    Walker’s death last June sparked protests in Akron after police released body camera footage showing him dying in a hail of gunfire. Activists, including from the family of the Rev. Martin Luther King Jr., spoke about his death. The NAACP and an attorney for Walker’s family called on the Justice Department to open a federal civil rights investigation.

    President Joe Biden responded to the shooting during a trip to Ohio last summer by saying the DOJ was monitoring the case.

    The state investigation found that police first saw Walker driving with a broken taillight and a broken light on his rear license plate, but they decided not to follow him. They saw him 10 minutes later at the same intersection and decided to pursue him for the equipment violation, Yost said.

    Police said Walker refused to stop and then fired a shot from his car 40 seconds into the pursuit.

    Officers chased the car on a freeway and city streets until Walker bailed from the still-moving vehicle and ran into a parking lot where he was killed while wearing a ski mask, body cam video showed. Authorities said he represented a “deadly threat.” A handgun, a loaded magazine and a wedding ring were found on the driver’s seat of his car.

    Dash-cam video from a police cruiser captured images of Walker firing the gun from his car, said Anthony Pierson, an assistant state attorney general. Walker had no criminal history and had never fired a gun until he went to a shooting range with a friend in early June, Pierson said.

    Walker’s family called it a brutal and senseless shooting of a man who was unarmed at the time and whose fiancee recently died. Police union officials said the officers thought there was an immediate threat of serious harm and that their actions were in line with their training and protocols.

    Walker had been grieving his fiancée’s recent death but his family had no indication of concern beyond that, a family representative previously said.

    Pierson wouldn’t speculate about Walker’s state of mind that night and said there was no direct evidence that he was suicidal.

    “That night he encountered the police he wasn’t acting himself,” Pierson said. “By all accounts he was a good person, a good man.”

    Blurry body camera footage released last summer did not clearly show what authorities say was a threatening gesture Walker made before he was shot.

    The eight officers, whose names have been withheld from the public, initially were placed on leave, but they returned to administrative duties 3 1/2 months after the shooting.

    Yost would not release the names of the officers, saying it was his office’s policy not to release the names of people who were not charged.

    Attorneys for the eight officers released a statement calling the incident a tragedy for the entire community, including Walker’s family and all of the officers who were involved. “A split-second decision to use lethal force is one that every police officer hopes he or she will never be forced to make,” the statement said.

    A county medical officer said the autopsy found no illegal drugs or alcohol were detected in Walker’s body.

    After taking over the investigation last summer at the request of Akron police, prosecutors with the Ohio attorney general’s office presented the case to the grand jury.

    City leaders have been meeting with community leaders, church groups, activists and business owners ahead of the grand jury meeting while also preparing for potential protests.

    The city created a designated protest zone downtown outside the city hall building, where workers put plywood over the first-floor windows. There’s also temporary fencing around the county courthouse and many businesses boarded up their windows.

    The city’s school district canceled classes on Tuesday in the wake of the grand jury announcement.

    Less than 24 hours before the chase, police in neighboring New Franklin Township had tried to stop a car matching Walker’s, also for unspecified minor equipment violations. A supervisor there called off the pursuit when the car crossed the township’s border with Akron.

    A trial would force Fox to answer for its actions in the weeks after the 2020 presidential election and litigate denial about the outcome of the race in general. The case centers on whether Fox defamed Denver-based Dominion Voting Systems by spreading false claims that the company rigged the election against then-President Donald Trump.

    A settlement is certainly a possibility in a trial that carries risks for both sides. Fox already has been embarrassed by revelations that some of its executives and on-air personalities did not believe fraud claims that the network spread on the air, and it doesn’t want to see 92-year-old founder Rupert Murdoch testify. Dominion could miss a big payday if a jury rules against it.

    Not everyone wants the case to go away quietly, however.

    “PLEASE Dominion — Do not settle with Fox! You’re about to prove something very big,” tweeted Gretchen Carlson, the former Fox anchor whose accusations of sexual misconduct by former Fox chief Roger Ailes led to his downfall in 2016.

    Fox, meanwhile, paid for a full-page advertisement in The New York Times on Monday headlined “Trusted Now. More Than Ever.”

    Dozens of journalists gathered at the courthouse in downtown Wilmington, some before dawn, for a hearing that lasted about five minutes. The courtyard in front of the court building was full of TV crews ready to do live shots.

