Secret Pence ruling breaks new ground for vice presidency

    [ad_1]

    ap23080841851602

The vice president’s role as Senate president has become almost entirely ceremonial, with the occasional exception of casting tie-breaking votes and — every four years — presiding over the count of electoral votes after a presidential election. Vice presidents have long suggested they should enjoy the legal protections afforded to Congress, but Boasberg’s ruling is the first time a court has extended so-called speech-or-debate immunity to the vice presidency.

Experts say the ruling — which remains under seal but was described to POLITICO by a person familiar with its contours — is an important foray into thorny, unresolved questions about vice presidential power.

“Any such movement is significant, as it sets a precedent that potentially can expand at a later time, in a different circumstance,” said Mark Rozell, a George Mason University political scientist who specializes in executive power. “The vice president is now acknowledged to possess a form of privilege by virtue of his or her legislative role, something that a president cannot claim.”

The ruling is the latest example of how Trump’s multi-year stress test on the norms and mechanics of the federal government has forced courts to answer long-dormant questions about the separation of powers.

The immunity question arose from special counsel Jack Smith’s bid to force Pence to testify before a Washington D.C. grand jury investigating the Jan. 6, 2021, attack on the Capitol. Trump opposed the subpoena on executive-privilege grounds, a position Boasberg rejected.

Pence did not join Trump’s fight but mounted his own, claiming that his role presiding over Congress on Jan. 6 should afford him speech-or-debate immunity.

Boasberg, the chief judge of the federal district court in Washington, agreed with Pence, at least to a limited extent: Pence must testify, he ruled, but the speech-or-debate immunity may allow him to avoid answering questions about his legislative role on Jan. 6.

Pence praised the ruling on Wednesday, even as he is considering whether to appeal it for not going far enough.

”For the first time ever, a federal court has recognized that these protections extend to a vice president,” Pence told supporters in Iowa, acknowledging the sealed ruling but saying he was “limited” in how much he could say about it. “I am pleased that the judge recognized the Constitution’s speech and debate protection applies to my work as vice president.”

The drafters of the Constitution included the speech-or-debate clause to guard against executive-branch efforts to coerce lawmakers with the threat of investigation or compelled testimony. But until this week, a court had never decided whether vice presidents — who are not members of the Senate but are officers like the parliamentarian — are covered by the protection.

The Supreme Court has said that immunity under the speech-or-debate clause covers “legislative” activities, such as voting on bills and giving speeches on the floor of Congress. For decades, the courts — particularly in Washington D.C. — have interpreted the clause to cover a broad range of activities connected to those duties, including the actions of congressional aides and officers who help facilitate the work of lawmakers.

The immunity, however, does not extend to purely “political” activities. So while Boasberg’s ruling may allow Pence to avoid testifying about his presiding role on Jan. 6, he might still have to testify about conversations he had with Trump leading up to that day, and he has indicated he is willing to do so.

Before Jan. 6, Trump pressed Pence to use his perch as president of the Senate to refuse to count Joe Biden’s electoral votes, either declaring Trump the victor or sending the election back to the states — an action Pence viewed as unconstitutional and refused to abide. He later returned to the chamber to complete the count of electors, all but sealing the Biden presidency. Trump famously attacked Pence on Twitter amid the chaos at the Capitol, an escalation that Jan. 6 committee investigators cited as a dangerous turning point in the day’s violence.

Two of Pence’s top White House aides — chief of staff Marc Short and counsel Greg Jacob — testified to the grand jury in October after then-Chief District Court Judge Beryl Howell rejected Trump’s similar bid to block their testimony via executive privilege.

Although Boasberg’s precise reasoning remains a mystery because of the secrecy surrounding the grand jury proceedings, legal experts called it a precedent-setting decision that could reshape the understanding of the vice presidency.

“Without seeing the opinion, hard to say much about it beyond the fact that it is clearly in my view correct that the VP enjoys speech-or-debate clause immunity when acting in her capacity as president of the Senate,” said Josh Chafetz, a Georgetown University constitutional law professor. “It’s also the case that the courts have consistently taken far too narrow a view, in my judgment, of what activities by members are protected under the clause, so I suspect that Boasberg ruled that Pence has to testify about some stuff that I would think ought to be privileged.”

Stan Brand, who helmed the House counsel’s office for Tip O’Neill and today represents top Trump aide Dan Scavino, said applying the speech-or-debate clause to a vice president for the first time is “a victory for the independence of Congress against an overreaching DOJ.”

The Justice Department has at least three times argued that vice presidents should enjoy speech-or-debate protection for their role presiding over the Senate — including in the context of Jan. 6, 2021, when the department adopted the position to fend off a lawsuit from then-Rep. Louie Gohmert and a separate Utah-based lawsuit filed in 2021.

The precise contours of the department’s position in the secret proceedings with Boasberg were not immediately clear.

The Pence immunity decision underscores the extraordinary volume of precedent-setting rulings that are being issued in secret — the result of the typical confidentiality afforded to the grand jury process in criminal investigations. Howell, whose seven-year term as chief judge expired on March 17, issued dozens of secret rulings in Trump-related matters that may have sweeping implications for the separation of powers.

