SC dismisses plea seeking direction to issue public apology to relative of Narayan D Apte

    [ad_1]

New Delhi: The Supreme Court on Friday dismissed with a cost of Rs 25,000 a plea which sought a direction to the Centre to issue a public apology to a relative of Narayan D Apte, who was hanged in November 1949 for his role in the assassination of Mahatma Gandhi, for being responsible for his “custodial murder”.

The plea also challenged the constitutional validity of a law which granted ex-post facto powers to a special judge to grant pardon to an accused saying it was used to “falsely implicate” Vinayak Damodar Savarkar in the Gandhi murder trial.

“Everybody can just walk-in in this court and file whatever they want?” a bench of Justices S K Kaul and A Amanullah wondered.

    MS Education Academy

The bench also referred to one of the prayers made in the petition, filed by Abhinav Bharat Congress’ through its founding president Pankaj K Phadnis, which said in “partial atonement of injustice” done to Savarkar, the Centre may be directed to form an empowered committee of eminent persons for giving overseas scholarship to meritorious students for undertaking post graduate studies as envisaged by Savarkar in 1944.

“I think we should impose cost,” the bench told the counsel who was appearing for the petitioner.

“You cannot waste our time like this,” the apex court observed, adding, “The habit of walking in this court without anything….we will not allow this”.

The counsel said the petition is not for either Nathuram Godse or Savarkar and it was only for Apte.

The bench dismissed the plea with a cost of Rs 25,000 to be deposited in the lawyers’ welfare fund.

The petition had challenged the constitutional validity of the Bombay Public Security Measures (Delhi Amendment) Act, 1948, which amended section 13 of Bombay Act 6 of 1947 by introducing sub section 2 (A).

It said this granted ex-post facto powers to a special judge to grant pardon to an accused and the powers were used to falsely implicate Savarkar in the Gandhi murder trial and “eliminate him as contender for being Prime Minister in independent India.”

“The murder trial of such an esteemed person (Mahatma Gandhi) had to be conducted in a manner that ought to have set standards for criminal trials in Republic of India. Respondent failed to do so to promote his own vested interests” it claimed.

The plea alleged that the three victims of the “legal mistrial” were Savarkar, D S Parchure and Narayan D Apte.

Pachauri had filed a contempt of court petition in February 2016, alleging several media houses for deliberately and contemptuously not following the court’s orders restricting them from publishing sexual harassment claims against him.

“The counsel for respondent No. 5 (Arnab Goswami) states that she as well will file an affidavit tendering unconditional apology within a period of one (1) week. It is ordered accordingly,” Justice Manmeet Pritam Singh Arora recorded in his order.

  • Vivek Agnihotri appears in Delhi HC, tenders apology, gets discharged

Vivek Agnihotri appears in Delhi HC, tenders apology, gets discharged

    [ad_1]

New Delhi: Filmmaker Vivek Agnihotri appeared before the Delhi High Court on Monday and tendered an unconditional apology in connection with a criminal contempt case over his alleged remarks against a judge of the court.

Accepting his apology, a bench of Justices Siddharth Mridul and Vikas Mahajan discharged Agnihotri of the contempt charge and cautioned him to remain careful in the future.

The high court recalled the criminal contempt notice issued to him and noted that an affidavit filed by Agnihotri also reflected the regret and remorse unconditionally expressed by him to the court.

    MS Education Academy

“In view of the circumstances that Vivek Agnihotri stated that he has utmost respect for the institution of judiciary and did not intend to wilfully offend the majesty of this court, the notice to show cause issued to him is hereby recalled. Vivek Agnihotri stands discharged as the alleged contemnor,” the bench said.

“Mr. Agnihotri we will be cautioning you to be careful in future,” the bench told the filmmaker who appeared before the court in pursuance of its earlier direction.

In 2018, the filmmaker had put out tweets alleging bias against Justice S Muralidhar, who was then a judge of the Delhi High Court and is currently the chief justice of the Orissa High Court, as he had released rights activist Gautam Navlakha from house arrest in the Bhima-Koregaon violence case.

Subsequently, contempt of court proceedings were initiated against Agnihotri and others by the high court.

On December 6 last year, the court asked the filmmaker to “show remorse in person” after he tendered an unconditional apology through an affidavit.

“We are asking him (Agnihotri) to remain present because he is the alleged contemnor. Does he have any difficulty in appearing before this court? He has to be present and show remorse in person,” the court had said.

The lawyer appearing for another alleged contemnor, Anand Ranganathan, assured the court that he would remain present before it on May 24, the next date of hearing in the case.