    Besides its implications for Fox, the case is being watched carefully by journalists for what it could mean for libel law. Defamation is generally hard to prove, since it requires a finding that journalists published information they knew to be false, or with a reckless disregard for the truth.

    Some First Amendment lawyers say Dominion’s lawsuit presents a powerful case, given the doubt expressed within Fox about the fraud allegations. Fox says Dominion can’t prove that the people with such doubts were in position to affect what was said on the air about the company.

    Even before a jury hears the case, Davis has made some rulings in Dominion’s favor, including stating that the allegations of election fraud made against the company were clearly false. That means the issue will not have to be litigated in the trial.

    “We still don’t know who this guy was talking to outside of the Discord server and if he had any other intention for leaking the documents beyond wanting to impress friends,” said a fourth person — a former U.S. intelligence official.

    It’s standard practice for investigators to examine a suspect’s potential ties to foreign governments and entities, especially in leak cases, said Mick Mulroy, a former top Pentagon official and retired CIA officer. Defense Department and CIA employees are required to disclose any “close and continuous” contact with foreigners, he noted.

    If they find any foreign links it would mean the leak is likely even more damaging than believed. It could signify that it was orchestrated by a foreign government, or that materials were available to foreign officials well before they became public knowledge.

    A foreign connection could also open Teixeira up to more charges.

    So far, Teixeira has been charged with “unauthorized retention and transmission of national defense information” and “unauthorized removal and retention of classified documents or material.” Each charge carries a sentence of up to 10 years in prison.

    According to court documents, Teixeira violated two sections of the Espionage Act. If the government were to establish probable cause, it could add another charge for Teixeira under a separate section of the act that deals with gathering or delivering defense information to aid a foreign government.

    The former U.S. intelligence official said that is unlikely to happen at this stage.

    The Justice Department is leading the investigation into Teixeira. The Pentagon and the intelligence agencies are also looking into the breach.

    The Defense Department closely monitors any employee’s activity on the Joint Worldwide Intelligence Communication System, the secure intranet system that houses top secret and sensitive information, including what information is accessed, downloaded and printed.

    The Pentagon is also reviewing Teixeira’s records, including his security clearance as part of the investigation, according to one of the people familiar with the probe. DoD hopes that the review will help it decide if changes to procedures regarding access to classified documents need to be made, the person said.

    Teixeira is an IT specialist assigned to the 102nd Intelligence Wing, giving him access to the computers of analysts tasked with packaging intelligence for senior military commanders, said a fifth person, a Defense Department official.

    The FBI and Justice Department declined to comment. The CIA and the Office of the Director of National Intelligence did not respond to a request for comment.

    Some press reporting in recent days has suggested that people from other countries were members of the original server where Teixeira allegedly posted the documents. Others, however, have rejected that assertion. In an interview with The Washington Post, one of Teixeira’s friends said any suggestion that the server’s members were Russian or Ukrainian was “pure fabrication.”

    According to another report by The Washington Post, users who interacted with Teixeira on Discord, the social media platform where the documents appeared, thought he posted the materials partly to educate them on how the U.S. government operates in the world and partly to show off his access.

    Understanding Teixeira’s motivation is also important for the government in determining how to prevent such leaks in the future.

    The leak allegedly carried out by Teixeira is different from past breaches of intelligence, including those perpetrated by Edward Snowden and WikiLeaks. Teixeira is accused of disseminating the documents on social media, instead of packaging and filtering them through the press, and did not appear to publish the intelligence as a result of a specific ideology.

    Teixeira allegedly posted the documents to a Discord server last year. In recent weeks, a member of that server posted them to a second Discord group before they began to circulate more widely on other social media sites, including Telegram and Twitter.

    The leaked documents include extraordinary detail on troop and battlefield movements by both Kyiv and Moscow in Ukraine as well as other global issues such as Iran’s development of its nuclear program, protests in Israel and China’s relationship with Russia. They also expose the extent to which the U.S. spies on its adversaries and allies.

    While POLITICO and many other media outlets have obtained and reviewed more than 50 of the classified documents, there appear to be perhaps dozens of other documents that have not been posted publicly on social media. The Washington Post and The New York Times have exposed several of those documents in recent days.

    At least one of the documents posted on Telegram appears to have been altered to include higher Ukrainian and lower Russian death tolls, according to a document reviewed by POLITICO. It’s unclear who altered the documents.

    A woman who recently ended her enlisted service in the U.S. Navy told The Wall Street Journal that she oversaw the Telegram channel where the altered documents were posted. That woman, 37-year-old Sarah Bils, has previously posted pro-Russian content on social media but denied having altered the classified document. She also told the Journal she deleted the documents from the channel as soon as she noticed they had been posted.

