    IIT Bombay student jumps to his death from hostel building

    Mumbai: An 18-year-old student of the Indian Institute of Technology (IIT) Bombay, located in Powai area, allegedly committed suicide by jumping off the seventh floor of a hostel building located on the campus on Sunday, police said.

    The deceased, who hailed from Ahmedabad, was a first-year student of the B.Tech (Chemical) course.

    The incident came to light after security guards on the campus spotted the youth lying in a pool of blood, a police official said.

    He said the deceased had not left any suicide note and prima facie he jumped from the refuge areas of the hostel building.

    “Based on the primary information, we have registered a case of accidental death. Further investigation is underway,” said senior police inspector Budhan Sawant.

    Mumbai: The Bombay High Court has vacated the stay on trial in the 2010 killing of criminal lawyer Shahid Azmi and rejected a plea filed by an accused seeking a change of the trial court on the grounds of “bias”.

    Azmi was shot dead in his office in suburban Kurla on February 11, 2010.

    At the time of his death, Azmi represented many accused in the 7/11 train blasts cases, Malegaon 2006 bomb blasts cases, the Aurangabad arms haul case, and the Ghatkopar blasts case. Hansal Mehta’s 2013 film Shahid’ starring Rajkummar Rao is based on the life and work of Azmi.

    The prosecution case is that Azmi was killed at the behest of gangster Chhota Rajan.

    The High Court stayed the trial in September 2022 after an accused Hasmukh Solanki moved an application to transfer the case to another sessions judge.

    A single bench of Justice P D Naik on February 7 vacated the stay order and rejected Solanki’s plea seeking transfer of the case from the sessions judge in Mumbai, currently conducting the trial, to another sessions judge. Solanki had alleged bias by the present judge.

    Justice Naik in the order said he did not find sufficient material on record to conclude that the trial court was biased against Solanki.

    “The material on record is not sufficient to draw the conclusion that the trial court is biased against Solanki and that he would not get a fair trial before the said court. No case is made out for transfer of trial,” HC said.

    Azmi had been in Tihar jail for 7 years after being charged under the now-repealed Terrorist and Disruptive Activities Prevention Act (TADA) for his alleged involvement to kill politicians.

    He was later acquitted by the Supreme Court. Meanwhile, he obtained an LLB degree while in prison.

    Mumbai: The Central Bureau of Investigation (CBI) on Monday informed the Bombay High Court that it has completed its probe into the 2013 killing of rationalist Narendra Dabholkar, and submitted the report to the competent authority for its decision.

    The submission came following a query by a division bench comprising Justices A.S. Gadkari and P.D. Naik, which asked whether the investigation into the murder of Dabholkar — who was shot dead in Pune on August 20, 2013 – was complete.

    To this, the CBI counsel, Additional Solicitor-General Anil Singh, said that the investigating officer of the agency has already submitted to the concerned authorities that the probe is over and no further investigation is required.

    On Singh’s request, the bench allowed three weeks’ time to the CBI to confirm whether its probe is over to enable the high court to decide whether it should continue monitoring the same.

    Singh said that the CBI has carried out the investigation, and no further probe is needed, adding that the IO has also filed his report which is pending before the competent authority. So far, 15 out of 32 witnesses have been examined in the trial, which commenced in September 2021, Singh informed the court.

    The court’s order came on a petition filed by Dabholkar’s daughter, who had sought a high court-monitored probe, contending that the CBI investigation was not satisfactory and it had left loopholes in its probe.

    The founder of Maharashtra Andhashraddha Nirmoolan Samiti (MANS), Dabholkar was gunned down while on a morning walk in Pune, allegedly by members of a right-wing group, Sanatan Sanstha.

    Mumbai: A woman has the right to choose whether to continue her pregnancy or not and the decision is hers and hers alone to make, the Bombay High Court said while allowing a married woman to terminate her 32-week pregnancy after the foetus was detected with severe abnormalities.

    A division bench of Justices Gautam Patel and S G Dige, in its judgment of January 20, a copy of which was made available on Monday, refused to accept the medical board’s view that the even though the foetus has serious abnormalities it should not be terminated as the pregnancy is almost at its fag end.

    The woman had approached HC seeking to terminate her pregnancy after sonography revealed the foetus had severe abnormalities and that the baby would be born with physical and mental disabilities.

    “Given a severe foetal abnormality, the length of the pregnancy does not matter. The petitioner has taken an informed decision. It is not an easy one. But that decision is hers, and hers alone to make. The right to choose is of the petitioner’s. It is not the right of the Medical Board,” the court said in its order.

    Refusing termination of pregnancy only on grounds of delay would not only be condemning the foetus to a less-than-optimal life but would also be condemning the mother to a future that will almost certainly rob her of every positive attribute of parenthood, the HC said.

    “It would be a denial of her right to dignity, and her reproductive and decisional autonomy. The mother knows today there is no possibility of having a normal healthy baby at the end of this delivery,” the court said.

    “Accepting the Medical Board’s view is not just to condemn the foetus to a substandard life but is to force on the petitioner and her husband an unhappy and traumatic parenthood. The effect on them and their family cannot even be imagined,” it added.

    The petitioner’s foetus is detected with both microcephaly and lissencephaly, and this is what the future portends, the bench said.

    Asserting that the rights of the woman should never be compromised in the “blind application of a statute”, the court said, “Justice may have to be blindfolded; it can never be allowed to be blindsided. We are agnostic about the relative positions of parties. We can never be agnostic about where justice needs to be delivered.”

    It said cases such as this often raise profound moral questions and dilemmas, but it is immutable that the “arc of the moral universe always bends towards justice”.

    The bench said the existence of the foetal anomaly, as well as its severity, was certain as also the fact that it was detected late.

    “Because it is difficult to predict at birth what problems will occur, microcephalic babies need constant and regular follow up and check-ups with health care providers. There is no known cure or standard treatment for it. In more extreme cases, microcephalic babies need intervention almost constantly,” the court said.

    Most disturbingly, the prognosis for children with lissencephaly depends on the degree of brain malformation, it added.

    The bench noted the medical board did not take into account the social and economic position of the couple.

    “It ignores their milieu entirely. It does not even attempt to envision the kind of life, one with no quality at all to speak of, that the petitioner must endure for an indefinite future if the Board’s recommendation is to be followed,” the HC said.

    “The Board really does only one thing: because late, therefore no. And that is plainly wrong, as we have seen,” the court said while allowing the pregnancy to be terminated.
