Bhopal gas tragedy survivors condemn SC’s dismissal of Curative Petition

    [ad_1]

Bhopal: Five organizations of the December 1984 Union Carbide disaster in Bhopal have jointly condemned the Supreme Court’s dismissal of the Curative Petition on Tuesday.

Likening Tuesday’s decision with the apex court’s February 1989 decision on the settlement of the case, the organizations called it a “judicial assault on the constitutional and legal rights of the Bhopal survivors”. The organizations resolved to continue their struggle for justice in Bhopal till all survivors are adequately compensated.

Rashida Bi, president of the Bhopal Gas Peedit Mahila Stationary Karmchari Sangh, said: “The Bhopal victims were denied their day in court because of the pro-corporate bias of the Supreme Court bench. The counsel for Union Carbide that continues to abscond from charges of culpable homicide was given ample time to speak by the bench, while the counsel for the survivors’ organizations was only heard for just 45 minutes. Apparently, the Bench believes in a ‘fugitive entitlement doctrine.”

“The Supreme Court judges dismissed the case for additional compensation due to their insistence that the case must attain finality in line with the wishes of the corporate counsel,” said Balkrishna Namdeo, President of the Bhopal Gas Peedit Nirashrit Pensionbhogee Sangharsh Morcha.

“How can you impose finality when the corporation’s crimes continue to victimize people? When gas affected people continue to die untimely deaths from cancers and other exposure induced chronic diseases? When the criminal remains absconding, and the suffering of its victims, including that of their progeny, continues, how can a Supreme Court bench draw the curtain over the injustice in Bhopal?

Rachna Dhingra of the Bhopal Group for Information & Action condemned the Supreme Court for deliberately ignoring arguments and facts presented by the survivors’ organizations.

“We presented official figures of injury and death analyzed by an international expert on epidemiology that proved the 1989 settlement has perpetrated a gross miscarriage of justice but the Supreme Court bench chose to blind themselves to it. The bench said that only an argument of fraud could re-open that settlement, while entirely ignore our counsel’s detailed submissions on the fraud committed by the Union Carbide to procure the settlement of 1989,” Dhingra pointed out.

“We refuse to accept the injustice delivered by the Supreme Court on Tuesday”, said Nawab Khan, President of the Bhopal Gas Peedit Mahila Purush Sangharsh Morcha. “We fought and won against the injustice of the settlement of 1989 and we will resume our fight again. We will fight in the court and we will fight on the streets till justice is done in the World’s worst corporate massacre”, he said.

Nousheen Khan of Children Against Dow Carbide said: “Tuesday’s decision exposes the perversity of the Supreme Court bench that took the government to task for ignoring the health impact on the next generation but failed to hold the corporation accountable for the crime against the unborn.”

Kerala: Journalists’ bodies condemn SFI activists’ barging into Asianet office

    [ad_1]

New Delhi: A day after a group of SFI activists allegedly barged into the Kochi office of Asianet News and intimidated channel staff over a news report, journalists’ bodies condemned the incident and called it yet another example of growing attacks against media and scribes.

Barging into media offices is “illegal” and should be considered as “an attack on press freedom”, the Press Club of India, Indian Women’s Press Corps, Delhi Union of Journalists and the Kerala Union of Working Journalists said in a joint statement.

“We expect the Kerala government to take strict action against those who attacked Asianet,” they said.

A group of Students’ Federation of India (SFI) activists allegedly trespassed into the office of Malayalam news channel Asianet News in Kochi on Friday and intimidated the staff over a report about the sexual assault of a girl, according to Kerala Police.

A case was later registered against 30 SFI activists, the students’ wing of the ruling CPI(M) in Kerala, on the basis of a complaint lodged by the channel.

Condemning the incident, the journalists’ bodies said, “We protest the attack on the TV channel Asianet News’ office in Kochi by the activists of the Students Federation of India.”

“This is yet another example of the growing attacks against media organisations and journalists in the country.”

The journalists’ bodies said Asianet News had used “a mock video” to bring out the issue of drug and sexual abuse of a young girl in Kerala.

