  • CBI brand of truth, officers should act against corrupt, however powerful, without hesitation: PM

CBI brand of truth, officers should act against corrupt, however powerful, without hesitation: PM

    [ad_1]

New Delhi: There is today no dearth of political will to act against corruption and officers should take action against the corrupt, however powerful, without any hesitation, Prime Minister Narendra Modi said on Monday.

Addressing a gathering at the diamond jubilee celebrations of the Central Bureau of Investigation (CBI), the prime minister said the agency has developed as a brand of “truth and justice” over the last 60 years. Terming corruption the biggest roadblock to democracy and justice, he said the agency’s key responsibility is to free India from it.

Stressing that the CBI should not be distracted by those trying to tarnish its image, Modi said a developed India is not possible without professional and efficient institutions and this puts a huge responsibility on the agency.

    MS Education Academy

The CBI’s chief responsibility, he said, is to rid the country of corruption.

Corruption is not an ordinary crime, it snatches the rights of the poor, it begets many other crimes, corruption is the biggest obstacle in the path of justice and democracy, he said.

He asked the CBI to devise ways to fast-track its investigations against the corrupt because a languishing probe gives a sense of safety to the corrupt while innocent people keep suffering.

Those who benefitted from corruption for decades have created an ecosystem that attacks probe agencies. But the agencies should not be deterred by stories about the power of the corrupt and their ecosystem to tarnish them, Modi said.

“I am aware that the people you are acting against are very powerful…. These people will keep distracting you, but you have to focus on your work. No corrupt person should be spared. There should be no laxity in our efforts. This is the wish of the country, this is the wish of the people of the country. The country, law and constitution are with you,” the prime minister said.

“Today there is no dearth of political will to take action against corruption in the country. You should not hesitate to take action (against the corrupt, however powerful)…,” he told the gathering of CBI officers and personnel.

The CBI was established by a resolution of the Ministry of Home Affairs on April 1, 1963.

Referring to international transactions and the movement of people, goods and services on a large scale, even outside geographical boundaries, Modi said India’s economic power is growing while those who create obstacles are also rising.

He warned that attacks on India’s social fabric, its unity and brotherhood, and its economic interests and institutions would also increase.

“Corruption money will be spent on this,” the prime minister said, stressing the need to understand and study the multinational nature of crime and corruption.

Modi said India got a legacy of corruption at the time of Independence and lamented the fact that some people kept nourishing this malady instead of removing it.

While a discussion on trillion dollars refers to a strong economy these days, a decade ago, when the CBI celebrated its golden jubilee, such figures were used to describe scams in the country, he said.

“There was a competition underway on who will set a new record of corruption,” he said. The scams and the prevailing sense of impunity led to the destruction of the system, and an atmosphere of policy paralysis brought development to a standstill.

He said Internet banking and UPI stand in stark contrast to the earlier “phone banking” malaise, where loans worth thousands of crores of rupees were sanctioned on the basis of phone calls from influential people.

The beneficiaries scooted away with the public money, the prime minister said. He said the Fugitive Economic Offenders Act has so far enabled the confiscation of Rs 20,000 crore worth of properties of fugitive offenders.

Modi said the corrupt would even go to the extent of looting the aid given to beneficiaries of government schemes, be it rations, homes, scholarships or pensions, and the original beneficiary would feel conned every time.

Modi said the beneficiaries of government schemes are now getting their full entitlement due to the trinity of Jan Dhan, Aadhaar and mobile, and more than eight crore fake beneficiaries have been removed from the system.

“Due to DBT (direct benefit transfer), about Rs 2.25 lakh crore has been saved from falling into wrong hands,” he said.

The prime minister said it was the resolve of his government after assuming office in 2014 to launch a crackdown on corruption and benami properties, and it started to act against these evils on mission mode.

The prime minister said even today when a case remains unsolved, there are demands for it to be handed over to the CBI.

The CBI has earned people’s faith through its work and techniques, he said.

“CBI’s name is on everyone’s lips. It is like a brand for truth and justice. Even at the panchayat level, if some major crime happens, people want it to be referred to the CBI,” he said.

Modi said wherever there is corruption, the youth don’t get equal opportunities, and just one special eco-system gets emboldened.

Terming corruption the biggest enemy of merit, he said corruption gives encouragement to nepotism and dynastic rule.

