    Lucknow: The Lucknow bench of Allahabad High Court has said that the Centre should take an appropriate decision to ban cow slaughter and declare it as a ‘protected national animal’.

    “We live in a secular country and must have respect for all religions. In Hinduism, the belief is that the cow is the representative of divine and natural beneficence. Therefore, it should be protected and venerated,” Justice Shamim Ahmad said while dismissing a plea seeking the quashing of criminal proceedings against a person under the Uttar Pradesh Prevention of Cow Slaughter Act, 1955.

    The petitioner, Mohammad Abdul Khaliq, had pleaded that the police booked him without any evidence and hence the proceedings pending against him in the court of additional chief judicial magistrate should be quashed.

    Dismissing the plea, the bench held that from the facts on record, prima facie case was made out against the petitioner.

    While passing the order, the judge observed, “The cow has also been associated with various deities, notably Lord Shiva (whose steed is Nandi, a bull) Lord Indra (closely associated with Kamadhenu), Lord Krishna (a shepherd in his youth), and goddesses in general.”

    He said, “According to legend, she emerged from the ocean of milk at the time of Samudramanthan (the great churning of the ocean by the gods and demons). She was presented to the seven sages and with time came into the custody of sage Vasishta.”

    The judge further said that a cow’s legs symbolise the four Vedas and her milk is four ‘purushartha’ (or human objectives — ‘dharma’ or righteousness, ‘artha’ or material wealth, ‘kama’ or desire and ‘moksha’ or salvation. ‘Her horns symbolise the gods, her face the sun and moon, and her shoulders ‘Agni’ (the god of fire).

    The cow has also been described in other forms: Nanda, Sunanda, Surabhi, Susheela and Sumana,’ Justice Ahmad said. He said that the origin of the veneration of the cow can be traced to the Vedic period.

    “The Indo-European peoples, who entered India in the second millennium BCE, were pastoralists. Cattle had a major economic significance that was reflected in their religion. The slaughter of milk-producing cows was increasingly prohibited. It is forbidden in the Mahabharata, and in the ‘Manusmriti’. A cow which produces milk was said to be ‘unslayable’ in the Rigveda, the court said.

    According to the high court bench, legends also state that Brahma gave life to priests and cows at the same time so that the priests could recite religious scriptures while cows could afford ghee as an offering in rituals.

    “Anyone who kills cows or allows others to kill them is deemed to rot in hell for as many years as there are hairs upon his body,” the judge said.

    New Delhi: The Delhi High Court on Friday refused to interfere with the decision of the Animal Welfare Board of India (AWBI) to withdraw its notification declaring February 14 as Cow Hug Day’.

    Justice Prathiba M Singh said the celebration of any event by AWBI was within the domain of the board and the government and the court cannot interfere with it.

    Petitioner Kolisetty Shiva Kumar said in his plea that being a spiritual person and a cow lover, he “made arrangements for conducting the event in a massive manner in Hyderabad and the entire Telangana State” and the sudden withdrawal of ‘Cow Hug Day’ without specifying any reason was unjust, arbitrary and contrary to the provisions of the Constitution of India.

    “The celebration of any event by AWBI clearly is within the domain of policy of board and government. The same cannot be interfered with in a petition under Article 226,” said the court.

    Besides assailing the withdrawal, the petitioner –represented by lawyer Sravan Kumar, also sought a direction to the authorities to take initiative for the implementation of the February 6 notification on celebration of Cow Hug Day’ on February 14.

    February 14 is observed as Valentine’s Day across the world.

    The petitioner had submitted that the Supreme Court has in certain cases emphasised the importance of cows and held that protection of cow progeny was needed in the interest of the nation’s economy.

    The plea argued the revocation of the decision on celebrating Cow Hug Day’ was illegal.

    “The notification dated 6.2.2023 was issued for protection and promotion of cows in the country in accordance with the Article 48 of the Constitution of India after due consultation and approvals from the authorities. The Cows being sacred in India holds importance very much but they are also beneficial in other manners,” the plea asserted.

    “No reason was stated in the revocation notification for the withdrawal of cow day announcement. The act of the Respondent is illegal and contrary to the law,” it added.

    The AWBI, which is under the Department of Animal Husbandry and Dairying, had issued a notice appealing to people to celebrate ‘Cow Hug Day’ on February 14 to spread “positive energy” and encourage “collective happiness”, saying “All cow lovers may celebrate February 14 as Cow Hug Day keeping in mind the importance of mother cow and make life happy and full of positive energy.”

