    Srinagar, Mar 23: A court here on Thursday dismissed bail plea of man from Gujarat, Kiran Patel, who conned the security establishment in Jammu and Kashmir into believing him to be a PMO official and got the requisite perks prior to his arrest earlier this month.

    Having reserved the order on Monday after hearing the arguments of the counsel representing Patel and additional public prosecutor, the court of Chief Judicial Magistrate (CJM) Srinagar Raja Mohammad Tasleem found the bail plea “devoid of any merit”.

    “I am of the considered opinion that arguments advanced by APP are just, proper and appealing and carries much weight and on the other hand I respectfully disagree with the submission put forth by Counsel for the applicant (Patel) because in case at this stage discretion of bail is exercised in favour of the accused it shall definitely destroy the very fabric of the investigation,” the court said as per the order, a copy of which lies with GNS. “Resultantly, in my considered opinion the instant application is devoid of any merit which deserves to be rejected, hence rejected.”

    Kiran Patel, the alleged imposter hailing from Gujarat posed as an additional director (strategy and campaigns) in the Prime Minister’s Office and enjoyed many perks, including a bulletproof car and security cover besides other hospitality. Kiran Patel was on his third visit to the Kashmir Valley when he was nabbed by security officials from a five-star hotel in Nishat area of Srinagar on March 2.

    Police has ruled out any intelligence failure in the entire episode but blamed field officers for “lapse” with further avowal of action against those involved. “There has been a proper FIR in this case. See, when Srinagar police got information on March 2, a team headed by a senior IPS officer arrested him red handed. Fake visiting cards were recovered,” ADGP Kashmir Vijay Kumar (IPS) said recently. “Rigorous interrogation was done. He remained under police custody for 14 days. He is presently in judicial remand. He is in jail completely,” he had said, adding, “We are professionally carrying out investigation. We are taking help from Gujarat police and nobody will be spared”.

    Asked about “clear cut” guidelines by MHA that no security should be given to anyone on verbal instructions, he had said, “The SOP is there from the beginning. Instructions come from time to time. Police should not provide security to anyone on verbal instructions. We don’t. The mistake which has happened is being looked into and action will be taken against the officer who has given instructions.”

    Asked if it was an intelligence failure, the ADGP had responded in negative, saying “we cannot call it intelligence failure. There has been negligence at the field officer level and action will be taken.” (GNS)

    SRINAGAR: A court in Srinagar reserved orders on the bail plea of Kiran Bhai Patel, a man from Gujarat who allegedly impersonated a PMO official to obtain benefits before being arrested earlier this month. While the accused’s counsel argued for his release based on personal liberty and the absence of “serious” charges against him, the prosecution opposed the bail plea, citing the early stages of the investigation.

    “I applied sometime back to seek a personal security officer but my request is yet to be approved. Then how is it possible that a man comes to Kashmir from Gujarat and gets a Z-plus security cover? What was the state doing all this time?” The judge observed.

    The defence argued in court, stating that “my client has not committed any offence and that his liberty was curtailed by false allegations.” They also questioned, “even if he managed to get security cover, whose negligence is it? How come an outsider comes and gets security without getting mandatory clearances in a region where security remains on the highest degree of alert.”

    After hearing the submissions of the counsels, the court of Chief Judicial Magistrate (CJM) Srinagar Raja Mohammad Tasleem reserved the order to be pronounced on Thursday (March 23).

    Pertinent to mention, Kiran Patel, who was arrested earlier this month for allegedly impersonating a senior government official and duping people, has been sent to judicial custody by a local court in Srinagar. The accused has been booked under sections 419, 420, 467, 468, and 471 of the Indian Penal Code.

    The Jammu and Kashmir police has formed a three-member team, led by SP East Srinagar, to investigate the case against Patel, who had been posing as a member of a “PMO team” that has been visiting Kashmir since October last year. The imposter had also visited forward areas near the Line of Control and shared pictures and videos of his ‘official visits’ on social media.

    The conman’s first visit to the valley was on October 27 last year. He came with his family. In subsequent visits, the other members of the “PMO team” joined him.

    According to a senior officer, the fact that an IAS officer introduced a conman as a PMO official, and that the security wing of the police and other officials granted him official protocol and Z plus security cover for an extended period of time, is a major concern.

    In a statement, the police reported that on March 2, 2023, the CID wing of the J&K Police provided information about the arrival of an impersonator in Kashmir. “SSP Srinagar immediately dispatched a team led by SP East to Lalit hotel, where they discovered Kiran Bhai Patel, son of Juddesh Bhai Patel and a resident of Ahmadabad, Gujarat, who was impersonating himself as Additional Director (Strategy and campaigns) PMO New Delhi. As his responses were found to be suspicious, he was taken to Police Station Nishat, where he confessed to his crime,” the statement said.

