SI Scam: Court denies bail to three suspects in SI recruitment scam case

The Jammu and Kashmir and Ladakh Court turned down the bail requests of three people who were accused of the JK Service Selection Board Police sub-inspector exam scam.

Ashsish Yadav, Sunrender Singh, and Pawan Kumar were in jail because they were suspected of taking part in the well-known SI hire scam. After hearing both sides, Second Additional Sessions Judge Jammu Balbir Lal Jaswal turned down their bail requests.

The court said that they are accused of leaking the paper of the J&K Police Sub Inspector, which hurt the future of young people. The court said that the accused man’s actions can’t be compared to scams that involve millions of Rupees. Instead, they are an example of an organised crime that hurts the public as a whole. After figuring out how bad the situation was, the court said that if the accused had been successful in their plan, unqualified candidates would have been able to get top jobs. This would have hurt the qualified candidates and deprived society of qualified officers.

The court said that the suspects knew what they were doing and did it on purpose to make money for themselves, no matter what effect it had on the students and their parents. The court also said that if bail was given to these criminals while the investigation was still going on, it would hurt the feelings of the people as a whole and slow down the investigation.

The court didn’t say what it thought about the case itself, and it said that its comments were only meant to help with the question of bail. The accused committed a major crime that could get them up to 7 years in prison, and there was no reason to consider their bail at this point.

  • Delhi riots: Investigating Officer playing hide and seek, says court

Delhi riots: Investigating Officer playing hide and seek, says court

    [ad_1]

New Delhi: A Delhi court hearing a case of the 2020 northeast Delhi riots has deprecated the conduct of an investigating officer (IO), saying the police official was playing a game of hide and seek with the court and trying to mislead it.

Additional Sessions Judge Pulastya Pramachala, while hearing arguments on charges in a case registered by Dayalpur police station against three accused, noted in addition to the first information report (FIR) the case pertained to four complaints.

The judge said one of the complaints by Farooq Ahmad mentioned two separate alleged incidents on the intervening night of February 25 and 26, while the FIR was regarding a rioting incident around 9.50 am on February 25 in front of Victoria Public School on Main Wazirabad road.

    MS Education Academy

“Due to the clubbing of several incidents in one chargesheet, it had been a matter of deliberation by the court time and again, so as to have a clear-cut picture in order to decide within the parameters of law for what allegations the charges are to be decided,” the judge said in a recent order.

The judge noted the IO’s earlier statement before the court, according to which the alleged incidents pertaining to Ahmad’s complaint would be separately investigated, and a separate report regarding the same would be filed.

The judge said after the court directed him to file a status report in September last year, the IO did not submit the report, and when confronted again, the police official informed the court that no separate FIR was registered, and that “some investigation” was being conducted.

“I fail to understand, under which particular law and following which particular procedure of law, such investigation is going on, without resorting to Section 154 of the code of criminal procedure (CrPC)…,” the judge said.

Section 154 of the CrPC provides for registration of an FIR if the information discloses the commission of a cognizable offence.

The judge further said, “Moreover, from the conduct of IO, it is well apparent that till date he had been trying to play a game of hide and seek from this court and to mislead the court in respect of proposed actions.”

ASJ Pramachala said the complaint regarding the alleged rioting incident was still awaiting investigation by adopting the due process of law.

“I do not wish to speculate any final reason behind such inaction over the aforesaid complaint, because it shall be a matter of internal inquiry and assessment of investigating agency ie, Delhi Police,” the judge said.

“Hence, this matter requires serious attention from the higher officers, not only to take appropriate legal action on the pending complaint but also to make an assessment of the conduct of the IO so far,” the judge added.

Seeking certain clarifications from the prosecution, including why the alleged incident which occurred prior in time was clubbed with this case, the court posted the matter for further proceedings on May 22.

Directing a copy of the order be sent to the deputy commissioner of police (northeast) for “necessary action,” the court said a report was expected from the police officer regarding its observations.

  • Widows Entitled To Family Pension: High Court

    [ad_1]

SRINAGAR: A woman who had ongoing divorce litigation with her late husband has been granted the right to receive family pension by the Jammu & Kashmir and Ladakh High Court. The court’s bench, led by Justice Rahul Bharti, stated that “earning family pension is a law given right” and can only be denied if the law allows it, which was not applicable in this case.

In 2017, the woman submitted a writ petition after her request for the release of family pension and other benefits was denied. Her husband, who had retired from the Border Security Force (BSF) as a Constable in 2015, passed away a year later. The woman subsequently applied to the Commanding Officer of the relevant Battalion in BSF for the release of the family pension to be granted to her. However, the Commanding officer stated that since the woman’s name was not found in the deceased’s pension records and due to the ongoing divorce proceedings, the case for the release of family pension to the widow could not be pursued.

