    Telangana HC issues notice to QNet in Swapnalok Complex fire case

    Hyderabad: The Telangana High Court, on Monday issued notices to QNet Vihaan Direct Selling Private Limited in the fire accident case at the Swapnalok Complex in Secundrabad.

    A two-judge bench comprising Chief Justice Ujjal Bhuyan and Justice N Tukaramji was dealing with a suo moto PIL taken up based on a media report on the fire accident that claimed the life of 6 staff members of Qnet.

    Reports suggested that the lack of an emergency exit was found to be the major reason for the mishap while the management of the complex failed to install firefighting equipment in place after the first significant fire accident in 2011.

    Converting the report into PIL (Public Interest Litigation), the HC, on March 29 sought answers from the state and civic authorities as to why the fire safety norms were not followed.

    According to a preliminary investigation, a short circuit was said to be the reason behind the blaze.

    Following the mishap, GHMC officials seized the complex and set up a banner stating that the building was closed temporarily under safety measures.

    While awaiting the response from the authorities, the court adjourned the matter to June 26.

    Dubai: The Dubai Court of Cassation has rejected the appeal of British-Indian Sanjay Shah, who is wanted by Danish authorities on charges of money laundering and committing tax fraud to the tune of $1.7 billion.

    In doing so, it upheld the Dubai Court of Appeal’s ruling last year to grant Denmark’s request for his extradition.

    “Chancellor Essam Issa Al Humaidan, Attorney General of Dubai, announced that Dubai Court of Cassation has rejected the appeal of Sanjay Shah, a British national wanted by Danish authorities, and Sanjay Shah can be extradited to Denmark over fraud and money laundering charges,” the Dubai government’s media office announced on Twitter.

    Shah, 52, a hedge fund trader who lived on The Palm Jumeirah, was arrested by Dubai Police in June last year following Denmark’s extradition petition.

    His fraud scheme involved submitting thousands of applications to the Danish Treasury on behalf of investors and companies from several countries around the world in order to receive dividend tax refunds, according to Dubai Police.

    The Dubai Courts had initially rejected Denmark’s extradition request.

    Attorney General Chancellor Essam Issa Al Humaidan appealed the decision in accordance with the Law of International Judicial Cooperation, and the Dubai Court of Cassation has now upheld the decision to extradite the suspect to Denmark, according to a statement.

    Shah is accused of masterminding a scam, which ran for three years since 2012, has been described as one of the largest fraud cases in Denmark’s history.

    His fraud scheme involved submitting thousands of applications to the Danish Treasury on behalf of investors and companies from several countries around the world in order to receive dividend tax refunds, according to a Dubai Police statement.

    Hyderabad: Bahujan Samaj Party’s (BSP) Telangana President R.S. Praveen Kumar has written to President Droupadi Murmu, seeking her intervention to replace Chairman and members of Telangana State Public Service commission (TSPSC) which has been rocked by a question paper leak.

    Praveen Kumar, a retired Indian Police Service (IPS) officer, has also requested the her to order a probe by the Central Bureau of Investigation (CBI) into the question paper leak scandal.

    He argued that the Special Investigation Team (SIT) constituted by the state government is not at all competent to investigate such a serious scandal. Not much can be expected from the SIT which reports to the Chief Minister whose office itself is under the cloud of suspicion, he wrote.

    The press briefing by the Chief Minister’s son K.T. Rama Rao on behalf of the TSPSC and SIT is further adding strength to the suspicion that SIT is formed by the government only to save the actual perpetrators who are holding high offices from prosecution and punish only the small fry and give the case unceremonious burial, he alleged. This is precisely the reason why the BSP is requesting for an investigation by the Central Bureau of Investigation (CBI), which has a proven track record of successfully investigating such scandals in the country since independence, he added.

    He also wrote that the future of lakhs of job aspirants is at stake now with the ongoing scandalous paper leakage/selling of the prestigious Group-I, AEE, AE and 15 other examinations notified by the TSPSC in the last several years.

    “It’s a matter of shame on the part of the TSPSC which is constituted under Article 315 of the Constitution to indulge in such illegal and criminal activities with active collusion of the ruling party,” he said.

    The entire affairs of TSPSC exams ended up as a scandal of gigantic proportions, where most of the question papers with master answer keys were leaked to the insiders and their relatives working in the commission for several years. This spine-chilling episode has compromised the integrity of the selection process and caused immense harm to the aspirations of millions of job seekers, reads the letter.

    Stating that the TSPSC, which is the prime accused in this scandal, is going ahead with recruitment schedules at the behest of the government, he demanded that TSPSC Chairman and members be replaced with most competent and reputed persons.

    “An independent inquiry by the CBI is not only crucial but also urgent, because there is very chance that critical evidence that can nail prime accused may either be destroyed or the lives of suspects who have been arrested so far will be endangered as they hold the crucial secrets of the unholy nexus among the ruling party, the CMO and the commission,” Praveen Kumar claimed.

