    Karnataka Golf Association is a ‘public authority’ under RTI Act, declares HC

    Bengaluru: Dismissing a petition by the Karnataka Golf Association (KGA), the High Court has upheld the decision of the Karnataka Information Commission (KIC) that it is a ‘public authority’ under the Right to Information (RTI) Act.

    The KIC had declared the KGA a public authority under Section 2(h) of the RTI Act in an order on October 14, 2014. KGA had challenged this order before the HC.

    Justice N S Sanjay Gowda heard the final arguments and delivered his judgment on the petition recently.

    In a batch of petitions earlier, the High Court had held that societies registered under the Karnataka Societies Registration Act such as Bangalore Turf Club, Mysore Race Club, Ladies Club and the Institution of Engineers (India) which were granted lands on the basis of lease by the government were public authorities since the grant of lands under lease amounted to these clubs being substantially financed by the government.

    The HC in its judgment on the KGA said, “The government order which is produced along with this petition indicates that 124 acres of land has been leased to the petitioner’s Association for a period of 30 years from May 17, 2010, subject to the petitioner paying two per cent of annual gross income as lease rent for the fresh lease period.”

    Thus, KGA was a public authority, the HC said.

    “In my view, the fact that 124 acres of land has been leased on two per cent of the annual gross income would indicate that the Association has been substantially financed by the State. It is to be noticed here that the Golf Association can run the Golf Course only if the land is available to them and if the land is given to them on a heavily subsidised rent, this would amount to a substantial financing as contemplated under RTI Act,” the judgement said.

    Citing the earlier judgments in the cases of the other clubs, the HC said, “In my view, it would be appropriate to follow the decision rendered in the aforementioned Writ Petitions and uphold the order of the Karnataka Information Commission which has held that the petitioner is a public authority as contemplated under the RTI Act.”

    Umpathi S had filed a RTI application seeking information about the Club in 2012. Since his application was refused, he had approached the KIC.

    Hyderabad: The Police Officers Association has condemned the YSR Telangana Party chief Y S Sharmila over her assault on police personnel earlier in the day while she was being detained by the Telangana police on Monday.

    In a press release, Vijayamma and the Hyderabad City Police Officers’ Association president Nalla Shankar Reddy condemned Sharmila’s behaviour towards police personnel.

    “We strongly condemn Sharmila’s behaviour, rudeness and assaulting the police. Such actions should not test the police’s patience by hurting their self-esteem. In the recent past, some political leaders with positions of power have, in the past, tried to undermine the morale of the police which such cheap measures,” the statement read.

    The Telangana Police has the highest recognition in the country in monitoring peace and security in society and controlling crime, the press release ended.

    Following the assault, Y S Sharmila was arrested on a complaint by a sub-inspector. Her two drivers were also booked under various sections of the Indian Penal Code (IPC).

    Earlier, Deputy Commissioner of Police Joel Davis said police had gone to Sharmila’s house following information that she was going to the office of the Special Investigation Team (SIT) probing the Telangana State Public Service Commission (TSPSC) question paper leak. Since there was no permission for Sharmila’s visit to the SIT office, the police personnel were trying to explain the same to her but she assaulted police personnel.

    The driver of Sharmila’s car also did not stop the car on the order of the police and hit them, injuring constable Giribabu.

    Sharmila’s husband Anil Kumar later went to Jubilee Hills police station and met her.

    Hyderabad: Leading surgeon Dr Raghu Ram Pillarisetti has received lifetime achievement award by the Telugu Association of London.

    Dr Raghuram is the founding director of AKIMS-Ushalakshmi Centre for Breast Diseases in Hyderabad. He is one of the youngest recipients of the award and the only person of Indian origin living outside of the UK to have been conferred the honour.

    The award was presented to him during the glittering Ugadi 2023 celebrations organised by the Telugu Association of London (TAL) in London. Representing over 10,000 Telugu speaking people in and around London, TAL is the largest Telugu Charity Organisation in the UK.

