Make bulldozer last resort; give people chance to prove their claim; issue notices before demolition: Omar to J&K Admin

    [ad_1]

Srinagar, Feb 06: Stating that the ongoing demolition drive going on across J&K has triggered a wave of frustration and chaos among people, National Conference vice-president Omar Abdullah Monday advocated that the government should make the bulldozer its last resort, give people a chance to prove their claim and issue proper notices to the people having illegal possession of State land. He was quick to add that the National Conference was not against those who have grabbed State land but “a proper procedure should be followed.”

“In J&K, there is chaos everywhere. Bulldozers are being sent everywhere to demolish houses, complexes and buildings. But nobody knows what is the procedure and on what basis this demolition drive is being conducted,” said Omar while addressing a press conference in Srinagar, as per news agency—Kashmir News Observer (KNO). He said his sister approached the High Court with regard to the proposed demolition of the Gupkar house of Omar and was told by the government before the Court that the list making rounds in the media are “forged.” “Given the government response in the court, I urge the government to make the genuine list of people who have grabbed State land public,” he said.

Omar suggested a slew of measures to the government with regard to the demolition drive. “No government is supposed to bring trouble for the people. Bulldozers should be the last resort. The Government must issue proper notices to those who, according to it, have grabbed State land and given them at least six weeks’ time to prove their claim on land under them and show the documents,” he said. “In our case, my sister produced the documents before the HC that states that the lease of Gupkar house is still active and has some years to expire. Likewise, people should be given time to present the documents and let the revenue team verify the same. If after proper verification land under anybody is found under illegitimate possession, then a bulldozer can be used for sure.”

Omar said that the government should also make a public “genuine list of people who have occupied State land.” “It seems that the ongoing drive is aimed at creating a wedge between communities. This drive lacks proper procedure,” he said.

He said in the case of demolition of NC leader Ali Muhammad Sagar, he found that no notice was served. “There is a procedure that if the person doesn’t receive the notice, the same is fixed on the front portion of the gate. Nowhere this is being done,” he said, adding, “Officials accompanying bulldozer at Nedous, told my relatives that they had pressure from the top and have to do something to show their bosses.”

Omar said in many areas the ongoing demolition-cum-eviction drive is becoming a “hub of corruption.” “I got many calls from several areas with people saying that they are being told to pay Rs 1 or 1.5 lakh to get their names removed from the list,” he said.

He said that NC MPs will try to raise the issue in the Parliament if they are given time to speak.

To a query that whey NC would approach the court on the issue, Omar said that he has suggested some measures to the government and that if the J&K administration fails to give positive response, they would surely consult lawyers and discuss the future course—(KNO)

Jordan fires off first subpoenas against Biden admin

    [ad_1]

    20230201 judiciary 8 francis 2

Garland and the FBI have strenuously rejected the GOP accusation — which fact checkers have also deemed false — saying their focus was on protecting school board members amid sharply escalating threats of violence, with no emphasis on parents or those raising policy concerns about Covid restrictions.

The subpoenas primarily seek communications between top FBI and Justice Department officials and outside advocates and the Department of Education. Despite the March 1 deadline, subpoenas typically give way to further negotiation that results in shifting due dates and a narrower scope of document production.

Jordan’s quick-trigger finger on the subpoenas underscores the intensely adversarial posture that is likely to define the GOP’s investigations of the Biden administration. It also illustrates Jordan’s effort to maximize his leverage ahead of a potential brawl with the administration over access to sensitive documents.

On the other side of Pennsylvania Avenue, it’s the first test of the Biden administration’s willingness to cooperate with some of the red-meat Republican-led House investigations that Democrats largely regard as rooted in conspiracy theories and grievance politics. The administration has repeatedly insisted that it will take the GOP House’s oversight requests seriously and attempt to negotiate document production when possible — for example, the Justice Department, in a Jan. 20 letter obtained by POLITICO, offered “staff-level meetings” to Jordan. But those promises often belie deep distrust and resistance between the branches.

Previewing the fierce political battle to come, Democrats and the White House immediately hit back at Jordan — saying he was marshaling his powerful gavel in pursuit of right-wing conspiracy theories that had largely been debunked.

