Bhopal gas tragedy: SC to deliver judgment on Centre’s plea on Tuesday

    [ad_1]

New Delhi: The Supreme Court will on Tuesday deliver its verdict on a curative petition filed by the Centre demanding an additional compensation of Rs 7,400 crore from the successor firms of Union Carbide Corporation (UCC) for the victims of 1984 Bhopal gas tragedy.

The successor firms of the UCC had told the Supreme Court that the Indian government never suggested at the time of settlement (of 1989) that it was inadequate. The firms’ counsel emphasized that depreciation of the rupee since 1989 cannot become a ground to seek a top-up of compensation now for the Bhopal gas tragedy victims.

After hearing detailed arguments, a five-judge bench headed by justice Sanjay Kishan Kaul on January 12 reserved its verdict on Centre’s curative petition seeking an additional Rs 7,844 crore from the successor firms of UCC for extending greater compensation to the victims.

Senior advocate Harish Salve, representing successor firms of the UCC, submitted before the bench – also comprising Justices Sanjiv Khanna, Abhay S. Oka, Vikram Nath, and J.K. Maheshwari – that there are affidavits starting from 1995 and ending as late as 2011, where the Indian government has opposed every single attempt to suggest that the settlement is inadequate.

During the hearing, Salve also cited several conspiracy theories connected with the case. He said in one of the theories it was claimed the then Prime Minister Rajiv Gandhi had met UCC Chairperson Warren Anderson in a hotel in Paris before the settlement, and added that Anderson had by then retired from his post.

The top court had grilled Attorney General R. Venkataramani, representing the Centre, on how the government could file a curative petition without filing the review. It told the AG that the Central government was not prohibited from granting relief to the Bhopal gas tragedy victims, and it cannot absolve from itself from the welfare state principle saying, “I will take it from them (successor firms of Union Carbide Corporation), as and when taken from them, I will pay”.

  • JEE Advanced: Court seeks Centre’s response on plea seeking relaxation for students

JEE Advanced: Court seeks Centre’s response on plea seeking relaxation for students

    [ad_1]

New Delhi: The Delhi High Court on Tuesday issued a notice to the Centre and other respondents and sought a response to a plea seeking relaxation for the students appearing for the JEE Advanced 2023.

The applicants have urged that it be made possible for them to retake the engineering entrance exam. The court listed the matter for next hearing on March 23.

Technical issues plagued both JEE Main 2022 sessions, which were held in June and July last year. These errors prevented the candidates from giving the exam a fair shot, which led to significant decreases in many candidates’ scores and percentiles.

Last year, there were a number of technological issues with the JEE exams, including frequent computer crashes, a frozen screen for many minutes, questions that took too long to load, unfinished questions, and more.

Some students claimed that they were unable to take the exam because their centres were abruptly relocated without intimation.

Some candidates encountered mistakes in their results as well as differences in their response sheet.

Students encountered similar technical issues during JEE Advanced 2022. For many of the students who experienced technical difficulties, it was their final try. It was the final JEE Main test for students who finished from Class 12 in 2020, and the final JEE Advanced attempt for students who graduated from Class 12 in 2021.

Justice Purushaindra Kumar Kaurav issued a notice and sought a response within two weeks.

It is argued that the deadly delta Covid wave of 2021 caused the Class 12 students of that year to experience extreme mental stress, anxiety, sadness, and other compensable damages, ranging from financial hardship to family member loss.

This was after the Covid outbreak in 2020 had already negatively impacted their education for more than a year.

  • Delhi HC seeks Centre’s reply on journalist Angad Singh’s plea

Delhi HC seeks Centre’s reply on journalist Angad Singh’s plea

    [ad_1]

New Delhi: The Delhi High Court on Tuesday asked the Central government to file a proper counter affidavit to a Vice News journalist Angad Singh’s plea challenging his deportation from Delhi to New York in August last year and being “blacklisted” despite being an Overseas Citizen of India (OCI) card holder.

Appearing for the Centre, advocate Anurag Ahluwalia had last month told the court that as the US-based journalist has violated Section 11A of the Foreigners Order, 1948, which prohibits a foreigner from producing any picture, film or documentary without permission in writing from the Centre, he is a blacklisted subject.

During the hearing on Tuesday, appearing for Singh, Advocate Swathi Sukumar said that she had moved an amendment application against the blacklisting which was mentioned in the counter affidavit of the Ministry of Home Affairs (MHA).

