    Indian sentenced in US for distribution of child sexual abuse material

    New York: A 34-year-old cruise ship employee from Goa has been sentenced in a federal district court to 188 months in prison for distributing child sexual abuse material.

    Angelo Victor Fernandes sent 13 child pornography videos through an instant messaging application to Daniel Scott Crow between January 16 and April 30, 2022, the US Department of Justice said.

    Fernandes also communicated with Crow about arranging for the latter to travel to engage in sexual activity with minor children.

    During a separate communication with an unidentified person, Fernandes talked about sexual abuse of minor children and his ability to obtain children for sex.

    Crow pled guilty to one count of enticement of a minor and one count of production of child pornography in case number 22-cr-14035.

    He was sentenced on December 12, 2022, to 30 years in prison.

    New Delhi: The BJP on Thursday asserted that the law has to take its course if Rahul Gandhi abuses people and slammed the Congress over its criticism of his conviction in a defamation case, asking whether the opposition party wants “complete freedom” for him to “abuse” others.

    BJP leader and former law minister Ravi Shankar Prasad cautioned Gandhi, saying he will find himself facing “more troubles” if he doesn’t refrain from making defamatory remarks, while Union Minister Piyush Goyal asked the Congress leader to apologise for his series of “defamatory” comments.

    Both the leaders also hit out at Congress president Mallikarjun Kharge for questioning the court’s order by noting that several judges hearing the matter were changed.

    “They should come out of their dynastic mindset and realise that no one is above the law,” Goyal told reporters, while Prasad accused Kharge of contempt of court at another presser.

    It was “grossly unfair” on the part of Kharge to make such comments, Prasad said.

    Making such comments show that the Congress does not believe in the judiciary, he said and asked, “Does it want to keep even the judiciary in its pocket.”

    “If they think that they would get action in their favour by levelling allegations against the judiciary and putting pressure on it, it is their misconception,” he said.

    Asked whether Gandhi will be disqualified from Lok Sabha, Prasad cited the provisions made in the Representation of People Act in this regard and said it is for Speaker Om Birla to decide. “This is speaker’s decision. I don’t have to say anything on that,” he said.

    On Thursday, a court in Gujarat’s Surat sentenced Gandhi to two years in jail in a 2019 criminal defamation case filed against him over his “Modi surname” remarks.

    The case was filed against the Congress MP for his alleged “how come all the thieves have Modi as the common surname?” remark on a complaint lodged by BJP MLA and former Gujarat minister Purnesh Modi.

    Goyal said, “We are all in public life and have to chose our words wisely and maintain basic decorum and dignity in public discourse. Gandhi has disrespected people and every democratic institution be in Parliament or democracy. He should apologise for his series of defamatory statements.”

    The BJP leaders in this context mentioned various allegations levelled by the former Congress president, be it during his recent visit to Britain or in the Rafale case.

    Prasad said Gandhi with his comments insulted people with Modi surname, asserting that it was very much defamatory.

    “The Congress party and others are saying many things but they are not saying what Rahul Gandhi had said,” he said and asked, “Won’t any action be taken against you if you insult a surname in such a way?”

    He said Gandhi got the opportunity to defend his case and his lawyers argued in the court before the verdict was given. He has been convicted in the case because the court was not convinced with the arguments made in his defence, Prasad added.

    It has become Gandhi’s “nature” to weaken and defame the country as well as level the “filthiest abuse like accusations” against Prime Minister Narendra Modi and the BJP, Prasad said, cautioning him against continuing with such remarks.

    A number of defamation cases has been filed against Gandhi for his remarks, he said.

    Referring to the defamation case in Gujarat, Prasad said a similar case was filed against Gandhi in Patna by BJP leader Sushil Kumar Modi and its proceedings are underway.

    The BJP leader also took a swipe at Gandhi for his remarks in a tweet after the court’s verdict in his case in Gujarat, asking if his faith in truth and non-violence meant insulting people by abusing them citing their caste.

    “You will abuse freely, insult country’s Army, make fun of the Martyrs’ supreme sacrifices, insult patriotism, insult people’s votes, people’s manadate and say you are worshipper of ‘satya’ (truth) and ‘ahimsa’ (non-violence),” he charged.

    Prasad said if the Congress leader has the right to abuse people, those aggrieved also have right to file case against him.

    “Does Congress want Rahul Gandhi to have complete freedom to abuse people? There is rule of law in the country and it will prevail,” the BJP leader said, alleging that the Congress leader has a history of making defamatory comments and unfounded allegations.

