    Doctor couple arrested for sexually abusing ‘adopted’ children in Guwahati

    Guwahati: A doctor couple has been arrested in Guwahati for allegedly assaulting two children, including sexual abuse, whom they were claiming to be adopted kids, the police said on Sunday.

    Three children, one boy and a girl aged around three years and another boy of about 11 years, were rescued from the residence of the doctor couple.

    “After conducting medical examination, it was found that the girl suffered brutal physical abuse as well as sexual assault. The younger boy was also assaulted.

    The 11-year-old boy looks healthy and a medical examination is going on,” Guwahati Police Commissioner Diganta Barah told a press conference.

    The police have slapped various sections of the IPC along with the Protection of Children from Sexual Offences Act, 2012 (POCSO) against the doctor couple and their maid, who has also been arrested, Barah said.

    The male doctor and his family’s maid were arrested in Guwahati on Saturday, while his psychiatrist wife, who is frequently seen in local TV channels’ talk shows on mental health, was caught on Sunday while trying to flee from the city, he added. A local court remanded them to police custody for five days.

    “They are being interrogated. We found that the children were not their own, but they are claiming them to be adopted,” the police commissioner said.

    However, it is yet to be established whether the three children were adopted by the well-known doctor couple legally. The arrests of the man and the maid were made on Saturday after photographs of the girl tied to a pole on the terrace of their residence went viral on the previous day.

    The doctor’s wife made a video and uploaded it on social media, claiming that a conspiracy was hatched to “defame and destroy” the family. Later, the Assam Commission for Protection of Child Rights (ASCPCR) took cognisance of the matter and wrote to the civil and police administration to initiate enquiry and take action against the accused.

    ASCPCR Chairperson Sunita Changkakoti said the Commission took note of the matter and wrote to the Guwahati Police Commissioner and the Kamrup Metropolitan Deputy Commissioner on Friday evening, seeking details about the incident. She claimed that the previous wife of the accused doctor had brought similar charges against him of abusing their child a few years back.

    SRINAGAR: Officials have reported that four people, including a couple, were killed in incidents of cloud burst and lightning strikes at two different locations in the Kashmir Valley on Saturday.

    According to a senior police officer, a cloudburst occurred in the Bujbagh area of Pampore in south Kashmir’s Pulwama district this afternoon, resulting in the deaths of Hilal Ahmed Hanji (25) and his wife, Rozia Jan (25).

    In a separate incident, officials informed GNS that two people died after being struck by lightning in a high-altitude meadow land in the Mujpathri area of central Kashmir’s Budgam district. The deceased have been identified as Taja Begum, wife of Abdus Samad Chopan, and Mohammad Sultan Chopan, son-in-law of Ghulam Mohammad Chopan of Gurwaith Kalan.

    They added that the police have registered cases in connection with both incidents.

    New Delhi: The Supreme Court has told a couple, who are software engineers seeking a divorce, why don’t they give a second chance to the marriage as both of them were not able to devote time to their union.

    A bench of Justices K M Joseph and B V Nagarathna said, “Where is the time for marriage? Both of you are software engineers posted in Bengaluru. One goes to duty during the day and the other at night. You have no regret for divorce but have regret for marriage. Why don’t you give a second chance to the marriage.”

    Justice Nagarathna said that Bengaluru is not a place where divorces take place so frequently and the couple may give a chance towards their union.

    However, the counsels for both the husband and wife told the bench that during the pendency of this petition, the parties were referred to the Supreme Court Mediation Centre in order to explore the possibility of a settlement between them.

    The bench was informed that both husband and wife have agreed upon a settlement agreement in which they have decided to dissolve their marriage by a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955 on certain terms and conditions.

    The counsels informed the bench that one of the terms was that the husband would pay a total sum of Rs 12.51 lakh towards a full and final settlement of all monetary claims of the wife as a permanent alimony.

    The bench noted in its order dated April 18, “When queried by this Court, the parties stated that they have indeed agreed to settle their disputes amicably by parting ways and seeking divorce by mutual consent. They also state that the terms of settlement would be adhered to by them and hence the marriage may be dissolved by a decree of divorce by mutual consent.”