    “TAL has recognised Dr Raghu Ram with the Lifetime Achievement Award for his outstanding contribution towards transforming Breast Cancer Care in India. His distinguished academic track record, love for his motherland and passion for social service are his trademarks and he has achieved at a very young age, what most cannot achieve in a lifetime,” reads the citation.

    TAL founder chairman Dr Ramulu Dasoju and current chairperson Bharathi Kandukuri read out excerpts from the citation. Councillor Raghwinder Siddhu, Mayor of London Brorough of Hounslow, described Dr Raghu Ram as a perfect role model living bridge between the UK and India and has been an advocate of best practices in his chosen field coupled with human touch and many altruistic values.”

    Tollywood actor Sai Kumar felicitated Dr Raghu Ram with a “Lifetime Achievement award Pagadi” during the event.

    A Padma Shri and Dr B.C. Roy national awardee, Dr Raghu Ram revolutionised breast cancer care in India over the past 17 years through a series of innovative measures. He established South Asia’s First comprehensive Breast Health Centre and founded a charitable Foundation to raise awareness of the disease nationwide. He implemented South Asia’s largest population-based screening programme in the southern Indian states of Telangana and Andhra Pradesh. This programme is currently being rolled out nationwide.

    New Delhi: Delhi riots accused Asif Iqbal Tanha on Tuesday objected to the “intervention” by a news broadcasters’ association in his plea before the Delhi High Court against the “leak” of his alleged “disclosure statement” in the case pertaining to the larger conspiracy behind the 2020 violence.

    Counsel for News Broadcasters & Digital Association (NBDA) said the petition concerns a prayer for registration of FIR against journalists which would have ramifications and, being a well-recognised body, it wanted to assist the court in the matter by filing an intervention application.

    Following the application, Justice Anup Jairam Bhambhani had earlier suggested his recusal from the matter on account of his “past association” with the body.

    Senior advocate Siddharth Aggarwal, appearing for the petitioner, alleged that the association, which was “not interested” in the issue of broadcast of the alleged disclosure statement when a complaint was made to it, has now filed the intervention application to ensure that the eventuality of the judge’s recusal “must come true”.

    He asserted there can be no “intervention” by a third person in a criminal matter and urged the court to consider the fact that the application was filed only when the petition, which was filed in 2020, travelled through six judges to reach before this court for adjudication.

    “Notice is not for asking in criminal matters… this is not a PIL. I am espousing a personal cause. This is my grievance,” Aggarwal argued.

    Counsel for NBDA as well as another media organisation, which is seeking a hearing in the case, said their applications were not for recusal of the judge but only intervention.

    The counsel for the petitioner also said he was not seeking the recusal of the judge on account of any apprehension of bias.

    Justice Bhambhani then said although “recusal should not come so easy”, he “has to have some comfort to decide the matter” and there should be no perception of bias.

    “Recusal should not come so easy but there are higher considerations than deciding than A versus B… It is not actual bias but the perception of bias. Even deciding the application, I have to have the comfort level. I never get into a matter where I myself am not comfortable with my independence,” said Justice Bhambhani.

    Aggarwal said instances where applications are filed with the “knowledge” about a judge’s “predisposition” in relation to not hearing certain matters should be dealt with an “iron hand”.

    Additional Solicitor General Sanjay Jain, who appeared for Delhi Police, said the present case was not a “criminal matter as such” and the media organisations have a legitimate interest in its outcome.

    He said the issue of recusal pertained to the judge’s “conscience” and “nobody has to persuade” him on that issue as there was no application for recusal from any party.

    “There is a party your lordship has represented earlier (as a lawyer)… This (recusal) is your lordship’s own judgement,” Jain said.

    Senior counsel for Tanha has earlier argued that the application for intervention was an “attempt to overreach the institution” after Justice Bhambhani suggested sending the plea to another judge on account of his “past association” with NBDA.

    The senior counsel had then said that he would assist the court on the law of recusal, adding “This is the dirty tricks department at its worst and if we do not stand up to this, I think we are making it far too easy for people to do this exercise”.

