Jammu: An Army helicopter crashed after a “hard landing” in a forested area in the upper reaches of Jammu and Kashmir’s Kishtwar district on Thursday following a technical fault, killing a technician and injuring the two pilots on board, officials said.

The advanced light helicopter (ALH) Dhruv on an operational mission came down on the banks of a river in Marwah area, cut off from the district headquarters due to heavy snow.

A court of inquiry has been ordered and further details are being ascertained, the Army said in a statement.

    MS Education Academy

Thursday’s crash was the fifth involving Army helicopters in Jammu and Kashmir since 2021.

In a statement, the Udhampur-based Northern Command said, “At about 1115 hours on 04 May 2023, an Army Aviation ALH Dhruv helicopter on an operational mission made a precautionary landing on the banks of Marua river in the Kishtwar region of Jammu and Kashmir.”

The pilots had reported a technical fault to the Air Traffic Controller (ATC) and proceeded for a precautionary landing, it said.

“Due to the undulating ground, undergrowth and unprepared landing area, the helicopter apparently made a hard landing. Immediate rescue operations were launched and Army rescue teams reached the site,” the statement said.

The injured were evacuated to the command hospital in Udhampur, where the technician Craftsman Pabballa Anil – succumbed to his injuries, the Army said.

General Officer Commanding-in-chief of the Northern Command Lt Gen Upendra Dwivedi paid rich tributes to the technician.

“#LtGenUpendraDwivedi, #ArmyCdrNC & All Ranks #NorthernCommand offer tribute to supreme sacrifice of CFN (Avn Tech) Pabballa Anil, in the line of duty during operational flying of ALH MK III near #Kishtwar #JammuKashmir & offer deepest condolences to the bereaved family,” the Army’s Northern Command tweeted.

Pabballa Anil, 30, hailed from Rajanna Sircilla district in Telangana.

Defence sources said the condition of both the pilots was “stable”.

Locals in the area rushed to the site and helped rescue the injured men. Some videos showing Kashmiri-speaking locals comforting the injured while they awaited evacuation to hospital drew praises on social media.

The wreckage of the helicopter was found on the banks of the river, said Senior Superintendent of Police, Kishtwar, Khalil Ahmad Poswal.

He had earlier put the time of the incident at around 10.35 am.

For people in the area, helicopters are the only mode of transport during winter. Helicopters are also the only source of supplies, including rations.

There was some confusion earlier in the day over how many people were on board.

The helicopter crash in Kishtwar district was the fifth such incident in Jammu and Kashmir since 2021.

On January 25, 2021, Army helicopter Dhruv crash-landed in Kathua district’s Lakhanpur near Punjab border, killing one pilot and injuring another.

On August 3, 2021, Army aviation squadron’s Rudra helicopter crashed into Ranjit Sagar Dam on Kathua-Pathankot border, killing both the pilots – Lt Col Abheet Singh and Captain Jayant Joshi. While the body of Singh was retrieved from the dam on August 15, Joshi’s mortal remains were fished out on October 17.

On September 21, 2021, the Army’s Cheetah helicopter crash-landed in dense forests near Patnitop in Udhampur district, killing both the pilots – Major Rohit Kumar and Major Anuj Rajput.

On March 11, 2022, the Army’s Cheetah helicopter crashed in Gurez sector of north Kashmir’s Bandipora district, killing its co-pilot Major Sankalp Yadav and injuring the pilot, a Lt Col-rank officer.

  • Stay on show-cause notice to Anil Ambani under Black Money Act to continue: Bombay HC

Stay on show-cause notice to Anil Ambani under Black Money Act to continue: Bombay HC

    [ad_1]

Mumbai: The Bombay High Court on Wednesday continued till further orders an interim stay on show-cause notice and penalty demand issued to industrialist Anil Ambani by the Income Tax department under the Black Money Act.

A division bench of Justices Gautam Patel and Neela Gokhale posted Ambani’s petition challenging the notice and penalty demand for hearing on April 28, and gave time to the IT department to file its reply.

The HC had in September 2022 granted an interim stay to the show-cause notice pending hearing.

    MS Education Academy

In March this year, Ambani’s lawyer Rafique Dada informed the court that the department later also issued a penalty demand notice to his client.

The court then granted interim stay to the demand notice too.

On Wednesday, when the petition came up for hearing, advocate Akhileshwar Sharma, appearing for the IT department, sought two weeks to file a “comprehensive affidavit” in response to the amended petition.

“The petition has been amended adding some more IT officials as respondents and (the petitioner) has also annexed certain new documents. The department wants time to file a comprehensive affidavit,” Sharma said.

The court directed that the affidavit be filed by April 21.

“The petition shall be listed for hearing on April 28. The interim orders passed earlier — stay on the show-cause notice and the penalty demand — shall continue till further orders,” the bench said.