    The police spokesperson stated that during the investigation, ten counterfeit visiting cards and two mobile phones were confiscated from the accused. The investigation is being headed by a team led by SP East Srinagar, SDPO Nehru Park, and SHO Nishat. Several relevant individuals have been interrogated in connection with the case, and the investigation is in its initial stages.

    The police have revealed that the accused has three cases registered against him in various police stations in Gujarat: Raopura Police Station, Baroda City Case No I/0064/2019, Naroda Police Station Ahmedabad City case No I/0066/2017, and Bayad Police Station, Aravali Case No I/0047/2019. The accused has been charged under various sections of the IPC, including 114, 294(KH), 406, 420, and 5072, as well as 120B. The police will share further details regarding the case in due course.

    SRINAGAR: Jammu and Kashmir police Sunday said that providing a security cover and bullet proof vehicle to a Conman from Gujrat who posed himself as a PMO official, was not an intelligence failure but a “mistake” which is being investigated.

    “We don’t provide security cover to anyone on verbal communique or order,” ADGP Kashmir Vijay Kumar told reporters, on the sidelines of a function in Srinagar. He said that a team led by a senior IPS officer raided a hotel and arrested the Conman from Gujrat and recovered fake visiting cards from him. “A proper FIR has been lodged and the Conman was interrogated. At present he is behind the bars under judicial remand,” the ADGP said, adding, the JK police is in touch with the Gujrat police.

    Asked whether providing security cover to Conman was a security lapse and intelligence failure, the ADGP said: “It was not an intelligence failure but yes a mistake for sure which is being investigated,” adding that any officer who ordered for providing security to the Conman will be dealt with.

    About the query about possible rise in the crime rate, he said that there is no surge in the crime rate but there is an increase in reporting the crimes by the people who trust police for its thorough investigations. “Crime cases are being investigated thoroughly and culprits are being arrested and punished as well,” he said.

    On attaching the properties, he said that property used for terrorist activity or used by terrorists for shelter will be attached be that a vehicle, building or a House. (KNO)

    SRINAGAR: Former chief minister of erstwhile J&K state and National Conference (NC) vice president, Omar Abdullah on Saturday said that the present government in J&K is not for the people, but to appease the Prime Minister’s Office (PMO).

    Reacting to the Conman from Gujarat arrested in Srinagar, Omar while addressing a gathering in Kulgam said that it is the worthlessness of the present government, who was busy appeasing the fake conman from Gujarat.

    According to the news agency KNO, he alleged that it is the fourth such incident, adding that it has been heard that three have already left for their places.

    “How worthless this government is. The conman was given security, chaired meetings of officers, and also visited the Line of Control in Uri. Without confirmation from the PMO office, the administration was busy appeasing the conman. This government is not for the people, but to appease PMO,” he said, adding that this is the difference between the present government and the elected government. (KNO)

    New Delhi: The Congress on Saturday expressed concern over the case of a conman posing as a PMO official and getting requisite perks, saying if the government is serious about the country’s security then it must make it clear who will resign for the lapse.

    Kiran Bhai Patel from Gujarat has been arrested by police from a five-star hotel in Srinagar for posing as an ‘additional secretary’ in the Prime Minister’s Office (PMO) and enjoying security cover besides other hospitality.

    He had three cases registered against him in his home state, police said on Friday.

    At a press conference, Congress’ media and publicity department head Pawan Khera said it was a very serious matter pertaining to the country’s security and the government probably was not focussed on such matters as it was “busy protecting the prime minister’s best friend”.

    “If anyone asks questions to the Modi government, he is anti-national. Which national interest are you serving? If you are at least a little serious about the security of the nation, then tell me that at the political level who will resign in this matter?” Khera said.

    “Our three essential questions are — can a PMO officer get Z+ security, should Z+ security be given and is Z+ security availed so easily. It is very important to know from which level the instructions to give security to a thug came?” he said.

    In a sensitive area like Jammu and Kashmir, a person has been cheating the security forces for five months and is roaming in those areas with Z+ security by making a PMO card, where common citizens cannot go, he said and raised questions over the government’s intelligence mechanism.

    Khera said the government must answer whose resignation will be taken for this lapse.

    The ruling party has such a toolkit that the one who asks questions of them is an anti-national while one person takes Z+ security by printing fake cards of the PMO, the Congress leader alleged.

    According to court documents, Patel was on his third visit to the Kashmir valley and was subsequently nabbed by alert security officials on March 3.

    Patel had claimed he had been given a mandate by the government to identify buyers for apple orchards in south Kashmir and a couple of IAS officers were in awe of him as he had been dropping names of high-ranking bureaucrats and politicians in the national capital.

    SRINAGAR: Kiran Bhai Patel, a resident of Gujarat, who falsely claimed to hold a high position in the Prime Minister’s Office (PMO) and had meetings with influential individuals in Jammu and Kashmir, has been formally arrested by the Jammu and Kashmir Police on March 3.

    The arrest followed a day after the police registered a case of cheating and forgery at police station Nishat against the conman.