    Tanha had moved the high court in 2020 against certain media houses disseminating his alleged admission of his guilt before filing of cognisance was taken by the trial court.

    In his petition, Tanha has said he was aggrieved by various publications reporting that he has confessed to orchestrating the Delhi riots and alleged that he was coerced to sign certain papers in the effective custody of the police.

    He has contended that the action of two media houses in placing contents from charge sheet in the media violated the programme code.

    Tanha, who was arrested in May 2020, was released from jail in June 2021 after the high court granted him bail in the riots case on larger conspiracy.

    In its status report filed the case, the police said that while the inquiry could not establish how the details of the investigation were shared with the media, no prejudice was caused to Tanha in his exercise of the right to a free and fair trial.

    Tanha’s counsel has earlier argued before the high court that the internal inquiry conducted by the police into the leak was an “eyewash”.

    The matter would be heard next on April 12.

    This is unique to Aligarh Muslim University that its students feel proud of continuing their association with their alma mater in whatever ways possible, even when they are no longer students and become involved with their professional and family duties. Various prominent cities across the globe, whatever shores did ex-Aligs reach. they formed AMU Alumni Associations and started working for social upliftment of society. Even if they don’t involve themselves in social and community development, they at least unite every year in the month of October to celebrate Sir Syed Day with great pomp and festivity. Present in various big cities all over the globe, these associations are called AMU Old Boys Association.

    In a first of its kind, AMU Old Boys Association Lucknow took the initiative of uniting the representatives of various Old Boys Associations spread across the globe to form a Global AMU Alumni Association, which aims at uniting the representatives of various associations spread in different cities and work cohesively and jointly for the benefit of AMU, its ex-students, their families and the AMU community at large.

    More than 200 ex-Aligs, representing AMU Old Boys Associations based in the United States, Canada, Britain, Saudi Arabia, Kuwait, Qatar and UAE and several old boys (read alumnis) from various cities in India, including many from Lucknow who chose to be physically present, joined in this hybrid meet of ex-Aligs.

    Most of the Aligs who joined commended AMU Old Boys Association Lucknow for this unique initiative. As per an online survey, 97.7  per cent of respondents agreed that the formation of a Global Association of ex-Aligs was the need of the hour and gave full authority to the AMU Old Boys Association Lucknow to proceed with formative procedures and relevant documentation. This too was agreed upon that the Global Association would work for the benefit of AMU, its ex-students and their families, and the AMU community on the whole. Representatives from various associations spread across the globe will be joined under an umbrella organization for effective carrying forth of welfare and other activities.

    A bit of a debate ensured whether the Secretariat of the Global Association be based in Aligarh, Delhi or Lucknow. However, a sizeable group was of the view that for the effective working of the Global Association, it was imperative that the Secretariat be anywhere but not in Aligarh itself.

    Professor Shakil Qidwai, President of the AMU Old Boys Association Lucknow, said that under such circumstances, the Lucknow Association be given the opportunity to host the Secretariat. Majority sided with this suggestion.

    Former President of AMU Old Boys Association Lucknow and well-known social worker and politician, Mohd Tariq Siddiqui presented the likely layout of the organization. He elaborated on the suggested format of the soon to be formed association, and how Old Boys Associations from various different cities and countries be united under an umbrella. Mohd Tariq Siddiqui was the Chief Guest at the Sir Syed Day celebrations of AMU Old Boys Association Al-Jubail (Saudi Arabia) in 2022 where initial discussions related to formation of a Global Association of various associations of AMU Old Boys was first mooted. Some prominent ex-students of AMU, residing in places in far off United States and the Middle East have been expressing about the need for such an organization. It goes to the credit of AMU Old Boys Association Lucknow that it took initiative and went ahead with the call for formation of the Global Association.