    “The law of India has it that if an individual or an organisation has been defamed with scurrilous statements, scandalous comments, abuses or any defamatory remarks, then he has a right to seek redress. But the Congress party has an objection. It wants complete freedom for Rahul Gandhi to throw abuses,” he added.

    Prasad also lashed out at Gandhi for his recent democracy remarks in the UK, saying democracy is run by certain probity and propriety with regard to fair play.

    “One of the most element of that is you please respect the popular verdict,” he added.

    Chennai: A Church priest in Kanyakumari was arrested on Monday over alleged sexual abuse of a nursing student.

    Based on a complaint from the nursing student, the Kanniyakumari police had registered a case against Benedict Anto but he was absconding since the past couple of days.

    Sources in Kanyakumari police told IANS that he was arrested from a farmhouse in Nagercoil this morning.

    Notably, scandalous videos of the priest exposing himself to women had gone viral on social media.

    A few days ago, the priest was assaulted by a group of people and his laptop taken away. However, he did not file any police complaint against his attackers.

    A couple of days after the laptop was seized, intimate scenes of Anto with young women appeared on social media sites.

    The priest had earlier filed a false complaint against a youth, Austin Gino, and had sent him to jail.

    Gino had earlier filed a complaint against the priest for having sent lewd messages and trying to sexually exploit a medical student who was a friend of Austin.

    Anto had resigned from the post of parish priest earlier and will soon be replaced by another priest.

    SRINAGAR: Given the rise in drug addiction in Kashmir, the seventh play of Theatre Festival Kashmir 2023 staged the consequences of the menace. The name Dakh-e-Loor (Walking stick or walking cane) implies the old age support of people that are their children who are ruined due to drugs. The play is written by Dildar Ashraf Shah and presented by the Shahkaar Cultural society.

    The play starts with a conversation between an old man – Khoje Salaam and a lady. The former asks the latter about her brother. She replies in anger that he has spoiled the lives of the young people and their families.

    The next scene is a conversation between Bilal and Waseem. Bilal is lying on the road and, when asked why, replies that he needs the drug. They belong to low-income families and can’t manage money from their homes, so they choose theft and involve other people. While talking, they see Jehangir and call him. Jehangir belongs to an affluent family. He shares his problem of not being loved enough by his father – Mansoor since he lost his mother. He craves love, even though he gets more than enough money from his father. Waseem and Bilal somehow persuade him to attain happiness through drugs. Jehangir argues with his father every day to get the money.

    Jehangir starts to return home late. Tota, their servant, whom he treats like a brother, gets concerned about Jehangir’s condition and repeatedly insists his father take the matter seriously. Mansoor always gives excuses for his busy schedule.

    One day when Jehangir leaves home, Tota convinces Mansoor to follow him. Meanwhile, Jehangir, Waseem, and Bilal go to a graveyard to have a ‘special drug’ where Waseem gives them injections for intravenous intoxicants. As soon as Jehangir injects it, he falls unconscious. The other two ignored him and went to have a meal. Mansoor and Tota while trying to find Jehangir reached the same spot and found him lying unconscious. Coincidentally, a doctor passes by and Mansoor calls her for help. On checking, she declared him dead. Mansoor couldn’t bear the shock and he died too.

    The play sheds light on the alarming rise in drug abuse and its consequences. During the whole play, there was a good mix of seriousness and comedy. A few incidents could have been improved, especially in the beginning Bilal was shown in dire need of drugs that he was losing himself, but as soon as the conversation began, without consuming any intoxicant he was behaving fine which seemed a little off. In another act where Mansoor moves out to find a doctor, he finds her family doctor outside the graveyard in full uniform and a stethoscope which also appeared unnatural.

    The play was written and directed by Dildar Ashraf Shah, and presented by Shahkaar Cultural Society and assistant director of the play is Jameela Akhter. The character of Mansoor was played by Mohammad Rafiq Mattoo, Jehangir by Fuzail Farooq, Tota by Mohammad Zaki, Waseem by Gulzar Ahmad Khanday, Bilal by Junaid Manzoor, Khoje Salaam by Shakeel Ahmad Naqash, Nargis by Tehseena Afaq Mir and Dr Henna by Jameela Akhter. The set effects were managed by Waris Hamid Khan, make up by Tehseena and Jameela, sound operation by Ajaz Ahad Saboon, Light operation by Tariq Hajini, costume by Javeed Jameel, property by Bilal Ganderbali, and overall in-charge is Shakeel-ul-Rehman.

