    SRINAGAR: A tragic incident has occurred in the Khawaja Bagh Baramulla area of North Kashmir where a minor lost his life due to alleged negligence by PDD employees. The incident happened when an iron gate, which was being repaired by another house owner, fell on the child while he was in the courtyard of his house.

    Reports said that PDD employees were present in the area, installing meters, and allegedly used the same gate as support, causing it to give way and fall on the child. Despite being rushed to a nearby hospital by family members and locals, the child passed away on the way.

    The AEE Projects PDD Baramulla and other PDD officials denied having any employees present at the time of the incident, adding more mystery to the tragedy.

    Police have launched an investigation to gather more information on the incident, while official sources have stated that they are ascertaining more facts. (KNS)

    Telangana HC suspends junior civil judge for alleged misconduct

    Hyderabad: The Telangana High Court on Wednesday issued orders suspending Bommathi Bhavani, principal junior civil judge and additional metropolitan magistrate, Rangareddy District, at Kukatpally.

    Bhavani faced allegations that she freed an accused in a narcotics case on personal bail despite evidence presented before her.

    Hence, a decision based on a letter from the Principal District Judge, Rangareddy, as well as the report of the Cyberabad Police Commissioner, and other evidence against her was made.

    The Vigilance Wing of the HC decided to initiate disciplinary proceedings against her in accordance with the provisions of the Telangana Civil Services (CC&A) Rules, 1991 after the court concluded that the judicial officer was guilty of grave misconduct.

    The decision to suspend her in public interest was bought to effect immediately.

    Mumbai: When two mature persons have had a relationship, one of them can not allege rape later when the relations turn sour or do not culminate in marriage, the Bombay High Court has said.

    Justice Bharati Dangre passed the ruling on March 29 while discharging a man from a case of rape lodged against him by a woman at the suburban Versova police station in 2016. The judgement became available this week.

    “Two matured persons coming together and investing in a relationship, one cannot be blamed only because the other complained of the act at some point of time when the relationship did not go well and for whatever reason need not ultimately culminate into a marriage,” the court said.

    The 26-year-old woman had claimed in her complaint that she met the man through social media, and he had a physical relationship with her by making false promises of marriage. The man subsequently moved the court seeking to be discharged from the case, pleading innocence. The judge, while granting his plea, noted that he and the woman were in a relationship for eight years.

    “Admittedly, the prosecutrix (the complainant) was major at the time when the relationship was established, both emotionally and physically. She was at the age where she is presumed to have sufficient maturity of understanding the consequences of her act and according to her own version, on some occasions, the relationship was consensual, but some times it was forcible,” HC said.

    The relationship had continued for “a considerable length of time” and this fact does not lead to the conclusion that “on every occasion, only on the promise of marriage the sexual relationship was established,” it added.

    Further, Justice Dangre noted that merely because the relationship had turned sour it cannot be inferred that the physical relationship on every occasion was against her will. As per her own version, she consented to physical relationship not only because of the promise of marriage but also because she was in love with him, the judgement said.

    Hyderabad: Several activists of the National Students Union of India (NSUI) were taken into custody when they staged a protest in front of the SSC Board at Nampally following the alleged paper leak issue in Vikarabad on Monday.

    In the afternoon, around 30 NSUI activists stormed the SSC Board at Chapel Road Nampally holding flags and attempted to gate crash into the office. The staff shut the gates immediately and did not allow them inside.

    The Abids police who were standing in front of the office on bandobast tried hard to stop the activists from scaling the walls and damaging the board. However, the NSUI activists climbed atop the wall and waved party flags demanding resignation of the concerned officials.

    The NSUI activists raised slogans against the TRS Government and Minister for IT, K T Rama Rao.

    The police took all the activists into custody and shifted them to different police stations.

    Following the protest security was beefed up in front of the SSC Board office.

    New Delhi: The Supreme Court directed the Centre on Wednesday to file a report on alleged attacks on Christian institutions and priests across the country as well as on the implementation of its earlier guidelines to curb hate crimes.

    A bench comprising Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala directed the Union Ministry of Home Affairs (MHA) to collate a report on the state’s compliance with the court’s guidelines and file the same before it.

    The court passed the directions after the petitioner’s counsel, senior advocate Colin Gonsalves, said nodal officers have been notified in every district but they are not registering cases, even though hate speeches have been delivered during rallies in Uttar Pradesh and Chhattisgarh and such news appear regularly on television and in newspapers.

    Additional Solicitor General Aishwarya Bhati opposed the submission made by Gonsalves, saying it is “easy to make sweeping statements”.

    The CJI then said, “Let the MHA file a reply…. We can keep this after two weeks.”

    In 2018, the apex court issued a slew of guidelines for the Centre and states for dealing with hate crimes. These included fast-track trials, compensation to the victims, deterrent punishment and disciplinary action against lax law-enforcing officials. The court said offences such as hate crimes, cow vigilantism and lynching should be nipped in the bud.

