    It’s also opening a window into yet another way powerful individuals and groups can wield influence in the state, often without public scrutiny and far outside the Capitol.

    Critics of Weinstein’s latest approach say it is pure “astroturf activism,” designed to look like he has a groundswell of support for his corresponding ballot initiative in an attempt to pressure Newsom to back it. And ethics experts contend Weinstein and AHF should be transparent about paying people to get signatures for the draft letter, which references by name the proposed new ballot initiative. California law on campaign advertising requires general or public communication that’s authorized and paid for by a committee to support a ballot measure to contain a “paid for by” disclaimer.

    Ann Ravel, former head of the state’s political and campaign ethics watchdog and chair of the Federal Election Commission, told POLITICO she believes the draft letter for Newsom must require a disclosure that states who is paying for it.

    “It is definitely a form of advertising and clearly for a political purpose,” Ravel said.

    Weinstein, himself a former candidate for Los Angeles City Council, has tried for years to cap rents in California. He has argued that affordable housing policy aligns with the foundation’s objectives and has spent tens of millions of dollars in recent years on failed statewide and local bids to limit rents and curb development.

    Newsom opposed two of those statewide efforts. One of them was Proposition 21 in 2020, which the governor suggested was unnecessary since California had already passed sweeping rent control — enacting the nation’s strongest rent caps and protections. Newsom also said it risked discouraging the availability of affordable housing. Before that, Newsom opposed Weinstein’s Proposition 10 in 2018, saying it may have unintended consequences on housing production that could be deeply problematic.

    Proposition 21 and Proposition 10 each were defeated by about 20 percentage points.

    Weinstein’s latest initiative — to repeal a 1995 state law known as Costa-Hawkins that prevents localities from limiting rental costs on certain properties — was submitted to the state late last year. He has until late August to gather nearly 550,000 signatures from registered voters to qualify the measure for the ballot. A fiscal analysis by the state found that AHF’s proposed repeal would lead to a possible drop in state and local revenues “in the high tens of millions of dollars per year over time,” depending on how localities responded to it.

    Weinstein’s corresponding draft letter hasn’t been publicized until now. But his pay-per-signature campaign represents a novel wrinkle in a system designed to promote direct democracy by ordinary citizens yet is often used by moneyed interests to circumvent the legislative process.

    In the documents obtained by POLITICO, the draft letter calls on Newsom’s support for “real rent control.” It charges that prior legislation the governor signed to impose “rent caps” on certain residential rentals still allows 10 percent yearly increases, “which Californians can’t afford.”

    The draft letter goes on to argue that even if Newsom doesn’t come out in favor of AHF’s repeal proposal, called the Justice for Renters Act, he should not use his political capital to oppose it.

    “Keep your promise,” the draft states. “Don’t stand with corporate landlords against renters.”

    Ged Kenslea, a longtime spokesperson for AHF, defended its use of the paid letter. In a statement, he said voters have a right to place a petition on the ballot and also have a right to sign a letter to the governor. “Critics of our efforts are simply trying to silence the voice of voters before they would even have a chance to consider the issue,” he said.

    The foundation also doesn’t believe a disclosure is warranted in this case, arguing that the letter is not meant for the public but for Newsom, an elected official.

    “It’s democracy at work,” Kenslea said, before again turning attention to AHF’s critics. “It is unconscionable that opponents to rent control and who seek unbridled profits for corporate developers are making a concerted effort to undermine the voices of community members concerned about skyrocketing rents and homelessness.”

    The fresh political ire directed at AHF comes as the organization sustains a barrage of attacks for failing to disclose financial payments to influencers and consultants. The group is also enduring criticism over its past scorched-earth campaigns and legal showdowns that have made Weinstein a pariah to many in the capital and around Los Angeles where he’s based. Last month, a Los Angeles Times investigation found potential conflicts-of-interest and disclosure failures involving AHF. California officials said last year they would refuse contracts with AHF to provide medicine and advocacy for hundreds of HIV-positive patients after accusing the nonprofit of improper tactics during health care plan rate negotiations. Weinstein countered the state was retaliating against him for pushing for higher rates.

