    New Delhi: A court here is likely to deliver on Friday its order on the bail application of former Delhi deputy chief minister Manish Sisodia in a money laundering case related to the alleged excise policy scam.

    Special Judge M K Nagpal had reserved the order after hearing arguments on Sisodia’s plea seeking relief claiming that his custody was no longer required for investigation.

    The Enforcement Directorate (ED) had opposed the application, asserting the investigation was at a “crucial” stage and claiming the senior AAP leader had planted fabricated e-mails to show there was public approval for the policy.

    The federal agency had also said it has found fresh evidence of his complicity in the alleged crime.

    The court had on March 31 dismissed Sisodia’s bail application in a corruption case, being probed by the Central Bureau of Investigation (CBI), saying he was “prima facie the architect” in the criminal conspiracy behind alleged payment of advance kickbacks of around Rs 90-100 crore meant for him and his colleagues in the Delhi government.

    The court had observed that the release of Sisodia, at the moment, will “adversely affect the ongoing investigation”.

    The CBI and the ED had arrested Sisodia for alleged corruption in the formulation and execution of the now-scrapped Delhi Excise Policy 2021-22 and for laundering the money so generated.

    Tehran: The Iranian court has ordered the United States government and nine individuals and entities, including former Presidents Barack Obama, and George Bush to pay 313 million dollars (Rs 25,60,26,33,150) in compensation for the 2017 attacks carried out by the Islamic State militant group.

    On Wednesday, an Iranian court issued the verdict based on complaints from the families of three people killed and six injured during the June 2017 attacks in Tehran, according to the judiciary’s official news website, Al Jazeera reported.

    Those convicted in this case include the US government, former Presidents Barack Obama, George Walker Bush, Central Command and its former commander Tommy Franks, the CIA, the Treasury Department, arms manufacturer Lockheed Martin and American Airlines.

    The court ruled that 9.95 million dollars (Rs 81,37,95,575) should be paid in compensation for financial damages, while 104 million dollars (Rs 8,50,74,13,200) and 199 million dollars (Rs 16,27,86,07,950) in moral and punitive damages, respectively, for a total of 313 million dollars (Rs 25,60,26,33,150).

    On June 7, 2017, the Iranian parliament and the shrine of Imam Khomeini in the capital, Tehran, were subjected to terrorist attacks.

    Four gunmen disguised as women entered the parliament and opened fire on the security guards, and gunmen separately attacked the shrine of Imam Khomeini and opened fire on the people inside the compound.

    At least 17 people were killed and nearly 50 injured in these attacks, for which the terrorist organization ISIS later claimed responsibility.

    Hyderabad: A court in Telangana on Thursday dismissed the petition by the police to cancel the bail of state BJP president and Karimnagar MP Bandi Sanjay Kumar in the Class 10 question paper leak case.

    Hanamkonda district court dismissed the petition by the police, which had sought cancellation of the bail on the ground that Sanjay was violating bail conditions.

    After hearing arguments of both the sides for the last two days, the court ruled that there are no grounds for cancelling the bail of Sanjay.

    The court had on April 6 ordered Sanjay’s release on bail subject to certain conditions.

    The Karimnagar MP was arrested amid high-drama from his in-laws’ house in Karimnagar on the night of April 4.

    Warangal police had named Sanjay as the main accused in the leakage of the Hindi question paper of Secondary School Certificate (SSC) exam from an exam centre at Kamlapur in Warangal district.

    After the arrest, Sanjay was taken to a police station in Yadadri Bhuvanagiri district and then brought to Warangal in the evening. He was produced at the residence of the First Class Magistrate in Hanamkonda on April. The magistrate had remanded him to judicial custody till April 19. The court granted bail the next day.

    Police alleged that Sanjay hatched a plan with other accused to leak the Class 10 question paper.

    Sanjay and nine other accused were booked under Indian Penal Code (IPC) sections 120B (criminal conspiracy), 420 (cheating), 505 (circulating any report or statement with an intent to cause alarm to the public)

    Police had also invoked sections 4 (A), 6 of TS Public Examinations (Prevention of Malpractices) Act and 66-D of Information Technology Act.

    SRINAGAR: The central government has notified the transfer of Justice Atul Sreedharan from Madhya Pradesh High Court to Jammu & Kashmir High Court.

    Union Minister for Law & Justice Kiren Rijju announced the development through a tweet. With this development, the number of High Court judges in J&K High Court has reached 16.

    On March28, 2023, the Supreme Court collegium has recommended that Justice  Atul Sreedharan be transferred from MP High Court to J&K. Justice Atul Sreedharan has sought his transfer on the grounds that his elder daughter would enter practice next year and would be appearing before the District Court and the Indore Bench of the High Court.

    “Justice Atul Sreedharan has stated that he does not desire to continue in the High Court of Madhya Pradesh when his daughter enters practice,” reads the collegium resolution.

    “The collegium has resolved to accept the request of Mr Justice Atul Sreedharan and to recommend that he be transferred, in the interest of better administration of justice, to the High Court of Jammu & Kashmir and Ladakh,” it further states.

    The ruling is a victory for Jack Smith, the special counsel probing Trump’s bid to subvert the 2020 election. Smith subpoenaed Pence in February, prompting separate challenges by both Trump and Pence.

    While Trump argued that Pence’s testimony should be barred or limited by executive privilege, Pence took a different tack. He contended that his role presiding over Congress on Jan. 6, 2021 — fulfilling his constitutional role as president of the Senate — entitled him to immunity under the so-called “speech or debate” clause, which protects Congress from Executive Branch intrusion.