    The notification was withdrawn on February 10 following directions from the government amid widespread criticism on social media.

    The board, established in 1962 under Section 4 of the Prevention of Cruelty to Animals Act, 1960, provides grants to animal welfare organisations and advises the Centre on animal welfare issues.

    It is a statutory advisory body on animal welfare laws and promotes animal welfare in the country.

    New Delhi: The Delhi High Court on Thursday issued notice on a plea seeking a separate cell for cow protection in every district and to put a stop to its slaughtering.

    Filed in a form of Public Interest Litigation (PIL), a division bench Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad while hearing it, sought response of the Centre, Arvind Kekriwal-led Government and Police.

    The bench has listed the matter for the next hearing on May 17.

    Ajay Gautam’s PIL alleges that there have been rampant incidents of cow slaughtering in Delhi despite a large number of policemen here.

    Appearing for Centre, Additional Solicitor General (ASG) Chetan Sharma said that it is a “genuine case.”

    It is the petitioner’s case that people from Mewat or Nuhu district in Haryana, kidnap cows from the roads, farms or dairies in the capital and take them for slaugtering.

    “These places are infamous for cow slaughters,” it says.

    The petitioner has shown displeasure stating that witnessing incidents of ill-treatment and torture to cows becomes intolerable for people who reveres cow as “his mother”.

    “Sometimes situation goes out of control,” the plea adds.

    “In many cases, Gau Saveks raided the crime site before the police and resulted in conflict/clash reported between cow smugglers and cow saveks.. That Impounding of vehicles transporting cow meat is a very common occurrence. It is submitted that due to above reasons/incidents communal tension also increase and resulted in communal harmony disturb,” the plea states.

    According to the Delhi police Act, 1978, the Police is empowered to make special cell or unit for the protection of cows to avoid conflict between cow smugglers and cow sewaka, the petition reads.

    “Cows are the goddesses of the gods and the refuge of all auspiciousness. Cows bestow every kind of happiness and for this reason they always are worshipable. Cows are the support of all the worlds for by their milk they nourish terrestrial beings and by their ghee offered in the sacrifice they nourish the denizens of the celestial realms. Nothing superior to cows,” the plea states.

    Members of the Muslim community were attacked in two separate incidents on allegations of cow smuggling and beef consumption in Haryana and Bihar respectively.

    Haryana

    Two Muslim youths – Saleem and Mujahid – had gone to Manpur village to buy cattle. Saleem and Mujahid sell cattle to zamindars for a living.

    “Suddenly someone shouted, ‘These two are Muslims’ and we were surrounded by men with axes,” Saleem alleged.

    On seeing the mob, Mujahid said that he started his motorbike but was attacked. “My bike fell to the ground. I ran away to save my life,” Mujahid alleged. Saleem however could not escape. “They tried to aim my head but I raised my hand and got cut. I also got hit on my legs,” he alleged.

    According to Saleem, he heard one of them shouting, “Take him to the room and electrocute him.”

    “I remember one of my attackers is the nephew of the sarpanch,” Saleem said adding, “They took away my watch and Rs 50,000.”

    Fortunately, a man, who was also a Hindu, went to save Saleem. He asked the attackers to stop and told Saleem to run. “He was also a Hindu. He told the attackers that he knows me and asked me to leave the place,” Saleem said.

    Later Saleem lodged an FIR at the Mundkani police station.

    However, Siasat.com spoke to Mundkani police who although agreed there was an FIR lodged by Saleem but denied any such incident took place.

    “There was a small fight between Saleem and the accused – Manish. An FIR was registered and Manish was arrested yesterday,” the police said.

    Manish is currently on bail, police added.

    Saleem and Mujahid are residents of Roopraka village in Haryana. Saleem has six children, the oldest being nine years old.

    Bihar

    On February 20, police arrested a 58-year-old Muslim man – Ansarul Sheikh – on charges of allegedly carrying beef. A video has emerged on social media from Raxaul, Bihar, where a distraught Sheikh can be seen begging a mob that it is not cow’s meat, but buffalo’s.

    A case was registered against Sheikh and he was produced before the court that sentenced him to jail. Sheikh is currently lodged in Motihari jail.