    Democrats who have faced off against Weinstein predicted that the backlash over the paid-for letter would make the effort pointless.

    “The guy has such sub-zero credibility that it won’t be worth a grain of salt,” said Steve Maviglio, a Democratic strategist in Sacramento. “If his fingerprints are on it, it’s irrelevant to policymakers in California.”

    POLITICO spoke with a person approached by a signature gatherer in Sacramento who said they were asked to sign both the proposed ballot measure and the draft letter to Newsom separately. (It is standard practice for organizations and individuals to pay for signatures on ballot measures themselves and, indeed, on the documents related to the current ballot measure, AHF’s role is disclosed).

    Another person familiar with the operation confirmed that the draft letter did not contain a disclosure and provided a photograph of it taken at the site.

    POLITICO also reviewed voicemail recordings from a signature-gathering firm verifying that the campaign was paying $5 total for both signatures (one on the letter, the other on the ballot measure) as recently as April 6, including $3 for a signature for the rent control measure and another $2 for a signature for the letter.

    Ravel, who believes the law requires AHF to disclose its role on the letter, added that it might be different if the draft letter advocated the issue more generally versus being part of a paid campaign that clearly states the name of the measure.

    Others aren’t so sure, however. AHF may have some legal wiggle room on the disclosure piece, said Jessica Levinson, former president of the Los Angeles Ethics Commission.

    “Any good lawyer would make the argument that it’s not an ad but could later show up as a datapoint in an advertisement,” Levinson said.

    But, she concluded the emerging letter campaign does strike her as a workaround.

    “It’s one more example of what we always say: ‘We create a law and then people change their behavior or embark on new behavior in ways that push the boundaries of that law,’” she said.

    New Delhi: The Congress on Sunday accused the central government of indulging in “headline manipulation” and diverting attention from former Jammu and Kashmir governor Satypal Malik’s allegations over the 2019 Pulwama attack.

    Congress general secretary Jairam Ramesh alleged on Twitter that the “Modi machine” has quickly either suppressed the “revelations” or diverted attention from them by generating other headlines and debates, an apparent reference to the narrative around the killing of gangster-turned-politician Atiq Ahmad and his brother Ashraf.

    The BJP has cited Malik’s past remarks, including the one that mocked former Congress chief Rahul Gandhi as a “political juvenile”, and slammed him as the “disgraced governor of Jammu and Kashmir”.

    BJP’s I-T department head Amit Malviya had on Saturday tweeted an old remark of Malik, who has become a strong critic of the government in recent years, praising Prime Minister Narendra Modi as the “best PM” for Jammu and Kashmir, to hit out at his “U-turn”.

    Congress’ media department head Pawan Khera also slammed the government on Sunday, saying questions do not vanish by “headline manipulation”.

    He said, “Questions only increase. Why clean chit to China? Why no JPC on Adani? Where did 20K crores come from in Adani’s shell companies? Why no answers on Pulwama?”

    Senior Congress leader and MP Shashi Tharoor put out a Twitter thread summarising the “revelations” made by Malik which he said had been “under-reported” by the media.

    Tharoor said the “revelations” were on matters of national security which ought to be of concern to the nation.

    “There is no national security interest involved in suppressing the story, only the political interests of the ruling party. The media should press GoI for an honest admission of failure and corrective action. The 40 jawans won’t come back to us but they and our nation deserve the truth,” Tharoor said.

    The Congress had on Saturday demanded that the Centre reveal the outcome of the probe into the 2019 Pulwama incident in which 40 CRPF jawans were killed and asked why the paramilitary personnel were “denied” aircraft and made to commute by road despite the terror attack threat.

    Ramesh had accused the BJP-led Union government of “minimum governance and maximum silence” and sought its response to the allegations made by Malik, who was the governor of Jammu and Kashmir at the time of the Pulwama terror attack.

    There has been no reaction from the government since Malik’s interview to a news portal was released, while the BJP has said that there were serious questions about his credibility and cited various statements made by him in recent years.