Brand noted that some of the most significant rulings that have shaped the boundaries of the presidency, vice presidency and Congress have emerged in these sorts of proceedings as a result of national crises — from Watergate to Whitewater to the Vietnam War to Abscam.

“We are in the midst of another such episode,” he said.

Mumbai: Tajik singer Abdu Rozik is one of the most loved celebrities in India. He rose to fame after participating in the TV reality show Bigg Boss. During the season 16 of the Bigg Boss, Abdu remained part of Mandali (a group of various contestants) which was loved by most of the audience. One of the Mandali members, MC Stan emerged as the winner and these members were often seen partying after coming out of the house too.

After Stan suddenly started ignoring Abdu Rozik, the young singer recently revealed that his friendship with Stan has ended. Abdu’s team also issued a statement in this regard which reads that on March 10, Sajid Khan visited Abdu and called MC Stan but he hung up saying he will call later.  According to the statement, Abdu had also sent Stan a voice note to the Bigg Boss winner to which the latter didn’t respond.

A day after MC Stan did not respond to Abdu’s voice note, Tajik singer spoke to rapper’s manager saying he “wanted to support his brother by attending, not performing” at his show. Chota Bhaijaan according to the statement was told by the security team and organizers that Stan didn’t want Abdu at the venue.

“Abdu then thinking this was a mistake from Stan’s team, tried to go to the venue as a normal guest with a ticket only to be sworn at very bad words by Stan’s management and to be turned away at the normal entrance. Abdu’s car was also damaged ,” the statement further reads.

As per the statement, Stan’s team has informed the independent two record labels that Stan did not want to collaborate with Abdu after they wanted the duo to work on one of the label’s projects. “Abdu was naturally disappointed and saddened due to the response as he believed he and MC Stan are friends. Abdu at first wanted to discuss with Stan privately and sort out the differences before admitting publicly that they are not in good terms,” added the statement.

It also reads that the mandali members had informed Abdu earlier that Stan was offended after Chota Bhaijaan didn’t take a picture with Stan’s mother at the Bigg Boss finale.

“As little or large an issue may be, respect is so important between brothers and between fans and their idols. We condemn anyone who is being racist, body shaming, bullying, height shaming, and defaming Abdu and will take action against the specific group of accounts who are doing this,” the statement concluded.

MC Stan, Abdu Rozik, Sajid Khan, Shiv Thakare, Sumbul Touqeer Khan, and Nimrit Kaur Ahluwalia were the members of the mandali during the Bigg Boss season 16.

Video: Fire breaks out at pharma factory in Hyderabad’s Jeedimetla

    [ad_1]

Hyderabad: A massive fire broke out on Thursday night at a defunct and vacant pharmaceuticals firm in Jeedimetla. There were no reported injuries in the event.

According to fire officials, a distress call from local neighbours was received at about 8 p.m., and fire tenders from adjacent fire stations were quickly dispatched to the scene.

Because the fire was so intense, three fire tenders were dispatched to put out the flames. After catching fire, barrels of chemicals housed on the pharma company’s premises detonated.

The pharma company’s facilities have been closed for several months, and officials assume that the fire started owing to a short circuit or that some persons tossed combustible goods inside the grounds.

The explosion generated a massive ball of flames, which caused terror among the locals. As a precaution, the police stopped traffic on the main route and evacuated the inhabitants who lived nearby.

To prevent any unforeseen incidents, the local police had roped off the area. Top fire department officers also went to the scene. Officials from the fire department are investigating the cause of the fire.

Bhopal: Tension prevailed in Indore’s Mhow on Thursday following violent protests over the suspicious death of a tribal woman even as the government ordered a magisterial inquiry.

Over six police personnel, including an inspector, were injured in the stone pelting done by the protesters.

On Wednesday, a 23-year-old tribal woman, who was preparing for competitive exams, was found dead in a rented room. Alleging that the woman was gang-raped and murdered, the family members staged a protest while keeping the body on the road.

Upon receiving information, local police reached the protest spot and tried to disperse the assembled people. However, the angry mob pelted stones at the police. Subsequently, police had to use teargas and fired shots in the air to disperse the crowd.

“Six cops were injured due to stone pelting. The situation was brought under control, however, police personnel have been deployed in the area. Woman died under suspicious circumstances following which her family staged protests. The woman was living in a rented room for her studies,” Indore SP (Rural) Bhagwant Singh Virde said.

Chief Minister Shivraj Singh Chouhan ordered a magisterial inquiry into the matter, according to a statement issued by his office on Thursday.

Meanwhile, Madhya Pradesh Congress president Kamal Nath has sent a team of tribal MLAs of the party to the area. The Congress leaders are likely to visit the family.

“Murder after gang-rape of a tribal girl in Mhow of Indore district and murder of a tribal youth in police firing has proved the jungle raj is prevalent in Madhya Pradesh. I am pained, distressed by this heartbreaking incident and stand with the aggrieved tribal families in this hour of grief,” Kamal Nath said.

