    Why is PM Modi ‘silent’: Kapil Sibal on Bengal, Bihar communal violence

    New Delhi: In the wake of communal violence in West Bengal and Bihar, Rajya Sabha MP Kapil Sibal on Sunday questioned the “silence” of Prime Minister Narendra Modi over the matter, and said “let not 2024 general elections be the reason” for the violence.

    Sibal appealed to the people of the country to put a stop to the “burning of Bengal and Bihar, and to the seeds of hatred” which, he said, can only benefit politicians and political ideologies.

    The ordinary man becomes a victim of this hatred, he said in a statement.

    “I want the prime minister (Modi) to speak up, I want the home minister (Shah) to speak up and condemn the violence. It is unfortunate that in the midst of this violence neither of them have spoken, why are they quiet,” he asked.

    “It is my earnest appeal to all those, and it may not be about one particular party, who are responsible for this madness. The country needs to move forward away from the environment that is being created. Let not 2024 be the reason for this,” the former Union minister said.

    Sibal said let the rule of law prevail.

    Sources said Home Minister Amit Shah on Sunday expressed concern over incidents of communal violence in Bihar, and spoke to Governor Rajendra Vishwanath Arlekar to take stock of the situation.

    Sibal said it was not enough to express concern.

    His statement comes after communal violence rocked Sasaram and Bihar Sharif towns during Ram Navami festivities.

    The police till Saturday arrested 45 people in connection with the communal violence at Sasaram and Bihar Sharif.

    Vehicles, houses and shops were torched and several people injured in the communal flare-ups reported in both towns.

    Howrah’s Shibpur and Kazipara area in West Bengal had also witnessed clashes during a Ram Navami procession.

    Sibal, who was a Union minister during the UPA 1 and 2 regimes, quit the Congress in May last year and was elected to the Rajya Sabha as an independent member with the Samajwadi Party’s support.He recently floated a non-electoral platform ‘Insaaf’ aimed at fighting injustice.

    New Delhi Union minister Smriti Irani on Friday hit out at West Bengal Chief Minister Mamata Banerjee over the violence during a Ram Navami procession in Howrah and accused her of protecting those who pelted it with stones.

    In a statement, the BJP leader said it was not the first time that such an “attack” happened on a religious exercise of Hinduism and alleged a similar attack had taken place during Lakshmi Puja.

    “Even then Mamata Banerjee could not protect the Hindu community,” Irani said.

    “Instead of delivering justice, CM Mamata protected those who took law in their hands and attacked the Shobha Yatra of Ram Navami. She instead put those who took out the yatra in the dock and gave a clean chit to those who pelted the procession with stones,” the Union minister said.

    Banerjee on Friday asserted that neither Hindus nor Muslims, but the BJP and other right-wing organisations were behind the violence in Howrah’s Kazipara area during a procession on Ram Navami.

    She also appealed to the people of both communities to maintain peace and law and order in the area.

    Kolkata: West Bengal Governor C.V. Ananda Bose sprang into action on Friday regarding the clashes in Howrah district on Thursday over a Ram Navami procession after receiving a call from Union Home Minister Amit Shah on this count.

    Raj Bhavan sources said that after receiving the call from the Home Minister, the Governor summoned the Chief Secretary, H.K. Dwivedi, and Home Secretary, B.P. Gopalika, to the Governor House on Friday evening.

    The sources said that during his meeting with the two top bureaucrats of the state, Bose sought details of the prevailing situation in Howrah and actions taken by the police to restore normalcy in the troubled areas.

    The sources also said that there is a possibility that the Governor might also visit the troubled areas. However, there was no confirmation about the timing of his visit.

    As per the latest information available, a large contingent of police have already been deployed in the troubled pockets of Howrah district who are conducting flag- marches and frequent patrolling for the purpose of area domination.

    Frequent announcements are also being made asking the people to avoid any kind of gathering in the area, cautioning them of legal actions in case of any violation on this count.

    Kolkata: As tension over clashes in West Bengal’s Howrah district over a Ram Navami procession continued on Friday, a Public Interest Litigation (PIL) was filed at the Calcutta High Court seeking a CBI probe into the matter.

    The clashes which were mainly at Sandhyabazar area of Shibpur in Howrah district on Thursday, spread to adjacent Kazipara area this morning. A group of people started pelting stones towards the high-rises in the area. A couple of vehicles were vandalised and torched.

    Even the vehicle of the state cooperation minister Arup Roy, which was passing through the area then, was not spared. The window-screen of the vehicle was totally smashed. However, the minister was not present in the vehicle.

