    Telangana HC pulls up municipal body over killing of boy by stray dogs

    Hyderabad: The Telangana High Court on Thursday pulled up Hyderabad’s municipal body over the gruesome death of a four-year-old boy who was mauled to death by stray dogs on Sunday.

    Taking cognisance of the media report on the incident, the court initiated suo moto Public Interest Litigation (PIL).

    A division bench headed by Chief Justice Ujjal Bhuyan blamed negligence by the Greater Hyderabad of Municipal Corporation (GHMC) for the boy’s death and asked it what steps are being taken to curtail incidents of stray dog attacks.

    The GHMC has also been asked to explain what steps it would take to ensure that such an incident is not repeated.

    Expressing condolences over the death of the boy, the court said it would look into the matter of compensation for his family.

    The court included the Chief Secretary, Principal Secretary of the Municipal Administration and Urban Development Department, GHMC Commissioner, GHMC Deputy Commissioner (Amberpet), GHMC Veterinary Officer, Hyderabad District Collector and Member Secretary of Telangana State Legal Services Authority as respondents in the case and asked them to file the counter.

    It adjourned the hearing to March 16.

    Meanwhile, Animal Husbandry Minister T. Srinivas Yadav aling with Home Minister Mahmood Ali held a meeting with officials on the steps to check stray dog menace.

    After the meeting, Yadav told reporters the municipal authorities have been directed to undertake a month-long special drive to sterilise stray dogs.

    The Department of Municipal Administration and Urban Development directed all the Municipal Commissioners to enhance the current capacity of conducting animal birth control including rationalisation centre wise, increasing the number of dog catching teams and vehicles in order to attend the dog complaints effectively and to achieve 100 per cent sterilisation of street dogs.

    The Municipal Commissioners have also been asked to assess and identify high density stray dog areas and the areas where more number of dog bite incidents are reported by involving resident welfare associations, slum level federations and town level federations to take immediate necessary action in preventing further dog bites.

    The officials have been told to take stringent action against hotels, restaurants, function halls, non-vegetarian shops, hostels and hostels and other establishments that dispose of garbage on streets as this attracts stray dogs.

    They were also asked to arrange adequate number of water bowls in suitable locations, preferably away from public movement areas, to alleviate the aggression of street dogs during the summer season.

    The municipal officials were directed to install billboards/hoardings to highlight appropriate behaviour towards street dogs, including dos and don’ts.

    Lahore: A fact-finding mission led by the Human Rights Commission of Pakistan (HRCP) has reported an alarming uptick in the persecution of the minority Ahmadi community in the country’s Punjab province.

    The HRCP report, released on Wednesday, found evidence to suggest that the civil administration in Gujranwala and Wazirabad districts of Punjab were directly involved in destroying minarets on Ahmadi sites of worship in the last couple of months, following objections raised against the community by a local political-religious outfit.

    “The administration claims to have done so to circumvent the threat of mob violence,” the report said, adding that the way authorities handled the matter only fostered growing hostility towards the community, making community members more vulnerable.

    The Rights body expressed concerns on various issues faced by the minority community, including the desecration of Ahmadi graves, the destruction of minarets at their worship sites, and the FIRs filed against the members for carrying out ritual animal sacrifice on Eid.

    “Of particular concern is the administration’s perception that some legal and constitutional provisions provide room for the persecution of this kind, although the report notes that, under Article 20(b) of the Constitution, this is not the case,” the report said.

    “While the mission understands that the local bureaucracy, police and judiciary were successfully intimidated by a religious group (Tehreek-e-Laibbaik Pakistan), their response displays a pitiful inability to manage law and order while respecting the fundamental rights of the Ahmadi community,” the report added.

    The mission recommended the judgments of the Supreme Court from 2014 and 2021 be implemented, which includes the establishment of a special police force to guard religious minorities’ places of worship.

    It also called for developing the police’s capacity to deal with the threat of mob violence in such situations.

    Last month, an elderly woman of the Ahmadi community was denied burial at a graveyard by a local cleric and his followers in the Sialkot district of Punjab.

    In the past, such incidents occurred in other Ahmadi graveyards in Punjab, but not a single culprit was arrested or put on trial.

    Minorities, especially Ahmadis, are very vulnerable in Pakistan and are often targeted by religious extremists.

    Morbi: The Morbi municipality on Wednesday passed a resolution saying the civic body never gave its approval to hand over a suspension bridge in the town to Oreva Group, a day after the Gujarat government sought a fresh reply to a show-cause notice over the bridge collapse that killed 135 people.

    In the general board meeting held today to discuss this issue, 41 of 52 councillors of the BJP-ruled municipality submitted a separate reply asserting that the majority of the councillors were not aware of the agreement under which the bridge was handed over to Oreva Group by the municipality for maintenance and operation.

    The Gujarat government had on Tuesday asked the Morbi municipality to submit a fresh reply to a show-cause notice as to why it should not be dissolved for failing to discharge its duties before the collapse of the bridge that claimed 135 lives last year.

    The Urban Development Department had said in a letter to the chief of the municipality that the civic body should submit a written reply, duly approved by its general body, by February 16.

    The show-cause notice was issued on January 18 and the state did not accept a reply dated February 7 sent by the municipality’s lawyer.

    In view of the government’s new deadline, the municipality had called an urgent general body meeting on Wednesday, said N K Muchhal, in-charge chief officer of Morbi.

    “During today’s meeting, two separate replies, one from the civic body and another from councillors, were submitted. These replies will be sent to the state government for further action,” Muchhal told reporters after the meeting.