The woman’s representative contended that she was entitled to the family pension because she had not remarried. However, the respondent authorities opposed the petition, claiming that the woman was receiving monthly maintenance from maintenance proceedings against her deceased husband during his lifetime. They also emphasized that her name was not listed in the pension papers of the deceased.

The High Court noted that “there was not even a single provision of law quoted in the reply/objections by the respondents as to on what basis they were denying her claim.” The court further interpreted that the respondents were implying that it was the deceased’s wish not to grant family pension to the petitioner after his death. However, the court ruled that such a situation could not be used by the respondents to deny the woman’s claim.

The High Court determined that the stance taken by the respondent authorities lacked legal merit and was merely frivolous. As a result, the court granted the woman’s petition and ordered the respondent authorities to approve and award the family pension in her favor, along with all applicable retrospective benefits in accordance with the regulations.

SRINAGAR: In a dramatic turn of events that could have been lifted straight out of a Bollywood script, a high-security seizure room, also known as Malkhana, at the court complex in Rajouri has been robbed of seized drugs and contraband substances.

This brazen heist has resulted in the loss of a staggering 4 kilograms of heroin, 1.5 kilograms of charas, a large quantity of drugs and capsules, and fake currency. The theft of such a large quantity of illegal substances has sent shockwaves through the community, and law enforcement agencies are scrambling to track down the perpetrators of this audacious crime.

The incident, which occurred in the early hours of Tuesday morning, has left the local police department in disarray. While the Senior Superintendent of Police (SSP) and other senior police officials were tight-lipped about the matter, sources have revealed that an FIR has been registered at the Rajouri police station.

The incident has left the police and judiciary baffled as Malkhana is known for its high-security measures.

The stolen items are valued at several lakh of rupees, and the incident has sparked a wave of concern in the region. This is a unique case of theft, and the local police and judiciary are taking the matter very seriously.

The incident has caused a great deal of distress in the region, with many questioning how such a theft could take place in a high-security area. The stolen drugs and contraband could have a significant impact on the local drug trade and could lead to further crime in the region.

Liberals take over Wisconsin Supreme Court — with major implications for abortion

    [ad_1]

    wisconsin supreme court 54103

Kelly acknowledged his loss on Tuesday evening, but savaged the now-justice elect in his concession speech. “I wish in circumstances like this, I would be able to concede to a worthy opponent, but I do not have a worthy opponent,” he said, calling Protasiewicz’ campaign “beneath contempt” that launched “rancid slanders.” He said she would damage the integrity of the court.

Protasiewicz struck a more optimistic tone. “It means that our democracy will always prevail,” she said at her victory night party. “Too many have tried to overturn the will of the people. Today’s result shows that Wisconsinites believe in democracy and the democratic process.”

The race was the most expensive state judicial race in American history. As of late last week, over $45 million has been spent on the contest, according to WisPolitics.com.

That is roughly three times the previous record.

The election will have wide-sweeping effects on the state, including, in the nearest-term, access to abortion in Wisconsin. The state has a 1840s law on the books that bans abortion in nearly all instances in the state. State Attorney General Josh Kaul, a Democrat, has brought a lawsuit challenging that law in state court that is widely expected to eventually land in front of the state Supreme Court.

But in the interim, abortion providers have stopped performing the procedure in the state.

That was an animating factor for Protasiewicz’s campaign, whose advertising regularly spoke about abortion rights. On the trail, she has repeatedly said “my personal value is that a woman has a right to choose,” while stressing that she is merely speaking about her values and not prejudging any particular court case.

The race court could have a significant impact on election laws in the state, which has regularly ruled on contentious election issues since the 2020 election.

Perhaps most notably, the state Supreme Court turned away then-President Donald Trump’s attempts to throw out the 2020 election results in the state.

Its 4-to-3 vote came only after Justice Brian Hagedorn, a conservative who sometimes served as a swing vote, joined the liberal bloc to reject the case.

Protasiewicz’s win also makes Democrats much more likely to bring challenges to the state’s congressional and legislative lines.

Republicans have near-supermajorities in both legislative chambers and a 6-2 split of the congressional delegation in a state that routinely votes close to 50-50 on a statewide level.

Similarly to her comments about values on abortion, Protasiewicz has said that it is clear the maps in the state are unfair.“

Wisconsin has probably the most gerrymandered maps in the entire country,” she said in an interview with POLITICO in February. “I anticipate that it’s possible that some type of litigation in regard to fair maps could come before the Supreme Court.”
