    Karnataka bribe case: Lokayukta to file another case against accused BJP MLA

    Bengaluru: The Lokayukta sleuths are preparing to file another case against BJP MLA Madal Virupakshappa, accused in a bribe for tender case, regarding the accumulation of disproportionate wealth, sources said on Thursday.

    Sources said that the Lokayukta authorities are upset over the fact that the prime accused in the case, Madal Virupakshappa has obtained bail, whereas the second accused in the case, his son, Prashath Madal has been jailed.

    The Lokayukta has already approached the Supreme Court, questioning the granting of bail to the BJP MLA. The Supreme Court on other hand refused to hear the plea. The Advocates Association has also written to the Chief Justice of India raising concern about posting of the matter of bail of BJP MLA.

    The association has sought the attention of the CJI that justice should be the same for an ordinary man and VIP.

    Sources explain that the Lokayukta sleuths have started gathering inputs on assets of BJP MLA Madal Virupakshappa in Davanagere district, across the state and other parts of the country. After getting evidence regarding disproportionate wealth, the sleuths will lodge another complaint against him, sources confirmed.

    Prashath Madal, a government officer and son of the BJP MLA was caught red-handed while accepting Rs 40 lakh bribe at his office. Later, the authorities recovered more than Rs 8 crore from the residences. It was alleged that Prashath was receiving bribes for allocation of tender towards the procurement of raw materials for the Karnataka Soaps and Detergents Limited (KSDL).

    BJP MLA was the chairman of KSDL and following the trap, he was asked to tender resignation for his post.

    Hyderabad; The BRS party on Wednesday alleged that the second accused A Rajashekhar Reddy is a member of the Bharatiya Janata Party (BJP) and has put out photos of him wearing the saffron party’s shawl along with social media posts in support of the party.

    Responding to BRS leader Jagan Patimeedi’s post claiming the same, Telangana minister KT Rama Rao said that just to malign the state government, the BJP seems to have hatched a ‘conspiracy’. He asked the state DGP to investigate this matter thoroughly.

    “Even by the very low standards of BJP, this is vulgarity at its worst Just to malign Telangana Govt, BJP seems to have hatched a conspiracy to destroy the lives of innocent youth I request the @TelanganaDGP Garu to enquire this matter thoroughly and bring perpetrators to justice,” he tweeted.

    Raja Sekhar worked as a network administrator at TSPSC.

    The accused persons P Praveen Kumar (32) Assistant Section Officer (ASO) at TSPSC, A Raja Sekhar (35), a network administrator at TSPSC, Renuka (35) a school teacher, L Dhakya (38) a technical assistant, K Rajeshwar (33), K Neelesh Nayak (28), P Gopal Nayak (29), K Srinivas (30) and K Rajendra Nayak (31) had been arrested by the Begum Bazaar police with the assistance of Hyderabad Commissioner’s Task Force (Central) team on Monday.

    Praveen, who works at TSPSC, contacted Raja Sekhar for the question paper of the Assistant Engineer (Civil) and both of them allegedly managed to get the paper from the confidential section of the TSPSC by hacking into a computer of the section officer in charge of custody of the question paper.

    They allegedly transferred the 25 papers into a pen drive from the computer and later handed it over to Renuka and her husband Dhakya, who paid them Rs 5 lakh initially on March 2 and another Rs 5 lakh on March 6. Dhakya on getting the papers informed about it Rajeshwar Nayak, his relative who tried to make money, contacted Neelesh and Gopal, who were appearing for the exam, and discussed the possibility of striking a deal for the leaked exam question paper.

    “After fixing the deal for Rs 13.5 lakh, Rajeshwar, and Dhakya handed over the question paper to Neelesh and Gopal who appeared for the exam. Both Srinivas, a constable working at Medchal police station, and Rajendra had helped the candidates,” DCP (Southwest) Kiran Khare said.

    New Delhi: The Supreme Court on Wednesday quashed criminal proceedings against a doctor accused of stocking medicines for sale, saying the “extremely small” quantity of medicines which was seized can easily be found in the house or consultation room of a medical practitioner.