During the hearing, Justice Mridul said courts do not punish for contempt to secure their dignity as the dignity of courts does not come from what people have to say about judiciary but from the duties the courts discharge.

Referring to a previous judgement of the Supreme Court in a contempt case, the bench said, “Our dignity is founded on a stronger foundation and not on what somebody says about us. There are times when you have to give quietus to things.” The high court said it had kept the matter pending only to make it clear that “you can’t make things irresponsibly”.

It noted that Agnihotri has reiterated his remorse and tendered an unconditional apology for the alleged offensive statement made on Twitter.

“Twitter is a great source of misery,” the bench orally observed.

It also said every citizen of the country must know that they should be careful and added, “we invite just and fair criticism…” Senior advocate Arvind Nigam, who is assisting the court in the matter as an amicus curiae, had earlier informed that Ranganathan has made a tweet in relation to the contempt proceedings that he would go down fighting.

The court had initiated the contempt proceedings in the present case on its own after receiving a letter from senior advocate Rajshekhar Rao. Rao, in his letter, had stated that the tweets were a deliberate attempt to attack a high court judge.

The contempt proceedings were also initiated against Swaminathan Gurumurthy, the editor of the Chennai-based weekly, “Thuglak”, for his tweets against the judge.

The proceedings against Gurumurthy were subsequently closed in October 2019.

Earlier, the court had directed two social media platforms to block the weblinks to an offending article levelling scandalous allegations against the judge.

Modi surname row: BJP to seek Rahul’s apology during OBC outreach programme

    [ad_1]

New Delhi: The BJP has decided that the party, during its new outreach programme at village chaupals across the country, will seek an apology from Congress leader Rahul Gandhi for “insulting OBCs”.

BJP OBC morcha chief K. Laxman said on Tuesday that the party will seek an apology in every village chaupal “for the insult” inflicted by Congress leader Rahul Gandhi through his comments. This will be done during the “Gaon Gaon Chalo Ghar Ghar Chalo” campaign of the party.

He said: “Party will reach one crore OBC households in one lakh villages during the campaign, which will start on April 6 and end on April 14, the birth anniversary of B.R. Ambedkar. We will also focus on popularising the Modi government’s OBC-friendly schemes and policies during the campaign.”

“Our workers in every village will compare and explain how Prime Minister Modi worked for the development of the OBC community in nine years, while the Congress only cheated OBCs during 60 years of its rule,” Laxman asserted.

  • BJP asks if Cong want complete freedom for Rahul to abuse others, seeks his apology

BJP asks if Cong want complete freedom for Rahul to abuse others, seeks his apology

    [ad_1]

New Delhi: The BJP on Thursday asserted that the law has to take its course if Rahul Gandhi abuses people and slammed the Congress over its criticism of his conviction in a defamation case, asking whether the opposition party wants “complete freedom” for him to “abuse” others.

BJP leader and former law minister Ravi Shankar Prasad cautioned Gandhi, saying he will find himself facing “more troubles” if he doesn’t refrain from making defamatory remarks, while Union Minister Piyush Goyal asked the Congress leader to apologise for his series of “defamatory” comments.

Both the leaders also hit out at Congress president Mallikarjun Kharge for questioning the court’s order by noting that several judges hearing the matter were changed.

“They should come out of their dynastic mindset and realise that no one is above the law,” Goyal told reporters, while Prasad accused Kharge of contempt of court at another presser.

It was “grossly unfair” on the part of Kharge to make such comments, Prasad said.

Making such comments show that the Congress does not believe in the judiciary, he said and asked, “Does it want to keep even the judiciary in its pocket.”

“If they think that they would get action in their favour by levelling allegations against the judiciary and putting pressure on it, it is their misconception,” he said.

Asked whether Gandhi will be disqualified from Lok Sabha, Prasad cited the provisions made in the Representation of People Act in this regard and said it is for Speaker Om Birla to decide. “This is speaker’s decision. I don’t have to say anything on that,” he said.

On Thursday, a court in Gujarat’s Surat sentenced Gandhi to two years in jail in a 2019 criminal defamation case filed against him over his “Modi surname” remarks.

The case was filed against the Congress MP for his alleged “how come all the thieves have Modi as the common surname?” remark on a complaint lodged by BJP MLA and former Gujarat minister Purnesh Modi.

Goyal said, “We are all in public life and have to chose our words wisely and maintain basic decorum and dignity in public discourse. Gandhi has disrespected people and every democratic institution be in Parliament or democracy. He should apologise for his series of defamatory statements.”

