao, in his letter, had stated that the tweets were a deliberate attempt to attack a high court judge.

The contempt proceedings were also initiated against Swaminathan Gurumurthy, the editor of the Chennai-based weekly, “Thuglak”, for his tweets against the judge.

The proceedings against Gurumurthy were subsequently closed in October 2019.

Earlier, the court had directed two social media platforms to block the weblinks to an offending article levelling scandalous allegations against the judge.

Air India flight to London returns to Delhi after passenger ‘harms’ cabin crew

    [ad_1]

New Delhi: An Air India flight to London returned to Delhi on Monday due to the “serious unruly behaviour” of a passenger onboard.

The Air India flight AI 111 scheduled to operate on the Delhi-London-Heathrow route returned shortly after departure.

An FIR was lodged as the accused person allegedly misbehaved and caused physical harm to two of the cabin crew members.

    MS Education Academy

Officials said that the accused person continued to create a scene even after verbal and written warnings and the pilot-in-command had to return to Delhi. Subsequently, the accused person was handed over to the concerned security authorities and adequate action was initiated.

“Not heeding to verbal and written warnings, the passenger continued with unruly behaviour including causing physical harm to two of the cabin crew members. The pilot in command decided to return to Delhi and the passenger was handed over to the security personnel upon landing,” said an Air India spokesperson on Monday.

An FIR has also been lodged with the police. “Safety, security and dignity of all on board is important to us at Air India. We are providing all possible support to the affected crew members. We regret the inconvenience caused to the passengers and have rescheduled the flight to depart for London this afternoon,” added the spokesperson.

Airlines have witnessed many such incidents of unruly behaviour by some air passengers in the last few months.

Last week, a drunk flyer on board an Indigo flight from Delhi to Bengaluru tried to open the flap of the emergency doors. Subsequently, the matter was reported to the concerned agencies and appropriate action was initiated.

During the end of March, two passengers travelling on an Indigo flight from Dubai to Mumbai continued consuming alcohol onboard despite multiple warnings from the crew. They verbally abused the crew and co-passengers.

In order to deal withnunruly behaviour, DGCA has issued CAR, Section 3- Air Transport, Series M, and Part VI titled ‘Handling of unruly/ disruptive passengers’.

As per the procedure defined in the CAR, airlines are required to follow a prescribed procedure for holding passengers accountable before they are placed in the ‘No Fly List’ by the airline. Based on the information provided by the airlines, ‘No Fly List’ is maintained by the Directorate General of Civil Aviation (DGCA).

PM Modi visits Delhi church on Easter

    [ad_1]

New Delhi: Prime Minister Narendra Modi visited the Sacred Heart Cathedral Church here on Sunday on the occasion of Easter.

An official video showed the prime minister being welcomed at the church and him greeting priests and worshippers on the holy day.

Modi later joined them as they offered prayers. He also planted a tree on the premises.

    MS Education Academy

After the visit, Modi tweeted, “Today, on the very special occasion of Easter, I had the opportunity to visit the Sacred Heart Cathedral in Delhi. I also met spiritual leaders from the Christian community.”

The prime minister’s rare visit to the church is imbued with political significance as well, as the ruling BJP has been actively wooing Christians.

Modi in his recent speeches has underlined the minority community’s growing connect with the BJP by citing the party’s poll successes in Goa and recently, in the two northeastern states of Nagaland and Meghalaya. These states have a large Christian population.

Modi has underscored his government’s commitment to the mottos of ‘Sabka Saath, Sabka Vikas, Sabka Vishwas’ and development for all without any discrimination.

The BJP is looking for support from the community in Kerala, the state with their largest population in the country, as it works to make a fresh headway there after tasting little success in previous elections.

The party’s leaders in the state also met with community leaders on Sunday.

Anil Antony, son of senior Kerala Congress leader A K Antony, a Christian, joined the BJP a few days back.

Earlier in the day, Modi tweeted, “Happy Easter! May this special occasion deepen the spirit of harmony in our society. May it inspire people to serve society and help empower the downtrodden. We remember the pious thoughts of Lord Christ on this day.”