    Siasat.com spoke to Raxaul police station when officials said that the investigation is still on. “We have sent the meat sample to the veterinary doctor who is yet to confirm if it is cow’s or buffalo’s meat,” police said.

    Bhopal: Police have arrested three men on charges of killing a cow in Bhopal, an official said on Wednesday, as local authorities demolished “illegal” constructions at the house of one of them and moved to invoke the stringent National Security Act (NSA) against the trio.

    The alleged incident occurred on Tuesday in Paras Nagar under Gandhi Nagar police station limits of the Madhya Pradesh capital.
    Gandhi Nagar Police Station in-charge Arun Sharma informed that following a tip off, a police team reached the spot and spotted three persons with a blood-stained sharp-edged weapon.

    Remains of the slaughtered cow were also found at the spot, he said.

    The trio tried to flee the site of the crime after seeing the police team. The police, however, caught them and during interrogation they admitted to killing the bovine, Sharma said.

    The three men — identified as Imran (30), Irshad (28) and Javed (30) — were booked and arrested under provisions of the state’s anti-cow slaughter law — Madhya Pradesh Govansh Vadh Pratishedh Adhiniyam and — also the Prevention of Cruelty to Animals Act, said the police officer.

    He said process of invoking the National Security Act (NSA) against the accused has been initiated.

    The NSA allows the government to detain people for up to one year without a trial if they suspect that they could disrupt public order or endanger the security of India.

    After the incident, the Bhopal administration demolished “illegal” constructions at the house of Irshad on Wednesday, he said.

    Local MLA Rameshwar Sharma termed the cow killing incident as unfortunate and said this was a serious issue as intention of these people could be to trigger communal tension.

    The Bharatiya Janata Party (BJP) legislator said he has asked the police to find out if more people were involved in the incident.
    “I have asked the police and administration to take strict action in the matter,” he said.

    Jaipur: A Rajasthan court on Saturday sent one accused to police remand for five days in connection with the alleged abduction and murder of two men by cow vigilantes, while Haryana authorities moved to cancel the arms licence of Bajrang Dal member Monu Manesar who is among the four evading an arrest in the case.

    The family members of Nasir (25) and Junaid alias Juna (35), residents of Ghatmeeka village in Bharatpur district of Rajasthan whose charred bodies were found inside a burnt car in Loharu in Bhiwani in Haryana on Thursday morning, met Chief Minister Ashok Gehlot who assured them that all the accused would be arrested at the earliest.

    Rajasthan police had booked five persons linked to Bajrang Dal in the case and arrested one of them Rinku Saini.

    Separately, Haryana Chief Minister Manohar Lal Khattar said that Rajasthan and Haryana police were cooperating and the guilty would not be spared.

    Meanwhile, Haryana police said they are investigating a complaint filed in Nuh by the mother of one of the accused, Shrikant Pandit, alleging that Rajasthan police had forcibly taken away her two other sons after assaulting her family members, including her full-term pregnant daughter-in-law who lost her child after the incident.

    Varun Singla, Superintendent of Police of Nuh, said that a probe has been initiated on the complaint from Dulari Devi and they were verifying the facts.

    AIMIM president Asaduddin Owaisi, who was in Rajasthan on a two-day visit and met the grieving families in Bharatpur, alleged that “delay” by the Rajasthan government in acting on the missing complaint lodged by the family members of two men allowed the accused to flee the state. He also accused the BJP of protecting such vigilante groups.

    Members of Hindu outfits including Vishva Hindu Parishad (VHP) and Bajrang Dal held a protest in Gurugram and other districts in Haryana, demanding a CBI inquiry in the case.

    “The arrested accused Rinku Saini was produced before the court today from where he was sent to five days police remand. The accused will be further interrogated,” Station House Officer of Gopalgarh Ramnaresh Meena said.

    Saini, 32, a resident of Firozpur Jhirka in Haryana’s Nuh district, was arrested on the basis of interrogation and technical analysis on Friday night. He works as a taxi diver and was involved with a cow vigilante group, the Rajasthan police said.

    One of the key accused in the case is Mohit Yadav alias Monu Manesar, the Gurugram district president of Bajrang Dal who was a member of the district cow protection task force.

    He was earlier named in an attempt to murder case registered at Pataudi police station in Gurugram on February 7 and police said they were trying to nab him.

    Officials said they have started the process of cancellation of his arms licence.

    DCP Manesar Manbir Singh under the rules, an arms licence is cancelled if the licence holder is booked for a heinous crime.