    Sharing a clip of a recent interview, in which Malik withdrew a controversial comment he claimed Home Minister Amit Shah had made, Malviya had said Malik admitted to “lying and making up baseless stories on what Home Minister Amit Shah had said about Prime Minister Modi”.

    “No one took him seriously even when he made these allegations back then. But it raises serious questions on his credibility,” he had added.

    Earlier in the day, the Delhi Chief Minister, who has been asked to appear before the CBI in connection with an alleged liquor scam, hit out at Prime Minister Narendra Modi, alleging that the probe agencies were trying to frame him by torturing and threatening accused and witnesses in the excise case.

    “Kejriwal is speaking the language of gangsters like Atiq and indulging in theatrics to divert attention from scams of his government. He is also trying to avoid the questions of the investigating agencies by giving arguments,” alleged Delhi BJP president Virendra Sachdeva.

    But the people of the country have not forgotten Kejriwal’s questioning the valour of the Indian army and his suggestion to build a hospital instead of Shri Ram Mandir in Ayodhya.

    “Why did they withdraw the liquor policy after the CBI probe was recommended? Why was Rs 144 crore waived under the policy to benefit liquor mafia? He should also answer if the policy was changed in a meeting at his residence,” Sachdeva asked Kejriwal, and said 100 letters will be sent to him every day till he gives his response.

    BJP MP Parvesh Verma said, “He should give us time to meet. I will prove corruption with all the proof. Will Kejriwal quit politics if the corruption charges are proved?”

    Verma said that Kejriwal is scared because perhaps he has realised it’s now his turn to go to jail.

    He also alleged that Kejriwal did not keep a single department with him, nor signed any file, apparently suggesting that he knew about the alleged corruption.

    New Delhi: With the BJP accusing him of insulting OBCs with his “Modi surname” remark, Congress leader Rahul Gandhi on Saturday said he has been talking of brotherhood in all his speeches and the ruling party was just trying to divert attention from the Adani issue by making such allegations.

    Gandhi was on Thursday sentenced to two years in jail by a Surat court in a 2019 criminal defamation case over his “why all thieves have Modi surname” remark.

    Several BJP leaders, including party chief J P Nadda, have accused Gandhi of insulting Other Backward Classes (OBCs) through his remark in 2019.

    Asked about the BJP’s allegation, Gandhi said at a press conference here, “Look at any of my speeches in the Bharat Jodo Yatra, I am saying that all communities are the same, everyone should move forward together, there should be brotherhood, there should be no hate, there should be no violence. So my position is absolutely clear.”

    “This is not an issue of OBCs, this is an issue of the relationship between Narendra Modi and (businessman Gautam) Adani. I am asking how Adani shell firms got Rs 20,000 crore and want an answer to that,” he said.

    “The BJP tries to divert attention, they will sometimes talk of OBCs, sometimes of (remarks) abroad, sometimes about disqualification or something else but the question remains — Rs 20,000 crore belong to whom?” he said.

    Responding to media queries on the BJP’s charge of insult to OBCs, Gandhi described these questions as peddling of BJP’s agenda and asked if they were posed following orders from the ruling dispensation.

    Attacking Gandhi over his remark on media queries, BJP’s IT department head Amit Malviya tweeted, “I am told the journalist Rahul Gandhi snubbed for asking a perfectly legitimate question has been covering the Congress for 15 years and is fairly aligned. Yet, he was shot down, the moment he stepped out of the line. What arrogance! But Rahul Gandhi is messiah of free’ press.”

    Meanwhile, Chhattisgarh Chief Minister Bhupesh Baghel hit out at the BJP over its charge of insulting OBCs, saying it wants to divert attention from the Adani issue.

    “Does Akhilesh Yadav, Lalu Yadav, Tejashwi Yadav, Bhupesh Baghel or Tamil Nadu chief minister not belong to the backward classes? Why is BJP creating trouble for all of us?” he said.

    Hyderabad: Bharatiya Janata Party Telangana president Bandi Sanjay Kumar on Friday accused Bharat Rashtra Samithi MLC K Kavitha of using the hunger strike in support of the Women’s Reservation Bill to divert people’s attention from her involvement in ‘liquor mafia’.

