    Srinagar, Apr 29 (GNS): Body of a non-local, working as a bus conductor, was found in Batamaloo area in central Kashmir’s Srinagar district on Saturday afternoon, officials said.

    They told GNS that the body was found by some passersby along a road in the area, following which they evacuated him to SMHS Hospital.

    The person, they said, was however declared dead on arrival by the doctors there.

    The deceased has been identified as one Rakesh Kumar (40), a resident of Katra.

    Confirming it, a senior police officer told GNS that the person is believed to have died due to ‘overuse of drug’. “We still are ascertaining more detailed facts into his death”, the officer added.  (GNS)

    A UN body has declared that the detention of a long-term Guantánamo inmate, Abu Zubaydah, has no lawful basis and called for his immediate release, warning that the systemic deprivation of liberty at the camp may “constitute crimes against humanity”.

    The UN working group on arbitrary detention (UNWGAD), also declared the UK, among other countries, was “jointly responsible for the torture and cruel, inhuman or degrading treatment of Mr Zubaydah” over his more than 20 years in detention.

    The UNWGAD finding released on Friday specifically addresses the case of Zubaydah, a 52-year-old Palestinian captured in Pakistan in March 2002, and held and tortured in a series of CIA black sites, before being transferred to the Guantánamo Bay prison camp in 2006. The US initially claimed he was “number three” in al-Qaida but later conceded he was not a member at all.

    The finding went further to address detention at Guantánamo in general, and “expresses grave concern about the pattern that all these cases follow and recalls that, under certain circumstances, widespread or systematic imprisonment or other severe deprivation of liberty in violation of fundamental rules of international law may constitute crimes against humanity”.

    The UN working group is a quasi-judicial body, issuing legal judgments on behalf of the international community, but they are not binding, nor does it have the power to enforce its findings. It is made up of five legal experts from around the world: the current panel consists of lawyers, law professors and former judges drawn from Malaysia, New Zealand, Ukraine, Ecuador and Zambia.

    Friday marks the first time an international body has referred to the 21-year-old prison camp as a potential crime against humanity, the first time such a body has ruled against the US for Abu Zubaydah’s detention, and the first international case finding against the UK, Morocco, Thailand and Afghanistan, all of whom are deemed complicit in arbitrary detention, rendition and torture.

    The decision also found Pakistan, Poland and Lithuania to be part responsible: Pakistan for participation in his arrest and rendition, and Poland and Lithuania for hosting black sites. The European Court of Human Rights has previously ruled against Poland and Lithuania for their participation in the web of secret detention facilities and rendition flights.

    Helen Duffy, Zubaydah’s international legal representative, who runs a Hague-based legal group, Human Rights in Practice, said: “Today’s decision is a powerful reminder of the complete unlawfulness of Guantánamo, and our client’s situation in particular.”

    “The UK has been found legally responsible for ‘complicity’ in our client’s torture and ongoing unlawful detention, and reparations should follow,” Duffy said. “This can include offers of relocation, recognition and apology, rehabilitation and compensation.”

    She added: “We need to reckon with the fact that the ‘war on terror’, as waged for 20 years, has failed. But we cannot pretend to learn lessons from it while perpetuating its most notorious wrongs.”

    There are 30 inmates left at the Guantánamo camp, of which only one has been convicted of a crime; 10 are involved in military tribunal proceedings, although in most cases, the trials have not even started; 16 have been recommended for a transfer to another country, pending security guarantees; and the Biden administration has been in quiet negotiations with foreign governments to persuade them to accept transferred inmates.

    Zubaydah is one of three “forever prisoners” who have not been charged and not been recommended for transfer.

    SRINAGAR: A 21-year-old youth was found dead in the Dalgate area of Central Kashmir’s Srinagar district on Friday.

    An official said that the body was found near HB lighthouse Dalgate.

    It was later identified as Tanveer Ahmad Khan (21), son of Mohammad Lateef Khan, resident of Sumlar Bandipora.

    “It seems that Tanveer has died of drowning,” he said, adding that the dead body has been taken to SMHS Hospital for medico-legal formalities.

