    Hyderabad: Telangana’s Minister for Industries and Information Technology, K.T. Rama Rao, on Tuesday served legal notice to state Congress chief Revanth Reddy and BJP president Bandi Sanjay over their allegations against him in the Telangana State Public Service Commission (TSPSC) paper leak case, asking them to withdraw their allegations and tender a public apology or face defamation suit to the tune of Rs 100 crore.

    KTR’s lawyer sent legal notices to Reddy and Sanjay, stating that they cast aspersions on the minister and damaged his reputation through their their ‘false’, ‘baseless’ and ‘defamatory’ statements.

    The notice said that unless the leaders refrain from making such defamatory statements and tender a public apology, KTR will take forward the legal proceedings and file a defamation suit in the courts of competent jurisdiction.

    Reddy and Sanjay were told that by levelling the allegation, they rendered themselves liable for both prosecution for an offence of defamation punishable under Section 500 of the Indian Penal Code as defined under Section 499 of the IPC, and also made them liable for exemplary damage.

    “Though the loss suffered by my client on account of your above said acts are incalculable and irreparable in terms of money, my client calculates damages at a token sum of Rs 1,00,00,00,000 (Rupees Hundred Crore only),” read the notice.

    Both the leaders were asked to refrain from making any further derogatory/defamatory statements/imputations in any form against the minister and tender an unconditional apology forthwith by conducting similar press meets.

    “Else my client shall be constrained to prosecute you for an offence of defamation apart from claiming damages to the tune of Rs 100 crore by initiating appropriate proceedings in the courts of competent jurisdiction holding you solely responsible for all the costs and consequences thereof,” it added.

    KTR had earlier said that Reddy and Sanjay proved their ignorance by dragging the Telangana government and him into the issue of paper leakage without understanding the autonomous nature of the constitutionally constituted Public Service Commission.

    Stating that there is a terrible conspiracy by both the BJP and the Congress to stall the entire recruitment process, KTR also said that Sanjay and Reddy had earlier termed Telangana government’s job notifications as a conspiracy and their comments that the youth should put aside their preparation and get into politics reflect the deceitful mentality of these leaders.

    Hyderabad: Congress party on Monday protested at Moosarambagh crossroads as part of the nationwide Sankalp Satyagraha in support of Rahul Gandhi and claimed that it is not defamation if a thief is rightly called a thief.

    The Congress submitted a petition to the statute condemning Rahul Gandhi’s disqualification as a member of parliament and calling it a ‘murder of democracy’.

    Sameer Waliullah, Hyderabad District Congress Committee (DCC) president, on Monday, said, “Calling a thief a thief is not defamation. Rahul Gandhi said Nirav Modi and Lalit Modi plundered the country and Adani was still looting the country’s resources with the blessings of Prime Minister Modi, I challenge the Bharatiya Janata Party (BJP) leaders to prove these statements wrong.”

    During the protest, Sameer Waliullah said that Rahul Gandhi’s disqualification from the Lok Sabha was unfair and accused the BJP government of using defamation to target opposition leaders and suppress dissent.

    He said that the case’s revival has to do with Rahul Gandhi’s questioning of the Adani group in Parliament. “Rahul Gandhi did not claim all ‘Modis are thieves,’ but only questioned why some thieves, like Nirav and Lalit, have the Modi surname,” he added.

    “Rahul Gandhi never defamed anyone. However, BJP leaders run a factory of lies where they keep generating fake news,” he said.

    Sameer Waliullah praised Rahul Gandhi as an inspiration who consistently works to unite India. He said that the recent Bharat Jodo Yatra, a campaign for national integration, is an example of Gandhi’s commitment to bring Indians together.

    Anjan Kumar Yadav stated that the Congress party would continue protesting until Rahul Gandhi is reinstated and demanded a Joint Parliamentary Committee (JPC) probe into the Adani scam. He emphasized the party’s unwavering support for Rahul Gandhi, saying, “We will follow him come what may.”

    Mumbai: Bollywood actor Nawazuddin Siddiqui has filed a defamation suit in the Bombay High Court seeking Rs 100 crore damages from his former wife Aaliya alias Zainab Siddiqui and his brother Shamasuddin Siddiqui accusing them of making defamatory and false statements against him.

