    Kerala HC quashes ‘underwear’ case against Minister Antony Raju

    Kochi: The Kerala High Court (HC) on Friday quashed the case of an alleged ‘underwear’ evidence tampering against State Transport Minister Antony Raju.

    The court gave the verdict on a plea moved by Raju to quash the case against him.

    The case dates back to the year 1990 when Raju was a junior lawyer representing an Australian citizen Andrew Salvatore Cervelli, who was accused of smuggling hashish by concealing it in his underwear.

    When Cervelli approached the HC in appeal against his conviction by a trial court more than 30 years ago, the underwear in question was found to have mysteriously shrunk in size, leading the HC to acquit Cervelli of all charges.

    A few years later, the investigating officer in the smuggling case, approached the HC seeking a probe into the alleged evidence tampering.

    Later, an FIR was registered against Raju in 1994 on a complaint filed by an official of the Sessions Court, Thiruvananthapuram.

    After 12 years of investigation, in 2006, the Assistant Commissioner of Police filed a charge- sheet before the Additional Chief Judicial Magistrate Court, Thiruvananthapuram, alleging offences under charges of criminal conspiracy, cheating and dishonestly inducing delivery of property and causing disappearance of evidence of offence.

    It was Raju’s argument that the crucial piece of “underwear evidence” was in the custody of the trial court while it was allegedly tampered with and, therefore, it should have been the court in question that initiated the proceedings to look into the case.

    But in this case, the proceedings were initiated on the complaint of the police.

    His plea pointed out that the court took cognisance of the case upon a charge-sheet by the police and the police have no authority to conduct an investigation in such cases.

    The police also cannot file a charge-sheet before the court and the proceedings pending before the court is ‘non-est’ (one that can be ignored altogether) in the eye of law.

    Expressing happiness over the verdict, Raju said he was targeted politically by the then Chief Minister Oommen Chandy and a State Minister who was later defeated by him by going ahead with the case.

    “I knew I had done no wrong and now I am cleared and at this time I forgive those who worked against me,” said Raju.

    Thiruvananthapuram: Heaping praise on Rahul Gandhi, veteran Congressman and former Defence Minister A K Antony on Monday said that “with the Bharat Jodo Yatra ending in Kashmir a new Rahul has taken birth”.

    Antony said this at a party function and added that this Yatra of Rahul was unique, the country has ever seen.

    “With the yatra coming to a close, I am seeing a new Rahul and this Yatra will come to a close only when the present BJP government is sent packing at the upcoming Lok Sabha polls. The yatra has helped Rahul to see an India which has now realised that this is going to be a re-birth of him,” said Antony, while taking part in a party event here,

    “The aim of the Congress for the yatra was a unification of the democratic forces,” added Antony, who was caught on the backfoot last week when his son Anil Antony slammed the BBC for the documentary on Narendra Modi.

    This outburst saw Antony’s colleagues slamming his son, who quit the party posts the next day. This is the first time after his son’s episode that Antony was seen on a public platform and that too in the company of leaders who took on his son.

    Thiruvananthapuram: One of Congress’s top-notch leader A K Antony has reportedly gone into a shell after his son Anil Antony quit his party post, alleging “intolerant calls to retract a tweet”, in which he had defied his party line and criticised a BBC documentary on Prime Minister Narendra Modi, terming it a “dangerous precedent”.

    According to those in the know of things, 82-year-old Antony, who currently holds the record of being the longest-serving Defence Minister in the country, is deeply upset over a remark made by his junior colleague Jairam Ramesh.

    Without naming, Ramesh drew a comparison between former Kerala chief minister Oommen Chandy’s son — Chandy Oommen — and Antony’s son Anil Antony.

    “A tale of two sons of two CMs from the same state. One is a Bharat Yatri and walking tirelessly, mostly barefoot to unite our nation in the Bharat Jodo Yatra. The other is reveling in his day in the Sun today having ignored his duties to the party and the yatra,” the former Union minister Ramesh wrote on his Twitter handle.

    After his term ended in the Upper House in April last year, Antony returned to the state capital to his house here.

    Since then, other than his occasional visits to the office in the state party headquarters, he is rarely seen in public party functions. During a recent party meeting, he asked all in the party presently divided as always amongst various faction leaders to keep aside all differences and focus on the 2024 Lok Sabha polls.

    Antony, who is known for always keeping a low profile, is also known for his sensitive nature.

    A media critic on condition of anonymity said Antony is perhaps going through a very tough time because of the way his son reacted.

    “Knowing the Congress leaders’ mindset, it can be said that the attack is not against Anil, but against Antony. When in Delhi, Antony has always wielded the sword of discipline against erring state leaders by prevailing upon the party’s high command. And when it came to the distribution of party tickets, his was the last word. The ground rule in the state unit of the party in the past over two decades was never to rub Antony on the wrong way,” said the critic.

    Incidentally, yesterday when he came to attend a private function, Antony ducked the media’s questions on his son saying that he is in a private function.

    Now all eyes will be on the ongoing Assembly session as the treasury benches will lose no chance to hit the Congress-led opposition when they take Antony and his son’s statement to checkmate the opposition.
