    New Delhi: The Centre and the Gujarat government on Tuesday told the Supreme Court that they may file a plea seeking a review of its March 27 order asking them to be ready with original files on the grant of remission to the convicts in the Bilkis Bano case.

    A bench of Justices K M Joseph and B V Nagarathna questioned the paroles granted to 11 convicts during their incarceration period and said the gravity of the offence could have been considered by the state.

    It said, “A pregnant woman was gang-raped and several people were killed. You cannot compare victim’s case with standard section 302 (murder) cases. Like you cannot compare apples with oranges, similarly massacre cannot be compared with single murder. Crimes are generally committed against society and the community. Unequals cannot be treated equally.”

    “The question is whether government applied its mind and what material formed the basis of its decision to grant remission,” the bench said, adding, “Today it is Bilkis but tomorrow it can be anyone. It may be you or me. If you do not show your reasons for grant of remission, then we will draw our own conclusions.”

    The bench posted the batch of pleas challenging the remission to the convicts in Bilkis Bano case for final disposal on May 2 and asked all the convicts who have not been served notices to file their replies.

    It asked the Centre and the state to make its stand clear about filing of a review plea.

    On March 27, terming Bilkis Bano’s gang-rape and the murder of her family members during the 2002 Godhra riots as a “horrendous” act, the Supreme Court had asked the Gujarat government whether uniform standards, as followed in other cases of murder, were applied while granting remission to the 11 convicts in the case.

    It had sought a response from the Centre, Gujarat government and others on a plea filed by Bilkis Bano, who was gang-raped and seven members of her family were killed during the 2002 post-Godhra riots.

    Bano has challenged the remission of sentence of 11 convicts in the case.

    All 11 convicts were granted remission by the Gujarat government and released on August 15 last year.

    The top court seized of PILs filed by CPI(M) leader Subhashini Ali, Revati Laul, an independent journalist, Roop Rekha Verma, who is a former vice chancellor of the Lucknow University, and TMC MP Mahua Moitra against the release of the convicts.

    Bano was 21 years old and five months pregnant when she was gang-raped while fleeing the riots that broke out after the Godhra train burning incident. Her three-year-old daughter was among the seven family members killed.

    Hyderabad: The Central Bureau of Investigation (CBI) postponed questioning of Kadapa MP Y.S. Avinash Reddy in Y.S. Vivekananda Reddy murder case to Tuesday evening as his petition for anticipatory bail was being heard by the Telangana High Court.

    The CBI, which had directed Avinash Reddy to appear before the CBI regional office at 10.30 a.m., postponed the hearing on the suggestion of the High Court.

    The agency had earlier deferred the MP’s questioning on Monday in view of the hearing.

    The High Court was hearing the arguments of counsels of Avinash Reddy, CBI and Vivekananda Reddy’s daughter Suneetha Reddy, who has impleaded in the case.

    Avinash Reddy’s counsel pleaded to the court to direct the CBI not to arrest him. The agency submitted to the court that if necessary they will arrest Avinash Reddy.

    The CBI counsel told the court that they suspect Avinash Reddy’s involvement in the murder conspiracy. The central agency believes that he played a key role in causing disappearance of evidence from the scene of the crime.

    Suneetha Reddy has also filed an impleading petition in the High Court. She prayed to the court to hear her arguments before pronouncing its judgment.

    The MP fears arrest in the case as his father Y.S. Bhaskar Reddy was arrested in the case on Sunday. In its petition seeking custody of Bhaskar Reddy, the CBI had named Avinash Reddy as co-accused.

    Bhaskar Reddy, who was arrested in Pulivendula on Sunday, was brought to Hyderabad and produced before a magistrate, who remanded him to judicial custody for 14 days.

    The agency has alleged that Bhaskar Reddy along with co-accused D. Siva Shankar Reddy, Gangi Reddy, G. Uday Kumar Reddy and Avinash Reddy played key roles in causing disappearance of evidence from the scene of murder. For the first time, the CBI has named Avinash Reddy as accused in the case.

    Avinash Reddy, cousin of Andhra Pradesh Chief Minister Y.S. Jagan Mohan Reddy, has been questioned by the CBI four times during the last couple of months. However, his statements were recorded as a witness.

    Following his father’s arrest on Sunday, Avinash Reddy alleged that the CBI ignored some key facts in the case and was treating them as the accused.