    Jayrajsinh Jadeja, vice president of the municipality, said the office bearers of the civic body, including the president, vice president and standing committee chairman, are “innocent” because the proposal and subsequent agreement to hand over the bridge to Oreva Group in March last year was never approved through a general board meeting.

    “We are not guilty because the agreement to hand over the bridge to Oreva Group was never discussed or approved in the general board meeting. Moreover, we have also mentioned in our reply that Morbi municipality was ruled by Congress when the first agreement was approved by the board (in 2007) for the maintenance of the bridge,” said Jadeja.

    On behalf of the 41 councillors, Bhavik Jaria told reporters that 49 of 52 councillors were not aware of the agreement signed by the Morbi municipality with Oreva Group in March last year for the maintenance and operation of the bridge.

    “In our reply, we have stated that 49 of 52 councillors were not aware of this agreement. As per the law, the municipality’s permission is needed for such agreements. But, we were not informed about it. Even the Special Investigation Team (SIT) never said in its findings that the entire civic body was responsible for this tragedy,” said Jaria.

    The ill-fated bridge, which collapsed on October 30 last year, was maintained and operated by Oreva Group under an agreement signed with the Morbi municipality.

    In its show-cause notice of January 18, the government wanted to know why the civic body did not take note of the issues raised by Oreva Group between 2018 and 2020 about the dilapidated condition of the bridge and the possibility of a serious accident if it remained open to the public.

    Moreover, the municipality did not take any concrete action to take over the bridge from the company in 2017 after the completion of the previous contract despite knowing the situation of the bridge, the notice said.

    The state government had on December 13 told the Gujarat High Court during the hearing of a public interest litigation (PIL) that it had decided to dissolve the municipality.

    Amaravati: Andhra Pradesh High Court on Wednesday granted stay on the show-cause notice issued by the state government to leaders of the Government Employees Association (APGEA) for meeting state governor to seek his intervention to ensure payment of salaries and pensions on time.

    Hearing a petition filed by APGEA leaders challenging the show-cause notice, Justice Ravinath Tilahari granted a stay and directed the government to file a counter.

    A delegation of APGEA leaders led by its president K. R. Suryanarayana had met Governor Biswa Bhusan Harichandan on January 19 and submitted a memorandum to him on the problems faced by the employees.

    The delegation requested the governor to issue necessary advice to the government as he is competent authority as per the Article 309 of the Constitution to intervene in the affairs of the government employees.

    After the meeting, APGEA leaders told media persons that they were compelled to meet the governor as all their efforts to resolve the grievances through the state government had failed.

    However, taking a serious note of the action of APGEA leaders, the government had issued a show-cause notice on January 23 asking them to explain why their association should not be derecognized.

    Suryanarayana had challenged the show-cause notice in the high court. The court on January 31 directed the government not to take action against the APGEA.

    During the previous hearing, the judge had posed several questions to the government. He wanted to know if the rights guaranteed by Article 19 of the Constitution are not applicable for APGEA. He asked the government if it mentioned in the show-cause notice what rules the APGEA violated while speaking to the media.

    Petitioner’s counsel Ravi Prasad told the court that according to the 1990 Financial Code, salaries to government employees should be paid on the last working day of every month but employees are not getting current month salaries till 15th of next month.

    Suryanarayana alleged that the state government is not honouring the commitment to pay the salaries and pensions on the first of every month. The AGEA leader said the government also withdrew the GPF amount of Rs.415 crore from the accounts of over 90,000 employees without their permission. He termed this a “serious” financial fraud.

    SRINAGAR: Restoration of statehood to Jammu and Kashmir (J&K), as promised by the Centre, would be done after the Assembly poll in the Union Territory (UT) and a call to conduct elections would be taken by the Election Commission of India (ECI), Union Home Minister Amit Shah said today.

    Talking to news agency ANI in a interview, Shah noted that there has been a marked improvement in the security situation in Jammu and Kashmir as the lowest militancy-related incidents were reported in the recent past.

    He also insisted that Article 370, which was done away with by the Centre in August 2019, had actually harmed the country and the BJP had always been against it.

    Noting that development in J&K was leading to gradual ending of militancy, Shah said, “See all the figures. There is a lot of change in Jammu and Kashmir.” Indicating that he could not comment on the timing of the poll in J&K, Shah said, “I had clearly stated that statehood will be restored in Jammu and Kashmir after elections. The process for preparation of voters’ list is nearing completion in the UT. Now, the Election Commission has to take a call on elections.”

    On the issue of the emergence of new leadership in J&K, Shah said that new leadership would emerge from local bodies where poll had been held earlier. “The panches and sarpanches, who have been elected…new leadership will emerge from them…Since the time militancy started in J&K, the militancy-related figures are at their lowest today. Crores of tourists and ‘yatris’ are visiting J&K now. This is a huge change,” he noted.

    Shah said removing Article 370 has been on the agenda of BJP and Jana Sangh. He also referred to India’s first PM Jawaharlal Nehru in the context of Article 370. “Since 1950, it was on our agenda to remove Article 370 from J&K. Today, the way J&K is witnessing development and decrease in militancy shows that change is coming,” he said. Shah said those slamming the BJP should answer in whose tenure militancy grew in J&K.

    “As far as elections are concerned, do they not remember that local body polls were held under our rule? These did not take place for 70 years. Three families were holding sway in J&K and they are making noise…Farooq Abdullah had gone to England. In whose tenure, militancy grew…there should be an answer,” Shah said.