When nepotism and dynastic rule increase, the country’s strength gets affected, and when the country’s strength gets weakened, it hampers development, he said.

The prime minister conferred medals on the recipients of the President’s Police Medal for Distinguished Service and Gold Medal for Best Investigating Officers of the CBI during the programme.

He also virtually inaugurated the newly constructed office complexes of CBI in Shillong, Pune and Nagpur, released a postage stamp and commemorative coin, and launched the Twitter handle of the agency.

Among those present were Minister of State for Personnel Jitendra Singh, National Security Advisor (NSA) Ajit Doval and CBI Director Subodh Kumar Jaiswal.

In his welcome address, Jaiswal said the CBI has evolved from an agency combating corruption to a multidisciplinary investigative and prosecuting organisation of international repute.

“No wonder, the bureau enjoys the confidence of the judiciary as well as the common people and victims of crime who invariably demand its services to undo wrongs,” he said.

Bengal Ram Navami clashes: PIL filed at Calcutta HC seeking CBI probe

    [ad_1]

Kolkata: As tension over clashes in West Bengal’s Howrah district over a Ram Navami procession continued on Friday, a Public Interest Litigation (PIL) was filed at the Calcutta High Court seeking a CBI probe into the matter.

The clashes which were mainly at Sandhyabazar area of Shibpur in Howrah district on Thursday, spread to adjacent Kazipara area this morning. A group of people started pelting stones towards the high-rises in the area. A couple of vehicles were vandalised and torched.

Even the vehicle of the state cooperation minister Arup Roy, which was passing through the area then, was not spared. The window-screen of the vehicle was totally smashed. However, the minister was not present in the vehicle.

Finally, a huge contingent of police force, accompanied by the personnel of the Rapid Action Force (RAF), reached the spot. They resorted to massive lathicharge to bring the unruly mob under control. Some of the policemen also suffered injuries in the clashes. Till the filing of the report, the total number of arrests in this connection was 36. Though the situation has been brought under control, tension prevails in these pockets.

Chief Minister Mamata Banerjee gave a strong message and said that her administration will not tolerate such rowdy activities. “I have asked the police to take strong action,” she said. Admitting that there had been complaints of inaction or delayed action by police, the chief minister said that these complaints will also be looked into. At the same time, she claimed that Thursday’s clashes mainly happened because of the last moment change in route of the procession.

On Friday, Leader of Opposition in state Assembly Suvendu Adhikari filed a PIL at the division bench of Calcutta High Court’s Acting Chief Justice T.S. Sivagnanam and Justice Hiranmay Bhattacharyya, seeking a CBI probe in Thursday’s clashes.

The PIL has been admitted and the hearing in the matter will be on April 3. Besides seeking a CBI probe in the matter, the leader of the Opposition had also sought deployment of central armed forces in the troubled pockets on this count.

In the PIL he also claimed that the deployment of central armed forces had been necessary as the state police had failed miserably to bring the situation under control.

Mother of minor girl used as drug carrier approaches Kerala HC for CBI probe

    [ad_1]

Kochi: The mother of a 12-year-old girl has filed a petition before the Kerala High Court alleging that her daughter was used as a “drug carrier” by drug mafia and sought a CBI probe into the matter.

In her plea, she said her daughter’s involvement with drug trade came to light when she was called to her school after her daughter was found in school washroom in an inebriated state with fully wet uniform and she was told that her daughter informed that someone made her smell a white powder and that she vomited four times.

Her plea also points out that the authorities informed the matter either to the police or to Child line, the agency which monitors children.

According to her daughter, she was first introduced to drugs by a fellow student during Kabbadi practice in October last year.

Later she fell into the hands of few men and she was taught to make blade-cut injuries on the wrist to put MDMA for intoxication.

The plea further submitted that at the police station, the child explained the entire incident to the police and lodged a complaint.

Adhinan, an influential man who was allegedly behind this, was subsequently summoned to the police station and even though he was questioned, police colluded with him and recorded a false statement limited to the allegation that he touched the girl’s hand, the mother said.

She further contended that Chief Minister Pinarayi Vijayan allegedly made statements exonerating the accused during a debate in the Assembly, terming the media reports of the drug mafia case as fake.