    “The process of cancellation of the arms license of Monu Manesar has started and it will be cancelled soon,” he said.

    Monu, who frequently courts controversy over the actions of his cow protection group, had posted a video on social media denying his involvement in the case.

    He is known for sharing videos of vigilantes chasing, confronting and nabbing alleged cow smugglers. The videos, mostly live streams, have thousands of views and comments.

    Junaid had a criminal record of cattle smuggling and five cases were registered against him at different police stations, a police officer said.

    “Family members had demanded justice and early arrest of all the accused. Chief Minister has assured that the accused will be arrested and cooperation from Haryana will be sought if it is required,” Rajasthan Minister of State for Education Zahida Khan, who led the delegation which met Gehlot, told reporters.

    Owaisi said that it is not a matter of Muslims, but of all those people who believe in rule of law and the Constitution.

    “Nobody has the right to take the law into their hands. Otherwise where will be the need for police, administration and courts,” he said.

    “Had the Rajasthan government taken immediate action on the missing complaint related to Junaid and Nasir, then they (abductors) would have not been able to cross the Rajasthan border,” Owaisi told reporters He said it was a painful incident.

    “If the BJP keeps sheltering such radicals then it is not right for the country. These incidents occur only and only because the BJP helps such organisations, gives them strength and shelters them due to which police and administration do not take immediate action,” Owaisi alleged.

    But protesting members of right-wing Hindu outfits on Saturday demanded an apology from the Gehlot government, accusing it of “defaming” Bajrang Dal and its members and alleged that Rajasthan police was wrongly implicating members of cow protection groups in the case.

    “There should be an impartial inquiry into this entire matter first because we feel that the Gehlot government, by adopting a policy of appeasement under a conspiracy, wants to gain political mileage in the upcoming elections by implicating the cow vigilantes in false cases,” said Ajit Yadav, Gurugram district president of the VHP.

    In Nuh, complainant Dulari Devi alleged that a team of over 40 personnel of Rajasthan police forcibly entered her house and asked about the whereabouts of her son Shrikant.

    “When I told them that my son was not at home, they thrashed me and my son’s pregnant wife Kamlesh. They uttered abuses and took away my two sons Vishnu and Rahul with them and we still don’t know about their whereabouts,” she claimed.

    Devi claimed that her daughter-in-law had completed nine months of pregnancy.

    “The cops also kicked the pregnant wife of Shri Kant on her stomach and she started having stomach pain. She was admitted to Mandi khera hospital and soon after referred to Nalhar Medical College where her child was born dead,” she claimed and added her daughter-in-law is still hospitalised in critical condition.

    “Both my sons Vishnu and Rahul should be recovered and strict action should be taken against the culprits,” Dulari said in her complaint.

    A senior police officer said on condition of anonymity that the family buried the body of the child without a postmortem. In this situation, it is a matter of investigation first.

    “As per the complaint, we are verifying the facts. Further action will be taken as per the law,” said SP Singla while speaking to PTI.

    Superintendent of Police of Bharatpur Shyam Singh had said the FIR was registered at Gopalgarh police station against five people – Anil, Shrikant, Rinku Saini, Lokesh Singhla and Monu – on the basis of a complaint lodged by the victims’ family members.

    The accused have been booked under sections 143 (unlawful assembly), 365 (kidnapping), 367 (grievously hurt after kidnapping) and 368 (wrongfully keeping in confinement) of the Indian Penal Code (IPC), he said.

    On the victims’ families alleging the Bajrang Dal’s role in the killings, the Rajasthan BJP has said it is not justified to malign an organisation before the investigation is completed.

    Bharatpur: Relative of Junaid, one of the two men who were allegedly abducted and charred to death in Haryana, on Saturday reacted to the Rajasthan Police’s “cow smuggler” claims.

    Earlier, IG, Bharatpur Range has said that Junaid has five cases pertaining to cow smuggling against him, to which Junaid’s cousin Ismail said, “If he [Jumail] was a cow smuggler then why police didn’t arrest him?”

    “When there were cases on Junaid, then why was he not caught earlier? Now when he is dead, they are saying that there was a case [of cow smuggling]. He was residing here but the police never came,” Junaid’s cousin said.

    “These people are only hooligans, who do such work. They have just worn the cloak of cow vigilantes, but they do hooliganism because this is their only business,” he added.

