    Former civil servants condemn Rijiju’s remarks on judiciary in open letter

    New Delhi: Former civil servants in an open letter on Thursday criticised Law Minister Kiren Rijiju for several of his comments which, they said, constituted a concerted attack by the government on the collegium system of appointments and on judicial independence.

    The open letter, signed by 90 former bureaucrats, argued that preserving the independence of the judiciary is non-negotiable, and any sign of executive overreach cannot be accepted in a democracy.

    “We write to you today in response to comments you made on various occasions and very recently at the India Today Conclave on March 18, 2023. Your statements that day are the latest in what is emerging as a concerted attack by the government on the collegium system of appointments, the Supreme Court of India and, ultimately, on judicial independence. We unequivocally condemn this onslaught,” the letter said.

    In the appointment of judges to the High Courts and Supreme Court it appears that it is the government that is stonewalling appointments, it said

    “Names forwarded by the collegium are left pending for years, only to be finally returned without approval. Candidates with distinguished careers marked by their commitment to due process and to constitutional norms are turned down by the government,” said the letter, written by the former civil servants under the banner of Constitutional Conduct Group.

    Rather than engage constructively with the Supreme Court and collegium, high offices of the executive such as yours, and that of the Vice President, have responded with venomous barbs, it said.

    The government’s continued refusal to accept some candidates can only give rise to the suspicion that the underlying intention is to create a pliant judiciary, the letter said.

    “We are puzzled by your repeated criticisms of the Supreme Court collegium while simultaneously stating that there was no confrontation between the government and the Supreme Court. To the average Indian, there does, indeed, seem to be a confrontation,” it said.

    It is no surprise that retired judges, senior lawyers, and experts have been expressing serious concern in the public domain on the urgent need to safeguard judicial independence, the letter said.

    Former Lieutenant Governor of Delhi Najeeb Jung, former home secretary G K Pillai, ex-foreign secretary Sujatha Singh and former health secretary K Sujatha Rao are among 90 signatories to the open letter.

    “The process of determining judicial appointments goes to the heart of this independence. It is a testament to their commitment to the institution that retired judges of the Supreme Court and High Courts are not mute spectators to abrasive attacks on the judiciary,” it said.

    “Yet you have not hesitated to call them anti-India and have stated that a few retired judges are working in tandem with activists, groupings you described as ‘anti-India gangs’ and attempting to influence the judiciary to ‘play the role of an Opposition party’,” the letter said.

    The bureaucrats also took exception to Rijiju’s remark that the government will take strict action against “those who have worked against the country.”

    “It seems to us that you are confusing the government with the country, construing criticism of the government as disloyalty to the country. You seem to believe that if a person disagrees with the views of the government, that is enough to permanently label him or her as ‘anti-national’,” they said in the letter and accused the Centre of trying to suppress dissent with punitive actions.

    “As the Law Minister, if you have concerns about opinions being expressed or discussions taking place in public fora, you can avail of multiple platforms and ways to respond, beginning with inviting dialogue,” the letter said.

    To label public-spirited citizens as an “anti-India gang” and threaten them with action which will exact “a price” rings of authoritarianism, and “unbecoming of your high post”, the letter read.

    The former civil servants said they recognise that there is need for continued deliberations on ways to improve the current system of judicial appointments, to deepen transparency, and the rigour of the process as also diversity amongst appointees.

    “We conclude by reminding you of a simple but cardinal truth: all organs of the State are bound by the Constitution of India and a government, simply because it is in a majority, cannot ride roughshod over Constitutional provisions regarding the separation of powers amongst the executive, the legislature and the judiciary. By doing so, you breach your own oath of office,” it said.

    Neither Carroll nor Trump asked Kaplan, an appointee of President Bill Clinton, to block access to the jurors’ names, addresses and similar information. Kaplan raised the idea on his own and announced Thursday he will impose the secrecy despite objections from two news outlets: the Associated Press and the New York Daily News.

    The secrecy measure is typically reserved for criminal cases involving alleged mafia or drug kingpins. But Kaplan cited a series of alleged threats of violence by Trump, his public attacks on jurors in other cases and various reports describing Trump’s role in fomenting the Capitol riot on Jan. 6, 2021, as well as his statement Saturday urging his followers to protest what he said was his looming arrest in a probe led by Manhattan District Attorney Alvin Bragg.

    “Mr. Trump’s quite recent reaction to what he perceived as an imminent threat of indictment by a grand jury sitting virtually next door to this Court was to encourage ‘protest’ and to urge people to ‘take our country back,’” Kaplan wrote in an 18-page decision. “That reaction reportedly has been perceived by some as incitement to violence. And it bears mention that Mr. Trump repeatedly has attacked courts, judges, various law enforcement officials and other public officials, and even individual jurors in other matters.”