    New Delhi: Bharata Rashtra Samithi (BRS) MP K. Keshav Rao today moved a notice under rule 267 for suspension of business in the Rajya Sabha to ‘abuse’ of central agencies like CBI and ED by the government.

    On the other hand, Lok Sabha Congress MP Manish Tewari has moved the notice on the issue of Chinese transgressions, and Manickam Tagore’s notice is on the issue of hike in LPG prices.

    In the Rajya Sabha the suspension notice was given on post-poll violence in Tripura by Binay Vishwam, CPl MP.

    Congress President and Leader of Opposition in the Rajya Sabha, Mallikarjun Kharge, who met Vice President and Rajya Sabha Chairman Jagdeep Dhankhar on Sunday ahead of the second part of the Budget Session, said that they want discussion on every burning issue.

    “We, as Opposition parties, are keen to play a constructive role in making the government accountable and would want discussion on every burning issue facing the nation,” he said.

    Srinagar, Mar 3 (GNS): National Conference on Friday expressed concern over rising drug addiction cases in Jammu and Kashmir, saying the entire region  foresee a doomsday scenario if the problem is not nipped in the bud.

    This was said by the party’s State Spokesperson Imran Nabi Dar while addressing a one day workers convention of the party workers in Yaripora Kulgam. The convention was marked by threadbare discussion on various issues concerning the public and party. Prevailing political situation in Kashmir and the future course of action was also deliberated upon during the course of meeting. District Kulgam Vice Presidents Mubarak Raina, Mohammad Younis Malik, YNC Kulgam district President Adil Guroo, Block Presidents M Ayub Pala, Ijaz Shah, party functionaries were also present.

    Kashmir’s drug problem is worsening with Kulgam district unfortunately taking a big hit viz a viz the drug abuse cases, Imran Nabi Dar said adding, “The addiction/abuse among Kashmiri youth has reached catastrophic levels and if no serious effort is initiated by the government agencies we are at the risk of losing an entire new generation to drugs.”

     “It is a point of concern for all of us here in Kashmir, particularly in Kulgam. The first step towards stopping such incidents starts with contemplation by all of us. It goes without saying that the menace is an awful manifestation of widespread unemployment in the district. It is the time for the government to change the discourse about the drug addiction issue and start to view it as a disease rather than a law-and-order issue.”

    Strife-torn Kulgam needs special attention, he said seeking a comprehensive plan to cope up with the menace. “Administration adopted a multi-pronged strategy – increasing awareness, restricting the availability of drugs, and increasing affordability and accessibility to eradicate the menace of drug abuse.”

    In addition, he said the Treatment Facility (ATF) available in Kulgam for the rehabilitation of the addicts should be upgraded and augmented. (GNS)

    London: An Indian-origin businessman in south east England has been sentenced to 12 months’ imprisonment after admitting abuse of an interest-free loan offered by the UK government to businesses to cope with the Covid-19 lockdown.

    Kulwinder Singh Sidhu, 58, from Stanwell in Surrey, pleaded guilty to offences under the UK Companies Act and the Fraud Act for having abused the Bounce Back Loan financial support scheme in 2020.

    He was director of Wavylane Ltd, a haulage company based in Stanwell trading since 2010, and was found to have dissolved it soon after receiving a 50,000-pound taxpayer-funded loan and transferring the funds to a personal account.

    “Our action has ensured repayment of the loan money and taxpayers have not been left out of pocket,” said Julie Barnes, Chief Investigator at the UK’s Insolvency Service.

    “Any other company directors who might be tempted into dissolving their business to try to keep public money they are not entitled to, should be aware they are risking a lengthy prison term,” she said.

    Under the UK government’s Bounce Back Loan scheme, genuine businesses impacted by the pandemic could take out interest-free taxpayer-backed loans of up to a maximum of 50,000 pounds.

    Sidhu applied on behalf of his business on June 9, 2020, and it was paid into his company bank account.

    On 26 June 2020, Sidhu filed paperwork with the UK’s Companies House to have the business dissolved.

    The striking-off application to dissolve the company was explicit that interested parties and creditors, such as a bank with an outstanding loan, must be notified within seven days of making an application to dissolve a company.

    The form also highlighted that failure to notify interested parties is a criminal offence, however, the Insolvency Service found Sidhu did not follow these rules.

