Bandi Sanjay was arrested by the Warangal police criminal conspiracy along with three other persons to create rumours and provoke a breach of peace in the ongoing SSC examination. All of them have been remanded to 14 days judicial custody. His lawyer ˙as also filed a bail petition.

The Warangal police had arrested three persons including a minor in the SSC Hindi paper leak. The paper was shared on Whatsapp minutes after the exam began. After his arrest, security has been tightened by the police in Karimnagar and Warangal districts.

Bandi Sanjay has been named the prime accused (A1) in the case.

Dismissing all claims of ‘illegal arrest’ Warangal Commissioner AV Ranganath stated that the Lok Sabah Speaker was informed about the MP’s arrest, as per the law.

Addressing the media, AV Ranganath, said that the SSC paper in the second language Hindi was leaked at the exam centre on Tuesday.

“Bandi Sanjay gave instructions to Prashanth to exploit the situation of the SSC paper leak in the Vikarabad stating that if it also happens on Wednesday it will defame the government and show it as a failure of the state government,” the remand report of police stated. The police alleged Karimnagar MP conspired with other BJP workers.

The photo and message then went viral via different WhatsApp groups. Prashanth also sent the same to Bandi Sanjay and is said to have made 146 calls in about an hour.

  • Excise policy scam: Sisodia’s judicial custody extended till April 17

Excise policy scam: Sisodia’s judicial custody extended till April 17

    [ad_1]

New Delhi: A Delhi court on Monday extended former Deputy Chief Minister Manish Sisodia’s judicial custody until April 17 in connection with the now-scrapped excise policy case being probed by the Central Bureau of Investigation (CBI).

CBI Judge M.K. Nagpal of the Rouse Avenue Courts ordered the AAP leader to be produced before the court on April 17.

The central probe agency had sought the extension of Sisodia’s custody as the investigation is at a crucial stage.

    MS Education Academy

On March 31, the court had dismissed former Deputy Chief Minister’s bail plea.

While denying him bail, Judge Nagpal had said that Sisodia can, prima facie, be held to be the “architect of the criminal conspiracy”.

He observed that the payment of advance kickbacks of around Rs 90-100 crore was meant for him and his other colleagues in the AAP government.

“The payment of advance kickbacks of around Rs 90-100 crore was meant for him and his other colleagues in the GNCTD and Rs 20-30 crore out of the above are found to have been routed through the co-accused Vijay Nair, Abhishek Boinpally and approver Dinesh Arora and in turn, certain provisions of the excise policy were permitted to be tweaked and manipulated by the applicant to protect and preserve the interests of South liquor lobby and to ensure repayment of the kickbacks to the said lobby,” the court held.

The court is not inclined to release Sisodia on bail at this stage of investigation as his release may adversely affect the ongoing investigation and will also seriously hamper the progress, the order stated.

It said that the evidence collected by the probe agency so far shows that the applicant through the co-accused Vijay Nair was in contact with the ‘South lobby’ and formulation of a favourable policy for them was being ensured at every cost and a cartel was permitted to be formed to achieve monopoly in sale of certain liquor brands of favoured manufacturers and it was permitted to be done against very objectives of the policy.

“Thus, as per allegations made by prosecution and the evidence collected in support thereof so far, the applicant can prima facie be held to be architect of the said criminal conspiracy,” the court said.

It held that the allegations made against Sisodia are “serious in nature” and he does not deserve to be released on bail as he was arrested in the CBI case only on February 26 and that the investigation qua his role has still not been completed.

Mere filing of a charge sheet against seven other co-accused in the matter does not matter much in a case like this where deep rooted conspiracy for commission of some economic offences effecting the people at large is alleged to have been committed, the court observed.

It said that the evidence collected so far by the CBI not only shows Sisodia’s active participation in the criminal conspiracy, but also the prima facie commission of some substantive offences of the PC Act by him.

“There is also nothing apparent on record to infer or show that arrest of the applicant in this case was illegal or violative of any directions of the Hon’ble Supreme Court or the Hon’ble High Courts and rather, the material placed before this court by the CBI justifies the arrest of applicant in the case,” the court said.

During the last hearing, one of Sisodia’s counsel had said that nothing exceptional was stated by the CBI which would warrant continued custody.

“Nothing on record to show that Sisodia will be threatening the witnesses,” the counsel said, arguing that Sisodia has cooperated with the CBI investigation and none of the searches have revealed any incriminating material against him.

Gujarat Police File Cheating Case Against Conman, Custody May Follow

    [ad_1]

SRINAGAR: The Gujarat state’s Ahmedabad Crime Branch has filed a fresh First Information Report (FIR) against Kiran Patel, a fraudster who posed as a PMO (Prime Minister’s Office) official and deceived the security establishment in Kashmir to obtain various benefits before being apprehended earlier this month.

According to an official who spoke to news agency KDC, the Ahmadabad Crime Branch has lodged a fresh FIR against Kiran Patel, dubbed a ‘conman’, after being arrested by a team of Srinagar police based on information from the CID department. Patel had posed as an additional director (strategy and campaigns) at the Prime Minister’s Office and received numerous benefits, such as a bulletproof car, security protection, and various other amenities.

The official stated that the police station of Ahmadabad’s Crime Branch in Gujarat state has registered a new FIR (number 11191011230073) against Kiran Patel under sections 406, 420, 170, and 120 B.

Sources have verified that a two-member team from the Crime Branch has been dispatched to Srinagar to assume the custody of Kiran Patel from the Srinagar police.

