    Lucknow: The Allahabad High Court has directed the state government to ensure the selection of Class-lll posts in the legislative assembly and the legislative council is made through the Uttar Pradesh Subordinate Services Selection Commission (UPSSSC).

    The court’s Lucknow bench also asked the government to amend in rules within three months for this.

    Justice DK Singh passed the order recently while dismissing a writ petition by Sushil Kumar and others. The bench said the petitioners, who were appointed on contractual basis, should be allowed to work and be paid remuneration accordingly till regular selected candidates join through UPSSSC.

    The petitioners had challenged the selection of candidates in the legislative council in accordance with the advertisement issued in September 2020 for 99 posts of 11 cadres. They had alleged nepotism and favouritism in the selection process.

    Opposing their plea, the respondents’ counsel Gaurav Mehrotra argued that the court had dismissed a similar petition earlier and the petitioners were not able to establish any fault in the selection process.

    Mehrotra also said the petition was not maintainable on their behalf as they are unsuccessful candidates.

    Dismissing the petition, the bench observed, “It is required to note that appointments for a post in a public body must be fair and reasonable. Fairness and reasonableness must be ensured in entire process of selection.”

    “In view to maintain the public confidence in the recruitment process in the legislative assembly and legislative council in respect of Class-III posts, the recruitment should be in the hands of the specialised statutory recruitment body and not in the hands of a selection committee or a private agency,” the bench said.

    Budgam, Apr 9: Union Minister for Law and Justice Kiren Rijiju Sunday said that there will be some amendments in the entire election process.

    “We are looking towards making certain amendments in the entire election process but I can’t keep any commitment because it’s a consultation process that is going on,” the law Minister told reporters after inaugurating District Court Complex and District Aid Legal Council in Central Kashmir’s Budgam district.

    Kiren Rijiju declined to give an appropriate date for elections in Jammu and Kashmir, however, as per news agency Kashmir News Trust he maintained that elections will be held at an appropriate time.

    He said that the Government of India is in a process of defining what ‘fake news’ is all about and deliberations in this regard are going on.

    “The definition of fake news, false news, misrepresentation, these are important things which require lots of deliberation and we are doing it,” he said.

    When asked National Conference leader Dr Farooq Abdullah has appealed to all opposition parties to get united to defeat BJP in the next elections, Kiren Rijiju who is a native of Arunachal Pradesh said that all this shows that BJP is a strong party.

    When asked about the conditional passport issued to Iltija Mufti – the daughter of Mehbooba Mufti, Kiren Rijiju said that he is a Law Minister and doesn’t issue passports. [KNT]

    Raipur: The Congress on Friday announced that it will amend its Constitution to give proper representation to SCs, STs, OBCs, minorities, women, and those below 50 years in the Congress Working Committee – the party’s top decision-making body.

    In one of the proposals as made at the Udaipur ‘Chintan Shivir’ in May last year, the party will make these provisions by amending 26 articles and 32 rules.

    If the proposed amendments are passed in the plenary, then former party chiefs Sonia Gandhi and Rahul Gandhi will become lifelong CWC members, along with former Prime Minister Manmohan Singh.

    General Secretary, in charge of communication, Jairam Ramesh said that the most important proposal is to provide 50 per cent reservations in the Working Committee for Scheduled Castes, Scheduled Tribes, OBCs, Minorities, women and youth.

    There is also a proposal to increase the strength of the CWC, which is 25 right now including party’s floor leaders in Parliament and the party president.

    The Congress Steering Committee, on Friday morning, decided unanimously to empower the party President to nominate members to the CWC.

    “We had a 2-1/2 hour discussion on this issue and the dominant view, overwhelming view was keeping in mind the political challenges facing the country, facing the Congress Party in its capacity as the main opposition and keeping in mind the far-reaching amendments that we are going to bring about tomorrow and day after in our party’s constitution, 16 Articles are being amended, 32 rules are being amended.

    “Keeping in mind, both these factors, the unanimous view of the Steering Committee was that this is the time to empower the Congress President to nominate members to the Congress Working Committee,” Ramesh added.

    However, sources said that Abhishek Manu Singhvi, Digvijaya Singh and Ajay Maken advocated elections to the CWC elections but eventually aligned with the majority view. The members of G-23 and their sympathisers of the grouping did not speak in favour of the elections, sources said.

    JAMMU: The Administrative Council (AC) which met here under the chairmanship of the Lieutenant Governor, Manoj Sinha gave its assent for authorizing Revenue Department to move an amendment in Section 21 and Section 28-A of Agrarian Reforms Act, 1976

    Rajeev Rai Bhatnagar, Advisor to the Lieutenant Governor and Dr. Arun Kumar Mehta, Chief Secretary, J&K attended the meeting.

    The proposed amendments shall lift prohibition on transfer of land vested under section 6,7 and 12 of the Act and to bring these lands at par with the land vested under section 8 of the said Act. The proposed amendment bill will be submitted to the Ministry of Home Affairs, Government of India, for placing before the Parliament for enactment. The enactment will be a big relief to such land holders who were vested land under section 6, 7 and 12 of the Agrarian Reforms Act, as this would enable them to sell off their land parcels which was earlier prohibited under the Agrarian Reforms Act, 1976.

    The amendment will also lead to vesting of revisional power to the Financial Commissioner Revenue which shall facilitate to dispose of the cases arising out of the said Act in the larger interest of the public.