    “Inquest proceedings u/s 174 CrPC have been initiated in this regard,” he said. (KS)

    Gurugram: A 34-year-old man accused of chopping her wife into pieces was arrested here from Manesar, police said on Thursday.

    A half-burnt torso of a woman was found in a village in Manesar on April 21, with police suspecting she was murdered somewhere else. The woman had her head was missing and her hands chopped off.

    Gurugram Police Commissioner Kala Ramachandran said that the accused, Jitender, is being interrogated and more details will be shared on Friday.

    According to a senior police officer, Jitender is a resident of Gandhi Nagar and was living on rent in Manesar area.

    The woman’s body was found from one of the two rooms built on a farm leased by Kukdola village resident Umed Singh.

    According to police, Umed Singh had leased eight acres of land located by a road leading from Pachgaon Chowk to Kasan village.

    “My neighbour called me and told me he saw some smoke coming out of one of the rooms on my farm. When I went to the farm, I found a half-burnt torso in the room and I informed the police,” Umed Singh said in his complaint.

    Police in its investigation concluded that the torso belonged to a 30-year-old woman.

    They found both the chopped hands of the woman on Sunday, and her head on Wednesday evening, from the Kherki Daula area.

    On Umed Singh’s complaint, an FIR was registered under sections 302 (murder) and 201 (hiding evidence) of the IPC at Manesar Police Station.

    A source in the police said the accused confessed to killing his wife.

    SRINAGAR: Officials reported that an unidentified body was recovered from the Jhelum River in the Barrage Boniyar area of North Kashmir’s Baramulla district on Thursday morning.

    Local residents had spotted the decomposed body and alerted the police, who arrived on the scene.

    The body was then taken to a nearby hospital for medico-legal formalities. The victim’s identity is currently under investigation.(KS)

    Kolkata: The Calcutta High Court on Tuesday ordered exhumation and a second post-mortem examination of IIT Kharagpur student Faizan Ahmed’s body, which was buried in his home state Assam six months ago, saying that it is necessary to bring out the truth behind his death.

    The father of the third-year student had moved the court seeking formation of a special investigation team (SIT) to probe into the death of Ahmed. His body was found in his hostel room at IIT Kharagpur in West Bengal’s Paschim Medinipur district on October 14, 2022.

    “The body of the victim Faizan Ahmed is ordered to be exhumed,” Justice Rajasekhar Mantha directed, holding that a second post-mortem examination is “vital and necessary for arriving at the truth behind his death.”

    He directed that the second post-mortem of the body of Ahmed, a mechanical engineering student who hailed from Tinsukia in Assam, be conducted at the state-run Medical College and Hospital, Kolkata, after exhumation.

    Noting that an affidavit of Ahmed’s parents consenting to the exhumation and a second post-mortem has been filed in court, Justice Mantha directed the investigating officer to coordinate with Assam Police for the exhumation and ordered that the West Bengal police will bring the body to Kolkata.

    Justice Mantha directed that Dr Ajoy Kumar Gupta, a forensic expert appointed by the court for his opinion on the likely cause of death of Ahmed, will conduct the post-mortem examination in the presence of doctors who conducted the previous autopsy.

    Adjourning the hearing in the matter till June 13, the court directed that the exercise be completed within one month from the date of order.

    Gupta, a retired forensic expert of the state CID, stated in a preliminary report filed before the court that two injury marks on the back of the head of the victim were not mentioned in the first post-mortem examination report.

    It said that some cut marks on the arms of the body were inflicted after the student’s death.

    The police had mentioned seizure of a chemical called Emplura (sodium nitrate) in a bottle from the student’s hostel room.

    Court-appointed amicus curiae Sandip Bhattacharya submitted that sodium nitrate, a yellowish powder, is normally used to preserve meat.

    There was some yellowish residue in a bucket found by Gupta and Bhattacharya during their visit to the room, the report stated.

    It was stated before the court that when a body decomposes, it is impossible that the fellow inmates of the hostel would not be able to detect it, but there was mysteriously no smell from the body for three days.

    “The presence of this chemical Emplura opens up serious questions as regards the time of death and whether it may have been used to preserve the body after the death of the victim,” Justice Mantha observed.