    Speaking at the ‘Mahila Gosa-BJP Bharosa’ dharna at the party headquarters in Hyderabad, he said that Kavitha has no ‘moral right’ to take up a strike for women’s bill and alleged that she had no support of any women in the state.“The entire country is bowing its head in shame because of Kavitha’s nefarious activities,” he added.

    “It is an open secret that the only well-known female face in the Bharat Rashtra Samithi party is K Chandrashekhar Rao’s daughter. Even in Telangana Jagruthi, there is no other woman except Kavitha. People are laughing at her for taking up the strike for the women’s bill,” said Sanjay.

    He said that Telangana women were scared of two flags – that of the BRS and the AIMIM, as the parties were protecting those accused of atrocities on women.

    He questioned why the women’s bill was not discussed at the cabinet meeting convened by KCR on Thursday and why the BRS MPs had not raised the issue in Parliament.

    The BJP leader also questioned why KCR was not following the 33 percent quota for women in the formation of cabinet, distribution of party tickets to MPs and MLAs, and BRS organisational structure.

    The BJP state president said, “During the Atal Bihari Vajpayee regime, the NDA government had introduced the bill on July 13, 1998 but it was torn to pieces by Rashtriya Janata Dal”.

    “Even in 1999, 2002 and 2003, the NDA government introduced the women’s reservation bill, but the opposition parties had opposed the same,” alleged Sanjay.

    He said that the Modi government had given utmost respect to women, as many as 11 women were inducted into the Modi cabinet. “Sushma Swaraj is the first female foreign minister and Nirmala Sitaraman is the first defence and finance minister,” he added.

    “An Adivasi woman has been made the President of India, eight women were made Governors and four as chief ministers. Women were given prominent positions in all the three military forces,”Sanjay said.

    Accusing KCR of doing nothing for the women in the state he recounted the Union government’s schemes that benefited women. “Modi had granted gas connections to nine crore women, power connections to 2.5 crore people under Sowbhagya scheme, houses for 3 crore women and opened 25 crore Jan Dhan bank accounts for 25 crore women,” he added.

    Hyderabad: BJP MP Arvind Dharampuri has alleged that BRS leader K. Kavitha’s proposed ‘dharna’ on women’s reservation Bill is an attempt to divert people’s attention from her involvement in Delhi liquor policy scam.

    The MP from Nizamabad on Wednesday targeted the Member of Telangana Legislative Council after the Enforcement Directorate (ED) summoned her for questioning in the case.

    Calling Kavitha’s proposed dharna in Delhi on women’s reservation Bill a farce, the BJP leader suggested her to convince her father and Telangana Chief Minister K. Chandrasekhar Rao to accommodate 33 per cent women in his cabinet.

    “Aap chronology Samjiyea KCR govt. didn’t have a single woman in his cabinet from 2014-2018, for obvious reasons of Ms Kavitha’s hegemony in the party, who was an MP from Nizamabad then. After losing to BJP candidate in 2019 General Elections, subsequently becoming MLC in Nepotism quota & now evolving as a key conspirator in Delhi liquor scam, her sudden epiphany to fight for Women’s Reservation bill is just her futile attempt to divert people’s attention,” tweeted Arvind, who had defeated Kavitha in 2019 Lok Sabha election.

    The BJP MP also slammed Kavitha for her statement issued earlier in the day after ED issued summons to her.

    “Telangana never bowed down to anyone in the First or Recent Telangana movement, but now is bowing in shame before the Nation in the light of your involvement in Delhi liquor scam,” he wrote.

    “Let me also remind the power mongers in Delhi that Telangana has never and will never bow before the oppressive anti people regime. We will fearlessly and fiercely fight for the rights of the people,” Kavitha had stated in her statement.

    Arvind also reminded Kavitha that her community represents not more than one per cent of Telangana population but represents more than 22 per cent of the Telangana cabinet. “Kindly convince your father to accommodate 33% women in his cabinet to gain tiny sanctity to your farce agitation on Women Reservation Bill,” Arvind told the MLC.