    He demanded that all recent TSPSC examinations be reconducted, all upcoming ones be postponed until the Commission is completely overhauled, the recruitment process is thoroughly insulated from extraneous influences and all guilty are made to feel the full weight of law.

    He also demanded that the entire functioning of the TSPSC may thoroughly be probed into by a sitting Supreme Court judge to avoid such serious embarrassment in future.

    Hyderabad: The Special Investigation Team (SIT) probing the question paper leak at Telangana State Public Service Commission (TSPSC) on Monday examined TSPS Chairman Janardhan Reddy.

    SIT officials questioned him for about three hours and recorded his statement. They reportedly gathered information from him as to how the accused managed to access the login ID and password of the confidential section to steal question papers and leak them.

    The Chairman was also reportedly asked about the functions and responsibilities of various employees in the commission. The SIT officials gathered information about the process of preparing the question papers, steps taken for their security, the procedure of conducting the exams and related matters.

    The SIT had on Saturday questioned TSPSC Secretary Anita Ramchandran and member B. Linga Reddy. Main accused Praveen Kumar and co-accused Ramesh were personal assistants to Anita Ramchandran and Linga Reddy, respectively.

    Meanwhile, a Nampally court has sent three of the accused in the case to the custody of SIT. The court heard a petition by the SIT for custody of Prashanth, Rajender and Tirupataiah and sent them to police custody for three days. The SIT officials will question the three accused from Tuesday.

    The SIT has so far arrested 15 persons in the case apart from questioning scores of candidates who scored more than 100 marks in the Group I preliminary exam.

    A 32-year-old Ph.D. student of the Indian Institute of Technology (IIT), Madras, was found dead in his room in Velachery area, Chennai, police said on Sunday.

    The deceased student identified as Sachin was a resident of West Bengal who allegedly died by suicide.

    On March 31, Sachin posted a cryptic WhatsApp status that read: “I am sorry, not good enough”. Seeing the status, his friends rushed to his home where Sachin’s body was found hanging in his room.

    Following this, the deceased was rushed to the hospital but declared dead by doctors. “The dead body was taken into custody and sent to Royapet Government Hospital for autopsy. Further investigation is underway,” police said.

    This is the third incident of suicide reported from IIT Madras this year while 11th case since 2018.

    Kota: Newly appointed Rajasthan BJP chief C P Joshi on Monday attacked Chief Minister Ashok Gehlot, alleging that the failure of his government to put up a strong legal team led to the acquittal of the accused in the 2008 Jaipur serial blasts case.

    Joshi asked what was the reason and under “whose pressure he did not deploy even a single legal counsel” in the case.

    On Wednesday, the Rajasthan High Court acquitted four accused who were convicted by a special court in 2019 for the serial blasts on May 13, 2008 in Jaipur that left 71 people dead and 185 injured.

    Later, Chief Minister Gehlot had said the government would file a Special Leave Petition (SLP) in this matter in the Supreme Court.

    Joshi said the terrorists had at least 18 lawyers defending them “meanwhile, his AAG was not present there? Whose pressure was it”.

    “When he had to save his government”, Gehlot deployed top lawyers, said Joshi who was on his maiden visit to Kota, a saffron bastion in Hadouti region, after assuming charge as the state BJP chief.

    “Who were those he (CM Ashok Gehlot) wanted to please by not calling any counsel in the serial blasts case,” Joshi said.

    Replying to queries, the BJP leader said Gehlot had been speaking against the Rashtriya Swamsevak Sangh (RSS) to save his government and to please his party leaders in Delhi.

    “Ashok Gehlot called doctors, who are revered by all, ‘gaddar’ (traitors). However, he had even called his own party colleague Sachin Pilot a ‘gaddar’,” Joshi said.

    Gehlot also “supported demand for Khalistan”, he alleged.

    During his recent visit to Kota, Gehot had alleged that 4-5 doctors who had links with RSS were behind the doctors’ stir against the Right To Heath Bill and had called them traitors.

    Joshi was given a rousing welcome at several places by party workers. There was some commotion as three workers slipped from a crowded stage at the Kunhari petrol pump in the city but no major injury was reported.

    Referring to Congress-in-charge Sukhjinder Singh Randhawa’s remark, Joshi said, “Those who gave a call to kill(Prime Minister) Modi have died and crores of people of the country are standing with him (Modi) as his strength.’

    Joshi also refuted claims of factional fighting in the state BJP.

    “Entire Rajasthan and country are now a bastion of the BJP and the lotus is blooming in almost every state,” he said.

    At a meeting in Kota, Joshi called upon the party workers to keep up their enthusiasm till the state election later this year to dislodge the Congress government.