    Chief U.S. District Court Judge James Boasberg rejected Trump’s argument but agreed with Pence that the congressional immunity applied on certain topics — a historic decision that for the first time found vice presidents enjoy a form of privilege.

    Although Boasberg’s ruling was narrower than Pence’s attorney, Emmet Flood, had argued for, Pence opted not to appeal the decision.

    Trump earlier this month sought an emergency order from the court of appeals blocking Boasberg’s ruling. But Wednesday’s order — a unanimous ruling by Judges Patricia Millett, Robert Wilkins and Gregory Katsas — rejected that effort. Millett and Wilkins are Obama appointees, while Katsas is a Trump appointee.

    It’s unclear when Pence will appear before the grand jury, but Trump’s previous emergency appeals — which have nearly all failed when it comes to similar sealed orders — have occurred just days before witnesses were scheduled to appear.

    Mumbai: A court in Maharashtra’s Ratnagiri has granted bail to 111 people, most of them women, who were arrested for holding an agitation against a proposed oil refinery at Barsu village in the coastal district.

    More than 100 women were among the protesters who tried to block a road in Barsu and Solgaon areas of Ratnagiri, around 400km from Mumbai, on Tuesday by lying on the ground to stop government vehicles from entering the proposed site of the refinery.

    “The Ratnagiri police arrested the 111 protesters. After their arrest, they were produced in a court later that evening, which then granted bail to them,” an official said.

    Since a large number of police personnel were deployed in the area on Wednesday, peace prevailed in the area and no agitation was held during the day, he said.

    The protesters were booked under Indian Penal Code (IPC) sections related to unlawful assembly, rioting, disobedience to an order lawfully promulgated by a public servant, wrongful restraint and relevant provisions of the Maharashtra Police Act, he added.

    Local residents fear that the mega project will adversely affect the fragile biodiversity of the coastal Konkan region and also hit their livelihood. The opposition Shiv Sena (UBT) came out in their support and demanded an immediate end to “atrocities” against protesters.

    New Delhi: As the Supreme Court hears pleas seeking legal sanction for same sex marriages, Union Law Minister Kiren Rijiju on Wednesday said an important matter like the institution of marriage has to be decided by people of the country and that courts are not the forum to settle such issues.

    He, however, clarified that he does not want to make the matter a “government versus judiciary” issue. “It is not. Absolutely not,” the minister asserted.

    Responding to a question at Republic TV conclave, he said, “It is a matter which concerns every citizen of India. It is the question of people’s will. The will of the people is reflected in Parliament or in the legislature or assemblies…”

    Apparently referring to the Constitution bench of the top court hearing the matter, Rijiju said, “If five wise men decide something which is correct according to them — I cannot make any kind of adverse comments against them — But if people do not want it, you cannot impose things on the people…,”.

    Same-sex partners from around the country have approached the Supreme Court with a plea stating that same sex marriages should be legalised under the Special Marriage Act.

    The law minister further said that sensitive and important matters like institution of marriage have to be decided by the people of the country.

    The Supreme Court has the power to issue certain directions. Under Article 142, it can also make laws. If it feels some vacuum has to be filled, it can do so with certain provisions, he pointed out.

    “But when it comes to a matter which effects every citizen of the country, SC is not the forum to decide on behalf of the people of the country,” Rijiju added.

    The Centre on Wednesday requested the apex court to consider leaving questions raised in the pleas seeking legal sanction for same sex marriages to Parliament.

    Appearing for the Centre, Solicitor General Tushar Mehta told a five-judge constitution bench headed by Chief Justice D Y Chandrachud that the court is dealing with a “very complex subject”, which has a “profound social impact”.

    He said the warrants have been issued in case FIR 90/2022 of PS Chatroo, under Section 120-B/121-A/IPC, 13/18/39/UAPA, 120B/121-A/IPC

    SSP Kishtwar Khalil Poswal said that chief investigation officer DySP PC Vishal Sharma approached the special NIA Court for issuing non-bailable warrants against the accused for their active involvement in militant activities for creating unrest in the Chenab valley and other parts of Jammu and Kashmir.

    He said they mobilised sleeper cells and pushed them into J&K in connivance with secessionist and separatist leaders for waging war against the Government of India with nefarious design of seceding Jammu and Kashmir from Union of India.

    The SSP said further investigation into the case is underway. (KNO)

    But a Durbin spokesperson told POLITICO Tuesday that Roberts declined to appear for the hearing. Durbin has previously said he plans for the hearing to proceed even if Roberts declined to appear.

    “I am surprised that the Chief Justice’s recounting of existing legal standards of ethics suggests current law is adequate and ignores the obvious. The actions of one Justice, including trips on yachts and private jets, were not reported to the public. That same Justice failed to disclose the sale of properties he partly owned to a party with interests before the Supreme Court,” Durbin said in the statement.

    He added: “It is time for Congress to accept its responsibility to establish an enforceable code of ethics for the Supreme Court, the only agency of our government without it.”

    In a letter to Durbin explaining his reasons for declining, Roberts wrote that a chief justice’s testimony before Congress “is exceedingly rare, as one might expect in light of separation of powers concerns and the importance of preserving judicial independence.”

    Durbin, who is also the majority whip, has previously suggested the committee cannot subpoena Roberts because of the absence of Sen. Dianne Feinstein , a longtime Judiciary Committee member who has been away from the Senate for months while being treated for shingles.