The BJP leaders in this context mentioned various allegations levelled by the former Congress president, be it during his recent visit to Britain or in the Rafale case.

Prasad said Gandhi with his comments insulted people with Modi surname, asserting that it was very much defamatory.

“The Congress party and others are saying many things but they are not saying what Rahul Gandhi had said,” he said and asked, “Won’t any action be taken against you if you insult a surname in such a way?”

He said Gandhi got the opportunity to defend his case and his lawyers argued in the court before the verdict was given. He has been convicted in the case because the court was not convinced with the arguments made in his defence, Prasad added.

It has become Gandhi’s “nature” to weaken and defame the country as well as level the “filthiest abuse like accusations” against Prime Minister Narendra Modi and the BJP, Prasad said, cautioning him against continuing with such remarks.

A number of defamation cases has been filed against Gandhi for his remarks, he said.

Referring to the defamation case in Gujarat, Prasad said a similar case was filed against Gandhi in Patna by BJP leader Sushil Kumar Modi and its proceedings are underway.

The BJP leader also took a swipe at Gandhi for his remarks in a tweet after the court’s verdict in his case in Gujarat, asking if his faith in truth and non-violence meant insulting people by abusing them citing their caste.

“You will abuse freely, insult country’s Army, make fun of the Martyrs’ supreme sacrifices, insult patriotism, insult people’s votes, people’s manadate and say you are worshipper of ‘satya’ (truth) and ‘ahimsa’ (non-violence),” he charged.

Prasad said if the Congress leader has the right to abuse people, those aggrieved also have right to file case against him.

“Does Congress want Rahul Gandhi to have complete freedom to abuse people? There is rule of law in the country and it will prevail,” the BJP leader said, alleging that the Congress leader has a history of making defamatory comments and unfounded allegations.

“The law of India has it that if an individual or an organisation has been defamed with scurrilous statements, scandalous comments, abuses or any defamatory remarks, then he has a right to seek redress. But the Congress party has an objection. It wants complete freedom for Rahul Gandhi to throw abuses,” he added.

Prasad also lashed out at Gandhi for his recent democracy remarks in the UK, saying democracy is run by certain probity and propriety with regard to fair play.

“One of the most element of that is you please respect the popular verdict,” he added.

Will run nationwide campaign to seek Rahul’s apology: BJP

    [ad_1]

New Delhi: The Bharatiya Janata Party (BJP) on Thursday said it will run a nationwide campaign to seek Congress leader Rahul Gandhi’s apology over his remarks on the country’s democracy in London, if the Wayanad MP does not apologise.

Speaking at a press conference, former Union minister and BJP leader Ravi Shankar Prasad said: “Rahul Gandhi has insulted India on foreign soil for which he should apologise. The BJP will run a campaign for his apology.”

Prasad said that it has become Rahul Gandhi’s habit to insult the people of India and democracy on foreign soil. “How long will he mislead the country?” he questioned.

He said Rahul Gandhi does not apologise, the BJP will run a campaign against him in which the Congress leader will be exposed.

The BJP leader further said that “Rahul Gandhi has not expressed regret for his statement yet”.

Addressing the former Congress president, Prasad said: “Your ego is not bigger than the country.”

Govt demands apology from Rahul over remarks in UK; Congress objects

    [ad_1]

New Delhi: Leader of the House in Rajya Sabha Piyush Goyal on Monday demanded an apology from Congress leader Rahul Gandhi on his statement in the UK.

Goyal said that his statement has brought disrepute to the country and Rahul Gandhi should apologise.

He said, “A prominent Opposition leader goes abroad and attacks Indian democracy. He has levelled allegations against the press, judiciary and institutions. He has insulted the people of India and the Parliament. There is freedom of speech in India and MPs can speak in Parliament. Rahul Gandhi should apologise in Parliament.”

The opposition, especially the Congress, objected to it and raised slogans. Leader of the opposition Mallikarjun Kharge condemned the statement of Goyal amid sloganeering from treasury benches. The House was adjourned till 2 p.m.

Kharge said Rahul is not a member of this House and Prime Minister himself has insulted the country in China.

Addressing the MBA students at the Cambridge Judge Business School on the topic of ‘Learning to Listen in the 21st Century’, Rahul Gandhi said that the opposition parties are under ‘constant pressure’ as numerous cases have been slapped on them by the BJP government.

“Indian democracy is under attack. The institutional framework which is required for a democracy — Parliament, free press, the judiciary, just the idea of mobilisation — are all getting constrained. We are facing an attack on the basic structure of democracy,” Rahul Gandhi said.