    The bench added that in the circumstances, “We have taken on record the settlement agreement as well as the application filed under Article 142 of the Constitution. We have perused the same. On perusal, we find that the terms of the settlement agreements are lawful and there is no legal impediment for accepting the terms of settlement”.

    It also took on record that the husband paid a total sum of Rs 12,51,000 to the petitioner-wife who has acknowledged the receipt of the demand drafts.

    “In the circumstances, we exercise our power under Article 142 of the Constitution and dissolve the marriage between the parties by a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955,” the top court said.

    It also quashed various other proceedings lodged by husband and wife in Rajasthan and Lucknow under the Dowry Prohibition Act, domestic violence Act and other connected cases.

    New Delhi: The Supreme Court has declined to use its plenary powers under Article 142 of the Constitution to quash a marriage — where the parties had met on Facebook in December 2019 and got married in December 2020 as per Christian rites and customs at a Mangaluru church, noting that parties have lived together only for 40 days.

    A bench of Justices Rajesh Bindal and Aravind Kumar said: “We do not find this to be a fit case for exercise of power under Article 142 of the Constitution of India as good sense may prevail on the parties. They had lived together only for 40 days. It takes time to settle down in marriage.”

    The plea was filed by Mangaluru doctor and CEO of a global health organisation to use the court’s extraordinary power under the Constitution to dissolve his marriage with a permanent resident of Canada. He contended that there is an irretrievable breakdown of marriage and this court should exercise its jurisdiction under Article 142 to dissolve the marriage.

    The apex court also dismissed a plea by the wife to transfer the divorce proceedings filed by her husband from Mangaluru to a court in Mumbai.

    “Though, at present, considering the financial condition of the parties on the basis of material which has come on record, we do not find that any ground is made out for issuing direction to the respondent (husband) to pay the expenses to the petitioner for travelling to Mangaluru. However, still in case she feels like seeking reimbursement of expenses, she shall be at liberty to file an application before the court concerned, which may be examined on its own merits,” it said.

    The bench noted that both the parties are well-educated and engaged in their own jobs and professions. She can travel to Mangaluru to attend the hearing of the case and can also seek exemption from appearance whenever required, it said.

    “In our view no case is made out for transfer of the petition from Mangaluru, Karnataka to Mumbai, Maharashtra,” the bench said. The court pointed out the wife is a permanent resident of Canada and she must be travelling abroad regularly.

    The top court noted that a number of transfer petitions are filed in matrimonial cases, primarily by the wives for transfer of matrimonial proceedings, initiated by the husband.

    “This court normally has been accepting the prayer made while showing leniency towards ladies. In Anindita Das vs Srijit Das (2006), this court observed that may be this leniency was being misused by women. Hence, each and every case has to be considered on its own merits,” the bench said.

    Kochi: On Monday, all roads led to the uncompleted house at Vengara in Malappuram of a couple who died in a massive fire that broke out in a residential building in Dubai killing 16 people, on Saturday.

    When the fire broke out the couple was busy preparing a feast for their friends who were observing the Ramzan fast.

    Their bodies arrived here in the wee hours of Monday and were brought to their soon to be completed house at Vengara, which they were getting ready to live in from June.

    Rijesh Kalangadan, 38 was working in a travel agency in Dubai, while his wife Jeshi Kandamangalath, 32 was a teacher at a local school in Dubai.

    Since morning hundreds of local residents filed past the bodies with tears in their eyes.

    “Rijesh was a great soul and was at the forefront of helping people here whenever anyone needed help. He was a very nice human being and we are all heartbroken and have nothing more to say,” said a close friend of Rijesh.

    Sixteen people were killed and nine injured in the blaze in the Al Ras area, which Dubai Civil Defence attributed to a lack of compliance with building security and safety requirements.

    The fire broke out on the fourth floor of the building on Saturday at 12.35 p.m. and soon spread to other areas.
