UP: Gym trainer who objected to obscene acts in public place dies after being assaulted, 6 held

Ghaziabad: A gym trainer who was allegedly assaulted by a group of youths after he objected to “obscene acts” by a man and a woman while riding a scooter here has succumbed to injuries, police said on Tuesday.

Six accused in the case have been arrested and charges under Indian Penal Code section 302 (murder) will be added in the FIR, they said.

Virat Mishra, around 27 years of age, was assaulted near the Lajpat Rai College in Sahibabad area around 1 pm on Saturday, according to Bunty, who knew the deceased and also got thrashed in the episode while intervening in it.

“Virat had objected to the man, identified as Manish, and the woman engaged in objectionable acts, saying it was a residential area and they should go somewhere else. “On this, Manish called up some his friends who immediately reached the spot and attacked Virat on his head and body with stones and sticks,” Bunty claimed in his complaint to the police.

“When I tried to intervene, they attacked me as well. When some more locals of the neighbourhood saw this and approached us, these men fled hurling abuses at us. After this, Virat was rushed to a hospital for treatment,” Bunty, who runs a shop in the area, added.

Assistant Commissioner of Police (Sahibabad) Bhaskar Verma said legal proceedings had been initiated in the case on the day of the incident but on Monday Virat succumbed to injuries during treatment at the hospital.

“The FIR was lodged immediately after which six persons accused in the case were arrested and sent to jail. Now that the victim has passed away, the FIR will get converted to add the murder charge under IPC section 302 as well,” Verma told PTI.

The initial FIR was lodged under IPC sections 307 (attempt to murder), 147 (rioting), 323 (causing hurt), 504 (provocation to provoke breach of peace), 506 (criminal intimidation), 149 (offence against public tranquility).

  • Delhi Ridge acts as a lung, supplying oxygen to city residents: SC

Delhi Ridge acts as a lung, supplying oxygen to city residents: SC

    [ad_1]

New Delhi: The Supreme Court on Wednesday said Delhi Ridge acts as a lung which supplies oxygen to city residents, while directing the Delhi Development Authority (DDA) to not go ahead with land allotment in areas considered to be notified as protected areas.

A bench, headed by Justice B.R. Gavai, said: “It cannot be doubted that the ridge in Delhi acts as a lung which supplies oxygen to the citizens of Delhi…”

Citing an order, the bench, also comprising Justice Vikram Nath, said it was observed that other areas having morphological ridges were required to be protected and no permission for construction should be given there.

It noted that it appears that there has been some difficulty in identifying the areas of ridge which are not notified but also have the same ridge-like features.

In order to identify areas, which need to be protected as a notified ridge, the apex court directed the Ministry of Environment and Forest to set up a committee consisting of a senior officer not below the rank of Joint Secretary, one representative each of the Delhi Forest Department, the Geological Survey of India and the DDA, and a nominee of the Ridge Management Board to work out modalities.

Seeking a preliminary report by March 15, the top court said the ministry’s officer would be the chairman and convener of the committee.

The Directorate of Revenue Intelligence (DRI), Ministry of Finance, had filed an application seeking permission for diversion of 6,200 square metres of morphological ridge area for construction of office building for DRI headquarters in Vasant Kunj. The DDA had allotted the land to the DRI.

The DRI’s counsel contended that the Supreme Court-constituted panel, Central Empowered Committee, has imposed a condition on it to plant 500 trees and his instructions are that they were ready to plant 1,000 trees.

After hearing arguments, the bench allowed the application filed by the DRI.

  • Court acts as protector & defender of fundamental rights and liberties: CJI

Court acts as protector & defender of fundamental rights and liberties: CJI

    [ad_1]

New Delhi: The Chief Justice of India (CJI), D.Y. Chandrachud said on Saturday that for the court, there are no big and small cases – every matter is important, and the court has sought to use the language of the Constitution to humanise law and act as the protector and defender of fundamental rights and liberties.

Addressing a programme to mark the 73rd anniversary of the establishment of the Supreme Court, the Chief Justice said: “If we peruse the history of this court, we realise that the history of the Supreme Court is the history of the daily life struggles of the Indian people.”

Citing the daily case mentioning list, he stressed that through these seeming requests, one can sense the pulse of the nation.

“Above all, the message in this uniquely citizen-centric initiative is an assurance that the court exists to protect our citizens from injustice, their liberties are as precious to us and that the judges work in close connection with the citizens,” he said.

Chandrachud emphasised that for the court, there are no big or small cases, as every matter is important, and because it is in the seemingly small and routine matters involving grievances of citizens that issues of constitutional and jurisprudential importance emerge.

“In attending to such grievances, the court performs a plain constitutional duty, obligation and function,” he said, adding that the Supreme Court serves the world’s most populous democracy and is in true aspect a ‘people’s court’ because it is a collective heritage of the citizens of India.

The Chief Justice added that the court has also ensured that the criminal justice administration is not de-linked from the framework of human rights.

He said, for instance, while the death penalty has been upheld to be legal, the Supreme Court laid down various mitigating and aggravating circumstances that a judge should take into account before awarding the death sentence.

“This ensures fairness in the process. Psychiatric assessment of death row convicts is a humanising influence on the law. Thus, the court has sought to use the language of the Constitution to humanise law and act as the protector and defender of fundamental rights and liberties,” he said, adding that the Supreme Court has made a constant endeavour to ensure access to justice for everyone.

Citing public interest litigation (PIL), he said anyone can approach the constitutional courts in India to seek redressal of a violation of the fundamental rights of any person.

“By doing so, the court opened its door to persons bereft of means to approach the courts because of their social and economic disadvantages. This has provided a space for citizens to converse with the state on equal terms. In turn, the court has been using its jurisdiction to make the ‘rule of law’ a daily reality for persons belonging to marginalised communities,” the Chief Justice said.

He also said that in the recent Budget, the Centre has announced a provision of Rs 7,000 crore for Phase III of the e-Courts project.

“This will help enhance the accessibility of the judicial institutions and improve the efficiency of the justice delivery system in India. Such endeavours will ensure that the court truly reaches out to every citizen of our country,” Chandrachud said.

He also pointed out that between March 23, 2020, and October 31, 2022, the Supreme Court alone heard 3.37 lakh cases through video conferencing.

The Chief Justice of Singapore, Justice Sundaresh Menon, also delivered a lecture on the topic ‘Role of judiciary in a changing world’.

The apex court came into existence on January 28, 1950, two days after India became a Republic on January 26.