    The suit is likely to be heard on March 30 by a single bench of Justice Riyaz Chagla.

    The actor, embroiled in a matrimonial dispute with his former wife, requested the HC to permanently restrain Aaliya and his brother from making any statements or remarks that would defame him.

    He also sought a written apology from his former wife and brother.

    As per the suit, Nawazuddin had appointed Shamasuddin as his manager in 2008 and “blindly” assigned all financial work to him.

    However, Shamasuddin started cheating and defrauding Nawazuddin and purchased properties using the actor’s money, the suit alleged.

    It added that when the actor learnt about the fraud and raised queries, Shamasuddin instigated Aaliya to file a false case against Nawazuddin. The actor claimed Aaliya and Shamsuddin have misappropriated Rs 21 crore from him.

    When Nawazuddin demanded that properties be returned to him, Shamasuddin and Aaliya joined hands and started blackmailing the actor by uploading “cheap videos and comments on social media”, the suit said.

    New Delhi: After a Surat court held Rahul Gandhi guilty in a 2019 criminal defamation case over his remarks about Prime Minister Narendra Modi’s surname, Congress leader Renuka Chowdhury announced that she would file a defamation case against Modi since the latter supposedly linked her laughter to ‘Surupanakha’, a demoness in Hindu mythology in a House proceeding.

    Taking to Twitter, Chowdhury on Friday said that Modi insulted her by his remark made in Parliament in 2018. She also posted a video of the House proceedings.

    She added: “This classless megalomaniac referred to me as Surupanakha on the floor of the House. I will file a defamation case against him. Let’s see how fast courts will act now.”

    In the video, Modi while addressing the Chairman said: “I request you not to say anything to Renuka ji. I am fortunate to hear such laughter today, after the Ramayana serial.”

    The Chairman had asked Chowdhury to be silent after her laughter was heard during Modi’s address.

    New Delhi: A Delhi court on Thursday reserved the order on the point of issuance of summons in a defamation case filed by Union Jal Shakti Minister Gajendra Singh Shekhawat against Rajasthan Chief Minister Ashok Gehlot over the latter’s “misleading statements” against him.

    Additional Chief Metropolitan Magistrate Harpreet Singh Jaspal of the Rouse Avenue Court has listed the matter for order on the issuance of summons for Friday after the conclusion of submission and recording of pre-summoning of evidence in the case.

    Shekhawat filed a defamation case against Gehlot earlier this month, claiming that the latter made defamatory statements against him in connection with the Sanjivani Credit Cooperative Society scam.

    He has said that an investigation was initiated in the case but his name was not mentioned anywhere and demanded prosecution against Gehlot for criminal defamation under the Indian Penal Code (IPC). He has also demanded appropriate financial compensation for the loss of his reputation.

    Earlier, the war of words between Gehlot and Shekhawat had intensified over the Sanjivani Credit Cooperative Society scam with the Rajasthan Chief Minister openly declaring the Union Minister “a culprit like the others”.

    “The Union Minister is trying to mislead the public in the case of the Sanjivani Cooperative Society Ltd scam. In the investigation of the Special Operation Group (SOG), the crime has been proved against him under the same sections as the other arrested accused.”

    Shekhawat had said that Gehlot terming him as an ‘accused’ in the Sanjivani Credit Cooperative Society scam is akin to his “political assassination to settle scores”.

    “The SOG presented three chargesheets but there is neither my nor my family’s name anywhere. Still, the Chief Minister called me an accused,” he said.

    SRINAGAR: Court in Gujarat’s Surat District on Thursday convicted Congress leader and MP Rahul Gandhi in a defamation case for his remarks “why all thieves  share the Modi surname” made during a political campaign in Karol in April 2019, as per media reports.

    India Today reported that the congress leader Rahul Gandhi has been sentenced to two years in jail in the defamation case against him. He was convicted by a Surat court on Thursday under Section 504 (Intentional insult with intent to provoke breach of the peace) of the Indian Penal Code (IPC).

    The case was filed against the Congress MP in 2019 by a Gujarat BJP MLA over his “why all the thieves have Modi in their name” remark. In the complaint, the MLA, Purnesh Modi, said Rahul Gandhi defamed the entire Modi community with his statement.