    As SM Shoeb, Secretary AMU Old Boys Association Lucknow aptly said, the Lucknow Association has been working ceaselessly and without any interruptions since 1975. Other than uniting for the Sir Syed Day functions in October each year, the Association is also very actively running various welfare programs for the benefit of the poor and the downtrodden. He welcomed all the participants in the Global Meet and informed that the next meeting will be held soon wherein the operative procedures of the organization will be laid out to the ex-Aligs.

    AMU Old Boys from various cities in Uttar Pradesh as well as Delhi were also present physically in the meeting.

    SRINAGAR: The All Jammu and Kashmir Patwar Association called off its strike after eleven days on Saturday. The announcement was made by the Association President after holding virtual meetings with the Divisional Commissioner and other regional offices of both Jammu and Kashmir.

    Addressing a presser, the All Jammu and Kashmir Patwar Association President Abdul Majeed, as per the news agency GNS said that a meeting was held between the Patwar association and several government offices in an attempt to resolve the issue.

    “The meetings were held in several phases and the first phase particularly was contentious”, he said adding the government offices tried to dissuade the Association, but members of the Association stood firm with their demands.

     

    “After the first phase, two more meetings were held. One of these meetings was conducted via video conference and was attended by the Commissioner Secretary of Revenue and other officials from Jammu,” he said. “The meeting was supervised by the Divisional Commissioner of Kashmir amid the presence of the members of the Association.”

    During these meetings, Majeed said, “the government requested three months to resolve the issue. However, the members of the Patwar Association resented the proposal, as they believe that the issues have already been lingering for too long. As a result, they proposed an alternative time of one month, which after a consensus the government agreed to.”

    “The Association as such decided to defer its strike for one month”, Majeed said adding that if the government fails to take concrete steps towards resolving the issue within the given period, they will resume their strike.

    “The members of the association are hopeful that the government will take their demands seriously and work towards a mutually beneficial solution,” he further opined. (GNS)

    Srinagar, Mar 7 (GNS): The Anantnag Patwar Association staged a sit-in protest at Achabal against the administration to press for an early redressal of their demands.

    Talking to GNS, the Patwar Association said they have also been demanding a hike in pay scales for Patwaris, timely departmental promotion of Patwaris and Girdawars, a ban on direct recruitment of Tehsildars, construction of Patwar Khanas, creation of Patwar Halqas and Girdawar circles, timely conduct of DPCs, and an increase in their allowances.

    “We are sitting here under the banner of All Jammu and Kashmir Patwari Association for the seventh consecutive day, to let the government know about our demands. We graduate patwaris have a grade pay issue which the government should consider.”

    “Like other Education and Finance departments have handsome grade pay, and teachers have a grade pay of 2800, while account officers in the finance department have handsome grade pay. Similarly, we graduate Patwaris demand a genuine increase in our grade pay.”

    “The other issue is that Girdawar circle and Pathwar Halqa are the same since the time of Maharaja Hari Singh. As we all are aware, so much development has been done since then we as such demand delimitation of Pathwar Halqa and Girdawar circle,” he said.

    “We would also like to draw the keen interest of the administration towards the direct recruitment of Naib Tehsildars and we demand a 75:25 quota, like the one in vogue in the Union territory of Ladakh. Of the 75%, Girdawars and departmental Patwaris should be promoted to Naib Tehsildar”, he further said.

    Meanwhile CPI (M) leader Mohamad Yousuf Tarigami has also urged the government to redress genuine demands of striking patwaris. “The strike of patwaris has paralysed the working in revenue department”, Tarigami said.

    “The administration has been giving assurances and making promises that their genuine grievances would be redressed, but nothing seems to be happening on ground, forcing them to go on protest. The demands include increase in the grade pay of graduate patwaris, timely departmental promotion of patwaris,girdawaris, rent for Patwar Khanas (Private accommodation), construction of new Patwar Khanas, creation of new patwar halqas and Girdawar circles are all genuine demands, which the must be fulfilled without any further delay”, Tarigami in a statement issued here said.

    He urged that the Government must talk to the representatives of the Association and take effective steps to settle their genuine demands. (GNS)
