    Karnataka Golf Association is a ‘public authority’ under RTI Act, declares HC

    Bengaluru: Dismissing a petition by the Karnataka Golf Association (KGA), the High Court has upheld the decision of the Karnataka Information Commission (KIC) that it is a ‘public authority’ under the Right to Information (RTI) Act.

    The KIC had declared the KGA a public authority under Section 2(h) of the RTI Act in an order on October 14, 2014. KGA had challenged this order before the HC.

    Justice N S Sanjay Gowda heard the final arguments and delivered his judgment on the petition recently.

    In a batch of petitions earlier, the High Court had held that societies registered under the Karnataka Societies Registration Act such as Bangalore Turf Club, Mysore Race Club, Ladies Club and the Institution of Engineers (India) which were granted lands on the basis of lease by the government were public authorities since the grant of lands under lease amounted to these clubs being substantially financed by the government.

    The HC in its judgment on the KGA said, “The government order which is produced along with this petition indicates that 124 acres of land has been leased to the petitioner’s Association for a period of 30 years from May 17, 2010, subject to the petitioner paying two per cent of annual gross income as lease rent for the fresh lease period.”

    Thus, KGA was a public authority, the HC said.

    “In my view, the fact that 124 acres of land has been leased on two per cent of the annual gross income would indicate that the Association has been substantially financed by the State. It is to be noticed here that the Golf Association can run the Golf Course only if the land is available to them and if the land is given to them on a heavily subsidised rent, this would amount to a substantial financing as contemplated under RTI Act,” the judgement said.

    Citing the earlier judgments in the cases of the other clubs, the HC said, “In my view, it would be appropriate to follow the decision rendered in the aforementioned Writ Petitions and uphold the order of the Karnataka Information Commission which has held that the petitioner is a public authority as contemplated under the RTI Act.”

    Umpathi S had filed a RTI application seeking information about the Club in 2012. Since his application was refused, he had approached the KIC.

    New Delhi: The petitioners seeking legal validation of same-sex marriage on Wednesday urged the Supreme Court to use its plenary power, “prestige and moral authority” to push the society to acknowledge such a union which would ensure LGBTQIA persons lead a “dignified” life like heterosexuals.

    A five-judge Constitution bench headed by Chief Justice D Y Chandrachud was told by senior advocate Mukul Rohatgi, appearing for one of the petitioners,that “the State should come forward and provide recognition to same-sex marriage.”

    He referred to the law on widow re-marriage, and said the society did accept it then and the “law acted with alacrity” and social acceptance followed.

    “Here, this court needs to push the society to acknowledge the same-sex marriage. This court, besides the power under Article 142 (which provides SC the plenary power to pass any order necessary for doing complete justice) of the Constitution, has moral authority and it enjoys public confidence. We rely on the prestige and moral authority of this court to ensure that we get our right,” Rohagti told the bench which also comprised Justices S K Kaul, S R Bhat, Hima Kohli and P S Narasimha.

    He said, “the State should come forward and provide recognition to same-sex marriage… which will help us leading a dignified life like heterosexuals.”

    At the outset of second day’s proceedings, Solicitor General Tushar Mehta, appearing for the Centre, filed a fresh plea urging the top court that all the states and UTs be also made parties to the proceedings on the pleas.

    In a fresh affidavit filed in the apex court, the Centre said it has issued a letter on April 18 to all the states inviting comments and views on the “seminal issue” raised in the pleas.

    “It is, therefore, humbly requested that all states and Union Territories be made a party to the present proceedings and their respective stance be taken on record and in the alternative, allow the Union of India, to finish the consultative process with the states, obtains their views/apprehensions, compile the same and place it on record before this court, and only thereafter adjudicate on the present issue,” the affidavit said.

    “It is submitted that the Union of India, has issued a letter dated April 18, 2023 to all states inviting comments and views on the seminal issue raised in the present batch of petition,” it said.

    Opposing the fresh plea of the government, Rohatgi said the pleas challenged the Central law, the Special Marriage Act, and just because the subject is there in the concurrent list of the Constitution, states and UTs need not be issued the notices.

    “You do not have to labour on this point,” the CJI said.

    Coming back to the submissions, Rohatgi referred to the judgements, including the decriminalisation of consensual gay sex, and said “The court was revisiting something which has already been decided”.

    “I am equal to heterosexual groups and it cannot be so that their sexual orientation is correct and all others are incorrect. I am saying let there be a positive affirmation…We should not be treated as lesser mortals and there will be full enjoyment of the right to life,” he said.

    The hearing is continuing.

    The top court on Tuesday made it clear that it will not go into personal laws governing marriages while deciding the pleas seeking legal validation for same-sex marriages and said the very notion of a man and a woman, as referred to in the Special Marriage Act, is not “an absolute based on genitals”.