    Even as he recounted a litany of provocative statements by Trump, Kaplan was careful to say that he was not accusing the former president of being responsible for incitement, only that the specter created by his statements could be seen as intimidating.

    “For purposes of this order, it matters not whether Mr. Trump incited violence in either a legal or a factual sense. The point is whether jurors will perceive themselves to be at risk,” the judge wrote.

    Kaplan noted that neither side in the case objected to the proposed jury-secrecy order, which instructs court personnel not to reveal the names, addresses or places of employment of prospective jurors or actual jurors empaneled in the trial, scheduled to start April 25 at a federal courthouse in lower Manhattan just a few blocks from where Bragg’s grand jury has been hearing evidence against Trump in a probe stemming from a payment of hush money in 2016 to porn star Stormy Daniels.

    Caroll’s lawsuit is the second she filed in connection with Trump’s alleged attack on her in a Bergdorf Goodman dressing room in 1995 or 1996. The first, filed in 2019, accused Trump of defamation for his statements denying her rape claim. The second suit, which Kaplan has ordered be tried first, was filed in November and seeks damages against Trump directly for the alleged rape. Caroll’s lawyers have said they couldn’t file that case until last year, after New York’s Legislature extended the statute of limitations for civil suits alleging sexual abuse or harassment.

    Trump’s attorneys argued that the extension was unconstitutional, but Kaplan disagreed.

    Guwahati: The Assam government on Tuesday said altogether 57 state civil servants of 2013, 2015 and 2016 batches have been arrested and dismissed from service for “cash for job scam”, while three others have become approvers.

    Replying to a query by Congress MLA Bharat Chandra Narah, Chief Minister Himanta Biswa Sarma said 60 people, who passed the Assam Public Service Commission (APSC) examinations in those three years, have been brought under investigation.

    Out of these officers, 57 were arrested and discharged from services in the “APSC cash for job scam”, he added.

    Besides, three other officials agreed to become the approvers and they are under suspension at present, said Sarma, who also holds the Personnel Department.

    He also stated that the report of the Justice B K Sharma Commission on the scandal has not been accepted yet by the government and it was forwarded to a committee for review.

    The APSC was embroiled in a cash-for-job scam being investigated by Assam Police, which arrested nearly 70 people, including its former Chairman Rakesh Kumar Paul and 57 civil services officials since 2016.

    Lahore: In a relief to embattled Imran Khan, a top Pakistani court here granted protective bail to the former prime minister on Friday in eight terrorism cases and a civil case after he appeared before the court, hours after another court suspended non-bailable arrest warrants against him till March 18 in a corruption case.

    Khan, the 70-year-old chief of the Pakistan Tehreek-e-Insaf (PTI) party, travelled to the Lahore High Court (LHC) in a bulletproof vehicle to seek protective bail in nine cases.

    A two-member bench of the LHC, comprising Justice Tariq Saleem Sheikh and Justice Farooq Haider conducted the hearing on bail pleas filed against the cases that are lodged under terrorism sections, according to Geo TV.

    For the five cases in Islamabad, the court granted bail to the PTI chief till March 24 and for the three cases in Lahore, Khan received bail till March 27, the report said.

    Meanwhile, Justice Saleem also heard the bail pleas that Khan filed against the civil case registered against him, it said.

    Earlier, the Islamabad High Court suspended non-bailable arrest warrants issued against Khan till March 18, providing him with a chance to appear before the district court hearing the Toshakhana case.

    Ahead of the LHC decision, a tense calm prevailed in Lahore’s upscale Zaman Park near Khan’s residence, which was the scene of pitched battles for two days between his defiant supporters and Punjab Police.

    The clashes ultimately subsided after the courts intervened on Wednesday.

    Khan has been in the crosshairs for buying gifts, including an expensive Graff wristwatch he had received as the premier at a discounted price from the state depository called Toshakhana, and selling them for profit.

    Established in 1974, the Toshakhana is a department under the administrative control of the Cabinet Division and stores precious gifts given to rulers, parliamentarians, bureaucrats, and officials by heads of other governments and states and foreign dignitaries.

    Khan was disqualified by the Election Commission of Pakistan in October last year for not sharing details of the sales.

    The election body later filed a complaint with the district court to punish him, under criminal laws, for selling the gifts he had received as prime minister of the country.

    Khan has vehemently denied those charges.

    According to Khan, he was facing over 80 different cases in various courts across Pakistan.

    Khan, the cricketer-turned-politician, was ousted from power in April last year after losing a no-confidence vote, which he alleged was part of a US-led conspiracy targeting him because of his independent foreign policy decisions on Russia, China, and Afghanistan.

    Since his ouster, Khan has been asking for early elections to remove what he termed an “imported government” led by prime minister Shehbaz Sharif.

    Sharif has maintained that elections will be held later this year once the parliament completes its five-year tenure.