    After the court announced the sentence, Rahul Gandhi’s legal team filed a bail plea which was granted to the Congress MP, reports said.

    Kolkata: A defamation suit has been filed against a West Bengal minister and the spokesman of Trinamool Congress on charges of making derogatory remarks against the leader of the opposition in the Assembly, Suvendu Adhikari.

    The suit was filed before a district court at Contai in East Midnapore district by Soumnedu Adhikari, the younger brother of Suvendu Adhikari.

    The suit has been filed against Cabinet minister Shashi Panja, Trinamool state general secretary and party spokesman Kunal Ghosh, and Trinamool mouthpiece ‘Jago Bangla’.

    Soumendu Adhikari told newspersons that for quite some time now, derogatory and baseless remarks are being made against the leader of the opposition, even tagging him with the recent development of termination of non-teaching staff in state-run schools.

    “There have been articles in ‘Jago Bangla’ claiming that 55 of the terminated staff were recruited following recommendations from Suvendu Adhikari when he was with the Trinamool Congress. These are all baseless allegations,” Soumendu Adhikari said.

    He also said that before filing the defamation suit on Wednesday, he had sent a legal notice to all the three parties, asking them to tender unconditional apology for making baseless and derogatory remarks.

    “Not receiving any reply, I finally filed the defamation suit against them on Wednesday,” he said.

    It is learnt that a criminal defamation suit has been filed against Panja and Adhikari under Section 500 of the Indian Penal Code, which deals with punishment for defamation.

    Though Carroll’s 2019 lawsuit alleges only defamation, not sexual assault itself, Judge Kaplan found that “in order to prevail on her libel claim, Ms. Carroll must prove that Mr. Trump sexually assaulted her.”

    Without proving the underlying claim of sexual assault, the judge wrote, “she cannot establish that Mr. Trump’s charge that her story was a lie and a hoax was false.”

    In November, Carroll also filed a second lawsuit in New York alleging defamation and battery under a new state law. The 2019 lawsuit is set to go to trial in April. A judge hasn’t ruled whether the two cases will be combined.

    Trump has denied defaming or assaulting Carroll. “We maintain the utmost confidence that our client will be vindicated at the upcoming trial,” a lawyer for Trump, Alina Habba, said in a statement Friday.

    The judge’s ruling Friday will also permit Carroll to use the testimony of Jessica Leeds and Natasha Stoynoff, two women who alleged Trump assaulted them in the years before he ran for office. Leeds alleged Trump groped her while they flew on an airplane together. Stoynoff alleged he sexually assaulted her while she was reporting a story for People Magazine.

    Trump has denied both of their accounts.

    New Delhi: The Delhi High Court on Tuesday stayed the proceedings before the trial court in a defamation case lodged by Delhi BJP spokesperson Tajinder Pal Singh Bagga against journalist Swati Chaturvedi.

    Justice Rajnish Bhatnagar issued notice on the petition by Chaturvedi challenging the summons issued by the trial court to her on the defamation complaint and asked Bagga to file his response to the plea in two weeks.

    “Till then, trial proceedings are stayed,” said the judge.

    The counsel appearing for the petitioner contended that no case for defamation was made out from the material on record and the complainant has not even brought forth witnesses before the trial court to substantiate his claim that his reputation was lowered due to the actions of Chaturvedi.

    The defamation case arises from a tweet Chaturvedi allegedly posted in 2017 in which she claimed Bagga had not only beaten up a lawyer once but was also arrested in a sexual harassment matter.

    Bagga’s counsel had told the trial court that the tweet was made after he was appointed a BJP spokesperson.

    The counsel for the complainant defended the summoning order and said the petition lacked merit and the issue of lowering of reputation was a question of fact to be decided during the trial.

    It was also said that there is no necessity under the law to examine any witness on the issue of loss of reputation at this stage.

    The counsel, who opposed stay on trial court proceedings, also said the allegation pertaining to the sexual harassment case was absolutely incorrect and the matter relating to beating up a lawyer was sub-judice.

    The petitioner’s lawyer said Bagga himself acknowledged the incident where he beat up another lawyer and the victim of the sexual harassment case in question had also earlier tweeted about it.

    A magisterial court order had directed Chaturvedi to appear before it in the case filed by Bagga in May 2018.

    The matter will be heard next on July 18.