The IT department issued a notice to Anil Ambani on August 8, 2022, for allegedly evading Rs 420 crore in taxes on undisclosed funds of more than Rs 814 crore held in two Swiss bank accounts.

The industrialist was liable to be prosecuted under Sections 50 and 51 of the Black Money (Undisclosed Foreign Income and Assets) Imposition of Tax Act of 2015 which prescribes a maximum sentence of 10 years with fine, the IT notice said.

The department charged Ambani with “wilful” evasion, saying he “intentionally” did not disclose his foreign bank account details and financial interests.

Ambani in his petition claimed that the Black Money Act was enacted in 2015 and the alleged transactions were of assessment years 2006-2007 and 2010-2011.

The provisions of the Act cannot have retrospective effect, he argued.

According to the IT department’s notice, Ambani was an “economic contributor as well as beneficial owner” of Bahamas-based “Diamond Trust” and British Virgin Islands-incorporated Northern Atlantic Trading Unlimited (NATU).

He “failed to disclose” these foreign assets in his income tax return (ITR) filings and hence violated the Black Money Act, it said.
The act was brought in by the Narendra Modi government soon after it came to power in 2014.

IT officials assessed the total value of undisclosed funds in the two Swiss Bank accounts at Rs 8,14,27,95,784 (Rs 814 crore) and tax payable on this amount at Rs 4,20,29,04,040 (Rs 420 crore).

The Bombay High Court ordered the Income Tax Department on Friday not to take any action regarding the penalty notices issued against Anil Ambani, the chairman of Reliance (ADA) Group till March 17, in connection with the income tax proceedings started against him.

The order was passed in response to a petition Ambani filed in which he contested a show-cause notice sent to him under the 2015 Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act.

On September 26, 2022, a co-ordinate bench of the High Court granted Ambani ad-interim relief from any coercive action over the show cause notice.

  • Court grants bail to ex-Maha minister Anil Deshmukh’s aide in corruption case

Court grants bail to ex-Maha minister Anil Deshmukh’s aide in corruption case

    [ad_1]

Mumbai: A special court on Friday granted bail to Kundan Shinde, an aide of former Maharashtra home minister Anil Deshmukh, in a corruption case being probed by the Central Bureau of Investigation (CBI).

Special CBI judge S H Gwalani allowed the bail plea of Shinde, who worked as a personal assistant to Nationalist Congress Party (NCP) leader Deshmukh, Shinde’s lawyer Aniket Nikam said.

The Enforcement Directorate (ED) had in June 2021 arrested Shinde in connection with a money laundering case, and later the CBI took his custody in a corruption case.

A special PMLA court on Wednesday allowed Shinde’s bail plea in the money laundering case.

Other accused in the case include Anil Deshmukh and dismissed assistant police inspector Sachin Waze. Deshmukh is out on bail, while Waze continues to be in judicial custody.

Former Mumbai police commissioner Param Bir Singh in March 2021 alleged that Deshmukh, the then home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars.

Former assistant police inspector Waze, who was arrested in the case of an explosives-laden vehicle found near industrialist Mukesh Ambani’s house in Mumbai last year, had also levelled similar allegations.

The high court in April 2021 directed the CBI to carry out a preliminary inquiry.

Based on the inquiry, the central agency had registered an FIR against Deshmukh and others for alleged corruption and misuse of official power.

  • Anil Antony’s views on BBC documentary ‘immature,’ says Tharoor

Anil Antony’s views on BBC documentary ‘immature,’ says Tharoor

    [ad_1]

Thiruvananthapuram: Senior Congress leader Shashi Tharoor on Wednesday rejected the views of Anil Antony, son of party colleague and former defence minister A K Antony, on a controversial BBC documentary on Gujarat riots and termed as “immature” his argument that it was an infringement into India’s sovereignty.

Anil had tweeted on Tuesday that placing the views of the British broadcaster over Indian institutions would undermine the sovereignty of the nation. He has since resigned from all posts he was holding in the Congress party, citing “intolerant calls” and “abuses” over the matter.

Tharoor, Lok Sabha MP from Thiruvananthapuram said people of the country have the freedom to watch or not watch the BBC documentary on the 2002 riots and asked who can say the British broadcaster has no right to do a story on the topic.

The Constitution of the country guarantees all rights for us to watch a documentary, he added.

When asked about Anil’s argument that placing the views of the BBC over Indian institutions would set a “dangerous precedence” and “undermine” our sovereignty, Tharoor said he cannot agree with it.

“I feel that this is an immature stand,” he said.

“Because, the sovereignty of our country cannot be affected so easily… will it be affected if a foreign documentary is screened?….whether our national security and sovereignty are so fragile to be affected by a documentary?” he said.

The leader, however, said Anil, who had handled the digital communications of the grand old party for sometime, was a “good person” and he had not discussed the BBC documentary issue with him.