    Vivekananda Reddy, brother of former Chief Minister Y.S. Rajasekhara Reddy and uncle of present Chief Minister Y.S. Jagan Mohan Reddy, was found murdered at his residence in Pulivendula of Kadapa district on the night of March 15, 2019, a few days before the elections.

    The 68-year-old former state minister and former MP was alone at his house when unidentified persons barged in and killed him.

    The CBI took over the investigation into the case in 2020 on the direction of Andhra Pradesh High Court while hearing a petition of Vivekananda Reddy’s daughter Suneetha Reddy, who raised suspicion about some relatives.

    The Supreme Court transferred the case to Hyderabad in November last year while observing that doubts raised by Suneetha Reddy about getting a fair trial and investigation in Andhra Pradesh were reasonable.

    Hyderabad: The Central Bureau of Investigation (CBI) has deferred, to Tuesday, the questioning of Kadapa MP Y.S. Avinash Reddy in the Y. S. Vivekananda Reddy murder case.

    When Avinash Reddy reached the CBI regional office in Hyderabad in response to the notice served on him on Sunday, he was informed that the questioning had been postponed to Tuesday.

    The CBI has sent a fresh notice to him asking him to appear for questioning at 10.30 a.m. on Tuesday.

    The central agency is believed to have postponed the questioning on the advice of the Telangana High Court, which was hearing the anticipatory bail petition of the MP.

    Avinash Reddy was directed to appear before CBI officials at 3 p.m. and he had reached Hyderabad from his native Pulivendula in Kadapa district of Andhra Pradesh.

    The MP had also filed a petition in the Telangana High Court for anticipatory bail. The court wanted the CBI to postpone the questioning in view of the hearing.

    Meanwhile, Vivekananda Reddy’s daughter Suneetha Reddy has also filed an impleadment petition in the High Court. She prayed to the court to hear her arguments before pronouncing its judgment.

    New Delhi: The Vishva Hindu Parishad (VHP) on Monday said none of the three accused arrested by the Uttar Pradesh Police for killing gangster-politician Atiq Ahmad and his brother Ashraf has any link with it or its youth wing, Bajrang Dal.

    Dismissing allegations regarding the Bajrang Dal’s involvement in the killing of Ahmad, a former Samajwadi Party (SP) MP, and Ashraf, VHP working president Alok Kumar said his organisation and the Bajrang Dal work “under the framework of laws and the Constitution”.

    “We have enquired properly. None of the three accused has any connection with the Vishva Hindu Parishad or the Bajrang Dal. What is being spread is false,” Kumar said when asked about the allegations.

    “Taking law in our own hands has never been our thought. We are confident that the truth will come out during the investigation,” he added.

    Ahmad (60) and Ashraf were shot dead at almost point-blank range by three men posing as journalists on Saturday night while police personnel were escorting them to a medical college in Uttar Pradesh’s Prayagraj for a checkup.

    “This is not a press conference,” Davis said during Monday’s brief hearing. “I don’t do that.”

    A trial would force Fox to answer for its actions in the weeks after the 2020 presidential election and litigate denial about the outcome of the race in general. The case centers on whether Fox defamed Denver-based Dominion Voting Systems by spreading false claims that the company rigged the election against then-President Donald Trump.

    A settlement is certainly a possibility in a trial that carries risks for both sides. Fox already has been embarrassed by revelations that some of its executives and on-air personalities did not believe fraud claims that the network spread on the air, and it doesn’t want to see 92-year-old founder Rupert Murdoch testify. Dominion could miss a big payday if a jury rules against it.

    Not everyone wants the case to go away quietly, however.

    “PLEASE Dominion — Do not settle with Fox! You’re about to prove something very big,” tweeted Gretchen Carlson, the former Fox anchor whose accusations of sexual misconduct by former Fox chief Roger Ailes led to his downfall in 2016.

    Fox, meanwhile, paid for a full-page advertisement in The New York Times on Monday headlined “Trusted Now. More Than Ever.”

    Dozens of journalists gathered at the courthouse in downtown Wilmington, some before dawn, for a hearing that lasted about five minutes. The courtyard in front of the court building was full of TV crews ready to do live shots.

    Besides its implications for Fox, the case is being watched carefully by journalists for what it could mean for libel law. Defamation is generally hard to prove, since it requires a finding that journalists published information they knew to be false, or with a reckless disregard for the truth.

