    Jodhpur: The Rajasthan High Court on Monday granted bail to self-styled godman Asaram in a case pertaining to furnishing a forged RTI reply in the Supreme Court in support of his bail plea.

    Granting bail to Asaram, Justice Kuldeep Mathur of the high court’s Jodhpur bench observed that no direct role was attributed to the petitioner in the creation of the forged RTI reply submitted before the apex court and the offences alleged to have been committed by him are triable by a magistrate.

    Asaram is already serving a life sentence since 2018, following his conviction in a case of sexual exploitation of a minor student of his “gurukul”.

    The court also took into account that co-accused Ravirai Marwah has already been granted bail and the trial is likely to go on for long.

    The case was lodged against Asaram after Marwah, one of his sympathisers, submitted the forged RTI reply pertaining to the self-styled godman’s health condition in the Supreme Court for the purpose of his bail in 2016.

    The document was allegedly obtained from a Jodhpur jail through an application filed under the the Right to Information (RTI) Act by one Ganesh Kumar and was provided to Marwah, who subsequently handed it to Asaram’s lawyer in the apex court.

    On finding that the document was forged following an objection by the state government, the Supreme Court had directed police to file a case against Asaram and Marwah despite the self-styled godman tendering an apology in the court.

    Asaram’s counsel Gokulesh Bohra said police had arrested Asaram in the case from the Jodhpur jail on a production warrant and filed a chargesheet against the two.

    “While Marwah has already been granted bail, we also argued in the court that Asaram has already been in judicial custody in another criminal case for the last 10 years and he is not allowed to meet devotees and other visitors in the absence of the jail authorities,” Bohra said.

    He further told the court that the petitioner could not have had any opportunity to prepare a fake document and was only a signatory to the vakalatnama filed before the Supreme Court for bail.

    Asaram files appeal in Gujarat HC against conviction in rape case

    Ahmedabad: The Gujarat High Court on Thursday admitted to hearing an appeal filed by self-styled godman Asaram against a recent trial court order convicting him of rape.

    The Gandhinagar sessions court in January this year sentenced Asaram to life imprisonment in a rape case, based on a complaint filed by a former woman disciple in 2013.

    A division bench of Justices S H Vora and Mauna Bhatt heard the appeal briefly on Thursday and admitted it for final hearing.
    The sessions court convicted Asaram of rape, unnatural offences and wrongful confinement.

    A woman disciple from Surat had alleged that Asaram raped her on several occasions between 2001 to 2007 at his ashram at Motera near Ahmedabad. The 81-year-old `godman’ is currently serving a life sentence in a Jodhpur jail in another case where he was accused of raping a girl at his ashram in Rajasthan in 2013.

    In its order, the Gandhinagar court noted that Asaram sexually abused a victim who was younger than his daughter.

    “The accused committed a very serious crime against society and such a heinous crime cannot have any place of sympathy and should be punished to the fullest extent prescribed by law…It becomes the moral responsibility not only of the society but also of the court to set an example and prevent such behaviour,” Additional Sessions Judge D K Soni noted in the order.

    In a 2013 rape case, a court in Gujarat’s Gandhinagar on Wednesday gave self-described godman Asaram Bapu a life sentence. The 81-year-old was found guilty in 2013 of raping a former female disciple.

    Ashupal Harpalani, alias Asaram Bapu, was found guilty of rape and criminal intimidation by a district and sessions court in Gandhinagar on Monday. Five other co-accused in the case were found not guilty.

    Asaram’s wife is one of them who was exonerated.

    Gandhinagar: A court in Gujarat’s Gandhinagar on Monday found “godman” Asaram Bapu guilty in a 2013 rape case, and will announce the quantum of punishment on Tuesday.

    The Additional District Sessions Court, however, acquitted six other accused in the rape case – Asaram’s wife Lakshmiben, daughter Bharati, Nirmala Lalvani, Meera Kalvani, Dhruvben Lalvani, and Javantiben Chaudhary.

    Special Public Prosecutor R.C. Kodekar told media that the victim had registered a case with Surat police, which was transferred to Ahmedabad police in 2013. The Chandkheda police station had registered a case under various section of the IPC, including rape by one or more in group, common intent, unnatural offence, criminal force on women, wrongful confinement and criminal intimidation against 8 persons, including Asaram Bapu, and his son Narayan Sai.

    While Asaram is presently in Jodhpur jail following conviction in another rape case, a separate trial against Narayan Sai is going on in the Surat court.

    Two sisters had filed complaint against Asaram and his son, alleging that between 1997 to 2006, they were raped at the Motera Ashram run by Asaram and his son. The younger sister had lodged a complaint against Narayan Sai and the older against Asaram.