    The people of the state would not forgive the state government that restricted several religious processions, Joshi said.

    Meanwhile, former BJP state president Arun Chaturvedi said the state government should stop the pretense of providing justice to the victims and instead file a strong appeal in the Supreme Court in the Jaipur blasts case.

    The government is doing politics of appeasement, he alleged.

    Thiruvananthapuram: After facing flak on the decision by its two-member bench to refer the verdict in a case of alleged misuse of Chief Minister’s Distress Relief Fund (CMDRF) by Chief Minister Pinarayi Vijayan to a larger bench, there were indications on Monday that the full bench (three members) of the Kerala Lok Ayukta will start proceedings from April 12.

    The Congress and the BJP on Friday questioned the credibility of the Kerala Lokayukta, which referred the case to a larger bench.

    It was after an year that the two-member bench of the Lokayukta, that had completed all its hearings in the case, gave its verdict on last Friday and this long delay came under fire.

    It was also noted that had the petitioner not approached the Kerala High Court seeking its intervention, maybe the verdict could have been even more delayed.

    Now all eyes are on April 12 and according to sources in the know of things, the full bench is likely to hear the case from the start and will also look into the issue if the Lokayukta is competent enough to take up the case involving a decision of the state cabinet.

    Leader of Opposition V.D. Satheesan has already pointed out that the decision to refer to the full bench is nothing but questioning the credibility of the Lokayukta institution as the Lokayukta in 2019 had made it clear that the petition is valid and now again it is going to be sent to a full bench. “It is strange,” he said.

    Public activist R.S. Sasikumar had filed the case in 2018, alleging misuse of the funds in the CMDRF.

    He had alleged that the money was given to those who were not eligible for the relief, including the family of a deceased CPI-M legislator, the family of a top leader from a Left ally who passed away, and also to a Kerala Police officer who died when his vehicle met with an accident while accompanying then top CPI-M leader Kodiyeri Balakrishnan.

    The plea to the anti-corruption ombudsman was filed by Sasikumar in September 2018 and the hearing ended on March 18, 2022. Since then till last Friday, the verdict was kept pending.

    All this comes at a time when Governor Arif Mohammed Khan continues to sit on the Bill that tweaked the powers of the Kerala Lokayukta.

    “As the media capital of the world — and the venue for the arraignment of Donald Trump — we must change this outdated law to allow the public to witness trials,” said Sen. Brad Hoylman-Sigal, a Manhattan Democrat who sponsors a bill to change the law.

    Alina Habba, an attorney who has represented Trump in the past, said on CNN Monday morning that she’s not strictly opposed to having cameras in the courtroom.

    “I think it depends. I think this whole rigmarole, for lack of better words has been through leaks, which I don’t appreciate as an attorney,” Habba said.

    “I think that transparency is very important. I’m going to leave that decision to the criminal team. But as somebody who has represented the president in court, I like transparency. I think that in certain situations, it’s a good thing,” she said.

    While New York has banned cameras in the courts for a century, New York experimented with a change from 1987 and 1997. But while the limited allowance of electronic media coverage was applauded, it was not turned into a permanent law by the state Legislature.

    The law is not unlike federal courts that prohibit video coverage of trials, and even the U.S. Supreme Court limits its oral arguments to an audio livestream.

    Still, New York judges have some discretion to allow cameras in the courtroom. The law does not prohibit coverage of trial court proceedings when witness testimony is not being taken — so a judge could rule to allow for videos and photos for parts of Trump’s case.

    Attempts to allow for broader trial coverage in New York have been rebuked. In 2005, Court TV took a case to the state’s highest court, the Court of Appeals, to broadcast trials, but section 52 of the state’s civil rights law was upheld, and the case was kicked back to the Legislature for a law change — which hasn’t happened, the Fund for Modern Court’s review noted.

    “Public access is the bedrock of our justice system — but its promise is hollow if constrained by geographic proximity, workday availability and space constraints. Without cameras, the vast majority of the public is effectively denied access,” Dan Novack, chair of New York State Bar Association’s committee on media law, said in a statement.

    Hoylman-Sigal said he is hopeful his bill, which doesn’t have a sponsor yet in the state Assembly, could be adopted as part of the state budget that is being negotiated for the fiscal year that started Saturday. The bill would give judges discretion over what could be filmed, limiting the number of video cameras and still photographers.

    Rep. Jerry Nadler, a Manhattan Democrat, said he has been trying to push for legislation in Washington to allow cameras in federal courts. Doing so in New York would be a step forward, he said.

    “Transparency is essential to our democracy. Without televised access, the courts are effectively out of reach to most of the public. That is why I have long sponsored legislation to require cameras in the federal courts,” Nadler said in a statement. “I hope that New York will follow the lead of other states and ensure that the public is able to witness important judicial proceedings in real time.”