Delhi HC to hear Monday Sharjeel Imam’s bail plea in sedition case

    [ad_1]

New Delhi: The Delhi High Court will on Monday hear a plea by JNU student Sharjeel Imam seeking bail in connection with a 2020 riots case involving allegations of sedition.

The case, which assails a January 24, 2022 order by the trial court dismissing Imam’s bail application in the matter, is listed for hearing before a bench of Justices Siddharth Mridul and Talwant Singh.

On January 30, the court had sought to know the stand of the city police as to whether Imam’s plea for bail could be remanded back to the trial court for adjudication as there was no ground mentioned in the lower court’s order rejecting the relief.

    MS Education Academy

The bench had said since section 124A (sedition) of the Indian Penal Code has been kept in abeyance following the directions of the Supreme Court, it will have to examine the trial court’s bail rejection order while keeping in mind the other sections framed against Imam.

Last year, the trial court had framed charges against Imam under sections 124A (sedition), 153A (promoting enmity), l53B (imputations prejudicial to national integration), 505 (statements conducing to public mischief) of the IPC and section 13 (punishment for unlawful activities) of the Unlawful Activities Prevention Act.

As per the prosecution, Imam had allegedly made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019, where he allegedly threatened to cut off Assam and the rest of the northeast from India.

In his petition before the high court, Imam has said the trial court “failed to recognise” that pursuant to the directions of the top court, the basis for dismissal of his earlier bail plea, i.e. the charge of sedition no longer existed and therefore relief must be granted to him.

On May 11, 2022, the Supreme Court had stayed till further orders the registration of FIRs, probes, and coercive measures for the offence of sedition across the country by the Centre and the states until an appropriate forum of the government re-examines the colonial-era penal law.

Delhi BJP office likely to be shifted to DDU Marg, construction to begin in 3-4 months

    [ad_1]

New Delhi: The office of the BJP’s Delhi unit is likely to be moved from Pant Marg to Deen Dayal Upadhyay (DDU) Marg close to its national headquarters in the near future, party leaders said on Friday.

The “bhoomi pujan” ceremony for the construction of the new office building is likely to be held in three-four months, a senior party leader said.

Necessary approvals for beginning the building construction have been sought from the agencies concerned, he said.

    MS Education Academy

“The Delhi BJP office will be shifted to the new building once its construction is completed,” he said.

The Delhi BJP office was shifted to its current location – a bungalow on Pant Marg – in 1989.

The bungalow was allotted to then Delhi BJP president and South Delhi MP Madan Lal Khurana in 1989 and he gave it for running the office, Khurana’s son Harish Khurana said.

Earlier, the Delhi BJP office was located at Ajmeri Gate near New Delhi railway station, party leaders said.

The offices of the Aam Aadmi Party (AAP) and the Delhi Congress are located on DDU Marg.

The national headquarters of the Congress is also coming up on DDU Marg.

Recently, a newly constructed BJP Central Office Extension close to the party headquarters on DDU Marg was inaugurated by the prime minister.

DCW’s surprise inspection leads to seizure of 50 lt acid from public toilet in Delhi

    [ad_1]

New Delhi: In a surprise inspection conducted by the Delhi Commission for Women (DCW) led by its chief Swati Maliwal, officials have seized around 50 litres of acid from a public toilet located opposite the G.B. Pant Hospital in central Delhi.

The operation was carried out on Thursday and the officials confirmed the seizure of the acid on Friday.

Maliwal has now asked the concerned officials from the Municipal Corporation of Delhi (MCD) to appear before the commission on April 11 with a detailed report on the matter.

    MS Education Academy

“I was shocked to discover huge quantities of acid kept in the open at a public toilet in Delhi. It could have been used by people for criminal activities. The fact that acid is being used in public toilets for cleaning purposes on a large scale is unacceptable and shameful,” said Maliwal.

“Strict action should be taken against the authorities for encouraging the use of acid for cleaning in toilets. Also, there should be no fee for using public toilets. All the toilets should be functional at all times, and if any toilet is non-functional, strict action should be taken against the official(s) responsible for it,” she added.

During the inspection on Thursday, the commission had noticed that Rs 10 was being charged from the users each time they used the toilet.

“The commission was also informed that the toilet closes down at 10 p.m., rendering women and girls vulnerable to open defecation,” said a DCW official.
