  • Accused in Vivekananda Reddy murder case to be produced in Hyderabad court

Accused in Vivekananda Reddy murder case to be produced in Hyderabad court

    [ad_1]

Hyderabad: The accused in the four-year-old sensational murder case of former Andhra Pradesh Minister Y.S. Vivekananda Reddy will be produced before the CBI Special Court in Hyderabad on Friday.

This would be the first time after the Supreme Court transferred the case from Kadapa to Hyderabad that the accused will make an appearance in the court.

Sunil Yadav, Umashankar Reddy and Devireddy Shivshankar Reddy, currently lodged in Kadapa jail, were being brought to Hyderabad amid tight security.

Erra Gangi Reddy, who is on bail and driver Dastagiri, who has turned an approver, will also appear in the court.

The CBI court has issued separate summons to all the accused to appear before it on Friday. Production warrants were issued to the accused lodge in the Kadapa Jail while the investigating agency issued summons to other two accused.

Vivekananda Reddy, paternal uncle of Andhra Pradesh Chief Minister Y.S. Jagan Mohan Reddy, was found murdered mysteriously at his residence at Pulivendula in Kadapa district on March 15, 2019, a month ahead of 2019 general elections.

The 68-year-old former state minister and former MP, brother of former chief minister Y.S. Rajasekhara Reddy, was alone at his house when unidentified persons barged in and killed him. He was killed hours before he was to launch YSR Congress Party’s election campaign in Kadapa.

Though three Special Investigation Teams (SITs) conducted the probe they failed to solve the mystery.

The CBI took over the investigation into the case in 2020 on the direction of Andhra Pradesh High Court while hearing a petition of Vivekananda Reddy’s daughter Sunitha Reddy, who raised suspicion about some relatives.

The CBI filed a charge sheet in the murder case on October 26, 2021 and followed it up with a supplementary charge sheet on January 31, 2022

In November last year, the Supreme Court transferred to a CBI court in Hyderabad the trial and probe into the larger conspiracy behind the murder. The apex court observed that doubts raised by Sunitha Reddy about getting a fair trial and investigation in Andhra Pradesh were reasonable.

Stepping up the pace of investigation, the CBI on January 28 questioned Kadapa MP Y.S. Avinash Reddy, for more than four-and-a-half hours.

Avinash Reddy is nephew of Vivekananda Reddy and cousin of Chief Minister Jagan Mohan Reddy.

On February 3, the CBI questioned Krishna Mohan Reddy, Officer on Special Duty (OSD) for the chief minister.

The central agency also quizzed Naveen, who works in the house of the chief minister. The CBI officials questioned the duo for six-and-a-half hours in Kadapa.

They were reportedly questioned about the sequence of events on the day when Vivekananda Reddy was murdered. They collected information about phone calls made or received by them on the day.

  • ‘PM CARES’ fund case: Delhi High Court posts hearing to April 20

‘PM CARES’ fund case: Delhi High Court posts hearing to April 20

    [ad_1]

New Delhi: The Delhi High Court on Thursday adjourned hearing in a plea seeking a declaration of PM CARES Fund as “State” under Article 12 of the Constitution of India, to April 20.

Due to the unavailability of Solicitor General Tushar Mehta, the matter was adjourned.

The Prime Minister’s Office (PMO) on December 31 told the High Court that the Prime Minister’s Citizen Assistance and Relief in Emergency Situations (PM CARES) Fund is not a public authority according to the Right to Information Act, 2005 and not a “State” under Article 12 of the Constitution of India, but a “public charitable trust”.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad was dealing with a plea moved by Samyak Gangwal, seeking a declaration of PM CARES Fund as “State” under the Constitution. It would attract consequential directions for disclosing the Fund’s audit reports periodically, disclosing the Fund’s quarterly details of donations received, utilisation thereof and resolutions on expenditure of donations, it added.

The affidavit stated that the plea is based on “apprehensions and suppositions” and that a constitutional question should not be decided in a vacuum.