    The apex court observed that considering the small quantity of medicines, most of which were in the category of lotions and ointments, it cannot be said by any stretch of imagination that they could be stocked for sale.

    It noted that the appellant is a senior doctor who is engaged as an associate professor and head of the dermatology department in a government medical college in Chennai.

    “When small quantity of medicine has been found in the premises of a registered medical practitioner, it would not amount to selling their medicines across the counter in an open shop,” a bench of Justices Krishna Murari and Sudhanshu Dhulia said.

    The bench delivered its verdict on a plea filed by the doctor against a June 2022 order of the Madras High Court which had dismissed her petition seeking quashing of criminal proceedings.

    The top court observed it is permissible for her under the law to practise medicine when she is not performing her official duties.

    It noted that the doctor, in her individual and independent capacity, was carrying on her medical practice at a premises in Chennai and an inspection was made there by the drugs inspector in March 2016.

    The bench further noted that as per the inspection report, the drugs inspector found some medicines like lotions and ointment in the inner room of her premises and he had also referred to certain sale bills of medicines.

    The bench noted the drugs inspector thereafter moved an application for obtaining sanction from the office of the Director of Drugs Control, Tamil Nadu, which was given in January 2018 and consequently, a complaint was filed before a court for prosecuting her under section 18(c) of the Drugs and Cosmetics Act, 1940.

    It said the prohibition under section 18(c) of the Act is on the manufacturing, distribution, stocking or exhibition of medicines for the purpose of sale.

    “The charge in the present case is that the appellant (doctor) had ‘stocked’ medicines for ‘sale’. The entire emphasis is on ‘sale’ of these medicines,” the bench noted.

    It said what the director of drugs control and the high court lost sight of is the fact that she is a registered medical practitioner and her area of specialisation being dermatology.

    “It is not a case that she had opened a shop in her premises from where she was selling drugs and cosmetics across the counter! It is possible that she was distributing these drugs to her patients for emergency uses and thus she is protected by the Act itself,” the apex court said.

    The bench observed it is not the case of the prosecution that she was selling drugs from an open shop across the counter.

    “But given the facts and circumstances of the case and considering that the appellant is a registered medical practitioner, along with the fact that the quantity of medicines which have been seized is extremely small, a quantity which can be easily found in the house or a consultation room of a doctor, in our considered view no offence is made out in the present case,” it said.

    The bench noted that the search was carried out in March 2016 and the sanction for prosecution was sought in September 2016.

    It said the sanction was given in January 2018 and there is no explanation given for this delay in getting the approval.

    “The sanction for prosecution given in the present case appears, prima facie, to suffer from the vice of non -application of mind. There is no reference to any of the documents, evidence or the submissions submitted by either of the parties, no reasons assigned or even an explanation pertaining to the delay which indicates it has been passed in a mechanical manner,” the bench said.

    While allowing the appeal, it set aside the order of the high court and quashed the criminal proceedings in the case.

    The accused, the statement reads, is involved in case FIR number 103/2022 under section 307 IPC, 7/27 Arms Act 18, 20, 23, 38 UAP Act of Police Station Kokernag and is presently lodged in District Jail Anantnag.

    “SIU went to the specific location under a posse of security men and pasted the notice on the house in the presence of Local Sarpanches, Panches and Chowkidars. According to the notice, the owner of the house have been restrained to ‘transfer, lease out, dispose off, change its nature or deal with the said property in any manner without the permission of designated authority”, reads the statement further.     Mumbai: A 34-year-old US citizen booked for allegedly smoking on board an Air India flight and unruly behaviour towards the crew was granted bail by a court here on Monday, police said.

    The passenger was found smoking in the lavatory of London-Mumbai flight AI130 on March 10 and behaved in an unruly manner with the crew after they were alerted by the smoke alarm and threw the cigarette from his hand, the official said.

    The airline officials handed him over to police when the flight landed in Mumbai, he said.

    “The man, who is of Indian origin and holds a US passport, was produced in Andheri court and was granted bail on a surety of Rs 20,000. He will be released once he deposits this amount,” the Sahar police station official said.