“Stamping such a programme as fake news suggests ignorance of the professional ways used by news organisations to protect the identity of victims of sexual assault,” they said, adding, “There are methods and platforms to raise complaints against any news item in a legal manner.”

The journalists’ bodies noted that Kerala Chief Minister Pinarayi Vijayan made it clear in the Assembly that the police were looking into a complaint against the news report in question.

“Barging into media offices is illegal and should be considered as an attack on press freedom. We expect the Kerala government to take strict action against those who attacked Asianet,” they said.

“We condemn the attempts by certain political outfits, organisations and social media influencers in Kerala to instill media phobia by labelling all news and views as fake if they disagree with it,” they said, adding, “Demonising or undermining the media often protects vested interests.”

Leaders of House China panel condemn attack on Rep. Judy Chu

asian pacific american history pelosi 02048

Speaking last week on Fox News, Gooden said of Chu: “I question her either loyalty or competence.” Gooden, who was responding to her defense of Biden appointee Dominic Ng, also told host Jesse Watters that Chu should be barred from access to classified information.

Chu, who was born in Los Angeles, called Gooden’s statements “racist.” “It is based on false information spread by an extreme, right-wing website,” Chu said. “Furthermore, it is racist. I very much doubt that he would be spreading these lies were I not of Chinese American descent.”

Gallagher is the chair of a new House select committee focused on China’s ruling Communist Party and Krishnamoorthi is the panel’s ranking Democrat. Both discussed the criticism of Chu in light of their committee’s mission.

“Absolutely, we shouldn’t question anybody’s loyalty,” Gallagher added. “And going forward, I think what’s critical and the reason we actually got the committee renamed to focus on the Chinese Communist Party, is to constantly make that distinction between the party and the people.”

    Krishnamoorthi concurred.

“The Chinese Communist Party loves it when we are internally fractious and they like it when we are stereotyping. We have to avoid that,” he said.

As for the work of the committee, which is designed to examine possible threats posed by the Chinese Communist Party, Gallagher said he expects to find a certain amount of bipartisan support for its efforts.

“I want both sides in some way to look to the committee as the area for the most forward-leaning, innovative, and bipartisan policy and legislation on China,” he said.

Host Margaret Brennan asked Gallagher how the American people can be sure the panel doesn’t end up as being seen as persecuting people, as in the 1950s loyalty hearings led by Sen. Joseph McCarthy (R-Wis.).

“Joseph McCarthy’s from my district, he’s buried in my district; we need not exhume his body and reanimate it,” Gallagher said, adding: “We must constantly be aware of going overboard as we try and win this competition with China.”

Condemnations of the killing poured in from all the sections of society. Cutting across the party lines , political parties unequivocally  condemned the killing.

The Lieutenant Governor, Manoj Sinha, strongly condemned the killing of Kashmiri Pandit in Pulwama saying the administration has given a free hand to security forces to deal with the killers. He said the administration is standing strong with the breaved family.

“My heartfelt condolences to the bereaved family. The administration has given a free hand to the security forces to deal with the terrorists and we will continue to combat such acts of terrorism firmly and decisively,” he said.

A few hours after the incident, former Chief Minister of Jammu and Kashmir, Omar Abdullah took to his twitter and wrote that he was deeply saddened to hear about the demise of Sanjay Pandith.

Former chief minister Mehbooba Mufti lashed out at BJP for its “failure to protect minorities” in J&K and accused BJP of using these types of incidents to defame Muslims in the country.

“It is the government’s failure. The BJP government has failed to ensure safety of the minorities here. They (BJP) use minorities to show normalcy in Jammu and Kashmir. They use these incidents to defame Muslims across the country,” the Peoples Democratic Party (PDP) chief told reporters.

NC’s chief spokesperson Tanvir Sadiq called the killing an unfortunate incident.

“ As a majority community, we have to ensure the protection of the minorities as the government has failed to do so,” he said.

  • Palestinians condemn Israeli killing of 10 in Nablus raid

Palestinians condemn Israeli killing of 10 in Nablus raid

    [ad_1]

Ramallah: Palestinians have condemned the killing of 10 Palestinians and wounding of 102 others during an Israeli raid in the northern West Bank city of Nablus.

