Srinagar Lawyer Seeks Details Of Amount Spent On Conman’s Perks

    [ad_1]

SRINAGAR: Aamir Masoodi, a lawyer from Srinagar, has submitted a request under the Right to Information Act (RTI) to the Divisional Commissioner of Kashmir. The application seeks disclosure of the total expenditure incurred on accommodation, transportation, and other expenses for the alleged fraudster from Gujarat, Kiran Patel.

Masoodi has also asked for information about the department responsible for covering the expenses during Patel Kiran Bhai’s previous two visits to the Kashmir valley before his arrest last month. The RTI application comes amid growing interest and speculation regarding the case, as authorities investigate the extent of Patel Kiran Bhai’s alleged fraudulent activities in the region.

In another development, a resident of Rambagh in Srinagar has filed a complaint with the court, seeking an FIR against Patel for allegedly defrauding him of Rs. 18 lakhs as share amount in a company. The complaint, filed through advocate Masoodi, states that Patel, who identified himself as Chetan Prakash from Begumpur in North West Delhi and the managing partner of a company dealing in areca nuts, convinced the complainant to invest in the said company. The resident of Rambagh alleged that he paid Rs. 18 lakhs in various installments after interacting with Patel at Pratap Park in Srinagar and at a restaurant in the city last year.

On last Wednesday, the government ordered an inquiry into the visits of “Kiran Patel,” who posed as a PMO official and enjoyed five-star treatment for a significant amount of time before being arrested for his fraudulent activities. The Divisional Commissioner of Srinagar is conducting the investigation and is required to submit a report within a week. It’s worth noting that Patel was on his third visit to the Kashmir Valley when he was caught by security officials at a five-star hotel in the Nishat area of Srinagar on March 2.

As per the police report, Patel has prima facie forged and manufactured some documents including some visiting cards on the basis of which he has defrauded not only a single or group of person but “extremely elevated class of the society including high officials of the civil administration and police authorities.” At the end of the day, the police said, Patel succeeded in getting Z Category Security, bullet proof vehicle and enjoyed five star protocol “brazenly” for a considerable period of time. Total amount of cess and surcharge grew by 63.74% from 2017-18 to 2022-23

New Delhi: The total amount of cess and surcharge grew by 63.74 percent from 2017-18 to 2022-23 (RE), the Parliament was told on Monday.

  • Criticising govt at home or abroad citizen’s right, does not amount to being unpatriotic: Sibal

Criticising govt at home or abroad citizen’s right, does not amount to being unpatriotic: Sibal

    [ad_1]

New Delhi: Amid a political storm over Rahul Gandhi’s “democracy under attack” remarks made in the UK, Rajya Sabha MP Kapil Sibal on Wednesday said criticising the government whether at home or abroad is a citizen’s right and does not amount to criticising India or being unpatriotic.

Gandhi’s remarks during his recent trip to the United Kingdom have rocked Parliament, with both Houses failing to transact any significant business on the first three days of the budget session’s second half.

In a tweet, former Union minister Sibal said, “House Logjam, Why? Government is not synonymous with India, India is not synonymous with the Government. Criticising the Government whether at home or abroad is a citizen’s right. That does not amount to criticising India or being unpatriotic.” “Modi ji did it often in the past,” added Sibal, the eminent lawyer who on Saturday had laid down the agenda and a new vision for the country with his newly-launched platform ‘Insaaf’ that is aimed at fighting injustice.

Sibal, who had been a Union minister during the UPA I and II, had quit the Congress in May last year and was elected to Rajya Sabha as an independent with the support of the Samajwadi Party.

During his interactions in the UK, Gandhi alleged that the structures of Indian democracy are under attack and there is a “full-scale assault” on the country’s institutions.

The former Congress president also told British parliamentarians in London that microphones are often “turned off” in Lok Sabha when an opposition member raises important issues.

Gandhi’s remarks triggered a political slugfest, with the BJP accusing him of maligning India on foreign soil and seeking foreign interventions, and the Congress hitting back at the ruling party by citing instances of Prime Minister Modi raising internal politics abroad.

  • ‘Remove hate, see the difference’: SC says everything said won’t amount to hate speech

‘Remove hate, see the difference’: SC says everything said won’t amount to hate speech

    [ad_1]

New Delhi: The Supreme Court on Monday observed that everything which is said could not be equated with hate speech, stressing: “We have a common enemy, that is hate. That is the only thing. Remove hate from your minds and just see the difference.”