    Earlier on Thursday, two skeletons were found inside a charred SUV in the Loharu area of the Bhiwani district.

    Later investigations, revealed that the skeletons were of two Muslim men– Junaid and Nasir– from Rajasthan’s Bharatpur, who were allegedly abducted.

    Rajasthan Police have made one arrest in the case.

    The police said that the accused was arrested on Friday after his involvement in the crime was found.

    “Several teams were formed to nab the people named in the FIR. A person named Rinku Saini was caught and interrogated. He has been arrested after his involvement in the incident was found. We’ll seek his police remand to gather more information,” IG, Bharatpur Range said.

    Reacting to the development, Junaid’s cousin thanked Rajasthan Police for the first arrest in the case.

    He also said that the government has promised Rs 15 lakh, a government job and a speedy arrest in the case along with strict action against the accused persons

    Asked about the deceased family members, he said that Junaid is survived by his wife, brother, sister-in-law, and six children.
    “His brother is unemployed and has six children, Junaid was the sole breadwinner for them too,” he added.

    Rajasthan Chief Minister Ashok Gehlot on Friday condemned the incident and assured strict action against the perpetrators.

    Rajasthan Police on Friday said special teams had been formed to arrest suspects based on an FIR filed by a family in Rajasthan alleging that the deceased had been kidnapped from the state’s Bharatpur district.

    Further investigation into the matter is underway.

    Lucknow: Uttar Pradesh Animal Husbandry Minister Dharmpal Singh on Tuesday celebrated Valentine’s Day as “cow love day” by offering jaggery and rotis to cows and said that they should be treated as mothers.

    He said there is no animal like a cow in the world whose “mal-mutra” (stool and urine) is “pious”.

    “Today, Valentine’s Day is celebrated all over the world. There are many relations like mother, father, brother, sister, husband, wife, and one’s love should be expressed,” Singh told reporters.

    “We have three mothers — our mother, who gives us birth, ‘gau mata’ (cow) and Bharat Mata. First love should be for our mother, then ‘gau mata’ (cow) and then Bharat Mata ‘ko pranaam karna chahiye’ (should be saluted),” the minister said.

    Singh offered gud’ (jaggery) and rotis to cows in the Bakshi ka Talab area here to mark the day.

    He urged people to celebrate “cow love day” on Valentine’s Day.

    “They (people) should go to a ‘gaushala’ (cow shelter home), feed roti to a cow and pray to her,” Singh said.

    “Even a simple visit to ‘Gaushala’ can keep tension away as there is an emotional connect to it. By entering ‘Gaushala’ the door to development opens. There are no such animals (like cows) in the world whose ‘mal-mutra’ (stool-urine) is pious. Its dung and urine are also pious. In cow’s dung lives Lakshmi,” the minister added.

    The Animal Welfare Board of India (AWBI) had on last Monday appealed to the people to celebrate February 14 as ‘Cow Hug Day’. The directive was later withdrawn on the directions of the government after the move became the subject of memes on social media.

    Singh had on Saturday appealed to people to celebrate February 12 by expressing love and faith towards cows by offering them gud and rotis.

    Besides, people should seek blessings of cows by touching their head and neck, the minister had said.

    “Gavo Vishwasya Matarah in vedas means the cow is the mother of the world. Therefore, on this day, one should resolve to serve the mother cow regularly,” he had said.

    Singh also said cow dung should be used on the occasion of ‘Holika Dahan’ as it is environment-friendly and reduces air pollution.

    A day after the Animal Welfare Board of India (AFIB) issued a notice appealing to people to celebrate ‘Cow Hug Day’ on February 14, an old video of BJP leader G.V.L Narsimha Rao getting kicked by a cow is going viral on social media.

    In the video, the BJP MP, who is trying to hug the cow gets kicked multiple times. The video has been shared by eminent advocate and social activist Prashant Bhushan on  Twitter. The post captioned ”Cow hug day!’

    After all-round criticism, the Animal Welfare Board of India (AWBI) on Friday withdrawn its appeal to celebrate February 14 as ‘Cow Hug Day’. February 14 is observed as ‘Valentine’s Day’ across the world.

    In a notice, the board’s Secretary S.K. Dutta said, “As directed by the competent authority and the Ministry of Fisheries, Animal Husbandry and Dairying, the appeal issued by the Animal Welfare Board of India for celebration of Cow Hug Day on February 14 stands withdrawn.”
