    Delhi HC seeks EC’s stand on plea against approval to amended AIADMK constitution

    New Delhi: The Delhi High Court on Thursday sought the stand of the Election Commission of India (ECI) and the AIADMK on a petition against the approval of amendments to the “original constitution” of the party.

    Justice Purushaindra Kumar Kaurav issued notice on a petition by B Ramkumar Adityan and K C Suren Palanisamy, who claimed to be primary members of All India Anna Dravida Munnetra Kazhagam (AIADMK), against the ECI order which also endorsed the elevation of Edappadi K Palaniswami as party’s general secretary.

    The petition said the order was “illegal” and passed without considering the petitioners’ representation.

    The lawyer appearing for the petitioners told the court the amendment to the party laws was approved in a “very mechanical” manner.

    “Issue notice returnable in six weeks,” the judge said and listed the case for hearing on October 10.

    On April 12, the high court had asked the ECI to decide within 10 days representation by AIADMK to update in its record the party’s amended bye-laws.

    The order was passed on a petition filed by AIADMK and its interim general secretary Thiru K Palaniswamy, which claimed that the records of the party were not being updated owing to certain internal disputes pending in AIADMK.

    On April 20, the ECI had endorsed the elevation of Palaniswami to the top position of the AIADMK as its general secretary, thereby also acknowledging the expulsion of O Panneerselvam and his supporters from the party last year.

    The EC had, however, made it clear that its decision to take on record the changes to the AIADMK’s organisational structure was subject to any further court order on the leadership dispute.

    In the petition filed through lawyer Ashish Kumar Upadhyay, the petitioners said the ECI order was “illegal, ultra vires to the provisions of the Section 29A of the Representation of People Act 1951, the provisions of Original Constitution of the Respondent No.2 Party (AIADMK) and Natural Justice”.

    “When there are civil suits pending before various forums challenging resolutions passed to amend the Party Constitution by the General Council on 12.09.2017, the Executive Council on 01.12.2021 and the General Council 11.07.2022 and Election of Shri. Edapadi.K.Palanisamy as the General Secretary of the Respondent No.2 Party, the Respondent has no choice to accept the Resolutions and amended Constitution of the Party on file,” the petition said.

    “If the respondent has taken a decision to take the amended Constitution on file pending disposal of the civil suits, it will cause irreparable damage to functioning of the party and rights of the Primary Members,” the plea added.

    AIADMK’s petition had earlier asserted that not updating the ECI records is wholly contrary to the various settled legal principles and the inaction will only cause severe disruption of the activities of the party which will in turn have a serious bearing on the democratic principles of the nation.

    “The inaction of ECI has grossly violated the Article 19(1)(c) of the petitioners as petitioner no. 1 (AIADMK) is an association of persons and owing to the inaction of ECI, the petitioner no. 1 is not able to effectively carry out its functions which is the dire need of the hour especially owing to the fast approaching General Assembly Elections to Lok Sabha,” the AIADMK petition had said.

    “The inaction of ECI is causing grave prejudice and hardship not only to the AIADMK party but also to the primary members of AIADMK party and entire citizenry of State of Tamil Nadu for the reason that absolute strangers to the AIADMK party are representing themselves as coordinators and other office bearers of party. They are also appointing various unknown persons to the posts of AIADMK party and such impersonation cannot be allowed in a vibrant democracy,” it said.

    Chennai: The AIADMK Executive, in its meeting held here on Sunday, decided not to contest the May 10 Karnataka Assembly elections, and support the BJP instead.

    The first executive meeting, since K Palaniswami was elected as the party’s General Secretary, was chaired by party Presidium Chairman Thamizhmagan Hussain.

    The AIADMK’s decision to support the BJP in Karnataka comes at a time when the BJP Tamil Nadu President K Annamalai had engaged in a confrontation with the party. However, sources in AIADMK told IANS that the BJP national leadership has requested the party to extend its support in the Karnataka elections.

    The party has decided to convene a public meeting in Madurai on April 20.

    A total of 15 resolutions were passed in the executive meeting of which 10 were against the ruling DMK, including one condemning it for the deteriorating law and order situation in the state. One resolution was passed to authorise Palaniswami to lead the party in the 2024 Lok Sabha elections.

    The AIADMK, after the election of Palaniswami, is trying to win at least a few Lok Sabha seats from Tamil Nadu in 2024.

    The party is trying to conduct several programmes in the run-up to the elections and the decision to support the BJP in the Karnataka elections is a political move.

    The AIADMK had won only one seat in the 2019 Lok Sabha polls in the 39 seats the NDA contested.

    The DMK has announced that it would win all 39 seats in 2024 and has already appointed coordinators for each Assembly constituency to work among the masses.

    Chennai: The main opposition in the Tamil Nadu Legislative Assembly, AIADMK, on Thursday strongly objected to a point made by Chief Minister M K Stalin while explaining the police action following the murder of a young man, in a case of alleged honour killing.