Nabil Abu Rudeineh, the spokesman of the Palestinian presidency, said on Wednesday in a statement that Palestine condemns the Israeli deadly aggression against Nablus, vowing to hold the Israeli government “responsible for this dangerous escalation, which is pushing the region toward tension and an explosive situation”.

“The crime committed by the occupation forces in Nablus reaffirms the importance of our demand that the international community must act immediately to stop the Israeli crimes against our people,” Abu Rudeineh added.

He called on the US administration “to take immediate action and put effective pressure on the Israeli government to stop its crimes and continuous aggression against our people”.

Palestinian Prime Minister Mohamed Ishtaye described the Israeli killing of Palestinians in Nablus as “organised terrorism” and urged the UN to stop practicing “double standards”.

“The Israeli aggression is organised terrorism through which Israel seeks to export its internal crisis to the Palestinian arena,” he said.

Ishtaye called on the UN “to stop the policy of double standards that encourages Israel to continue its aggression against the Palestinian people”.

“Whatever is practiced against our people will not deter them from continuing their legitimate struggle to achieve their goals of freedom, ending the occupation, and establishing their independent state, with Jerusalem as its capital,” he added.

In Gaza, Abu Obeida, the masked military spokesman of Al-Qassam Brigades, the armed wing of the Islamic Resistance Movement (Hamas), said in a short statement that “resistance in Gaza is observing the escalating occupation crimes in the West Bank”.

“The patience of the Palestinian resistance in Gaza is running out,” he added.

The Palestinian Ministry of Health said in a statement that 10 Palestinians were killed by Israeli soldiers, including an elderly man and a 14-year-old boy, during an Israeli army military operation in the city of Nablus, Xinhua news agency reported.

At least 102 Palestinians were also injured, including multiple in severe condition and three local Palestinian journalists.

The Israeli military confirmed in a statement that an operation was underway in Nablus, a militant stronghold that is frequently raided by the military, but did not provide further information immediately.

Local sources and eyewitnesses said that an Israeli army force backed by armoured vehicles stormed the outskirts of the old city of Nablus and surrounded a house to arrest several Palestinians wanted by Israeli security.

They added that the wanted Palestinians were armed, and exchanged fire with the soldiers who surrounded the building, adding that several explosions and intensive gunfire were heard in the city.

Meanwhile, clashes broke out in the city’s streets between dozens of Palestinians, who threw stones and empty bottles, and the soldiers, who opened fire at the demonstrators to disperse them.

The Palestinian Red Crescent Society in the city said in a statement that the Israeli soldiers prevented its ambulances from entering the area to evacuate casualties that needed medical treatment in the hospital.

Israeli media outlets reported that an Israeli army force carried out on Wednesday morning a regular military activity following reports that Palestinian militants and members of the Palestinian Islamic Jihad were hiding in a building in the old city.

The reports said that the soldiers moved to the city and traded fire with the militants hiding in the building, adding that no injuries were reported among the Israeli soldiers.

The tension between Israel and the Palestinians has been flaring since early January in the West Bank following a series of Palestinian attacks that killed nine Israelis, according to official Israeli figures.

In return, the Israeli Army carried out dozens of daily incursions into the West Bank cities, villages, and refugee camps to arrest Palestinians involved in carrying out attacks against Israel.

  • Congress unites to condemn China — but splits again over Biden — after spy balloon incident

Congress unites to condemn China — but splits again over Biden — after spy balloon incident

    [ad_1]

    image

Kennedy was hardly alone among Capitol Hill Republicans chastising the administration for handling the balloon’s incursion inappropriately, while Democrats stood by the administration’s decision to wait until the balloon had traveled toward the coast before bringing it down. The partisan lines that formed after the briefings starkly contrasted with the House’s Thursday morning vote on a resolution condemning China for the balloon that passed in a 419-0 blowout.

That measure, introduced by House Foreign Affairs Committee Chair Michael McCaul (R-Texas), required two-thirds support to pass, and its lack of opposition was a remarkable show of bipartisanship in the closely divided chamber. But the GOP remained openly concerned about the administration’s management of the balloon episode.