“Republicans do not want to be bothered by this inconvenient truth,” said Del. Stacey Plaskett (D-V.I.), the top Democrat on the Jordan-led panel probing claims of government politicization, in a statement. Plaskett also made a dig at Jordan’s defiance of a subpoena from the Jan. 6 select committee last year.

Ian Sams, a spokesperson for the White House, added that the subpoenas “make crystal clear that extreme House Republicans have no interest in working together with the Biden Administration on behalf of the American people — and every interest in staging political stunts.”

The information Jordan is requesting largely reflects a months-long push by the Ohio Republican. The White House previously warned him and Oversight Chair James Comer (R-Ky.) that they would have to re-submit any requests they made while they were still in the minority.

Among the broad swath of records Jordan is requesting from Garland is any documents or communications between DOJ employees and the National School Boards Association, any guidance that stemmed from Garland’s memorandum on threats against school officials and documents and communications from the task force the Justice Department announced in October that was supposed to discuss potential prosecution of any crimes. A DOJ official confirmed the receipt of the subpoena on Friday.

Jordan, in his subpoena to Wray, asked for documents and communications related to the task force, or the bureau’s role, and documents and communications related to a tag the FBI used to track threats against school officials. The committee also conducted a voluntary transcribed interview earlier this week with former FBI official Jill Sanborn as part of its broad investigation into the FBI and DOJ.

The FBI confirmed that it received the subpoena and pushed back on the central claim of Jordan’s investigation.

“As Director Wray and other FBI officials have stated clearly on numerous occasions before Congress and elsewhere, the FBI has never been in the business of investigating speech or policing speech at school board meetings or anywhere else, and we never will be. Our focus is and always will be on protecting people from violence and threats of violence,” the bureau said.

And in the subpoena for Cardona, Jordan is asking for any documents or communications between the Justice Department and Department of Education employees that refers or relates to Garland’s memo or the National School Boards Association’s letter to President Joe Biden about the rise in threats and asking for input from the FBI, among other entities. The National School Boards Association subsequently apologized for the letter.

The Department of Education had responded to Jordan’s January letter on Thursday, according to a copy of the letter obtained by POLITICO. In it, Gwen Graham, an assistant secretary for legislation and congressional affairs, noted that “as the Department has repeatedly made clear … the Secretary did not request, direct any action, or play any role in the development of the September 29, 2021, letter from the NSBA to President Biden.” That, Graham noted, was also “confirmed by an independent review by outside counsel retained” by the National School Boards Association.

Jordan had signaled in his January letters to Wray, Garland and Cardona, among others, that he would use subpoenas if they didn’t comply with his requests for records.

“Accordingly, for the final time, we reiterate our outstanding requests … and ask that you provide this material immediately. The Committee is prepared to resort to compulsory process, if necessary, to obtain this material,” he wrote in each of the letters.

  • Admin seal nearly 2 dozen shops at Aftab Market Srinagar

    [ad_1]

Srinagar, Feb 01(GNS): Authorities on Wednesday sealed around two dozen shops at Aftab market in Srinagar.

“Eviction notices to the occupants were already served but they failed to vacate on their own after which we sealed the shop”, an official said.

Reports reaching GNS said that Revenue officials accompanied by police reached the market and sealed the shops.

Meanwhile, shopkeepers held a protest claiming that they have been paying rent to the Srinagar Municipal Corporation. They said that they had been earning their livelihood for decades. “These shops have been in existence for more than five decades. The action by the government is tantamount to snatching our livelihood,” a shopkeeper said and urged the government to revisit the decision.

“Only a few days back, we got eviction notices, saying this was a private property. If that is the case, then where was this private person from 1970 till now,” another shopkeeper said and urged authorities not to “snatch” their means of sustenance. (GNS)

Anti-Encroachment Drive: J&K Admin likely to come up with formal order sparing poor, farmers

    [ad_1]

Srinagar, Jan 31: Jammu and Kashmir administration led by Lieutenant Governor Manoj Sinha is likely to come up with a formal order in a week’s time ensuring protection for the poor and common masses during the ongoing anti-encroachment drive aimed at retrieving the land grabbed by the influential people in the past.

Sources in the LG administration, told news agency—Kashmir News Observer (KNO), senior BJP leaders of J&K unit of the party, have made personal requests about protecting the poor and common masses during the ongoing anti-encroachment drive going on across J&K.