Anil, who is said to be close to Tharoor, specially thanked him for his support in the resignation letter which he sent to the party leadership on Wednesday quitting his roles in the Congress — as the Convener of KPCC Digital Media, and as the National Co-coordinator of AICC Social Media and Digital Communications Cell.”

Anil had on Tuesday tweeted that despite large differences with the BJP, those who support and place the views of the British broadcaster and of former UK foreign secretary Jack Straw, the “brain behind the Iraq war” (involving the US-led coalition in 2003) over Indian institutions are setting a dangerous precedent.

The two-part BBC documentary, which claims it investigated certain aspects relating to the 2002 Gujarat riots when Prime Minister Narendra Modi was the chief minister of that state, has been trashed by the Ministry of External Affairs as a “propaganda piece” that lacked objectivity and reflected a “colonial mindset”.

  • SC dismisses CBI appeal against bail to Maha ex-minister Anil Deshmukh

SC dismisses CBI appeal against bail to Maha ex-minister Anil Deshmukh

    [ad_1]

New Delhi: In a major relief for former Maharashtra home minister Anil Deshmukh, the Supreme Court on Monday dismissed the CBI’s appeal challenging the Bombay High Court order granting bail to the Nationalist Congress Party (NCP) leader in a corruption case.

A bench comprising Chief Justice DY Chandrachud and Justices V Ramasubramanian and JB Pardiwala noted that Deshmukh has also been granted bail in the related money laundering case.

The top court said it was not inclined to entertain the Special Leave Petition against the grant of bail by the high court to Deshmukh.

“Since the observations in the impugned order of the High Court are confined to the question as to whether the respondent was entitled to the grant of bail, we clarify that these observations shall be construed only for that purpose.

“In other words, the observations shall not affect the merits of the trial or be pressed in any other collateral proceedings. The Special Leave Petition is accordingly dismissed,” the bench said.

Solicitor General Tushar Mehta appeared for the CBI in the matter.

The CBI, in December last year, approached the apex court challenging the Bombay High Court order granting bail to Deshmukh in the graft case.

The high court had on December 12 granted bail to the 73-year-old NCP leader but said the order will be effective after 10 days, as the Central Bureau of Investigation sought time to challenge it in the apex court.

The high court had said except for dismissed police officer Sachin Waze’s statement, none of the others recorded by the CBI indicated money was extorted from bar owners in Mumbai at the behest of the politician.

In its plea filed in the top court, the probe agency has claimed the high court committed a “grave error” in granting bail to Deshmukh disregarding the serious objections raised by the probe agency both on the merits of the case as well as the effect his bail will have on the continuing investigation.

“The high court failed to appreciate that economic offences are required to be treated as a separate category of offences and bail in such offences is not required to be granted as a routine matter.

“Usually, socio-economic offences have deep-rooted conspiracies affecting the moral fiber of the society and causing irreparable harm, need to be considered seriously,” it said.

The CBI claimed the high court failed to appreciate that the charge sheet filed by the agency does not merely rely on the statement of Sachin Waze, an accused-turned-approver, but is also based on other material evidence which establishes the commission of a cognisable offence by Deshmukh.

“The High Court failed to appreciate that ascertaining veracity or otherwise of any statement of a witness is a matter of trial and the statement ought not to have been discarded at the stage of deciding on the grant of bail to the respondent,” it said.

The agency claimed, “The High Court failed to appreciate that the version of Sachin Waze, accused-turned-approver, is corroborated by WhatsApp chats exchanged between Param Bir Singh (PW (prosecution witness)-30) and Sanjay Patil (PW-24) to the effect that money collected from the bar and orchestra owners was at the instance of the respondent (Deshmukh).”

It said the high court committed an “error” in holding that the evidence in the form of testimony of Waze cannot be the ground to prolong Deshmukh’s custody.

The CBI said in its plea also contended that the high court also failed to appreciate that despite demitting the office of the home minister of Maharashtra, Deshmukh holds “considerable clout” in the state.

“There is every likelihood that he will command his authority by virtue of his high-level political associations and connections. Thus, grant of bail to the accused respondent would be detrimental to the morale of already named witnesses and would be an impediment for prospective witnesses to come forward,” it said.

As an interim relief, the CBI has sought an ex-parte stay on the high court order pending hearing of the plea filed in the apex court.

Deshmukh had earlier approached the high court after a special CBI court rejected his bail plea.

The veteran politician was in jail since November 2021, after his arrest by the Enforcement Directorate (ED) in a money laundering case. He was later arrested by the CBI in the corruption case.

Former Mumbai police commissioner Param Bir Singh had in March 2021 alleged that Deshmukh, the then-home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars.

Former assistant police inspector Waze, arrested in the ‘Antilia’ bomb scare case of March 2021, too, had levelled similar allegations.

The high court had in April 2021 directed the CBI to carry out a preliminary inquiry. The CBI, based on this inquiry, registered an FIR against Deshmukh and others for alleged corruption and misuse of official power.