Filed by the Under Secretary of PMO to the court, the affidavit said: “This Trust is neither intended to be, nor is in fact owned, controlled or substantially financed by any government nor any instrumentality of the government. There is no control of either the Central government or any state governments, either direct or indirect, in the functioning of the Trust in any manner whatsoever.

“According to the affidavit submitted, the PM CARES Fund is a public charitable trust accepting only voluntary donations and is certainly not the Centre’s business.

“PM CARES Fund does not receive funds or finances by the government,” it was mentioned.

However, counsel for petitioner Senior Advocate Shyam Divan had said: “High functionaries of the government like the Vice President had requested the Rajya Sabha members to make donations” and that “the PM CARES Fund has been projected as a government fund”.

In response, the PMO had argued: “The PM CARES Fund is administered on the pattern of Prime Minister’s National Relief Fund (PMNRF) as both are chaired by the Prime Minister. Like the National Emblem and domain name ‘gov.in’ are being used for the PMNRF, the same are also being used for PM CARES Fund.

“The affidavit stated: “The composition of the Board of Trustees consisting of holders of public office ex officio – the Supreme Court, Union Home Minister, the Union Finance Minister, the former chairman of Tata Sons Ratan Tata, former Judge K.T. Thomas, and Former Deputy Speaker Kariya Mund” – is merely for administrative convenience and for smooth succession to the trusteeship and is neither intended to be nor in fact result into any governmental control in the functioning of the Trust in any manner whatsoever.

“Besides the declaration of PM CARES Fund as ‘State’ under the Constitution, Gangwal has also sought that PM CARES Fund should be restrained from using ‘PM’ in its names/ website, State Emblem, domain name ‘gov’ in its website and PM’s Office as its official address.

“On March 27, 2020, the trust deed of PM CARES Fund was registered as a Public Charitable Trust under the Registration Act, 1908 in New Delhi.

“Keeping in mind the need for having a dedicated fund with the primary objective of dealing with any kind of emergency or distress situation, like posed by the Covid-19 pandemic, and providing relief to the affected, a public charitable trust under the name of PM CARES Fund was set up, the affidavit stated.

Leopard that attacked 3 in Ghaziabad court captured

    [ad_1]

Ghaziabad: A leopard that entered the premises of a Ghaziabad court on Wednesday, and attacked three persons including a lawyer, a cobbler and police constable near the old building complex, has been captured, officials said.

A 12-member team of the Forest Department along with the police personnel were engaged in a 4-hour-long operation to capture the leopard.

Nets were strategically placed in several points to capture the big cat. The leopard was also administered tranquilizer.

A huge crowd of people, including the court staff and lawyers, was witnessed outside the court, which was sealed while the operation to capture and rescue the leopard was underway.

The Forest Department team had brought nets and cages to trap the leopard.

Earlier, the cobbler was admitted to a hospital after he sustained critical injuries. Several people were also injured in the commotion.

All the rooms of the old building were evacuated as soon as news of the leopard entering the premises spread.

A video of the incident has surfaced, where three lawyers are seen patrolling the building with sticks to catch the leopard.

One of them was filming the video when the big cat suddenly attacked them, injuring one lawyer.

The main building was eventually cordoned off.

According to eyewitnesses, the leopard was first seen under the stairs in the CJM court building.

  • Appeals court backs N.C. attorney general in battle to avoid criminal libel prosecution

Appeals court backs N.C. attorney general in battle to avoid criminal libel prosecution

    [ad_1]

Freeman, O’Neill and Stein are all Democrats.

At Stein’s request, U.S. District Court Judge Catherine Eagles briefly blocked any prosecution, but she later withdrew the temporary order and allowed the prosecution to proceed. Stein appealed to the 4th Circuit, which granted an injunction pending appeal and in the new ruling said Eagles erred when she turned down Stein’s request to block the prosecution.