    The outcome will have significant ramifications for the country where common people and political parties hold divergent views on the subject.

    The apex court had on November 25 last year sought the Centre’s response to separate pleas moved by two gay couples seeking enforcement of their right to marry and a direction to the authorities concerned to register their marriages under the Special Marriage Act.

    LGBTQIA stands for lesbian, gay, bisexual, transgender, queer, questioning, intersex and asexual.

    Srinagar, Apr 16 (GNS): The University of Kashmir said on Sunday that it completely dissociates itself from allegations leveled by some students regarding alleged paper leak of Kashmiri subjects in the National Eligibility Test (NET).

    A KU spokesperson said in a statement to GNS that the NET is conducted by the National Testing Agency, and not the University of Kashmir, and hence all the examination-related domains including confidential setting of question papers, conduct of examination and evaluation etc. fall solely within the jurisdiction of the conducting authority.

    The University, the spokesperson said, strongly condemns that its name is being dragged into the alleged paper leak claim when the University, as an institution, is not even remotely connected with the process.

    “We inform one and all to refrain from trying to harm the reputation of the University with baseless claims and allegations. The University reserves the right to take appropriate legal recourse in such situations since it concerns the institution’s reputation and prestige,” the spokesperson said. (GNS)

    New Delhi: A bench headed by Chief Justice of India D.Y. Chandrachud everyday usually hears around 100 cases on an average seeking urgent listing before the benches of the Supreme Court. The Chief Justice’s court is often packed with lawyers, who mention their matter seeking urgent hearing.

    During the mentioning of the cases, the Chief Justice is very soft spoken while engaging with lawyers and has rarely lost his cool during the court proceedings. However, on Tuesday, he got irked and warned a lawyer: “Don’t mess around with my authority.”

    The lawyer had mentioned a case and requested the court for an early hearing in the matter but after the bench told him that his matter will be listed on April 17, he asked the liberty to mention the matter before another bench. “I can mention before another bench, if permitted,” said the lawyer.

    The bench, headed by the Chief Justice, and also comprising Justices P.S. Narasimha and J.B. Pardiwala, told the lawyer not to play tricks with him and said: “You can’t mention it here and then elsewhere for an earlier date.”

    The lawyer understood that his submissions have irked the Chief Justice and expressed regret and said he should be excused for his submissions.

    The Chief Justice told the lawyer, “Yes, you are excused. But do not mess around with my authority”, as he proceeded with the mentioning process.

    New Delhi: Omnichannel eyewear unicorn Lenskart has signed a definitive agreement with Abu Dhabi Investment Authority (ADIA) to raise $500 million from the authority.

    The investment is an extension to last year’s funding round, helping Lenskart maintain its $4.5 billion valuation.

    The company said that the capital will be deployed to deepen its presence in Asia and the Middle East.

    ADIA’s investment includes some secondary purchase of shares from some early backers of Lenskart.

    The eyewear company has so far raised $1.5 billion in primary and secondary rounds, according to reports.

    Founded in 2010, Lenskart ships over 10 million pairs of eyewear every year and has over 20 million app downloads, 300 home eye test representatives as well as over 1,100 stores across India, Singapore, and Dubai, the company said last year.

    Lenskart is backed by Falcon Edge Capital, SoftBank, KKR, Temasek, Premji Invest and Kedaara Capital, among others.

    In June last year, the eyewear unicorn took a majority stake in Japanese eyewear brand Owndays in a deal that was reportedly around $400 million.

    This took the merged firm to reach 13 markets in Asia including India, Singapore, Thailand, Taiwan, Philippines, Indonesia, Malaysia and Japan.

    The company said it will continue its rapid expansion in India and South East Asia to serve the mass to mid-premium segments.

    Srinagar, Mar 14 (GNS): In a bid to ensure hassle free movement of vehicular traffic in summer capital Srinagar, the Regional Transport Authority on Tuesday said to have designated 25 additional routes for e-rickshaws in addition to the 18 routes already notified to ply in and around the City. This decision has been taken in the interest of the functioning of e-rickshaws to provide for a smoother public transport service.

    Regional Transport Officer, Kashmir, while sharing details, citing a notification, told GNS that the Ministry of Road Transport and Highways notification No. S.O. 2812(E) dated 30.08.2016, provides that “the provisions of sub-section (1) of section 66 (dealing with permit for transport vehicles) of Motor Vehicles Act, 1988 shall not apply to any transport vehicle of the category e-cart and e-rickshaw as defined in section 2A of the aforesaid Act used, or to be used, for the purpose of carriage of goods and passengers with their personal luggage respectively – Provided that the State Governments authorities may impose restrictions on plying of these vehicles in specific areas or specific roads.”