The Guinness World Records is a rich mine of some of the oddest world records, some of which make us question why they were ever set in the first place.

Oscar Lynagh of Melbourne set a world record by bouncing 12 table tennis balls off a wall and catching them on his shaving cream-covered head in 30 seconds.

“The most table tennis balls bounced and caught in shaving foam on the head in 30 seconds (individual) is 12 and was achieved by Oscar Lynagh (Australia), in Melbourne, Australia, on November 30, 2022,” according to the record-keeping organisation.

The GWR tweeted a video of the effort with the statement, “New record: Most table tennis balls bounced and caught in shaving foam on the head in 30 seconds (individual) 12 by Oscar Lynagh. Yes, this is a real record you can try at home 🤣”

Kohli breaks Test century drought; puts India in command against Australia

    [ad_1]

Ahmedabad: Virat Kohli finally ended his Test century drought as he slammed an outstanding ton to put India in a commanding position on Day 4 of the ongoing fourth Test match against Australia here at Narendra Modi Stadium in Ahmedabad on Sunday.

At the time of tea break, India’s score read 472/5 with Kohli (135)* and Axar Patel (38)* unbeaten at the crease. The hosts still trail by just 8 runs.

Kohli ended his Test century drought as he slammed his first Test century since November 2019.

After lunch, Indian batsmen Virat Kohli and Srikar Bharat opened their hands and slammed Australian bowlers at regular intervals for boundaries.

Cameron Green was on the receiving end with Srikar Bharat smashing him for 21 runs with the help of two boundaries and two sixes in an over.

Srikar Bharat’s blistering stint at the crease came to an end as he was dismissed by Nathan Lyon for 44. The left-handed batter Axar Patel then came out to bat at the crease.

Kohli ended his Test century drought as he slammed his first Test century since November 2019. The former India captain brought up his much-needed hundred in 241 balls. It was the most-awaited ton as his last century came against Bangladesh in November 2019. With this century, he took his international century tally to 75.

Kohli continued his blistering form and slammed Mitchell Starc for brilliant two boundaries collecting 9 runs. Kohli along with Patel took India’s total beyond the 400-run mark in the 140 overs of the game.

The duo of Kohli and Patel stitched up their 50-run partnership stand –the 6th consecutive 50-run partnership for Team India.

The Indian pair remained unbeaten as the visitors ended the session at 472/5.

Earlier, Kohli and Srikar Bharat showed remarkable skill and determination to frustrate the Australian bowling attack in the opening session of Day 4.

The batting pair of Ravindra Jadeja and Virat Kohli were decisive in their approach and made the Australian bowlers toil hard making merry of the excellent batting conditions on offer.

Australia skipper Steve Smith introduced Cameron Green into the attack in the very first over of day 4 and the bowler concede just 4 runs. Australia started with spin with Nathan Lyon and Todd Murphy bowling in tandem from both ends.

The duo of Jadeja and Kohli took India’s total beyond the 300-run mark in the 102nd over of the game. However, the 64-run partnership stand was broken by Murphy who dismissed Jadeja for 28 runs. Srikar Bharat then came out to bat.

The Indian batters rotated the strike brilliantly, not allowing the Australian bowlers to settle down while whacking the loose balls on offer.

Kohli and Srikar Bharat both were aggressors of the batting pair, smashing boundaries regularly. The duo stitched a solid 50-run partnership for Team India.

The Indian pair took India’s score beyond the 350-run mark as the first session ended.

Brief Score: Australia 480 (Usman Khawaja 180, Cameron Green 114; Ravichandran Ashwin 6-91) vs India 362/4 (Virat Kohli 135*, Shubman Gill 128; Todd Murphy 2-64). (ANI)

Dubai provides short breaks for caregivers of senior citizens

    [ad_1]

The Community Development Authority (CDA) in Dubai has launched the “Respite Care” programme, which provides short-term breaks for caregivers of senior citizens and people of determination, the Dubai Media Office (DMO) reported.

The programme enables caregivers to take short-term breaks to attend to their daily activities without having to compromise on their caregiving responsibilities.

This ensures that the elderly and people of determination continue to receive needed care even when their primary caregiver is unavailable for a short period.

The programme, which falls under the umbrella of the Supreme Committee for Development and Citizens Affairs, gives primary caregivers an opportunity to focus on their physical and mental well-being.

The Programme eligibility requires that caregivers are Dubai citizens and first-degree relatives of senior citizens or people of determination they care for, and must also live in the same home.

Eligibility for the program requires that caregivers be Dubai nationals and first-degree relatives of the senior citizen or people of determination they are caring for, and must also live in the same household.

Caregivers of a senior citizens or determinate people residing in Dubai can apply for the temporary care service. Once the request is received, CDA will review the case and, upon approval, make arrangements to accommodate the request based on caregiver needs.

During the primary caregiver’s time off, the authority will provide a substitute to care for senior citizens or determined people, either at home or in temporary care centres.

The authority will appoint specialists to provide the necessary care and supervise them during the absence of the primary caregiver.