    The states shall designate a senior police officer not below the rank of superintendent of police as the nodal officer for the implementation of the guidelines in each district, the court had said, adding that these officers will set up a task force, to be assisted by a DSP-rank officer, for taking measures to prevent incidents of mob violence and lynching.

    The state governments shall immediately identify the districts, sub-divisions and villages where instances of lynching and mob violence have been reported in the recent past, the court had said.

    SRINAGAR: The Supreme Court (SC) on Monday directed the Chief Justice (CJ) of Jammu and Kashmir (J&K) High Court to investigate complaints related to the alleged recruitment of administrative staff through unauthorized means at the J&K High Court, Subordinate Courts, State Judicial Academy, Legal Services Authority, and the e-Court Mission Mode Project.

    During a hearing on a petition filed by J&K Peoples Forum, a bench consisting of CJI D Y Chandrachud, Justice P S Narasimha, and Justice J B Pardiwala was informed that the petition alleged that the appointment of administrative staff at the J&K High Court, Subordinate Courts, State Judicial Academy, Legal Services Authority, and the e-Court Mission Mode Project were not carried out in accordance with due selection procedures. The petition specifically claimed that the relatives of existing staff members, as well as present and former judges of the High Court, were appointed through unofficial channels.

    The bench said: “We will ask the Chief Justice of the High Court to look into the grievance of the petition. Time for filing counter affidavit has been extended. Counter shall be filed by the Registrar of J&K High Court after specifically taking instructions and directions from the CJ of J&K High Court.”

    The petition filed challenges appointments made from 2007 onwards that were either temporary or made through advertisements, citing them as “suspicious.” Additionally, the petition presents a list that indicates the current staff members and High Court judges who allegedly provided preferential treatment to their relatives and acquaintances during the recruitment process.

    It states: “There are instances where amendments have been made in the existing rules just to facilitate backdoor appointments and or or facilitating the appointment of kin of functionaries against higher cadres who otherwise were eligible only for lower cadres and that that too if selected after a regular legal recruitment process.”

    According to the petition, the appointments were made without a transparent selection process. It claims that there was no public notice or advertisement issued, and the selection of appointees was arbitrary. The petition emphasizes that there were several highly qualified candidates who could have been selected if a fair and just selection process was followed.

    The petition contended that a large number of daily wagers employed in various courts for over a decade had not been regularised, with only those who had close connections with High Court officers being considered for regularisation.

    Furthermore, the petition demanded that the Supreme Court quash these backdoor appointments and direct the respondents to refrain from making any more such appointments. Additionally, the petition implored the apex court to direct a credible agency to conduct an inquiry into the allegations of backdoor appointments of administrative staff in the High Court against both the officials involved in the process of making such appointments and those who have benefited from them.

    SRINAGAR: In continuation with ongoing raids to arrest on the run ‘Waris Punjab De’ chief Amritpal Singh, Police detained a couple for their alleged links with one of his aides from Ranbir Singh Pura area of Jammu on Saturday.

    According to an official who spoke to the news agency KNO, Amrik Singh and his wife Paramjit Kour, both residents of RS Pura, were taken into custody and later handed over to the Punjab Police.

    He stated that the couple had been apprehended for allegedly having connections with Papalpreet Singh, a trusted associate of Amritpal Singh. ‘The couple’s mobile phones have been confiscated for additional examination,’ he added. ‘The Punjab Police is investigating the issue, and they will be interrogating the couple.’

    The district magistrates of Kishtwar and Ramban districts have revoked the arms licenses of two bodyguards who were escorting the leader of Waris Punjab De and pro-Khalistan Sikh, Amritpal Singh. According to sources, the licenses for Talwinder Singh and Virender Singh, who serve as Amritpal Singh’s bodyguards, had been issued in the Kishtwar and Ramban districts. (KNO)

    Neither Carroll nor Trump asked Kaplan, an appointee of President Bill Clinton, to block access to the jurors’ names, addresses and similar information. Kaplan raised the idea on his own and announced Thursday he will impose the secrecy despite objections from two news outlets: the Associated Press and the New York Daily News.

    The secrecy measure is typically reserved for criminal cases involving alleged mafia or drug kingpins. But Kaplan cited a series of alleged threats of violence by Trump, his public attacks on jurors in other cases and various reports describing Trump’s role in fomenting the Capitol riot on Jan. 6, 2021, as well as his statement Saturday urging his followers to protest what he said was his looming arrest in a probe led by Manhattan District Attorney Alvin Bragg.