    Finally, a huge contingent of police force, accompanied by the personnel of the Rapid Action Force (RAF), reached the spot. They resorted to massive lathicharge to bring the unruly mob under control. Some of the policemen also suffered injuries in the clashes. Till the filing of the report, the total number of arrests in this connection was 36. Though the situation has been brought under control, tension prevails in these pockets.

    Chief Minister Mamata Banerjee gave a strong message and said that her administration will not tolerate such rowdy activities. “I have asked the police to take strong action,” she said. Admitting that there had been complaints of inaction or delayed action by police, the chief minister said that these complaints will also be looked into. At the same time, she claimed that Thursday’s clashes mainly happened because of the last moment change in route of the procession.

    On Friday, Leader of Opposition in state Assembly Suvendu Adhikari filed a PIL at the division bench of Calcutta High Court’s Acting Chief Justice T.S. Sivagnanam and Justice Hiranmay Bhattacharyya, seeking a CBI probe in Thursday’s clashes.

    The PIL has been admitted and the hearing in the matter will be on April 3. Besides seeking a CBI probe in the matter, the leader of the Opposition had also sought deployment of central armed forces in the troubled pockets on this count.

    In the PIL he also claimed that the deployment of central armed forces had been necessary as the state police had failed miserably to bring the situation under control.

    Kolkata: Taking a dig at West Bengal’s ruling Trinamool Congress and Chief Minister Mamata Banerjee, “The Kashmir Files” director Vivek Agnihotri on Sunday said many parts of the eastern state “have turned into Mini Kashmir”.

    Speaking at a seminar here on “India’s Heritage: From Kashmir to Bengal”, Agnihotri claimed that West Bengal has become a hotbed for corruption, cheap dialogues and communal violence.

    He said that the rich cultural heritage of Bengal has been tarnished by “negative instances in recent period to an extent”.

    “How can I forget how I was physically targeted at Jadavpur University for my film ‘Buddha in a Traffic Jam’? I made an attempt to make a film on the 1946 communal riots in Bengal for which I had sent a team of researchers to interview some survivors who witnessed those riots. But they were not allowed to work here,” Agnihotri said.

    Claiming that Chief Minister Mamata Banerjee had failed to control violence in the state, ‘The Kashmir Files’ director said one cannot even roam freely in West Bengal.

    “Already there are so many ‘mini Kashmirs’ in Bengal. However, I am determined to bring the true story about Bengal to the public through my movie at any cost. I will have to complete that work before the entire Bengal becomes Kashmir. No one can stop me from doing that,” he said.

    Kolkata: The West Bengal government has written to the Centre seeking permission for poppy cultivation in the state, Chief Minister Mamata Banerjee on Thursday told the state Assembly during the special and extended Budget Session.

    She also sought the support of the legislators from the opposition BJP on this count.

    “The Union government does not allow poppy cultivation in West Bengal despite this product being a popular food item of the people of the state. So, we are forced to import poppy from other states. That is why the price of this product is so high in West Bengal. If the Union government allows cultivation of poppy in the state, its price will automatically come down here,” she said.

    On this issue, she sought the support of BJP legislators claiming that poppy items are also quite favourite of the MLAs from the opposition camp.

    “Why is poppy cultivation allowed in just four Indian states? Why should our state be deprived of the permission to cultivate poppies here? The Union government should remember that poppy is not just cultivated for production of intoxicants. Hence, I have written to the Union government for the permission,” she said.

    This is not the first time that the West Bengal government has demanded permission to cultivate poppy in the state. Banerjee raised the matter at the Eastern Zonal Council Meeting at Bhubaneswar which was chaired by Union Home Minister Amit Shah. However, no positive decision came on this count since then.

    Banerjee also claimed that her government initiative to encourage onion cultivation in West Bengal has brought down the price of the food staple to a great extent. “Previously we had to depend on import of onion from Nasik in Maharashtra. But now through systematic research and development onion is produced in many districts of West Bengal. So, we want to achieve that in case of poppy cultivation as well,” the Chief Minister said.

    New Delhi: The Supreme Court on Friday acquitted a West Bengal resident of the charge of killing his wife 40 years ago, ruling his conviction on the basis of extra-judicial confessions cannot be sustained as it is weak piece of evidence.

    The top court said where an extra-judicial confession is surrounded by suspicious circumstances, its credibility becomes doubtful and it loses its importance.

    The murder was alleged to have taken place on March 11, 1983 in Burdwan district of West Bengal. The trial court decided the case on March 31, 1987, acquitting Nikhil Chandra Mondal, who was booked for allegedly killing his wife.

    The state government’s appeal against the verdict remained pending in Calcutta High Court till December 15, 2008 on which date he was convicted and awarded life sentence.

