    Delhi HC to hear Monday Sharjeel Imam’s bail plea in sedition case

    New Delhi: The Delhi High Court will on Monday hear a plea by JNU student Sharjeel Imam seeking bail in connection with a 2020 riots case involving allegations of sedition.

    The case, which assails a January 24, 2022 order by the trial court dismissing Imam’s bail application in the matter, is listed for hearing before a bench of Justices Siddharth Mridul and Talwant Singh.

    On January 30, the court had sought to know the stand of the city police as to whether Imam’s plea for bail could be remanded back to the trial court for adjudication as there was no ground mentioned in the lower court’s order rejecting the relief.

    The bench had said since section 124A (sedition) of the Indian Penal Code has been kept in abeyance following the directions of the Supreme Court, it will have to examine the trial court’s bail rejection order while keeping in mind the other sections framed against Imam.

    Last year, the trial court had framed charges against Imam under sections 124A (sedition), 153A (promoting enmity), l53B (imputations prejudicial to national integration), 505 (statements conducing to public mischief) of the IPC and section 13 (punishment for unlawful activities) of the Unlawful Activities Prevention Act.

    As per the prosecution, Imam had allegedly made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019, where he allegedly threatened to cut off Assam and the rest of the northeast from India.

    In his petition before the high court, Imam has said the trial court “failed to recognise” that pursuant to the directions of the top court, the basis for dismissal of his earlier bail plea, i.e. the charge of sedition no longer existed and therefore relief must be granted to him.

    On May 11, 2022, the Supreme Court had stayed till further orders the registration of FIRs, probes, and coercive measures for the offence of sedition across the country by the Centre and the states until an appropriate forum of the government re-examines the colonial-era penal law.

    Srinagar, Apr 08: A local court on Saturday sentenced a man to two years imprisonment in a cheque ‌bounce case and imposed a penalty of Rs 10 lakh on him.

    The Court of Special Magistrate (PT&E) sentenced the accused, who was identified as Altaf Hussain Rather, to two years simple imprisonment after finding him guilty for the commission of offense under section 138 of the Negotiable Instrument Act.

    “A fine of Rs 1000000 (Rupees ten lacs) which is double the cheque amount is also imposed upon the accused. The fine of Rs 1000000(Rupees ten lacs) so imposed shall be paid as compensation to the complainant,” the judge Fariqa Nazir said, in an order, a copy of which is in possession of news agency—Kashmir News Observer (KNO)—(KNO)

    Sultanpur: An MP-MLA court here on Friday acquitted former Uttar Pradesh minister Gayatri Prasad Prajapati in a case related to the violation of the election model code of conduct due to lack of evidence.

    During the hearing, Prajapati’s wife and Amethi MLA Maharaji Devi and many of her supporters were present.

    Prajapati was brought from Lucknow jail and produced before the court amid tight security.

    The case related to the Amethi Kotwali area where during the 2012 assembly elections, police sub-inspector Amarendra Nath Bajpai had filed a case against Prajapati, then a Samajwadi Party candidate, on January 28 accusing him of violating the rules by taking out a procession during nomination with his supporters.

    The trial of the case was going on in the court of Special Magistrate MP-MLA Yogesh Yadav, where the defence counsel argued that the former minister was implicated only due to political enmity.

    Prajapati’s counsel Santosh Kumar Pandey said after hearing both sides, the court acquitted the former minister due to lack of evidence.

    Prajapati is serving a life sentence in a separate case in Lucknow jail.

    Lucknow: A special court here on Friday framed charges against gangster-turned-politician Atiq Ahmad, his son Umar Ahmad and 15 others in connection with the kidnapping of businessman Mohit Jaiswal in 2018.

    Special court judge Ajai Vikram Singh directed the prosecuting agency CBI to produce its witnesses before it on April 17.

    Atiq was produced in the court through video conferencing. The remaining accused were present in the court.

    According to the prosecution, the FIR in the matter was registered at Krishna Nagar police station on December 28, 2018 based on a complaint filed by businessman Jaiswal.

    It was alleged that Atiq Ahmad, while in jail, got him kidnapped through his associates from his office at Gomtinagar. Later, he was taken to Deoria jail where Atiq Ahmad got him assaulted, obtained his signature on a blank paper and then grabbed his property worth Rs 45 crore.

    Following the Supreme Court’s directions, the Central Bureau of Investigation (CBI) took up the investigation in the case on June 12, 2019.

    In the course of its investigation, the CBI had filed four separate charge sheets.

    Recently, an MP-MLA court of Prayagraj had held gangster-turned-politician Atiq Ahmad and two others guilty in the 2006 Umesh Pal kidnapping case and sentenced them to rigorous imprisonment for life.

    This was the first conviction of Ahmad who faces more than 100 cases. A former Samajwadi Party (SP) MP, Ahmad is currently lodged in Sabarmati jail in Gujarat.

    Kozhikode: Kerala train arson accused Shahrukh Saifi was on Friday remanded to 14-day judicial custody.

    The order was issued by Kozhikode Judicial First Class Magistrate, who reached the Kozhikode Government Medical College Hospital, where the accused, Saifi, was undergoing treatment on Friday morning, to complete the process of remand.

    “City Police Commissioner Rajpal Meena and Munsiff Magistrate arrived at the hospital and the accused has been awarded 14 days of judicial custody,” officials said.

    Saifi was brought to Kozhikode Medical College for medical examination on Thursday morning and was admitted there.

    According to officials, taking into account the health problems of the accused, the magistrate court transferred the proceedings to the hospital.

    Judicial First Class Magistrate Manish physically came to the Medical College for proceedings. After speaking to the accused at the Medical College, Magistrate proceeded to remand him.

    They said that the accused will continue to remain in medical treatment at Kozhikode Govt Medical College Hospital.

    “A decision on whether to send the accused to police custody will be taken after the fitness of the accused is re-examined. If the court refuses to send the accused in custody, the detailed questioning of the accused will be delayed,” they said.

    Sharukh Saifi was detained in Maharashtra’s Ratnagiri on Tuesday night by the Anti-Terrorism Squad of Maharashtra police with the help of the National Investigation Agency(NIA).

    On Tuesday, he was handed over to Kerala police.

    The arrest was made based on a sketch released by the kerala police on information provided by an eyewitness.

    The Maharashtra police had said he confessed to the crime. Saifi is a resident of the Shaheen Bagh in Delhi’s Jamia Nagar.

    A team from Kerala police visited Saifi’s residence. Kerala police formed a special investigation team to probe the incident.

    The attack happened on a moving Alappuzha Kannur executive express on Sunday night.

    Three people were killed in the attack including an infant and a woman and around 10 were injured.

    The investigations so far indicated that Saifi was radicalised online. Handwritten notes were also found in which he allegedly said, “Let’s do it”.