    “Whereas, the Regional Transport Authority in its last meeting had defined 18 (eighteen) routes listed at Annexure-A for plying e-rickshaws in Srinagar. Whereas, the number of e-rickshaws in the city has increased substantially and in the interest of functioning of e-rickshaws for a smoother public transport service, it was felt imperative to define the additional routes for e-rickshaws.”

    “The issue was considered in the meeting of Regional Transport Authority, Srinagar, convened on 13-03-2023, and it was decided that in addition to the already notified routes, the e-rickshaws shall be allowed to ply on some additional routes in and around Srinagar city”, the traffic regulatory officer said adding now therefore, the e-Rickshaws shall be allowed to ply on the following additional routes with the restriction that no e-Rickshaw shall ply anywhere on the National Highway and from Tengpora Bypass to Sonwar and Jehangir Chowk to Airport road segments in the Srinagar City.

    “The routes have been carefully selected, taking into consideration the busy areas, the most popular destinations, and the residential areas. The e-rickshaws have been allowed to operate on 45 routes, covering almost every part of the city.”

    The first route runs from Parimpora Bypass (Toyota Showroom) to Dharmunnah. The second one starts from Pantha Chowk and goes to Zewan via Gamander BSF Camp. The third and fourth routes start from Shalteng and go to Sharifabad and Kalunna respectively. The fifth route covers Shalteng to Umerabad/Mustafabad.

    The sixth and seventh routes start from Batmaloo and go to Tengpora via Dobhi Mohalla, Firdous Abad Colony, and to Allochi Bagh Gurduwara. The eighth and ninth routes start from JVC and go to Qamarwari via HIG Colony, MIG Boat Colony, and Cement Bridge to Palapora via Guzarbal Colony. The tenth and eleventh routes run from Khumani Chowk to Hakkarmula and Bemina Bye Pass to Khumani Chowk.

    The twelfth route runs from Hamdania Colony to Sharifabad via Durbal. The thirteenth and fourteenth routes start from Maharaj Gunj and go to Chattabal via Aali Kadal Watal Kadal Safakadal and Cement Bridge via Malik Sahib Ghaisi Mohalla and Zaina Kadal to Shaheed Gunj. The fifteenth route runs from Nawa Kadal to DC Office via Jama Latta Nawab Bazar Zaldagar Sona Masjid Karfalli Mohalla. The sixteenth route starts from Mirwaiz Manzil and goes to Wazapora, Nawa Kadal, Jamallata, Nawabazar, and SMHS Hospital.

    The seventeenth and eighteenth routes start from Gojwara-Nowhatta-Malkah-Rainawari and Rawalpora to Baghi Mehtab via Flood Channel Road. The nineteenth and twentieth routes run from Rawalpora to Peerbagh via Flood Channel Road and Kralpora to Wanabal. The twenty-first and twenty-second routes start from Tengpora Bridge to Narkara and Hyderpora Chowk to Shah-Anwar Colony/Gulbarg Colony/Gul-Bahar Colony.

    The twenty-third and twenty-fourth routes run from Chanapora Bridge via Gulshan Nagar to Baghi Mehtab Housing Colony and Chanapora to Ahmad Hospital via Methan. The twenty-fifth and twenty-sixth routes run from Srinagar Railway Station to National Highway Bypass and Nowgam Bypass to Arebagh, Magraypora, Mochua. The twenty-seventh and twenty-eighth routes start from B.K Pora to Kralpora and Nowgam Bypass to B. K Pora.

    The twenty-ninth and thirtieth routes run from Sempora to Balhama via Zaffron Colony and Ram Bagh to Jawahar Nagar and Rajbagh via Bund. The thirty-first route runs from Broadway to Indra Nagar, among others. (GNS)

    Hyderabad: Hyderabad Metropolitan Development Authority (HMDA) on Monday generated revenue of over Rs. 88 crores by conducting an auction of plots in Medipally village, Medchal-Malkajgiri district.

    Against the upset price of Rs 32000 per square yard, the auction received an average bid price of Rs. 58,730 per square yard. The highest bid price was Rs. 63000 per square yard.

    TSIIC plots in neighbouring district of Hyderabad

    Meanwhile, the Telangana State Industrial Infrastructure Corporation (TSIIC) will auction 326 plots located in Rangareddy, the neighbouring district of Hyderabad, on March 9, 10, 13, 14, 15, 16, and 17. These plots are situated in Manneguda, Munaganoor, and Kawadipally.

    The minimum upset price for these plots ranges from Rs 10,000 to Rs 30,000. The EMD amount for Manneguda and Munaganoor is Rs 1,00,000, while it is Rs 50,000 for Kawadipally. Interested buyers can register for the plots’ e-auction under TSIIC by paying a non-refundable registration fee of Rs 1180.