    In an email to POLITICO, Bils said: “I didn’t leak the documents and had no part in that. You’re asking the wrong entity. [The documents] were never in my possession at all.”

    While Bils’ link to the spread of the classified documents on other social media sites raises questions about her potential involvement in their alteration, there is no apparent connection between the former sailor and Teixeira.

    The threat came after Disney in February quietly, through a bureaucratic vote, wrestled back control of the Orlando-area park — though state officials didn’t learn of it until March. Disney’s maneuvering left DeSantis administration officials scrambling to respond and the governor ordered an investigation into the California-based corporation.

    During Monday’s press conference, DeSantis also suggested a newly-created state board that owns property in and around Disney World may convert that land into a state park, a rival amusement park or even a state prison. He also floated the idea that the board could look at whether to raise its tax rates, a move that would result in more costs for Disney.

    The governor said that other ideas — such as imposing tolls on roads serving the park — would not be considered. But the recommendations, taken in whole, are meant to push back on the criticism directed at DeSantis by former President Donald Trump and others that he had been outfoxed by Disney.

    During his remarks, DeSantis touted his decisive reelection victory as proof that Floridians backed his push to strip Disney — which is one of the state’s largest employers — of its long-held control over a special district that was initially created in the late ‘60s to spur the development of Walt Disney World.

    DeSantis also added in a statement that “their cheerleaders in the media thought that Disney ‘outsmarted’ the state, but the new control board uncovered their sloppy scheme, and the agreements will be nullified by new legislation that I intend to execute. Disney will operate on a level playing field with every other business in Florida.”

    Disney did not immediately respond to a request for comment.

    The confrontation with Disney started over a year ago when the company opposed Florida’s parental rights in education bill, known by opponents as “Don’t Say Gay,” that banned classroom instruction about sexual orientation and gender identity in lower grades.

    After the company vowed to fight for the law’s repeal, DeSantis countered by having legislators pass a bill to dissolve Disney’s special district known as the Reedy Creek Improvement District. The governor and lawmakers followed that up during a February special Legislative session, however, by passing another measure that kept the district intact but with a new board appointed by the governor.

    However, before that new law took effect, Disney negotiated a deal with the old board during the winter that transferred control to the company. DeSantis and his board of appointees questioned the legality of this deal, though Disney has maintained in statements that it was perfectly legal and was approved in a public meeting.

    Florida currently exempts large theme parks from state inspections, which carves out not just Disney but competitors such as Universal. GOP Agriculture Commissioner Wilton Simpson, whose agency oversees ride safety, said the legislative proposal would allow state inspectors to go in if there had been an accident. DeSantis, in clarifying remarks to reporters, added however this requirement would only apply to parks in special districts, which would mean the new requirement would apply to just Disney.

    State Rep. Anna Eskamani, a Democrat from central Florida, blasted DeSantis over his latest confrontation with Disney.

    “Gov. DeSantis once again demonstrates his latest attempt to target Walt Disney World that this has nothing to do with corporate accountability and everything to do with his own ego and attempt to get a ‘win” for his GOP base,” Eskamani said. “He needs to let go and move on.”

    State Sen. Linda Stewart, another Democrat from Central Florida, said DeSantis was interested in “retaliation, not good government. Turning corporations and properties over to government-control, as DeSantis proposes, just because the governor doesn’t like a position they’ve taken on gay rights, belongs in the playbooks of banana republics, not the state of Florida.”

    DeSantis had hinted at his latest actions earlier this month, but when asked about potential legislation, GOP Senate President Kathleen Passidomo said last Wednesday that if “somebody is working on it they haven’t shared it with me.”

    Katie Betta, a spokesperson for Passidomo, said in email that DeSantis’ staff began speaking to Passidomo’s late last week and over the weekend ahead of his Monday announcement. She also added: “As you are aware, issues can develop throughout the course of session.”

    The Disney legislation adds to a long line of priorities that DeSantis is pushing through in the weeks ahead of an expected presidential campaign. The Legislature has already passed measures on the death penalty, a ban on abortion after six weeks of pregnancy, and easing gun restrictions that had the backing of the governor.

    Legislators who joined DeSantis on Monday said they fully backed his latest efforts to go after Disney, including one whose district includes the theme park and railed at what she called Disney’s embrace of “radical gender ideologies.”