    The company was ultimately dissolved in October 2020 and went on to be identified as likely Bounce Back Loan fraud by the Insolvency Service and cross-government counter-fraud systems.

    Their investigation found that Sidhu had “fraudulently” overstated the company turnover in the Bounce Back Loan application, and within two days of receiving the money he had transferred it to his personal account before dispersing the funds to his son and another company.

    Sidhu went on to plead guilty at Guildford Crown Court in December last year and was sentenced this week at the same court, which also imposed a confiscation order for 50,000 pounds which has been paid in full.

    In addition to the custodial sentence, Sidhu is disqualified as a company director for six years.

    New Delhi: A day after a Delhi court discharged Sharjeel Imam and 10 others in the 2019 Jamia Nagar violence case, senior Congress leader P Chidambaram on Sunday said the criminal justice system that tolerates pre-trial incarceration is an affront to the Constitution and urged the Supreme Court to put an end to this “daily abuse of the law”.

    A court here on Saturday discharged 11 people, including student activists Imam and Asif Iqbal Tanha, who participated in anti-CAA protests, in the 2019 Jamia Nagar violence case, saying they were made “scapegoats” by police, and that dissent has to be encouraged, not stifled.

    Reacting to the development, Chidambaram tweeted, asking whether there was even prima facie evidence against the accused.

    “The Court’s conclusion: unequivocal no. Some accused have been lodged in jail for nearly three years. Some got bail after many months.This is pre-trial incarceration,” the former home minister said.

    “An inept police and overzealous prosecutors are responsible for keeping citizens in jail before trial. What action will be taken against them?” Chidambaram said in a series of tweets.

    Who will give back the months or years that the accused spent in jail, he asked.

    “Our criminal justice system that tolerates pre-trial incarceration is an affront to the Constitution of India, especially Articles 19 and 21.The SC must put an end to this daily abuse of the law. The sooner the better,” Chidambaram said.

    “Bless the trial courts that push back against the abuse of the law and uphold liberty,” he added.

    Noting that the accused were merely present at the protest site and there was no incriminating evidence against them, the court said dissent is an extension of the fundamental right to freedom of speech and expression, subject to reasonable restrictions.

    An FIR was lodged in connection with the violence that erupted after a clash between police and people protesting against the Citizenship (Amendment) Act (CAA) in the Jamia Nagar area here in December 2019.

    Imam was accused of instigating the riots by delivering a provocative speech at the Jamia Millia Islamia University on December 13, 2019. He will continue to remain in jail as he is an accused in the larger conspiracy case of the 2020 northeast Delhi riots.

    Additional Sessions Judge Arul Varma said there were admittedly scores of protesters at the site and some anti-social elements within the crowd could have created an environment of disruption and havoc.

    “However, the moot question remains — whether the accused persons herein were even prima facie complicit in taking part in that mayhem? The answer is an unequivocal no,” the judge said.

    The clashes in bankruptcy and civil courts vindicate industry skeptics like Sen. Elizabeth Warren (D-Mass.) and Securities and Exchange Commission Chair Gary Gensler, who have long warned that crypto businesses are defying basic rules that would protect retail investors and traders.

    They are also fueling calls to enforce the laws and regulations that are currently on the books, which the industry has fiercely resisted.

    “There are a lot of regulatory tools out there already to deal with that,” Warren said in an interview. “We need regulators to use those tools, and Congress needs to make sure that those regulators have the resources they need to be an effective cop on the beat.”

    The legal conflicts are injecting even more uncertainty into a market that has lost two-thirds of its value since November 2021. For retail traders and customers — including those who were enticed into risky lending products with promises of secure and reliable investment returns — there is no safety net.

    The battles over the corporate remains of once high-flying digital asset startups may take years to resolve. More litigation is in the offing as the contagion that emerged last spring wends its way through the markets.

    “In traditional finance, there are means and mechanisms to wind down institutions. On the crypto asset side, because it grew so quickly — in a space that had a light touch regulation — you don’t have the same kinds of well-established procedures,” said John Rizzo, a former U.S. Treasury official who’s now a senior vice president of public affairs at Clyde Group.

    Some crypto businesses that have gone under-operated as banks, brokers, custodians and agents for their customers — a combination of services that doesn’t exist at regulated financial institutions — making their bankruptcy proceedings even more chaotic.