“I met LG sahib in person and requested him to spare the people having grabbed or constructed homes on State land measuring 8 to 10 malras. I requested him to fix a nominal registration fee for them so that they are not rendered homeless,” BJP General Secretary and party’s Kashmir affairs incharge Sunil Sharma told news agency—Kashmir News Observer (KNO).

He said that during his conversation with the LG it was decided that “influential won’t be spared and the land grabbed by them in the past will be retrieved at any cost.” “The LG told me that even though he has reiterated time and again that the poor won’t be touched and the influential won’t be spared, he would think on issuing a formal order in this regard,” he said.

Sharma said that he was hopeful that the LG administration may issue a formal order in this regard within a week’s time. “The order may have a mention about the registration fee for the poor having possession of State land up to 10 malras,” he said.

Another BJP leader, wishing not to be named, said that on behalf of the party, he too has urged the LG administration to spare the poor during the ongoing anti-encroachment drive. “Though it is up to the government to finalise whether they would keep 10 malras as the limit for having the State land for the poor lot who have constructed their homes or bring the number down to 5 malras or so. This is a matter of discussion and is being currently discussed by the Revenue officials and other officials of the LG led administration seriously,” the leader said, adding that “we expect a formal order shortly in this regard.”

J&K BJP spokesman Altaf Thakur said several delegations of farmers and poor people from Srinagar and other parts of Kashmir came to BJP office in Srinagar with a request that they have constructed homes on just 5,8 and 10 malars of State land and if they would be evicted, where would they go.

“We have requested the LG Sir not to touch the poor but go hard against the politicians especially all 34 former ministers whose names have surfaced in the list of land grabbers,” he said.

Congress party’s J&K unit too had vociferously opposed the eviction drive of the LG led administration and sought a formal order mentioning protection for the poor and farmers. Congress leader and MP Rahul Gandhi also expressed his displeasure over the J&K administration’s anti-eviction drive. In his press conference at Srinagar during Bharat Jodo Yatra (BJY), Rahul said that “poor are being left homeless and farmer’s land is being snatched during the eviction drive of the J&K administration.” In the J&K’s anti-encroachment drive, action has been taken against former ministers and officers. “The list of land grabbers is so long that it will take years to retrieve the land. The drive is on as per the directions from the LG office,” an official said, wishing not to be named—(KNO)

Dr Farooq Abdullah Asks Admin To Address Post Snowfall Exigencies

    [ad_1]

SRINAGAR: The Jammu and Kashmir National Conference President Dr. Farooq Abdullah on Monday asked the administration to come to the aid of people, whose lives continue to remain out of gear in wake of the heavy snowfall across Jammu and Kashmir.

Several villages in the upper reaches of Kashmir division remain disconnected from the district headquarters for the second consecutive day after receiving the snowfall, Dr. Farooq said, adding that the electricity distribution system, surface connectivity, water supply has also been badly affected.

“I have received various SOS calls from North, South and central Kashmir districts, particularly the upper reaches where people continue to face many inconveniences following the snowfall. I was told that the heavy snowfall has thrown life out of gear in the upper reaches of Baramulla, Bandipura, Kupwara, Anantnag, Shopian Pulwama, and Kulgam districts. People in these districts are facing tremendous hardships. The electricity, as well as potable water supply, is disrupted. In case there is any emergency on health grounds, locals are unable to shift the patients to the hospital as authorities have failed to clear snow from roads,” he said.

Dr Abdullah said resumption of connectivity is the main issue that has to be tackled on priority basis. “The major arterials connecting Dawar, Kanzalwun, Keran, Karna, Gurez, Jumgund and many far flung areas to their district headquarters haven’t been cleared of snow yet. People living in those areas are going through immense difficulties. The situation is no different across the upper reaches of South, Central Kashmir and Chenab region districts. Srinagar city has become a cesspool of slush. SMC and other concerned agencies are not visible on ground,” he said.

He said that students, elderly and patients are in particular at the receiving end due to the blockage of roads connecting these far-flung areas to district headquarters. “The situation is no different in the snow bound region of Chenab region where the access to all upper hamlets is yet to be restored,” he said.

“The divisional administrations in Jammu & Kashmir must ensure that flying squads are placed on the grounds to check price rise. The situation has become more precarious in wake of the absence of public representatives,” he said.