    Some First Amendment lawyers say Dominion’s lawsuit presents a powerful case, given the doubt expressed within Fox about the fraud allegations. Fox says Dominion can’t prove that the people with such doubts were in position to affect what was said on the air about the company.

    Even before a jury hears the case, Davis has made some rulings in Dominion’s favor, including stating that the allegations of election fraud made against the company were clearly false. That means the issue will not have to be litigated in the trial.

    New Delhi: The Enforcement Directorate (ED) has summoned Jharkhand IAS officer Chhavi Ranjan for questioning later this week in connection with a money laundering investigation linked to alleged illegal land sale, official sources said Monday.

    The 2011-batch officer has been asked to depose on April 21 at the federal agency’s office in state capital Ranchi. He was questioned briefly by the agency last week when searches were carried out in this case at his premises and those of some others in Jharkhand, Bihar and West Bengal.

    An assistant registrar of assurances of West Bengal government based in Kolkata has also been asked to depose on May 2, the sources said.

    The agency had arrested a total of seven people, including a Jharkhand government officer, after these raids. The searches in this case were launched on April 14.

    The action was taken under the provisions of the Prevention of Money Laundering Act (PMLA) and the agency is looking at more than a dozen land deals, including one pertaining to defence land, wherein a group including land mafia, middlemen and bureaucrats allegedly “connived” in forging land deeds and documents from as early as 1932.

    Lands of the poor and the downtrodden were “usurped” as part of this fraud, ED sources had said. To launch its investigation under the PMLA, the federal agency took cognisance of a police FIR of forgery of some personal identification documents registered by the civic authorities concerned.

    The agency, according to the sources, has recovered a number of fake seals, land deeds and registry documents during the searches.

    This is the second case in which a Jharkhand-cadre IAS officer has come under the scanner of the ED. Last year, the ED had raided and arrested IAS officer Pooja Singhal in a money laundering case.

    Bengaluru: Mining baron-turned-politician Janardhana Reddy, who is all set to contest Karnataka Assembly elections by launching a new party, on Monday suffered a setback as a special court has ordered filing of criminal case against him.

    The Special Court for People’s Representatives here has given this order in connection with the illegal selling of iron ore. Investigation Officer Manjunath Annigeri had submitted a private complaint in this regard.

    The court after looking into the complaint ordered filing of the criminal case against 16 persons including Janardhana Reddy and Congress MLA B. Nagendra.

    The court has given direction to lodge a case under the Mines and Mineral (Development and Regulation) Act, 1957, citing Sections 21, 23, 4(1), 41(A) of the act and adjourned the matter to June 24.

    The complaint is regarding the sale of iron ore which caused loss of Rs 211 crores for the state exchequer between 2008 and 2011. The accused came together to avoid payment of royalty, and cess to the state government.

    Presently, Janardhana Reddy has launched a new party in Karnataka to fight the May 10 Assembly elections, and claimed that without his support, the national parties can not form the government.

    With the Central Bureau of Investigation (CBI) arresting Y.S. Bhaskar Reddy in the four-year-old murder case and summoning his son and Kadapa MP, Y.S. Avinash Reddy, for questioning on Monday, Jagan Mohan Reddy called a meeting to discuss the situation and its likely fallout on the family and the party.

    Vivekananda Reddy, paternal uncle of Jagan Mohan Reddy, was murdered at his residence in Pulivendula of Kadapa district on March 15, 2019, a few days before Assembly and Lok Sabha elections.

    The former minister and MP was the younger brother of former chief minister Y.S. Rajasekhara Reddy, father of Jagan Mohan Reddy.

    The CBI has alleged that Y.S. Bhaskar Reddy and his son Avinash Reddy had hatched a conspiracy to kill Vivekananda Reddy as the latter was not in favour of YSRCP fielding Avinash Reddy as the party candidate for Kadapa Lok Sabha seat.

    Bhaskar Reddy is a cousin of Vivekananda Reddy. He is also the maternal uncle of Y.S. Bharati, wife of Jagan Mohan Reddy.