  • CBI files fresh chargesheet against Mehul Choksi

CBI files fresh chargesheet against Mehul Choksi

    [ad_1]

New Delhi: Months after Interpol removed a Red Corner Notice (RCN) against fugitive diamantaire Mehul Choksi, the CBI has filed a fresh chargesheet against him for allegedly pledging lab-grown diamonds valued at 98 percent less than what was projected for getting a loan of Rs 25 crore from the IFCI in 2016, officials said.

In its chargesheet filed before a special CBI court in Mumbai recently, the Central Bureau of Investigation (CBI) alleged that Choksi’s firm Gitanjali Gems took the loan from the Industrial Finance Corporation of India (IFCI) by pledging 896 pieces of studded jewellery, which were valued at more than Rs 45 crore by government-approved valuers.

Once the loan account turned a non-performing asset (NPA), the IFCI moved to realise the pledged jewellery, but came to a rude shock after fresh valuations showed that their value was 98 percent less than what was projected at the time of applying for the loan, the officials said.

The fresh valuation done by the IFCI pegged the value of the jewellery in the range of Rs 70 lakh to Rs 2 crore, the chargesheet said.

“The valuers said the diamonds are of low quality and are lab-prepared chemical vapour diamonds and other inferior colour stones and not real gem stones. Accordingly, the account of Gitanjali Gems Limited was declared as fraud on November 30, 2018,” the chargesheet accessed by PTI said.

The opinion of the valuers gathered by the CBI during the probe also put the value of 896 pieces of jewellery in the range of Rs 69.32 lakh to Rs 76.99 lakh, the officials said.

The CBI recently filed a chargesheet against Gitanjali Gems, its former director and guarantor Choksi, government-approved valuers Narendra Jhaveri, Pradip C Shah, Shrenik Shah and Keyur Mehta, assistant vice-president of the company Vipul Chitalia and its assistant general manager Aniyath Shivraman Nair, they said.

Giving details of the money trail, the federal agency alleged that Rs 25 crore received by Gitanjali Gems on September 30, 2016 from the IFCI were diverted to Premier Intertrade through a cheque signed by Chitalia and Nair on the same day.

It alleged that the company, Premier Intertrade, existed only on paper with dummy partners and employees of Gitanjali Gems as signatories.

The whole amount was reverted to Gitanjali Gems in three tranches, the CBI said, adding that the entire exercise was carried out to change the “colour of the money”.

Choksi allegedly used Rs 20 crore to settle the foreign letter of credit (FLC) issued in favour of Hong Kong-based 4C’s Diamonds Distributors. The investigation showed that the Hong Kong-based firm was also controlled by Choksi and had no genuine business transactions with Gitanjali Gems.

The money was again routed back to Gitanjali Gems, the agency alleged.

The remaining Rs 5 crore were used to repay a fraudulent letter of undertaking (LoU) in the Punjab National Bank (PNB), discharge outstanding liabilities of Gitanjali Gems and towards miscellaneous expenses, the CBI alleged.

An independent body of lawyers under Interpol — the Commission for Control of Interpol’s Files (CCF) — removed Choksi’s name from theN list in November 2022 and it came as a major setback to the CBI. The removal of the notice means Choksi can now freely travel out of Antigua and Barbuda, where he is holed up after fleeing from India in 2018.

Choksi is accused of siphoning off more than Rs 6,344.96 crore from the PNB, using fraudulent LoUs and FLCs.

Officials at the PNB’s Brady House branch in Mumbai issued 165 LoUs and 58 FLCs during March-April 2017, against which 311 bills were discounted.

These LoUs and FLCs were allegedly issued to Choksi’s firms without any sanctioned limit or cash margin and without making entries in the bank’s central banking system to evade any scrutiny in case of a default.

LoUs are a guarantee given by a bank on behalf of its clients to a foreign bank. If a client does not repay to the foreign bank, the liability falls on the guarantor bank.

Based on these LoUs issued by the PNB, money was lent by State Bank of India-Mauritius, Allahabad Bank-Hong Kong, Axis Bank-Hong Kong, Bank of India-Antwerp, Canara Bank-Mamana and SBI-Frankfurt.