The FRRO, in an affidavit, told the court that Singh was blacklisted at the instance of the Consulate General of India in New York.

According to the affidavit, Singh had allegedly depicted India in a negative manner in the “India Burning” documentary.

Ahluwalia had earlier submitted that Singh was entering India on his journalist visa for a personal visit but he wasn’t issued a visa for that.

On Tuesday, Sukumar further said that she did not have a copy of the blacklisting order.

Ahluwalia said that he would file a “detailed response”. He added that the primary condition was that Singh comes to the place, makes a video, gives it to the consulate general for approval, once approved, then the video could have been made public.

Sukumar argued that the Centre had to seek instructions on whether any proceedings were initiated for cancellation of Singh’s OCI card.

To this, Ahluwalia said that they have not initiated any proceedings as of now and added that filing the blacklisting order may not be necessary.

While allowing the amendment to the writ petition and directing the Centre to file a proper counter affidavit to the amended petition, the court noted: “It is submitted by the Centre that their stand would be stated in the counter affidavit which is now to be filed in the amended writ.”

The court listed the matter for the next hearing in May.

Singh has covered important issues in his documentaries, including the Shaheen Bagh protests, the farmers’ protests and the Covid-19 pandemic in India, among others.

In his plea, Singh has mentioned that his fundamental right under the Citizenship Act, 1955, is being violated by not letting him into India.

Earlier, Singh’s counsel had sought a declaration that his deportation from the government was illegal and disclosure of all the materials and data available with the government related to him.

Telangana: New drug de-addiction centres to function from Feb 28

    [ad_1]

Hyderabad: Telangana health medical and family welfare department informed the state High Court that the newly established rehab centres would function from Tuesday.

Deaddiction centres take up treatment and care of persons who are addicted to alcohol or other drugs with the availability of various supporting medical care services or a unit attached to a well-equipped general hospital.

The addicts are given free treatment, yoga therapy and counselling services to develop strong willpower to resist the craving for drug abuse.

Secretary to government SAM Rizvi made the submission in response to a petition filed by social activist and advocate Mamidi Venu Madhav, seeking the development of de-addiction clinics in every district.

He further informed that six such medical facilities have already been established and are under operation in Osmania Medical College/Institute of Mental Health, Gandhi Medical College/Gandhi Hospital, Kakatiya Medical College/MGM Hospital, Government Medical College/GGH Nizamabad, Rajiv Gandhi Institute of Medical Sciences/Hospital and Government Medical College/GGH Mahabubnagar.

These rehabilitation centres are much-needed relief with the state citing inter-state peddlers crashing into the cities luring youngsters into the consumption and illegal sale of drugs.

  • Maha: Name change of Aurangabad and Osmanabad cities gets Centre’s nod

Maha: Name change of Aurangabad and Osmanabad cities gets Centre’s nod

    [ad_1]

Mumbai: The Union government has approved the renaming of Maharashtra’s Aurangabad city as Chhatrapati Sambhajinagar’ and the Osmanabad city as Dharashiv’.

Maharashtra Deputy Chief Minister Devendra Fadnavis shared the news on Twitter.

Aurangabad derives its name from Mughal emperor Aurangzeb, while Osmanabad was named for a 20th century ruler of the princely state of Hyderabad.

Chhatrapati Sambhaji, the eldest son of warrior king Chhatrapati Shivaji Maharaj, was the second ruler of the Maratha state founded by his father. Sambhaji Maharaj was executed on Aurangzeb’s orders in 1689.

Dharashiv, the name of a cave complex near Osmanabad, dates back to the 8th century as per some scholars.

Hindu right-wing organisations had been demanding renaming of the two cities for long.

Fadnavis tweeted two letters from the Ministry of Home Affairs to the deputy secretary of the state General Administration Department dated February 24.

The letters stated that the Centre had no objection to the change in the names of these two central Maharashtra cities.

Fadnavis thanked Prime Minister Narendra Modi and Union Home Minister Amit Shah for the decision.

The state government headed by Chief Minister Eknath Shinde ”did what was promised ”, he said.

Notably, to rename Aurangabad as Sambhajinagar and Osmanabad as Dharashiv was the last cabinet decision of the Shiv Sena-NCP-Congress government which collapsed last June following Shinde’s rebellion against Uddhav Thackeray.

The new government headed by Shinde scrapped the cabinet decision and took a fresh decision.