“I think they should have taken it down earlier,” Rep. Don Bacon (R-Neb.) said in an interview. “I mean, I think there’s the debate, ‘what’s the collection opportunities for us if we shut it down early?’ but then they had their collection opportunities.”

And Florida Sen. Marco Rubio, the top Republican on the Intelligence Committee, also said the White House should have shot down the balloon before it completed its transit.

“We had both authority and the capability to bring it down much earlier than we did,” Rubio said. “What if it had malfunctioned, or what if it had a self-destruct mechanism and could have fallen on a city? If it wasn’t threatening, why did they shut down civil aviation?”

At least one Democrat also took the opportunity to slam Republicans for political jostling over the Chinese incursion. Sen. Jon Tester (D-Mont.) held a Thursday hearing on the balloon in the defense spending subpanel that he chairs. The centrist, who’s up for reelection in his red state next year, said Republicans were using China’s actions as an “opportunity to score some cheap political points and get attention on social media.”

“I do not care who was in the White House,” Tester said, vowing to “hold anyone accountable” he needs to in the Biden administration over the spy balloon.

While the State Department indicated it would “explore” potential punishment in response, McCaul argued on the House floor before the vote that the incident “cannot go unanswered.” A House vote in condemnation, he said, sends a “clear, bipartisan signal” to the Chinese Communist Party that the incursion “will not be tolerated.”

“I’ve never seen a foreign nation adversary fly a reconnaissance aircraft that you could see from the ground with your own eyes,” McCaul said. “The CCP threat is now within sight for Americans across the heartland, a vision and memory that they will not forget. This is further proof that the CCP does not care about having a constructive relationship with the United States.”

The bipartisan vote to censure China for violating U.S. airspace came after House Republicans initially weighed a symbolic measure more pointedly criticizing the Biden administration’s response to the balloon. GOP leaders pivoted amid lobbying from McCaul to call out China’s spy tactics on a bipartisan basis rather than ding Biden.

Democrats have noted, in particular, that bringing the balloon down closer to land would have risked injuring Americans with debris.

Republicans “would probably feel differently if the craft had been downed and killed someone on the ground and the administration put the security of the American people paramount as they should and so I think they made the right call,” Rep. Adam Schiff (D-Calif.), a former intelligence panel chair, said in an interview after the House briefing.

Biden last week ordered the balloon shot down, but military brass advised waiting until the aircraft was over water to minimize risks. The balloon was shot down by a U.S. fighter Saturday off the coast of the Carolinas, and the military is working to recover debris.

Pressed during Thursday’s hearing on why the balloon wasn’t shot down when it first approached U.S. airspace in Alaska, Pentagon officials told senators doing so would have made recovering the payload a much riskier operation.

Melissa Dalton, the Pentagon’s assistant secretary for homeland defense, said the depth of the waters near Alaska, cold temperatures and ice could make recovering debris “very dangerous.”

“If we had taken it down over the state of Alaska … it would have been a very different recovery operation,” Dalton added. “A key part of the calculus for this operation was the ability to salvage, understand and exploit the capabilities of the high altitude balloon.”

The No. 2 U.S. diplomat, Deputy Secretary of State Wendy Sherman, told the Senate Foreign Relations Committee in a separate China hearing on Thursday that the administration “responded swiftly to protect Americans and safeguard against the balloon’s collection of sensitive information.”

Sherman, one of the officials who briefed lawmakers behind closed doors, added that the U.S. “made clear to PRC officials that the presence of this surveillance balloon was unacceptable.

“And along the way we learned a thing or two, which you’ll hear in the classified briefing, about the PRC’s use of the balloon,” she said.

Senate Foreign Relations Chair Bob Menendez (D-N.J.) said he was convinced by Sherman’s presentation that the administration had done the right thing by monitoring the balloon’s path across the U.S. before shooting it down over the Atlantic Ocean — as well as by announcing they would postpone Secretary of State Tony Blinken’s visit to Beijing.

“I believe that the administration acted correctly in how it dealt with the surveillance balloon,” Menendez said. “To the Chinese, it sent very resolute message, including stopping the Secretary of State from his visit, [and] the downing of the balloon. And I think all of those sends a very resolute message to the Chinese.”