“Since the accused companies did not repay the amount availed against the said fraudulent LoUs and FLCs, the PNB made the payment of Rs 6,344.97 crore (USD 965.18 million), including the overdue interest, to the overseas banks, which had advanced buyer’s credit and discounted the bills against the fraudulent LoUs and FLCs issued by the PNB,” the CBI’s supplementary chargesheet in the PNB bank fraud case had alleged.

  • Land-for-jobs ‘scam’: Bihar Deputy CM Tejashwi questioned by CBI, ED quizzes sister Misa

Land-for-jobs ‘scam’: Bihar Deputy CM Tejashwi questioned by CBI, ED quizzes sister Misa

    [ad_1]

New Delhi: Investigation agencies on Saturday questioned Bihar Deputy Chief Minister Tejashwi Yadav and his MP sister Misa Bharti in connection with the railways land-for-jobs scam case here, officials said.

While Yadav was quizzed by the CBI for more than eight hours, the ED questioned Bharti for over six hours, they said.

Slamming the BJP over the questioning of the two Rashtriya Janata Dal (RJD) leaders, Congress general secretary Priyanka Gandhi Vadra alleged the ruling party wants to finish off the Opposition and democracy and also expressed solidarity saying, “We are all united against the attack on democracy.”

In a tweet in Hindi, she said, “BJP wants to finish off the Opposition and democracy from this country. That is why it is continuously attacking the voice of the people in the Opposition.”

Yadav had missed three earlier dates given by the agency and arrived at the CBI headquarters here around 10:30 am according to his commitment to the Delhi High Court last week, they said.

He was questioned till around 8 PM with a nearly 90-minute lunch break, during which he went out of the building, they said.

The CBI’s line of inquiry was believed to have focused on Yadav’s financial transactions, including his purported links to AB Exports Private Limited and AK Infosystems Pvt Ltd.

Last week, the CBI assured the Delhi High Court that Yadav would not be arrested this month.

Bharti was questioned by the Enforcement Directorate (ED) in the railways land-for-jobs linked money laundering case here, officials said.

The Rajya Sabha member went to the agency’s office in central Delhi around 11 am and exited around 7 pm.

She left for lunch for over an hour in the noon during she which told waiting reporters outside the ED office that the proceedings were “confidential” and hence she would not want to comment.

It is understood that her statement was recorded by the investigating officer under the Prevention of Money Laundering Act (PMLA).

Yadav’s counsel, Maninder Singh, had informed the high court that he would require some time to appear before the CBI investigators due to the ongoing Bihar Assembly session, scheduled to conclude on April 5.

The CBI’s counsel, D P Singh, had argued that the assembly was not convened on Saturdays and Yadav could appear before the agency on any Saturday in March according to his convenience.

The RJD leader had sought quashing of the summonses issued against him on February 28, March 4 and March 11.

A special CBI court had already granted bail to Yadav’s father Lalu Prasad, mother Rabri Devi, sister Bharti and others in the same case on March 15.

The CBI’s probe is part of an ongoing investigation into documents and evidence that came to light after the initial charge sheet was submitted, as well as the alleged involvement of accused persons that could not be completed by the time the initial report was filed.

Officials said that fresh questioning was taking place as part of further investigation based on new inputs gathered during the agency’s ongoing probe.

The CBI has alleged that during Lalu Prasad’s tenure as railway minister from 2004 to 2009, favourite candidates were appointed in violation of norms and procedures without any advertisement or public notice.

The agency further claimed that substitutes from Patna were appointed in various zonal railways in Mumbai, Jabalpur, Kolkata, Jaipur, and Hazipur. In return, the candidates, directly or through their family members, allegedly sold land to Prasad’s family members at highly-discounted rates.

WBSSC recruitment: CBI gets details about number of OMR sheets tampered with

    [ad_1]

Kolkata: With the arrest of a top official of an OMR sheet manufacturing entity, the Central Bureau of Investigation (CBI) sleuths have got the details about the number of OMR sheets that were allegedly tampered with in different examinations for recruitment of teaching and non-teaching staff in West Bengal state-run schools.

These examinations were conducted by West Bengal School Service Commission (WBSSC).

According to sources, during the interrogation of Niladri Das, the vice-president of OMR sheet manufacturing entity, NYSA, the CBI sleuths have secured information about 8,163 OMR sheets that were allegedly tampered with to make room for ineligible candidates.