    After Leader of the Opposition Edappadi K Palaniswami raised the issue of the murder that took place in Krishnagiri District and sought action, Stalin, quoting the police report, told the Assembly that Sankar, a person accused in the murder, was a local AIADMK functionary (branch secretary).

    AIADMK MLAs objected to the remark and said the man was not a party office-bearer. It led to an uproar.

    Speaker Appavu wondered if the Chief Minister did not have the right to mention what was reported by the police. Leader of the House Duraimurugan stated that the CM only referred to the police report and if fresh police inputs emerged later, that point — indicating to the AIADMK reference — may be changed.

    Stalin said both the police and district administration had been taking all steps, including commencing initiatives to spread awareness, to prevent such crimes.

    On March 21, 2023, a 28-year old man, Jagan, a construction worker, was hacked to death on a highway in Krishnagiri district allegedly by three men including Sankar, who is the father of Jagan’s wife.

    Sankar is now lodged in Salem Central Prison.

    Jagan had recently married Sankar’s daughter, a second-year college student, against the wishes of her family, police said. Enraged by this, Sankar and two others allegedly committed the murder.

    Chennai: With BJP’s Tamil Nadu President K. Annamalai slamming the AIADMK for inducting former leaders of his party and the AIADMK leadership hitting back, the relationship between the two alliance partners is at a low ebb.

    The BJP’s national leadership, however, wants a truce as it knows clearly that without the backing of the AIADMK, the party will be a big zero in Tamil Nadu, despite the super victories of Pon Radhakrishnan and C.P. Radhakrishnan in the Lok Sabha elections without any alliance.

    The latest issue between the AIADMK and BJP cropped up after state BJP IT cell President C.T.R. Nirmal Kumar quit the party and joined the AIADMK in the presence of its interim General Secretary K. Palaniswami. The very next day, state BJP IT cell Secretary Dilip Kannan also quit and after a day joined the AIADMK again in presence of Palaniswami. Both the leaders lashed out against Annamalai, saying that his “dictatorial line of functioning would not help the BJP in Tamil Nadu”.

    Annamalai did not take this lying down and in a Twitter post subtly threatened the AIADMK that he would also poach from its ranks. This led to a stern response from AIADMK leader, D. Jayakumar.

    The BJP national leadership does not want such a flare up in the relationship between the two parties as it knows clearly that the BJP can get gains only if it piggy rides the AIADMK.

    Sources in the BJP told IANS that the BJP national President J.P. Nadda and senior office-bearers including General Secretary and Tamil Nadu in charge C.T. Ravi will be communicating with Palaniswami directly. The party leaders have conducted private surveys and found that without the support of the AIADMK, the BJP cannot even win a single seat in the state.

    While Annamalai has lashed out against the AIADMK leadership, the national leadership of the party does not support this as it knows for sure that without the backing of a powerful Dravidan entity, the BJP will not be a force to reckon with in Tamil Nadu.

    The DMK-Congress alliance is looking to gain maximum seats from the state and Chief Minister M.K. Stalin has already told cadres that all the 40 seats in offing in Tamil Nadu and Puducherry must be won in 2024.

    The BJP was expecting to better the chances of its alliance from the present one seat of Theni won by expelled AIADMK leader O.P. Panneerselvam’s son O.P. Ravindranathan. However the recent rift between the AIADMK and BJP has not gone down well with the national leadership which was desperately trying to gain maximum seats from south India.

    Except from Karnataka, the party does not have much expectations and hence the national leadership does not want the situation in Tamil Nadu to be fanned up further.

    Sources in the BJP told IANS that the national leadership have already communicated to Annamalai to keep calm and have also spoken to Palaniswami. If needed, Nadda will soon reach Chennai and have a meeting with the AIADMK leadership to iron out the differences.

    Chennai: A total of 13 functionaries from Tamil Nadu’s BJP on Wednesday quit the party to join its alliance partner the All India Anna Dravida Munnetra Kazhagam (AIADMK).

    The 13 belonged to the BJP’s IT wing in Chennai West.

    The development comes as the State unit of the BJP accused the Edappadi Palaniswami-led AIADMK of allegedly “poaching” its leaders.

    BJP IT Wing District president Anbarasan in a statement said, “I have worked for BJP for years. People know that I have never expected any position. Considering the unusual scenario in the party for the past few days I have decided to resign from the party.”

    The statement bears the signatures of 10 IT Wing District Secretaries and two IT Wing District Deputy Secretaries.

    Several BJP MLAs have resigned and joined AIADMK recently.

    On Tuesday, BJP Intellectual Wing State Secretary Krishnan, IT wing State secretary Dileep Kannan, Trichy Rural District Vice President Vijay and State OBC Wing Secretary Ammu joined AIADMK after meeting with Edappadi K Palaniswami.

    This came just days after the exit of BJP State IT Wing Chief Nirmal Kumar to AIADMK who quit the party levelling serious allegations against Annamalai.

    Similarly, IT Wing State Secretary Krishnan also resigned from BJP blaming Annamalai. This has sparked a war of words on social media between supporters of AIADMK and the BJP.