    “Here in the free state of Florida it is we the people not woke corporations,” said Rep. Carolina Amesty (R-Windermere). “We love Disney however you cannot indoctrinate our children.”

    Prosecutors described the 34 officers as having created a “troll farm” consisting of thousands of fake online personas on social media sites, including Twitter, to target Chinese nationals living in the U.S. who held political views in opposition to those of the People’s Republic of China or who promoted democracy in China.

    Schumer said he is angling to have a conversation with Minority Leader Mitch McConnell about the matter soon — but over the course of Monday, deal-making GOP senators from Collins to Bill Cassidy (R-La.) to Thom Tillis (R-N.C.). lined up in opposition to temporarily replacing Feinstein on the panel.

    Republicans’ blockade of the resolution to replace Feinstein will effectively make it tougher for Democrats to confirm more judges — which Biden’s party can normally do unilaterally with a 51-49 majority. The judiciary panel’s chair, Dick Durbin (D-Ill.), has repeatedly delayed committee votes on lifetime appointees during Feinstein’s treatment for shingles. Democrats still have some judicial nominees ready for floor votes, but that list will run dry relatively soon without action at the Judiciary Committee.

    Schumer said he expects Feinstein to return to the Senate soon and that “We think the Republicans should allow a temporary replacement till she returns. I hope the Republicans will join us in making sure this happens, since it is the only right and fair thing to do.”

    But if her absence continues, the pressure on her to resign her seat will rise exponentially, given how high judges are on her party’s priority list.

    “I’m sure we’re going to be talking about this as a caucus this week,” said Sen. Tim Kaine (D-Va.). “These are the kinds of discussions where you really kind of have to get in the room to think it through. We haven’t started those discussions yet.”

    Reshuffling the panel’s roster this week would require unanimous consent from all senators, which means just one Republican could block it. And the Judiciary Committee members opposing a Feinstein replacement on Monday included Sens. Tom Cotton (R-Ark.), Marsha Blackburn (R-Tenn.), John Cornyn (R-Texas) and Tillis. All cited Democrats’ goal of confirming liberal judicial nominees.

    Cornyn said, “Republicans are not going to break this precedent in order to bail out Sen. Schumer or the Biden administration’s most controversial nominees.”

    McConnell hasn’t made a statement on Feinstein yet, but comments from Collins and Sen. Lisa Murkowski (R-Alaska) made it even more clear the temporary replacement that the 89-year-old senator sought is a dead end for Democrats.

    As Murkowski put it: “We need to respect not only Senator Feinstein, but also our protocols here in the Senate.”

    Republicans also noted that Democrats were only maneuvering to replace her on the Judiciary panel, not her other committee assignments. Summing up his party’s position, Senate Minority Whip John Thune (R-S.D.) said that “you’re starting to get a flavor that, certainly from Democrats’ standpoint, this is not going to be a slam dunk.”

    “The Dems are sort of using this because they want pressure on her to resign. And I think this gives them sort of a lever to do that,” Thune added of Feinstein.

    Democrats still haven’t even picked a potential Feinstein replacement. Schumer said he needs to talk to the caucus about who would take her spot on the Judiciary panel, which she was once in line to chair. Durbin said the choice is up to Schumer, but that he’ll be giving recommendations.

    With Feinstein absent — and her timetable to ever return to Washington increasingly uncertain — the committee is evenly split between Democrats and Republicans. That means judicial nominees without bipartisan support cannot come to the Senate floor without laborious procedural votes to shake them loose. Even then, those votes would face a 60-senator threshold.

    And the stakes are extra-high now: Confirming judges is one of the top Senate Democratic priorities given GOP control of the House.

    “Tomorrow, this could happen to the Republicans and they could find themselves in a vulnerable position through no fault of their own,” Durbin said Monday. “And I hope that they’ll show a little kindness and caring for their colleagues.”

    Feinstein rejected any talk of resigning in a statement last week, asking that she be removed from the committee until she returns to the Senate in order to allow Judiciary’s work to continue.

    There is little recent precedent in the Senate to make a temporary replacement on a committee roster, since changes are usually triggered by a lawmaker leaving the chamber entirely. Notably, Republicans said they would take a different approach if Democrats were seeking approval to seat a replacement California senator on committees, rather than a temporary swap for Feinstein.

    Describing Feinstein as currently in “a delicate part of her life and her Senate service,” Durbin said Republicans should “stand by her and give her a dignified departure from the committee.”