    SRINAGAR: Kiran Patel, a fraudster who was apprehended by the Jammu & Kashmir police in March of this year for purportedly presenting himself as an employee of the Prime Minister’s Office, has now been taken into custody by the Ahmedabad City Detection of Crime Branch (DCB) for an additional incident of impersonation, deception, and violation of trust. This marks Kiran’s fifth criminal case in Gujarat.

    Following a complaint by Hardik Chandarana (37), the proprietor of RX Events, an event management company located in Ahmedabad’s Ambawadi area, DCB personnel apprehended Kiran after registering an FIR on Saturday, Reported The Indian Express.

    The Indian Express reported that Kiran Patel is accused of deceiving Hardik Chandarana, the proprietor of RX Events, by requesting him to arrange a “G20 event” at a luxurious hotel in Ahmedabad city in January and making off with Rs 3.51 lakh. Chandarana claimed in the FIR that Patel contacted him in January 2023 and requested him to arrange an event. Patel then came to Chandarana’s office in Ambawadi on January 10, discussed the event, shared the guest list via WhatsApp while sitting there, and settled on the Hyatt Hotel on Ashram Road as the location.

    Patel claimed to work at the Prime Minister’s Office and was assigned to the “Kashmir development project.” Chandarana claims that Patel also promised to provide him with work on a large medical conference in Kashmir.

    “Patel sent me his visiting card to gain my confidence,” said Chandarana, who claimed that the card identified Patel as “additional director (strategy and campaigns)” in the PMO and listed his address as “34, Meena Baug Flats, opposite Vigyan Bhavan, off Janpath road, New Delhi, 110001.” Chandarana stated in the complaint that he made arrangements for the “G20 Summit – Scope and Priorities for Various Industries” event, and received event banners and a guest list with photographs from Patel. Patel also added Chandarana to a WhatsApp group called “29th Event @ Hyatt.”

    The event reportedly took place on January 29, and Chandarana claims to have paid Rs 1.91 lakh for it. The FIR alleges that Patel informed Chandarana that they would need to go to Srinagar from February 8 to 10 to prepare for a medical conference. “So, I booked air tickets and made a booking at the Lalit hotel in Srinagar, and stayed there, the cost of which was around Rs 1.60 lakh. He also showed me the venue for the conference, on February 10, which was to be held in the near future,” Chandarana said in the FIR. Patel is accused of cheating Chandarana out of Rs 3.51 lakh in total.

    Following his extradition from Jammu & Kashmir, Patel was brought to Gujarat by state police on April 8 and arrested in connection with a case of cheating and breach of trust filed by Jagdish Chavda, the brother of former BJP minister Jawahar Chavda. Patel’s wife, Malini, is also a co-accused in the case, which alleges that the couple swindled Chavda of Rs 15 crore under the guise of renovating his residential property in the Shilaj area of Ahmedabad in 2022. Malini was taken into custody on March 29, and after a six-day remand by a local court in Ahmedabad, she was sent to judicial custody.

    According to Deputy Commissioner of Police, DCB, Chaitanya Mandalik, Patel remained in police custody until Saturday in connection with the Chavda case. He was then arrested in the latest case registered by Chandarana, and a magisterial court has granted four days of police remand for him, Mandalik added.

    Kozhikode: Kerala police has decided to invoke provisions of the stringent Unlawful Activities (Prevention) Act against the main accused in the train arson incident that resulted in the loss of three lives.

    A senior police official, who is a part of the special investigation team (SIT), told PTI on Sunday that UAPA provisions will be slapped on the accused in the matter and further details will be revealed in the coming days.

    The investigating team, which has been granted custody of Shahrukh Saifi, had on April 12 taken him to Kannur for collecting evidence from the two train coaches of the Alappuzha-Kannur Executive Express train in which he had set fire to some passengers leading to the death of three persons, including a two-year old child.

    Saifi’s police custody is set to expire on April 18.
    A Kozhikode First Class Judicial Magistrate had granted 11-day custody of Saifi to police after he was discharged from hospital upon undergoing treatment for the injuries he suffered during an attempt to escape from the moving train.

    Saifi has also confessed to the crime committed by him, according to the police.
    On the night of April 2, Saifi had set his co-passengers on fire onboard the Alappuzha-Kannur Executive Express train when it reached Korapuzha bridge near Elathur in Kozhikode.

    Nine people had suffered burn injuries in the incident while three, including a toddler, were found dead on the tracks. Police suspect that they fell while trying to escape from the fire.
