  • NGT asks report on plea alleging illegal groundwater extraction

NGT asks report on plea alleging illegal groundwater extraction

    [ad_1]

New Delhi: The National Green Tribunal (NGT) has sought a factual report from a panel on alleged illegal extraction of groundwater by Mitsui Kingzoku Components India Private Ltd. in the industrial town of Bawal in Rewari district of Haryana.

The Central Ground Water Authority (CGWA) had already designated the area as “over exploited,” according to a petition before the NGT that claimed the project proponent (PP) was in violation of the terms of the ‘No Objection Certificate’ (NOC), which specified the amount of groundwater to be removed.

According to the applicant, NOC was granted to the PP by the ground water authority for groundwater abstraction up to 30m3/day and not exceeding 18,000 m3/year.

According to the petition, the tribunal’s earlier judgement from November 2022 directing the CGWA to take corrective action against non-compliance by the PP, including recovering compensation equal to 0.5 per cent of the project cost, was not followed, a bench of Chairperson Justice A. K. Goel observed.

The applicant has also referred the RTI reply dated October 6, 2020, such that the unit is not complying with the condition on which ground water extraction has been permitted.

The tribunal then directed that the report be submitted within two months.

“We find it necessary to require a factual report in the matter from a joint Committee of CGWA, central pollution control board (CPCB), State pollution control board (PCB) and District Magistrate, Rewari,” the bench, which also included Justice Sudhir Agarwal and Justice Arun Kumar Tyagi as well as A. Senthil Vel, an expert member, said.

The court scheduled the matter for the next hearing on July 10.

The state PCB will be the nodal agency for coordination and compliance, the bench noted.

  • SC seeks Centre’s reply on PIL alleging ‘unnecessary’ hysterectomies in Bihar, Raj, Chhattisgarh

SC seeks Centre’s reply on PIL alleging ‘unnecessary’ hysterectomies in Bihar, Raj, Chhattisgarh

    [ad_1]

New Delhi: The Supreme Court sought the Centre’s response on Monday on a PIL alleging that doctors in Bihar, Rajasthan and Chhattisgarh have been performing “unnecessary hysterectomies”, a surgical procedure to remove the uterus, on poor women just to reap high insurance fees from governments under the Rashtriya Swasthya Bima Yojana (RSBY).

A bench headed by Chief Justice DY Chandrachud also sought the assistance of Additional Solicitor General Aishwarya Bhati to deal with the public interest litigation (PIL) matter filed by Narendra Gupta, himself a medical practitioner.

The bench, also comprising Justices PS Narasimha and JB Pardiwala, granted four weeks’ time to the Centre for filing its response to the PIL.

A hysterectomy is a surgical procedure to remove the uterus after which a woman can neither conceive nor can have menstrual periods regardless of her age.

The PIL, based on media reports and researched facts, alleged a “widespread pattern of doctors performing medically unnecessary hysterectomies to reap high insurance fees from the government” in states such as Bihar, Rajasthan and Chhattisgarh.

It sought compensation for the victim women and meaningful policy changes to deal with the problem.

The women, aided by heavily-subsidised state-funded health insurance schemes, usually go to private hospitals for medical care for symptoms such as “abdominal pain and general weakness” and doctors resort to “unnecessary hysterectomy operations after cursory, or in some cases, no medical examinations”, the petition alleged.

“The present petition has been filed in the nature of public interest litigation…and arises from an influx of news stories and Right to Information (RTI) results in the states of Bihar, Chhattisgarh and Rajasthan regarding unlawful hysterectomies and related insurance scams,” it said.

The petition sought directions to the state governments “to implement monitoring, inspection and accountability mechanisms for the private healthcare industry”, which are empanelled to serve the poor covered under the government’s Rashtriya Swasthya Bima Yojana (RSBY).

The RSBY has been launched by the Union Ministry of Labour and Employment to provide a health insurance coverage to Below Poverty Line (BPL) families.

The objective of the scheme is to provide protection to BPL households from financial liabilities arising out of health shocks that involve hospitalisation.

  • SC to hear plea alleging delay in clearing names recommended by Collegium

SC to hear plea alleging delay in clearing names recommended by Collegium

    [ad_1]

New Delhi: The Supreme Court is scheduled to hear on Monday two pleas on the issue of alleged delay by the Centre in clearing names recommended by the Collegium for appointment of judges to the apex court and the high courts.

While hearing the matter on February 3, a bench headed by Justice S K Kaul had expressed displeasure over the delay in clearing recommendations for the transfer of high court judges, calling it a “very serious issue”.

Attorney General R Venkataramani had on February 3 assured the top court that the Collegium’s recommendation of December last year for the elevation of five judges to the apex court will be cleared soon.

On February 6, five judges – Justices Pankaj Mithal, Sanjay Karol, P V Sanjay Kumar, Ahsanuddin Amanullah and Manoj Misra – were administered the oath of office as apex court judges.

Two new top court judges – Justices Rajesh Bindal and Aravind Kumar – will be administered the oath of office by Chief Justice of India D Y Chandrachud on February 13.

Once these two judges will take oath, the top court will achieve its full strength of 34 judges, including the CJI, after a gap of nine months.

Meanwhile, four judges, including two who will retire later this month, were on Sunday appointed as chief justices of high courts.

The appointment of judges through the Collegium system has become a major flashpoint between the Supreme Court and the Centre with the mechanism drawing criticism from different quarters.

During the February 3 hearing in the apex court, advocate Prashant Bhushan, appearing for one of the petitioners, had flagged the issue of names reiterated by the Collegium not being cleared by the government.

During the earlier hearing in the matter on January 6, the attorney general told the apex court that all efforts were being made to “conform” to the timelines laid down by it for processing the names recommended by the Collegium for appointment of judges to constitutional courts.

One of the pleas in the apex court has alleged “wilful disobedience” of the time frame laid down in its April 20, 2021 to facilitate the timely appointment of judges.

In the order, the court had said the Centre should appoint judges within three-four weeks if the Collegium reiterates its recommendations unanimously.

  • Plea withdrawn in Delhi HC against wrestlers alleging sexual harassment by WFI chief

Plea withdrawn in Delhi HC against wrestlers alleging sexual harassment by WFI chief

    [ad_1]

Delhi: Hours after a plea was moved in the Delhi High Court on Monday against the sexual assault allegations on Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh by multiple wrestlers, it was withdrawn.

Talking to IANS, Lawyer Shrikant Prasad said that Vicky, who was the petitioner, has asked us to withdraw the plea as the matter has been highlighted a lot.

The lawyer further said that the motive to file the plea was about the misuse of law by women on sexual harassment and resorting to protests and there should be some guidelines set up in this context.

In the plea, it is said that Phogat, who is also the first respondent in the plea, started blackmailing Bhushan for resigning from the post of WFI president on the pretext of protest against the sexual harassment of the wrestlers.

It is said that the media thinks of itself as Janata Adalat and has started intervening in the proceedings of the court, the plea said.

It is contended that wrestlers, instead of moving to court, have approached the media to show their concern, said the petition.

In the petition, it has been argued that respondents (wrestlers) have crossed all their limits to approach the issue and that his reputation and dignity were being tarnished.

It further claimed that sexual harassment laws were being misused and an extortion was being done on him.

This writ petition is filed against the complete misuse of sexual harassment laws by the wrestler women, the petition read.

It is in the petition that wrestlers are trying to get their own benefits out of this issue.

A huge protest by the wrestlers at Delhi’s Jantar Mantar was called off following assurances from the Centre that grievances would be addressed and Brij Bhushan Sharan Singh was asked to step aside for four weeks.