Criminal libel prosecutions in the U.S. are almost unheard of in recent decades, but Freeman’s office argued that a 1964 Supreme Court decision upholding a similar Louisiana statute has never been overturned by the high court and remains good law. However, the unanimous three-judge appeals court panel said the North Carolina statute is constitutionally suspect because it appears to ban some truthful statements and because it imposes greater limits on speech related to political campaigns than on other topics.

“Under this law, prosecutors need never show—or even allege—a ‘derogatory’ statement was false so long as they contend the speaker acted with reckless disregard of its truth or falsity,” Judge Toby Heytens wrote in a 15-page opinion joined by Judges Albert Diaz and Allison Rushing. “Nothing more is needed to show this Act is likely unconstitutional.”

Heytens is the appeals court’s newest judge and an appointee of President Joe Biden. Diaz was appointed by President Bill Clinton and Rushing is an appointee of President Donald Trump.

Freeman, the Wake County district attorney, argued that North Carolina courts would interpret derogatory to mean false and that the chance of a prosecutor seeking to apply the law against reckless but truthful statements was remote, but the appeals court disagreed.

The appeals judges also said the statute’s focus on political speech was problematic. “The Act’s careful limitation to only a subset of derogatory statements to which elected officials may be particularly hostile—those harmful to their own political prospects—raises the ‘possibility that official suppression of ideas is afoot,’” Heytens wrote, quoting another Supreme Court precedent.

The appeals court ordered the case returned to Eagles for further action, instructing her to consider other factors related to a preliminary injunction against prosecution of Stein and others. But the 4th Circuit’s declaration that the underlying law is probably unconstitutional makes it highly likely the lower court will now block it, unless Freeman agrees to halt any enforcement.

Freeman’s office did not immediately respond to a request for comment on the ruling.

  • ‘Interview with Yogi’: Haryana court issues arrest warrant against Deepak Chaurasiya

‘Interview with Yogi’: Haryana court issues arrest warrant against Deepak Chaurasiya

    [ad_1]

In a 2013 case for allegedly airing ‘morphed, manipulated and obscene’ videos of a 10-year-old child and her family and tying the same to a sexual assault case, a new nonbailable arrest warrant has been issued for news anchor Deepak Chaurasiya.

The court has issued such a warrant for the second time in less than three months. The first nonbailable warrant was issued on October 28, 2017, after the journalist, who has recently joined Zee News as a consulting editor, skipped the hearing due to health concerns. He was granted bail after filing a petition with the Punjab and Haryana High Court.

The case involves an FIR based on a complaint filed on December 15, 2013, by a child’s relative. It accused three news channels of airing ‘morphed’ videos: News24, India News, and News Nation. Former News24 managing editor Ajit Anjum, Aaj Tak anchor Chitra Tripathi, and former News Nation anchor Deepak Chaurasia are among eight people charged in 2020 and 2021 for broadcasting ‘edited,’ ‘obscene’ videos of a 10-year-old girl and her family and linking the video to the sexual assault case against self-styled godman Asaram Bapu.

Charges are currently being argued over.

A Non-bailable warrant was issued against him by Additional Sessions Judge Shashi Chauhan in Gurugram after he failed to show up in court on the day of the hearing, ostensibly because he had a prearranged interview with Uttar Pradesh chief minister Yogi Adityanath.

Although his attorney filed a request for personal exemption from presence, the court observed that neither Chaurasia nor his attorney had submitted any affidavits to support the request. The Court further observed that the same was filed without any supporting persuasive documentary evidence substantiating his absence.

The counsel said that he even filed a message from the UP chief minister’s office, which said that the delay was not intentional because Chaurasia had to interview the chief minister.

However, the court pointed out that the aforementioned communication was not addressed to Chaurasia. The court further objected to the communication being filed since it was claimed that the message was confidential in nature.

Furthermore, the prosecution said that Chaurasia purposefully skipped the court hearing on the day the case was scheduled for the charge’s defence because he intended to drag things out.

The court also cancelled Chaurasia’s bail bond and surety bond, that was also forfeited to the state. A warrant for Chaurasia’s arrest has been issued for March 3, 2023. A notice to his surety was also issued under Section 446 CrPC.