    Bankrupt lending platforms like Celsius Network and Voyager Digital solicited customers with investment products that guaranteed double-digit yields in exchange for crypto deposits. FTX’s marketing campaigns assured crypto traders that its exchange offered a safe venue for buying, selling and storing digital tokens.

    But those customers were locked out of their accounts when those platforms ran into trouble. They now have to compete in bankruptcy court with major creditors who secured massive loans to those businesses.

    “The likelihood that these individuals are going to ever be made whole is distilled down to almost nothing,” said Martin Auerbach, a former federal prosecutor who leads the white collar and investigations practice at the law firm Withers.

    Gensler has already started to lay down the hammer on the industry. The SEC this month charged the crypto exchange Gemini and a widely used brokerage known as Genesis Global with securities law violations in connection to a lending product that froze roughly $1 billion of customer assets after the downfall of Bahamas-based FTX.

    Genesis had used Gemini customer assets to issue loans to groups like Alameda Research, the personal hedge fund of FTX founder Sam Bankman-Fried, as well as the defunct hedge fund Three Arrows Capital, according to the SEC. Genesis, which is owned by the crypto behemoth Digital Currency Group (DCG), declared bankruptcy a week after the SEC announced its charges, and Gemini, which is led by the Winklevoss twins, is the subject of a class action lawsuit.

    “It’s devastating,” said Hee-Jean Kim, an attorney who’s leading the class action case against Gemini. “People really felt this was safe.”

    Gemini and the Winklevoss twins, who accused DCG and Genesis of accounting fraud in a public letter, did not respond to requests for comment. DCG has waved off the allegations as a publicity stunt. Genesis also did not respond to requests for comment.

    Meanwhile, as multibillion-dollar failures cascade across the industry, the survivors are scrapping over a dwindling pool of assets that remain.

    “The crypto ecosystem right now is working towards solutions through the markets and market forces with no government bailouts and no government assistance,” Mike Katz, the vice president and head of legal at DCG, told POLITICO prior to Genesis’s bankruptcy.

    The calamity in crypto markets has been “a terrible outcome for unsophisticated people, but customers wanted their return,” said Brown Rudnick bankruptcy group partner William Baldiga, who’s advising Bahamian officials on the FTX restructuring. “If you’re going to promise customers 6 percent, 12 percent return, how is the company going to make the money to give them those returns? Well, too often, only by gambling with the funds the customer gave you.”

    “You get in the hole, some people keep digging,” he said.

    Crypto trading platforms and brokerages are highly interconnected, so when one company’s investments go south, those losses are felt by its lenders and business partners.

    That problem became acute in mid-2022 after a widely used crypto token lost its value and pushed one of its backers, hedge fund Three Arrows Capital, into liquidation.

    Others soon followed. Celsius Network and Voyager Digital, two trading platforms where millions of retail customers held accounts, both declared bankruptcy in July. Genesis, which had loaned almost $2.4 billion to Three Arrows, wobbled in the market downturn until DCG arranged to absorb some of the losses.

    That was only a dress rehearsal for FTX’s main event. Exposure to Bankman-Fried’s investment empire, which included dozens of exchanges, digital startups and venture capital investments, paralyzed Genesis and other crypto businesses that survived the initial downturn.

    With regulators circling and crypto asset values plummeting, FTX’s bankruptcy and the restructuring proceedings for Three Arrows, Celsius, Voyager and the crypto lender BlockFi’s assets became critical venues for creditors to recover their losses.

    “The domino effect is extensive, in part because FTX had positioned itself as such a successful and dominant player in the market,” said Auerbach. When a market pillar of that size falls, he said, “the ripples and waves are … dramatic.”

    Celsius, FTX, Three Arrows and Genesis did not respond to requests for comment.

    FTX’s restructuring team says it has recovered more than $5 billion from Bankman-Fried’s ruined empire, but it’s far from clear if that will be enough to compensate millions of customers and creditors whose funds were lost when the platform imploded last year.

    Meanwhile, a new ruling in Celsius Network’s bankruptcy determined that customers will be at the back of the line for any claims on its assets. Federal authorities have warned about Voyager’s sale of its assets to Binance.US — a deal the company’s restructuring team pursued after FTX’s planned acquisition of the portfolio was derailed by its collapse.

    Even if Binance.US completes its acquisition of Voyager’s assets, Voyager isn’t making any assurances that its customers will see the value of their accounts restored.

    “It’s a whack-a-mole problem,” Rizzo said. “You make one party whole, and then here’s less resources for another party.”