    Mondal preferred an appeal before the top court in 2010 against his conviction and sentence, which was decided on Friday.

    A bench of Justices BR Gavai and Sanjay Karol said, “The impugned judgment and order dated December 15, 2008 passed by the High Court at Calcutta in Government Appeal convicting the appellant for the offence punishable under Section 302 of the IPC is quashed and set aside.”

    The top court, referring to a 1984 verdict, said it can be seen that this Court has held that the circumstances from which the conclusion of guilt is to be drawn should be fully established.

    “It has been held that the circumstances concerned “must or should” and not “may be” established. It has been held that there is not only a grammatical but a legal distinction between “may be proved” and “must be or should be proved”. It has been held that the facts so established should be consistent only with the hypothesis of the guilt of the accused, that is to say, they should not be explainable on any other hypothesis except that the accused is guilty,” the bench said.

    The top court said it has been held that the circumstances should be of a conclusive nature and tendency and they should exclude every possible hypothesis except the one sought to be proved, and that there must be a chain of evidence so complete so as not to leave any reasonable ground for the conclusion consistent with the innocence of the accused and must show that in all human probability the act must have been done by the accused.

    “It is a settled principle of law that however strong a suspicion may be, it cannot take place of a proof beyond reasonable doubt,” the bench said, and noted the prosecution case rests basically on the extrajudicial confession alleged to have been made by Mondal before three of his fellow villagers, who have been made prosecution witnesses by the police.

    It said the trial court observed that where the prosecution case is entirely based on extra-judicial confession and the prosecution seeks conviction of the accused on that extra-judicial confession, the evidence of the witnesses before whom the alleged confessional statement was made, requires a greater scrutiny to pass the test of credibility.

    The bench noted the trial court found the testimonies of prosecution witnesses were contradictory and not trustworthy.

    “It is a settled principle of law that extra-judicial confession is a weak piece of evidence. It has been held that where an extra-judicial confession is surrounded by suspicious circumstances, its credibility becomes doubtful and it loses its importance.

    “It has further been held that it is well-settled that it is a rule of caution where the court would generally look for an independent reliable corroboration before placing any reliance upon such extra-judicial confession. It has been held that there is no doubt that conviction can be based on extra-judicial confession, but in the very nature of things, it is a weak piece of evidence,” the bench said.

    It said unless the finding of the trial court was found to be perverse, an interference would not be warranted and noted that the trial court found the testimonies of prosecution witnesses not reliable so as to base the conviction solely on such testimonies.

    “We find that the approach adopted by the trial court was in accordance with law. However, this circumstance which, in our view, could not have been used has been employed by the High Court to seek corroboration to the extra-judicial confession,” the bench said, adding the scope of interference in an appeal against acquittal is very well crystalised that unless such a finding is found to be perverse or illegal/impossible, it is not permissible for the appellate Court to interfere with the same.

    The top court directed Mondal to be set at liberty forthwith unless required in any other case and upheld the trial court verdict dated March 31, 1987 acquitting him of murder charges.

    On March 11, 1983, a case was registered at Ketugram police station of Burdwan district that the body of an unknown married woman aged 25 years was lying in a field on the side of the railway track at Ambalgisan railway station.

    Police found that the woman, identified as Mondal’s wife, was killed with a sharp edged weapon. During investigation, it was found that Mondal had accompanied his wife and son to a nearby village fair and she was missing ever since.

    Police claimed Mondal had confessed before three fellow villagers Manick Pal, Pravat Kumar Misra and Kanai Saha that he had killed his wife with a bhojali (a type of knife) at the very spot where her body was found.

    New Delhi: Union Minister for Road Transport and Highways Nitin Gadkari has sanctioned Rs 1,292.65 crore under the Bharatmala Pariyojana for the development of 32 km long 6-lane access controlled greenfield highway from Chandrasekharapuram to Polavaram on (NH-544G) Bengaluru-Vijayawada Economic Corridor in Hybrid Annuity Mode in Andhra Pradesh.

    In a series of tweets, Gadkari said the Bengaluru-Kadapa-Vijayawada Economic Corridor starts from Bengaluru STRR which utilises the existing Bengaluru-Hyderabad (NH-44) till the Kodikonda checkpost on NH 44.

    Gadkari said thereafter, the proposed Greenfield Economic Corridor traverses from Kodikonda checkpost (Kodur village) on NH-44 (Bangalore-Hyderabad Road) to Muppavaram village near Addanki on NH-16.

    He said that from Muppavaram, the alignment utilises the existing NH-16 till Vijayawada.

    The entire corridor from Kodikonda checkpost to Muppavaram with a length of 342.5 km is completely a greenfield highway. This stretch in the Prakasam district of Andhra Pradesh is proposed to be developed in 14 packages, he added.