The initial report of the arrest of the fraudster, hailing from Gujarat, who had allegedly used fake credentials to pose as an Additional Director (Strategy & Campaigns) of the Prime Minister’s Office in New Delhi, was published by the Srinagar-based news agency, KDC. The arrest had taken place at Hotel Lalit in Srinagar, in a significant case handled by the Srinagar police.

An FIR number 19 of 2023 was registered by Srinagar police in Police Station Nishat in Srinagar, reads “On 02-03-2023 a reliable information received by Police Station Nishat has revealed that a fraudster namely Kiran Bhai Patel son of Jagdesh Bhai Patel resident of Gujarat has by virtue of criminal intention indulged in activities within the jurisdiction of this police station and other parts of Kashmir valley and by employing high degree of forged means. Kiran Bhai has impersonated himself as a senior government official of India.”

“The said individual, by resorting to cheating, forgery and impersonation has duped gullible people and also intentionally induced people to do and also to omit to do activities, under a well-knit plan for securing monetary as well as material benefits,” reads the FIR.

The imposter had taken the J&K administration and security structure for a ride by securing Z-plus security cover, a bulletproof Mahindra Scorpio SUV, official accommodation at a five-star hotel, and a lot more,” reads the FIR.

On Thursday, after hearing the arguments of the counsel representing Patel and additional public prosecutor, the court of Chief Judicial Magistrate (CJM) Srinagar Raja Mohammad Tasleem found the bail plea “devoid of any merit”.

“I am of the considered opinion that arguments advanced by APP are just, proper and appealing and carries much weight and on the other hand I respectfully disagree with the submission put forth by Counsel for the applicant (Patel) because in case at this stage discretion of bail is exercised in favour of the accused it shall definitely destroy the very fabric of the investigation,” the court said. “Resultantly, in my considered opinion the instant application is devoid of any merit which deserves to be rejected, hence rejected.” (KDC)

  • Nikki Yadav murder case: Delhi court extends accused Gehlot’s judicial custody

Nikki Yadav murder case: Delhi court extends accused Gehlot’s judicial custody

    [ad_1]

New Delhi: A Delhi court on Wednesday extended the judicial custody of Nikki Yadav murder case main accused Sahil Gehlot and five others for 14 days.

The accused were produced in the court after the expiry of their custody and the Link Metropolitan Magistrate extended their judicial custody till April 5.

Gehlot had allegedly strangled 23-year-old Yadav near Kashmiri Gate on February 10 and married another woman on the same day. Four days later, Yadav’s body was found in a fridge at a dhaba, owned by Gehlot, in Mitraon village on the outskirts of Delhi.

The court had, on Monday, pulled up the police for not producing the case diary of the murder and had asked the Investigation Officer (IO) to come with it on Tuesday.

On Tuesday, the court then directed to preserve the Call Detail Record (CDR) along with the mobile location of accused, Lokesh Yadav.

Allowing a plea seeking the preservation of CDR, Link Metropolitan Magistrate Nitesh Goyal also permitted a plea for signing and pagination of the case diary by the IO.

The court had, on Monday, extended the judicial custody of the accused persons, including Gehlot for one day and by one more day on Tuesday.

During the hearing on Tuesday, Lokesh Yadav’s counsel, advocate Anirudh Yadav submitted that the accused had been arrested in the matter but he has no role in the murder and conspiracy.

Counsel further argued that it is necessary to preserve the CDR along with the mobile location of the accused in order to avoid any manipulation and that it is also necessary to get the case diary signed and paginated by the IO for the purpose of a fair investigation.

Advocate Yadav also submitted that some of the mobile phones seized by the police have recording facilities. All the conversations are recorded and the police must have heard them. These phones ought to be sealed and sent to the FSL for examination.

On the other hand, the investigation officer (IO) claimed that Lokesh Yadav and other suspects had been arrested in the murder case and that on the day of the murder, they were near the flat in Uttam Nagar, where Nikki Yadav had resided.

He also submitted that a request for obtaining a certified copy of CDR has been sent to the concerned mobile operator.

On Monday, Metropolitan Magistrate Paras Dalal had directed the IO to produce the case diary and pagination of the same on Tuesday.

The court had noted that the IO, due to his absence, deputed a Sub Inspector to attend the court hearing, who did not bring the case diary.

After noting the submission of advocate Anirudh Yadav, the court had asked the police how the offences related to murder and conspiracy are made out against him.

On March 6, the court had extended the judicial custody of Gehlot five others by 14 days, which expired on Monday.

Earlier, for Lokesh, advocate Yadav had moved an application seeking the marking of the case diary and showed displeasure over manipulation in it.

Gehlot’s father, Virender Singh; cousins Naveen (a constable in Delhi Police) and Ashish; and friends Lokesh and Amar are accused of hatching a conspiracy to get rid of Yadav, so he could go ahead with his wedding with another woman.

According to a senior police official, Gehlot was interrogated at length during police custody and disclosed that Yadav was trying to stop him from marrying someone else as they had already solemnised their marriage in 2020.

“She was pleading with him not to go ahead with the marriage fixed by his family with another girl on February 10. However, Gehlot along with his father, two cousins, and two friends hatched the conspiracy and planned to remove the deceased from their way,” the official had said.

“He executed the plan and murdered her and informed other co-accused persons about it on the same day and then all of them went ahead with the marriage ceremony.”