Sources, citing CBI sleuths, claimed that as many as 6,304 OMR sheets were tampered with in case of non-teaching staff, which included 3,481 Group-D posts and 2,823 Group-C posts.

In case of teaching staff, the total number OMR sheets that were tampered with stands at 1,859, out of which 952 were for recruitment of secondary teachers while the remaining 907 were for recruitment of teachers at higher secondary level.

“Our sleuths are now trying to track how Das financially benefited from this tampering of OMR sheets,” said a CBI associate.

Das is currently in CBI custody and is facing marathon investigation by the central agency.

Meanwhile, it is learnt that this is not the first time that Das had been arrested. In March 2019, he was arrested by the sleuths of Criminal Investigation Department (CID) of West Bengal police in a case of forgery following an FIR filed against him in East Midnapore district.

Preliminary investigation by the central agency have revealed that Das’s connection with the WBSSC was through the commission’s former chairman Subiresh Bhattacharya.

  • ‘Misuse of ED, CBI against Oppn’, SC to hear plea by 14 parties on April 5

‘Misuse of ED, CBI against Oppn’, SC to hear plea by 14 parties on April 5

    [ad_1]

New Delhi: Fourteen political parties, including the Congress, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), on Friday moved the Supreme Court against the alleged misuse of investigative agencies in arresting opposition leaders and sought guidelines on arrest.

The parties sought guidelines to fulfil and realise the guarantee of personal liberty entrenched in Article 21 of the Constitution, for all citizens, including those targeted for exercising their right to political dissent and for performing their duties as the political opposition.

The political parties forming the petitioners are: Congress, DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party, J&K National Conference, together representing 45.19 per cent of the votes cast in the last Assembly polls, and 42.5 per cent of the votes cast in the 2019 general elections, and holding power in 11 states/union territories.

Senior advocate A.M. Singhvi mentioned the matter before a bench headed by Chief Justice D.Y. Chandrachud for early hearing.

The top court agreed to hear the matter on April 5.

The counsel clarified that they are not attempting to affect the ongoing investigations.

The plea said that 14 opposition political parties have filed a petition, in light of the alarming rise in the use of coercive criminal processes against their leaders and other citizens exercising their fundamental right to dissent and disagree with the central government.

The plea submitted that investigating agencies such as CBI and ED are being increasingly deployed in a selective and targeted manner with a view to completely crush political dissent and upend the fundamental premises of a representative democracy.

The petition has been drawn and filed by advocate Shadan Farasat and settled by Singhvi.

According to the plea, only 23 convictions under the Prevention of Money Laundering Act, 2002 (PMLA) have been secured as of now, even as the number of cases registered by the ED under the PMLA have risen exponentially (from 209 in 2013-14 F.Y. to 981 in 2020-21, and 1,180 in 2021-22).

“Between 2004-14, of the 72 political leaders investigated by the CBI, 43 (under 60 per cent) were from the Opposition of the time. Now, this same figure has risen to over 95 per cent. The same pattern is reflected in ED’s investigations as well, with the proportion of Opposition leaders from the total number of politicians investigated rising from 54 per cent (before 2014) to 95 per cent (after 2014),” it further added.

The petitioners have sought from the apex court certain prospectively applicable guidelines governing the arrest, remand, and bail of persons in offences (which may or may not be punishable with imprisonment for above seven years) not involving serious bodily harm (thereby obviously excluding homicide, rape, terrorism etc.).

“As for arrest and remand, the petitioners seek that the triple test (whether a person is a flight risk, or whether there is a reasonable apprehension of the tampering of evidence or of the influencing/intimidation of witnesses) be used by police officers/ED officials and courts alike for arrest of persons in any cognizable offences except those involving serious bodily violence. Where these conditions are not satisfied, alternatives like interrogation at fixed hours or at most house arrest be used to meet the demands of investigation.

“As for bail, the petitioners seek that the principle of ‘bail as rule, jail as exception’ be followed by all courts throughout, especially in cases where non-violent offences are alleged, and that bail be denied only where the aforementioned triple-test is met,” the plea added.

It further contended that where special laws such as PMLA with stringent bail conditions are concerned, the petitioners seek that such bail provisions be harmonised with Article 21 of the Constitution.

“As such, therefore, where it appears that the trial is unlikely to complete within six months, the accused be released on bail even under special laws unless the conditions in the triple-test are not fulfilled.”