    Similarly, the minister approved Rs 410.83 crore for the construction of a 4-lane Raniganj Bypass with a length of 5.26 km on NH-14 (old NH-60) in Paschim Bardhaman district on EPC (Engineering, Procurement and Construction) mode in West Bengal.

    Gadkari said that NH-14 starts from its junction with NH-12 (Old NH 34) near Morgram connecting Rampur Hat, Siuri, Raniganj, Bankura, Garhbeta, and Salbani and terminating at its junction with NH-16 (Old NH 2) near Kharagpur in West Bengal.

    The Minister said the entire stretch is a 2-lane one with a paved shoulder configuration.

    This corridor is acting as one of the prime corridors for the traffic plying from south Indian states and Odisha towards north Bengal and northeastern states, he added.

    Gadkari said it connects many important industrial, religious and agricultural centres such as Kharagpur, Midnapore, Chandrakona Road, Garbeta, Bishnupur, Bankura, Raniganj, Pandabeshwar, Dubrajpur, Suri, Rampurhat, Nalhati, etc.

    Kolkata: Purported image of a few pages of the English second language question paper was circulated on social media, sometime after the class 10 state board examinations began in West Bengal on Friday, the second day of the exams.

    The image of the question paper was uploaded on WhatsApp from an exam centre in Malda district, Education Minister Bratya Basu said.

    West Bengal Board of Secondary Education (WBBSE) President Ramanuj Ganguly said it cannot be termed a leak as only three of the 16 pages of the question paper were circulated on WhatsApp one and a half hours after the three-hour-long exam started at 12 noon.

    “How can it be called a leak? The candidates were inside the exam centres and the exams were already in progress. You can describe it as an attempt by someone to sabotage the smooth conduct of the examination process. The board will not treat the issue lightly,” he said when contacted by PTI.

    Ganguly, who is touring exam centres in various districts since Friday, said the board has requested the state administration to trace the origin of this WhatsApp post which was later forwarded many times.

    “The image of the question paper was circulated from an exam centre in Malda district. As stated by the Board president, I also think it is an act of sabotage. The board President will probably submit a report by tomorrow,” the education minister told reporters on the sidelines of an event.

    A guardian of an examinee in a north Kolkata school, who got the image on her WhatsApp number, said it was forwarded from one of her acquaintances in Murshidabad district.

    Altogether 6,98,627 candidates are writing papers in 2,867 centres in the Madhyamik Examination conducted by the WBBSE. The exams began on February 23 and will continue till March 4.

    In 2022, a purported image of the English question paper similarly surfaced on social media but the Board had said it was fake with no resemblance to the original one.

    In past editions of the Madhyamik exams between 2017 and 2019, there had been similar instances when images of purported question papers of English, Physical Science and other subjects circulated on social media after the start of the exams. However, each time they did not tally with the original.

    Kolkata: Accusing the Mamata Banerjee government in West Bengal of misleading members of Scheduled Caste and Scheduled Tribe communities with “fake assurances”, BJP leader Sudip Das on Monday asked them to be “cautious” about the ruling dispensation’s game plan in future.

    Das, who led a rally of backward caste members of the BJP in Esplanade, said the TMC-controlled government is only interested in appeasing the minority community, overlooking the welfare of SC, ST and OBC members.

    “When it comes to delivering on the promises made to backward caste community members, including Matuas, Chief Minister Mamata Banerjee always fails. Members of Dalit and general category are overlooked when it comes to hiring them for state government jobs,” he alleged.

    In sharp contrast to the “double-faced policy” of the TMC regime, the BJP government at the Centre has shown its commitment to backward caste and Dalits by nominating personalities like Ramnath Kovind and Droupadi Murmu for the post of President, Das, the BJP state SC Morcha chief, said.

    “There are around 2.20 crore members of various backward communities in the state with several assembly seats reserved for them. If we all get together against the injustice meted out by the state government, the hypocrite anti-Dalit TMC can be defeated,” he stated.

    Das also claimed that “majority of those killed in TMC terror after the 2021 assembly poll results belonged to the backward caste”.

    The rally, attended by over 500 members of SC, ST and OBC members, was also addressed by BJP MLA Ambica Roy and several other leaders belonging to the morcha.

    Making light of the allegation, TMC state spokesperson Kunal Ghosh said that his party gives little importance to what the BJP says.

    “None should teach us ways to show respect to Matua community members. Our chairperson Mamata Banerjee has been a great admirer of Matua sect founder Harichand Thakur and ‘Baroma’ Binapani Devi.

    “The TMC has always worked for the welfare of backward community members including Matuas,” he added.