    Patel had been posing as an additional director (strategy and campaign) in the PMO and was caught during his third visit to Kashmir, where he was staying at a luxurious Srinagar five-star hotel. He received a Z-plus security cover, an armoured SUV, and luxurious lodging, which raised suspicions when he arrived in Srinagar for the second time in two weeks without any prior VIP movement information available to security agencies.

    The FIR, registered by Srinagar Police at Nishat Police Station, revealed that Patel had been using criminal means and forgery to carry out his activities within the jurisdiction of the police station and other parts of Kashmir. He had allegedly been involved in cheating gullible individuals and pursuing a well-conceived scheme to gain monetary and material benefits.

    Patel had been booked under Sections 419, 420, 467, 468, and 471 of the IPC at Nishat police station, and the police are currently conducting a thorough investigation. Pradipsinh Vaghela, the ruling BJP’s Gujarat General Secretary, is among 5000 people who follow Patel’s verified Twitter account.

    His social media posts and pictures suggest that he had been leading a lavish lifestyle, staying at luxurious hotels and traveling in bulletproof cars.

    In photos shared on various social media platforms, Patel can be seen at picturesque sites in Jammu and Kashmir, often in the company of armed personnel. One picture depicts him standing in front of Srinagar’s iconic clock tower, Lal Chowk.

    In his maiden February visit, Patel visited health resorts. He interacted with officials at Doodpathri and discussed way and means of improved tourist footfalls from Gujarat. He was at Shankaracharya Tempe on February 22, Doodhpathri on February 27, Gulmarg on February 26, Ahrabal on February 23, according to the photographs and videos he posted on Twitter.

    Patel’s Twitter bio states that he holds a doctorate from Commonwealth University, Virginia, an MBA from the Indian Institute of Management in Tiruchirappalli, a Master of Technology in computer science, and a Bachelor of Engineering in computer engineering. The police attempted to detain him at the airport, but he had already left in his bulletproof car for the hotel.

    This incident has raised serious concerns about the security protocols in place and the ease with which an individual can impersonate a high-ranking government official and gain access to sensitive information and influential individuals. After being taken for a ride, now the authorities say they will conduct a thorough investigation into the matter and take appropriate action to prevent such incidents from happening in the future.

    So far, the investigation has reportedly revealed that Patel had been operating a well-conceived scheme to defraud unsuspecting individuals and companies, promising them government contracts and other benefits in exchange for monetary and material gain. He had reportedly created fake letters and documents, which he used to dupe his victims.

    The police have also discovered that Patel had been in touch with several influential individuals, including politicians, businessmen, and bureaucrats, during his visits to Jammu and Kashmir. He had even managed to secure appointments with some of them, claiming to be representing the Prime Minister’s Office.

    According to sources, Patel’s activities had come to the attention of the security agencies after he arrived in Jammu and Kashmir for the second time in two weeks without any prior VIP movement information available to them. The police attempted to detain him at the airport, but he had already left in his bulletproof car for the hotel.

    The police seized several electronic devices, including laptops and mobile phones, during the search of Patel’s hotel room. They are currently analysing the data to gather more information about his activities and the individuals he had been in touch with.

    Report said two cops may face action for extending the hospitality without verifying the details. A media report said they had got information from some IAS officer.

    New Delhi: A Delhi court on Friday allowed Bollywood actress Jacqueline Fernandez, who is one of the accused in the Rs 200 crore money extortion case involving conman Sukesh Chandrasekhar, to fly to Dubai.

    Fernandez had filed an application on Wednesday to travel from January 27 to 30 ahead of the Pepsico India Conference.

    The Patiala House Courts took note of Fernandez’s submission that she is under a contractual obligation with the company and if she is not able to make it, she could be sued.

    She will be performing at the event on January 29 with other stars.

    The Enforcement Directorate (ED) had however, opposed it and said the actress did not put any contractual obligation on record before.

    Additional Sessions Judge of the Patiala House Courts, Shailendra Malik on Friday granted relief saying that she has professional commitments and personal liberty can’t be curtailed.

    On Monday, he had granted the actress a one-day exemption from personal appearance.

    The Judge was supposed to hear the arguments on framing charges in the matter but adjourned the hearing for February 15.

    Fernandez, even in December last year, had moved a plea seeking to travel abroad to visit her ill mother in Bahrain.

    But, she withdrew it as the court wasn’t willing to allow her to travel abroad.

    In the case, Chandrashekhar is accused of extorting money from politicians, celebrities and businessmen, and allegedly duped pharma company Ranbaxy’s former owner Shivinder Mohan Singh’s wife Aditi Singh of Rs 200 crore.

    He had allegedly sent super expensive gifts to Jacqueline, while he also booked a chartered flight for her from Mumbai to Chennai during his bail period.

    Moreover, according to the ED, it is suspected that he had sent huge chunks of money extorted from Aditi Singh to the actor.