    Vijayawada: Well-known filmmaker Ram Gopal Varma has received his engineering degree 37 years after he finished B Tech from Acharya Nagarjuna University in Guntur.

    RGV, as the filmmaker is popularly known, took to Twitter to share the picture of his degree certificate and also his excitement.

    “Super thrilled to receive my B tech degree today 37 years after I passed, which I never took in 1985 since I wasn’t interested in practicing civil engineering,” he tweeted. He thanked the university for the same.

    The director had passed B Tech (civil engineering) with second class in the examination held in July 1985.

    RGV also shared a picture with the professors of the university and wrote: “The uneducated me with the highly educated professors of Acharya Nagarjuna University.”

    Civil society groups seek help from opposition parties to ‘save’ MGNREGA

    New Delhi: Alleging that the NDA government is on its way to gradually doing away with the Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGA), many civil society groups and labour organisations have appealed to opposition parties to support their demands for an increase in budgetary allocation for the scheme.

    In a briefing held for the Members of Parliament on March 14 at the Deputy Speakers Hall, Constitution Club, New Delhi, the civil society members urged them to raise the issues of crores of labourers and workers who have “not been paid since December 2021”.

    They highlighted the issue of inadequate funding, adverse changes in the attendance system as well as the method of payment. The broad aim of the briefing was to help MPs defend peoples’ right to work under the MGNREGA.

    MPs of the opposition parties who attended the event were Sanjay Singh (Aam Aadmi Party), Digvijaya Singh, Uttam Kumar Reddy and Kumar Ketkar (Congress Party), S. Senthilkumar (Dravida Munnetra Kazhagam), Jawhar Sircar (All India Trinamool Congress Party) among others.

    They deliberated upon the ways to force the government to enhance budgetary allocation and reverse the recent amendments in the mode of payment which has proved “disastrous” to the interest of workers.

    Beginning the presentation, Jean Dr ze, visiting Professor at Ranchi University, alleged that the National Democratic Alliance (NDA) government has unleashed an unprecedented three-pronged attack on MGNREGA — inadequate funding, the introduction of an Aadhar-based Payment System (ABPS) and the inception of a real-time attendance system through the National Mobile Monitoring Software (NMMS) app.

    Prof Dreze claimed that this year’s funding is only Rs 60,000 crore which is the lowest allocation ever in the history of the programme.

    “Funds run out and projects come to a halt. The wages get delayed and are accumulated for months,” Prof Dreze said, adding that the introduction of digital attendance has deprived the workers of their wages due to technical and network glitches.

    “Aadhar-based Payment is so complicated system that even many bankers fail to understand its functionality and the majority of workers cannot be paid through this system. It is illegal and criminal not to pay wages to workers for the work that they have done” he added.

    Other speakers who expressed their concerns and shared the problems of workers were Nikhil Dey (Mazdoor Kisan Shakti Sangathan, Rajasthan), James Herenj (NREGA Watch, Jharkhand), Ashish Ranjan (Jan Jagran Shakti Sangathan, Bihar), Richa Singh (Sangtin Kisan Mazdoor Sangathan, UP), Anuradha Talwar (Paschim Bangal Khet Mazdoor Samiti, West Bengal) and Supreme Court lawyer Prashant Bhushan among others.

    They presented testimonies to show that the Aadhar-based Payment and Mobile Monitoring Software App are “depriving a large number of workers of payment” of wages to them. They said that according to the data from the Ministry of Rural Development (MoRD), only 43 per cent of NREGA workers are eligible for ABPS.

    “The current changes in MGNREGA impact 15 crore workers across the country which is a huge number. We want a political response from opposition parties to support people on the ground to give them their rights under the law,” Dey said.

    Civil society members requested MPs to issue a Privilege Notice in Parliament to demand an explanation from the Rural Development Minister on his remarks to the media suggesting that the state government should also contribute to the wage liability under the programme, contrary to the provisions of MGNREGA.

    Assuring the civil society members of full support, Congress leader Digvijaya Singh said that workers’ plight is genuine.

    “The intent of this government is always opposed to the ideals of the Mahatma Gandhi National Rural Employment Guarantee Act of 2005. They are cutting down all social service budgets. I am all for the support which is expected from us,” he said.

    AAP MP Sanjay Singh said the BJP government admitted in Parliament while responding to his questions that the dues of states under MGNREGA run over Rs 3,000 crore.

    “It is very surprising to know that out of guaranteed 100 days of work, the labourers are getting only 34 days of work due to lack of adequate funds. We will raise the issue in Parliament but at the same time we should also think about starting a people’s movement,” he suggested.

    Other MPs also pledged support and said they will do their level best to help highlight the plights of the workers.

    MGNREGA Sangharsh Morcha is a coalition of organisations working with rural labourers and workers around the country. It is in the midst of a 100-day dharna at Jantar Mantar, to protest against “recent attacks” on the scheme.