A bench of Justices K.M. Joseph and B.V. Nagarathna, hearing a batch of petitions seeking directions against hate speech, also considered a plea by Shaheen Abdullah in connection with an event organised by a body known as the Sakal Hindu Samaj in Mumbai earlier this month.

The top court had directed the Maharashtra government to record the event scheduled on February 5, and stressed that the government has to ensure that hate speeches are not made, while seeking a report on it.

During the hearing on Monday, the bench queried Solicitor General Tushar Mehta, did they make any hate speech, and he replied, according to his instruction: “No”.

Justice Joseph then told advocate Nizam Pasha, representing one of the petitioners in the matter, said: “Two days back we stayed the proceedings against (Delhi Chief Minister) Arvind Kejriwal… involved Section 125 of The Representation of the People Act… he brought a list of decisions of this court, as what is (Section) 123A. It is not everything is said amounts to hate speech. So, we have to be careful only in terms of (what) this section means, as interpreted by this court, will involve the offence. Correct. Bear that in mind also…”

Pasha submitted that reading of transcripts in these cases will help convince “my lords, that in these particular cases what is said amounts to hate speech”.

At this, the bench observed: “The problem is what is hate speech as such… we have to fall back on (IPC’s Sections) 153A and 295A… these are the provisions to deal with this kind of propensity… there has to be some vilification.”

Mehta said the counsel wants many things and “we were served yesterday, let us ascertain what he says is right or wrong”.

The bench told Mehta that it had asked him to give the report and video of the religious event and he said that it will be filed.

The bench asked Pasha if the meeting took place and he said that it did but was not on a large scale.

Justice Joseph orally observed: “We have a common enemy that is hate. That is the only thing. Remove hate from your minds and just see the difference. Everything will be clear.”

Concluding the hearing, he added: “We have got such a great, great civilisation… unparalleled in the whole world. Our civilisation, our knowledge is eternal.”

The top court scheduled the matter for further hearing on March 21.

The plea filed by Abdullah said: “The mass participation at these rallies being organised not just with the consent and knowledge of government authorities but with their active participation, pose a serious threat to the very foundation of our nation as a secular nation. The hatred being taught and the radicalisation of youth being carried out with such impunity will inevitably lead to communal disharmony and violence of an unfathomable scale across the country.”

The plea said rallies have been organized by the Sakal Hindu Samaj, an umbrella body of Hindu right-wing organisations under the banner of “Hindu Jan Aakrosh Sabha”. The last such rally took place on January 29 in Mumbai and more than 10,000 people attended a rally organised by Hindu far-right groups seeking boycott of goods from shops owned by Muslims and a law against “love jihad” and “religious conversions”.

“That the aforementioned Sakal Hindu Samaj will be organising yet another rally, of a similar nature, on February 5 in Mumbai. At least 15,000 people are expected to participate in the said rally. The very nature of all the previous rallies clearly indicate the kind of hate speeches that will in all likelihood be delivered at the same,” added the plea.

In October last year, the apex court had directed the Delhi, Uttar Pradesh, and Uttarakhand governments to come down hard on hate speeches, promptly registering criminal cases against the culprits without waiting for a complaint to be filed.

Kolkata: With the Enforcement Directorate (ED) continuing with its search operation till late on Wednesday evening in connection with the multi-crore coal smuggling case in West Bengal, the cash recovery amount by the central agency has increased to Rs 1.25 crore.

Although initially the ED was secretive about the identity of the business house at whose office the raid was conducted, later on Wednesday evening it surfaced that the cash recovery was made from at the registered office of Gajraj Towers Private Limited at 5A, Earle Street in South Kolkata. Raids were also conducted at the residence of the owner of the company at the posh Ballygunge area in South Kolkata.

Vikram Sikaria has already been detained by the ED for questioning in this connection.

Sources said that the central agency has got specific clues that the money recovered from the office Gajraj Towers was part of the coal scam proceeds which the said business was supposed to divert to different channels.

It is learnt that the team conducting the raids on Wednesday at the residence and office of the said businessman was led by three special officers of ED who arrived in Kolkata from Delhi especially for this purpose.

Sources said that the name of the businessman in question came from the examination of different documents and statements given by different businessmen in connection with the coal smuggling case.

Sources said that the names of some other businessmen on this count have also surfaced and similar raid and search operations will be conducted at their premises as well in the days to come.

It is learnt that recently a person named Ratnesh Burma, a close associate of the prime accused in the coal scam, Binay Mishra, surrendered at a special CBI court in Asansol.