    BJP functionaries raised questions about how Edappadi Palaniswami can welcome them with a smile by being an alliance partner.

    In one such Twitter post, BJP Sports and Skill Development State President Amar Prasad Reddy mentioned “AIADMK being an alliance partner shouldn’t have done this”.

    Meanwhile, earlier Annamalai told ANI, “Some four BJP leaders have joined, it’s an unfortunate state in Tamil Nadu where Dravidian politicians who think that they run big parties want to poach from BJP and grow their party. That only shows BJP is growing”.

    Reacting to Annamalai’s comments AIADMK IT Wing Secretary Singai Ramachandran retorted on Twitter, “Once BJP was getting votes lesser than NOTA. In the 2021 election, how BJP MLAs won the election is the answer for this (AIADMK – BJP faced the election as allies). AIADMK is the organization which won the election single-handedly. It is only a joke to say to develop AIADMK, BJP persons are needed”.

    Even during the Erode East bypoll, there was a war of words between AIADMK and BJP with AIADMK passing comments saying the BJP doesn’t have a role in inter-party issues. Now once again it has become debatable.

    Chennai: BJP’s Tamil Nadu unit President K. Annamalai, rattled by the back-to-back resignations of party functionaries who went on to join the AIADMK, on Tuesday lashed out at his ally.

    Accusing the AIADMK of poaching BJP leaders, he tweeted: “If I decide to go shopping (poaching), my shopping list will be big. But the time and venue, I will decide”.

    He also said that the presence of a former Chief Minister, while second-, third-, fourth-, and fifth-level BJP leaders were joining the AIADMK was a message that the BJP has grown in Tamil Nadu.

    Earlier the BJP used to poach from the Dravidian parties for it to grow, but presently Dravidian parties were poaching from the BJPA for their growth, he alleged.

    In a hard-hitting statement on Twitter, he said: “Before the Kurukshetra war, people were allowed to change camps. The war which will start in a few months from now, let everyone take positions.”

    The former IPS officer said that his aim was to bring his party to power in Tamil Nadu, adding that he was not a BJP manager but a BJP leader.

    BJP’s Tamil Nadu IT cell President C.T.R. Nirmal Kumar quit the BJP on Sunday and joined the AIADMK in the presence of its interim General Secretary K. Palaniswami. On Monday, BJP IT cell state Secretary, Dilip Kannan also resigned from the saffron party only to join the AIADMK on Tuesday along with a few other state leaders.

    BJP state leader and actor Gayathri Raghuram quit in December 2022, to protest the “dictatorial attitude” of Annamalai. BJP OBC Morcha leader Tiruchi Surya who is the son of DMK leader Tiruchi Siva, also quit the party.

    Sources in the BJP told IANS that several leaders were antagonised by the style of functioning of Annamalai ever since he has become the state President.

    Chennai: BJP’s Tamil Nadu IT Cell chief C.T.R. Nirmal Kumar on Sunday quit the party and joined the AIADMK in presence of its interim General Secretary K. Palaniswami.

    There has been reports that Nirmal Kumar and BJP state chief K. Annamalai were not on good terms since the last one year.

    Nirmal Kumar, in a social media post, said: “I travelled with the party for the past one and half years, despite facing a lot of problems and embarrassments. Despite working honestly and dedicatedly only anguish remains!”.

    He ended the message with “goodbye”.

    Blaming Annamalai for his decision, he charged that the party state chief of having “ill-treated” the party cadres and had snooped on them.

    In a one page letter released along with his resignation, Nirmal Kumar said: “The party is travelling on the path of disaster due to his one man show attitude, without considering the party and its cadres.”

    He also claimed that while the party leader was overtly showing that he was against a DMK minister, he was having a discrete understanding with that minister. “As a whole he is worse than the Dravidian model ministers. The person who is #420malai is not only dangerous to the state BJP but to the state as well.”

    The resignation of Nirmal Kumar is a major shock for the state BJP. BJP women leader and actor, Gayatri Raghuram had also quit the party earlier and OBC Morcha state leader Tiruchi Surya had also left recently.

    Chennai: The AIADMK on Wednesday alleged that the Election Commission is acting like DMK’s poll wing and that the police and all other departments are under the control of the DMK.

    AIADMK MP CVe Shanmugham alleged that the DMK had erected temporary sheds at all the booth areas in East Erode — where Assembly bypoll will be held on February 27 — and voters are confined in these sheds all through the day. He also claimed that food is being served to the voters along distribution of cash.

    AIADMK leaders are being prevented from meeting the voters, he claimed.

    Shanmugham also demanded that the Chief Electoral Officer and the District Election officer should intervene and get the people released.

    Shanmugham, who was the Law Minister in the previous AIADMK government, said that party leaders and functionaries are being intercepted by the police under the guise of vehicle checks.

    He claimed the police are doing this deliberately to prevent the crowd from gathering at the public rallies of AIADMK interim General Secretary, Edappadi K. Palaniswami.