    He was charged under section 336 (whoever does any act so rashly or negligently as to endanger human life or the personal safety of others) and other provisions of Indian Penal Code and Aircraft Act, the official added.

    Kochi: The National Investigation Agency (NIA) has announced a reward of Rs 10 lakh for providing information on the whereabouts of one Sawad — the prime accused in the 2010 Kerala hand-chopping case, an official said on Saturday.

    Sawad is a resident of the Ernakulam district in Kerala.

    The case pertains to the chopping of a professor, T.J. Joseph’s right hand in July 2010 by the activists of the now-banned organisation, Popular Front of India. Joseph was attacked while he was on his way to home from Church along with his mother and sister.

    The attackers told him that he was being punished for the alleged sacrilegious undertone of one of the questions he had framed during an exam at the college where he was teaching.

    The case was later investigated by the NIA.

    A special NIA court in 2015 convicted 13 people owing allegiance to the PFI.

    However, the key accused in the case, Sawad, continues to be on the run since then.

    Amaravati: The Crime Investigation Department of Andhra Pradesh Police on Thursday produced GVS Bhaskar, an accused in the AP State Skill Development Corporation scam, in a Vijayawada court on Thursday, an official said.

    Bhaskar, a former employee of Siemens Industrial Software, was arrested from Noida and brought to the state under a 36-hour transit remand.

    “He (Bhaskar) prepared a fake DPR (detailed project report) with overvaluation, keeping a margin of more than Rs 200 crore out of Rs 371 crore (released by the state government),” the official said.

    The skill development programme was envisaged under the then Telugu Desam Party government between 2014 and 2019.

    According to officials, Bhaskar inflated the valuation of the project, which involved Siemens Industrial Software India and Design Tech Systems, to Rs 3,300 crore. However, the cost of Siemens Industrial Software India’s software was only Rs 58 crore.

    Suman Bose, the then MD of Siemens Industrial Software India, and Design Tech System MD Vikas Kanwilkar allegedly met the then chief minister Chandrababu Naidu for the project in 2014-15.

    As part of the agreement, Siemens Industrial Software India and Design Tech Systems were to contribute 90 per cent of the funds for the programme with the balance 10 per cent coming from the state government.

    However, neither company spent a single penny while the state government’s share of 10 per cent — amounting to Rs 371 crore — was allegedly misappropriated, the CID stated.

    It is alleged that former special secretary to the state government Ganta Subba Rao and former IAS officer K Lakshminarayana had played key roles in the programme. The Crime Investigation Department (CID) identified Lakshminarayana as a close friend of Naidu.

    CID officials claimed that the misappropriated money was funnelled into shell companies such as Allied Computers (Rs 60 crore), Skillers India, Knowledge Podium, Cadence Partners and ETA Greens.

    According to reports, former finance secretary Sunita had objected to the release of funds but senior government officials overruled her.

    When the CID contacted the German headquarters of Siemens, it clarified that Bose had acted on his own volition, which resulted in his services being terminated, the official said.

    The Enforcement Directorate has also launched a probe into the alleged scam and has issued notices to 26 people.

    Budgam, Mar 9 (GNS): A Co-operative Societies Limited employee was killed after engaging in a scuffle with another person at Nasrullah Pora in central Kashmir’s Budgam district on Thursday afternoon, reports and officials said.

    Reports reaching GNS said that an argument ensued between two persons over some dispute at Kuzweera Budgam, which soon after turned ugly and one of the party attacked the other, leaving him grievously injured.

    Before the injured could be evacuated to a nearby hospital, he succumbed in the meanwhile.

    Confirming the incident, a police official told GNS that the deceased was a Co-operative Societies Limited employee.

    He identified the deceased as Kaisar Yousaf Zargar (29) son of Mohammad Yousuf Zargar, resident of Gowharpora Chadoora in Budgam.

    “The accused namely Abid Hussain Dar son of Mohammad Amin Dar, a resident of Pathan Pora in Nasrullah Pora area, has surrendered and he is being questioned about the whole episode”, the official said adding “A case has also been in the meantime registered into the unfortunate incident.” (GNS)