    “Mr. Trump’s quite recent reaction to what he perceived as an imminent threat of indictment by a grand jury sitting virtually next door to this Court was to encourage ‘protest’ and to urge people to ‘take our country back,’” Kaplan wrote in an 18-page decision. “That reaction reportedly has been perceived by some as incitement to violence. And it bears mention that Mr. Trump repeatedly has attacked courts, judges, various law enforcement officials and other public officials, and even individual jurors in other matters.”

    Even as he recounted a litany of provocative statements by Trump, Kaplan was careful to say that he was not accusing the former president of being responsible for incitement, only that the specter created by his statements could be seen as intimidating.

    “For purposes of this order, it matters not whether Mr. Trump incited violence in either a legal or a factual sense. The point is whether jurors will perceive themselves to be at risk,” the judge wrote.

    Kaplan noted that neither side in the case objected to the proposed jury-secrecy order, which instructs court personnel not to reveal the names, addresses or places of employment of prospective jurors or actual jurors empaneled in the trial, scheduled to start April 25 at a federal courthouse in lower Manhattan just a few blocks from where Bragg’s grand jury has been hearing evidence against Trump in a probe stemming from a payment of hush money in 2016 to porn star Stormy Daniels.

    Caroll’s lawsuit is the second she filed in connection with Trump’s alleged attack on her in a Bergdorf Goodman dressing room in 1995 or 1996. The first, filed in 2019, accused Trump of defamation for his statements denying her rape claim. The second suit, which Kaplan has ordered be tried first, was filed in November and seeks damages against Trump directly for the alleged rape. Caroll’s lawyers have said they couldn’t file that case until last year, after New York’s Legislature extended the statute of limitations for civil suits alleging sexual abuse or harassment.

    Trump’s attorneys argued that the extension was unconstitutional, but Kaplan disagreed.

    Srinagar, Mar 19: Alleged conman from Gujarat Kiran Bhai Patel has claimed that police didn’t provide him Z security but that was meant for two other persons, both hailing from Gujarat, who were accompanying him.

    The Counsel for the accused, Advocate Rehan Gowhar told the news agency Kashmir News Trust that all the allegations leveled against his client are baseless and untrue. Quoting his client, Advocate Rehan Gowhar said that police set both the accomplices of his client free and the Z security was actually for them.

    Kiran Bhai Patel, an alleged conman from Gujarat has been arrested by Jammu Kashmir Police for posing as Additional Director of the Prime Minister’s Office (PMO).

    The accused is in judicial custody for 15 days and the matter is before the Chief Judicial Magistrate Srinagar Raja Tasleem Arif.

    The Counsel for the accused said that they will apply for bail on the next hearing.

    “Granting bail is the discretionary power of the court but we are claiming bail as a matter of right,” he said adding that the offenses for which his client has been arrested are not serious and grave in nature. [KNT]

    Hague: The International Criminal Court (ICC) on Friday issued an arrest warrant against Russian President Vladimir Putin and Russian official Maria Alekseyevna Lvova-Belova for the alleged scheme to deport Ukrainian children to Russia, reported CNN.

    The Hague-based ICC accused the Russian president of responsibility for war crimes committed by Russian forces in Ukraine during the war that has been ongoing for over a year.

    The Hague-based court said in a statement on Friday Putin “is allegedly responsible for the war crime of unlawful deportation of the population (children) and that of unlawful transfer of population (children) from occupied areas of Ukraine to the Russian Federation.”

    It also issued a warrant for the arrest of Maria Alekseyevna Lvova-Belova, the commissioner for children’s rights in the office of the president of the Russian Federation on similar allegations, reported Al Jazeera.

    Russia did not immediately comment following the ICC’s move on Friday. Russia denies committing atrocities since it invaded Ukraine in February last year.

    The warrants came a day after a United Nations-backed inquiry accused Russia of committing wide-ranging war crimes in Ukraine, including the forced deportations of children in areas it controls, reported Al Jazeera.

    The UN genocide convention defines “forcibly transferring children of the group to another group” as one of five acts that can be prosecuted as genocide.

    However, the successful extradition of President Putin could prove a far greater challenge as Russia does not recognise the jurisdiction of the international criminal court in The Hague, reported DW News.

    Russia denies deliberately harming civilians but its defence ministry has claimed to have targeted Ukraine’s energy infrastructure.

    Russia signed the Rome statute, which governs the ICC, in 2000 but never ratified the agreement to become a member. It formally withheld its signature from the founding statute of the ICC in 2016, a day after the court published a report classifying the Russian annexation of Crimea as an occupation.

    Since Russia’s invasion of Ukraine in February 2022, the Kremlin has severed ties with several prominent international organisations, deepening the country’s isolation from the west.

    In March last year, Russia was expelled from the Council of Europe, the continent’s leading human rights watchdog, over its attack on Ukraine.

    Moscow is also pulling out of the International Space Station after 2024 and has threatened to withdraw from the World Trade Organization and the World Health Organization.
