SRINAGAR: Justice Tashi Rabstan, Judge of the High Court of JK and Ladakh and Executive Chairman of JK Legal Services Authority, accompanied by the Member Secretary of JK LSA, Joint Registrar (Judicial) Srinagar, and Secretary of DLSA Srinagar, visited Central Jail Srinagar and Juvenile Observation Home Harwan to obtain first-hand information about the facilities being provided to inmates of Central Jail Srinagar.

Upon his arrival, Justice Tashi Rabstan was received by Daljit Singh, Superintendent of Central Jail Srinagar, along with the Deputy Superintendent, other jail staff, and the Medical Officer. The Executive Chairman of JK LSA inquired about the number of convicts serving their sentences and also the undertrial prisoners belonging to JK, as well as other states and foreign nationals, upon which Justice Tashi Rabstan was informed that 15 UTPs from Burma were lodged in the jail.

Thereafter, Justice Tashi Rabstan visited the male as well as female blocks and interacted with the inmates to inquire about the medical and other facilities provided to them. Subsequently, he also visited the VC facility available in the jail and witnessed the court proceedings that were going on through virtual mode in which the jail inmate was appearing.

Justice Tashi appreciated the new initiatives introduced, like the installation of a prison inmate calling system for prisoners so that they can contact their family and lawyers at any time. He also inspected the kitchen, vocational centers, barber shop, wet canteen run by jail inmates, gymnasium, e-mulakat center, and legal aid clinic, also manned by a jail inmate (PLV).

Justice Tashi appreciated the efforts made by the government in general and the department of prisons in particular for maintaining the standard of living in jail and providing all the basic necessary facilities like hygienic food, medical facilities, and skill training, etc., to the inmates.

Later, Justice Tashi Rabstan visited the juvenile observation home in Harwan to take stock of the present status of the said home. Sameena Mir, Superintendent, along with the Home-father, Probation cum Child Welfare Officer, and Para Legal Volunteers received Justice Tashi and accompanied him to the rooms of the juveniles staying in the observation home and showed other facilities available there like the dispensary, recreation hall, library, and the room meant for offering prayers.

He also visited the kitchen where the evening meal was being prepared and was informed that for every inmate of the Observation Home, Rs. 100 per day is being provided by the concerned department for food and other basic needs, and the said amount has not been revised since 2011.

The superintendent of the said home also informed the Executive Chairman that no teacher on a regular basis is available for the Observation Home, and in this regard, a communication has already been sent to the higher authorities. Justice Tashi directed the superintendent of the Observation Home to ensure that the counsellor appointed for the said home is present on the day when he next visits the said home. (GNS)

‘Misuse of central agencies’: SC refuses to entertain plea of 14 parties

    [ad_1]

New Delhi: The Supreme Court on Wednesday refused to entertain a plea by 14 parties, led by the Congress, alleging arbitrary use of central probe agencies against opposition leaders and seeking guidelines for the future.

A bench comprising Chief Justice D Y Chandrachud and Justice J B Pardiwala said that “laying down general guidelines without having relation to facts of a case will be dangerous”.

Sensing the disinclination on the part of the top court in entertaining the plea, senior advocate A M Sighvi, appearing for the political parties, sought permission to withdraw the petition.

“Learned counsel seeks permission to withdraw the plea at this stage. The petition is accordingly dismissed as withdrawn,” the bench ordered.

“You please come back to us when you have an individual criminal case or group of cases,” the bench said.

The plea alleged an alarming rise in the use of coercive criminal processes against opposition political leaders and other citizens exercising their fundamental right to dissent.

Besides the Congress, the parties that are part of the joint move are the DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party and the J-K National Conference.

‘Misuse’ of central probe agencies: SC to hear plea of 14 Oppn parties on April 5

    [ad_1]

New Delhi: The Supreme Court is scheduled to hear on Wednesday a plea filed by 14 parties, led by the Congress, alleging arbitrary use of central probe agencies against opposition leaders and seeking guidelines for the future.

According to the list of businesses uploaded on the apex court website, the plea of opposition parties would be heard on April 5 by a three-judge bench headed by Chief Justice of India D Y Chandrachud.

Justices P S Narasimha and J B Pardiwala are also part of the bench.

    MS Education Academy

The joint plea was mentioned for urgent hearing on March 24 by senior advocate Abhishek Singhvi.

“I am asking for the guidelines for the future. This is a remarkable convergence of 14 parties against the misuse of the agencies, both CBI and ED,” Singhvi had said and claimed that 95 percent of cases of the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) are against the leaders of opposition parties.

The senior lawyer referred to the rise in the number of cases filed by the CBI and ED after the NDA government came to power in 2014.

“Second statistics, pre-2014 and post-2014: there is a humongous jump in cases. The rate of conviction is four to five percent. We are asking for pre-arrest guidelines and post-arrest bail guidelines,” Singhvi had said.

The plea alleged there is an alarming rise in the use of coercive criminal processes against opposition political leaders and other citizens exercising their fundamental right to dissent.

“Investigating agencies such as CBI and ED are being increasingly deployed in a selective and targeted manner with a view to completely crush political dissent and upend the fundamental premises of a representative democracy,” a statement issued on behalf of a petitioner alleged.

The plea filed through lawyer Shadan Farasat cited some statistics and said they demonstrated a “shocking and unconstitutional state of affairs”.

Besides the Congress, the parties that are part of the joint move are the DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party, and the J&K National Conference, the statement said.

  • Villagers Panic After Leopard Sighting In Central Kashmir

    [ad_1]

SRINAGAR: On Sunday morning, a leopard was seen in various villages of Central Kashmir’s Budgam, which caused panic among the residents.

Local sources said that a leopard was seen near the “Alamdar Brick Kiln,” and the same animal was also spotted freely roaming in the Sharatpora and Bonhuma areas of Budgam.

Those who saw the big cat near the brick kiln raised an alarm and informed the wildlife department. “We saw a big cat early this morning near the brick kiln. The same leopard was seen in the outskirts of Sharatpora village. We are very scared because leopard sightings have become a regular occurrence in the area. We have lost many cattle, and even human beings have been killed in leopard attacks,” said some locals.

The villagers appealed to the Wildlife Department to send a team to capture the leopard before it could harm anyone. [KNT]
