    MEPs approve plans for long-awaited overhaul to EU asylum system

    The European parliament has approved a series of proposals to overhaul the EU asylum system in a bid to end a years-long deadlock over the issue.

    Voting in Strasbourg, MEPs approved plans on the distribution of refugees and migrants across the bloc, screening of people at the EU’s external borders and giving non-EU nationals long-term residence permits after three years of legal stay in a member state.

    The votes open the way for MEPs to negotiate the final laws with EU ministers. All sides have pledged to aim for an agreement by April 2024 – before the European elections later that year.

    After seven years of deadlock over the issue, lawmakers who will be involved in the negotiations suggested this could be the last chance to create a truly common European asylum system.

    “If we miss this chance to make it right, I am very pessimistic about having any other chance to make it right and that will be an extremely, extremely disappointing, extremely sad, extremely counterproductive kind of a message,” Spanish Socialist MEP Juan Fernando López Aguilar told reporters before the vote.

    Tomas Tobé, a Swedish centre-right MEP, said the EU was at a crossroad. “Either the political deadlock continues … or we will see the situation where member states will act independently and we will have more problems ahead of us.”

    The crunch point is approaching as the EU grapples with the largest number of people seeking to come to Europe via irregular routes since 2016. The EU border agency Frontex reported 330,000 irregular crossings at the EU’s external borders in 2022, a 64% jump on the previous year and the highest since 2016.

    After more than 1.2 million people fleeing war and persecution sought refuge in the union in 2015, triggering a political crisis for EU leaders, the European Commission proposed mandatory quotas of asylum seekers to be distributed around the bloc. But member states failed to back the idea. While Mediterranean states, such as Greece, Italy and Spain, insisted on mandatory relocation, central European countries, such as Hungary and Poland, refused to accept such a plan.

    Under a new European Commission president, Ursula von der Leyen, the EU executive revised its ideas in September 2020, proposing that member states opposed to mandatory relocation could instead take charge of returning people denied asylum in the EU to their country of origin. The EU typically returns about 29% of people denied asylum to their home country and is seeking to boost this number by striking deals with governments in the Middle East and Africa.

    The European parliament argues that a country that refuses to take in asylum seekers during a crisis situation should be obliged to make financial contributions to frontline countries – an idea that was fiercely opposed and ultimately blocked by central Europe, led by Poland and Hungary’s nationalist governments, during the last round of failed talks.

    With the support of the European parliament’s largest groups – the centre-right, centre-left and centrists – that proposal, along with the other negotiating positions, passed with comfortable majorities of about three-quarters of MEPs present on Thursday.

    But EU member states have made little progress on the most controversial aspects of the draft laws, the shared management of asylum seekers during normal times and crisis situations. EU governments have, however, fixed a common position on tightening up screening on asylum seekers at the external border.

    MEPs have also called for tougher monitoring of human rights abuses at the EU’s frontiers, in response to numerous reports of illegal pushbacks and beatings.

    At the same time, sea crossings are claiming more lives. The International Organization for Migration said last week that 441 people died trying to reach Europe via the central Mediterranean route between January to March 2023, the deadliest first quarter since 2017. With more than 20,000 people having died on this route alone since 2014, the UN agency said it feared these deaths have become “normalised”.

    Stephanie Pope, an expert in EU asylum policy at Oxfam, said the votes were a significant step, but she was not hopeful of a better asylum system. “A lot of the proposals in the pact were pretty much a race to the bottom when it comes to the protection of human rights and the right to asylum and not much has changed in that regard,” she said.

    “The key sticking point, and the root of a lot of the ongoing human rights violations against refugees we’ve seen for years now is the lack of an effective responsibility sharing mechanism between member states.

    “Push backs and the violence we are seeing at borders are an unacceptable symptom of this failure to agree on responsibility sharing between member states.”

    After years of strained relations, United Arab Emirates (UAE) and Qatar are in the process of restore diplomatic relations and reopening the closed embassies in the coming weeks.

    The development in relations between Qatar and the UAE comes more than two years after the signing of the Al-Ula agreement, which ended the Gulf crisis and the blockade of Qatar. 

    “At present, the activation of diplomatic ties, which will include the reopening of embassies, is under process between both countries,” a UAE official said in a statement in response to a question from Reuters.

    “Work is underway between the Qatari and Emirati teams to reopen the respective embassies as soon as possible, exact date to be announced upon the finalization of the process,” Qatar’s International Media Office told CNBC in a statement.

    It is noteworthy that in mid-2017, Saudi Arabia, the UAE, Bahrain and Egypt imposed a land, air and sea blockade on Qatar, claiming its support for terrorism, which Doha has repeatedly denied. 

    Riyadh and Cairo were the first to reappoint ambassadors to Doha in 2021 following a Saudi-led Al-Ula agreement to end the dispute, while Bahrain announced last week that it had decided to restore diplomatic relations.

    All countries, with the exception of Bahrain, have already restored trade and travel links with Qatar in early 2021, while the UAE has said it will take some time to resume diplomatic relations.

    Labor case of over 70 enslaved Thai workers

    While Su was a lawyer for low-wage and immigrant workers in 1995, she represented more than 70 undocumented Thai garment workers forced to work under sweatshop conditions — a case that gained widespread attention at the time.

    Su’s anti-sweatshop work won her international recognition when she was awarded a McArthur Foundation “genius” grant in 2001.

    Sweatshop Watch founding

    Su co-founded the organization Sweatshop Watch in 1995, which worked to improve working conditions for garment workers in the United States.

    Over the past decade, the coalition, in collaboration with the Asian Pacific American Legal Center, has brought cases on behalf of hundreds of low-wage, immigrant and often undocumented women in the clothing industry against major corporations who use sweatshops to manufacture the garments they sell.

    Deputy position nomination scrutiny

    When Su was confirmed in 2021 to be deputy secretary, she faced scrutiny from Senate Republicans on her leadership of California’s Labor Department.

    Republicans focused on Su’s involvement in large-scale unemployment insurance fraud and employee classification legislation that was later partially overturned by California voters.

    Su’s record is likely to face even more scrutiny, and she will have to answer for moves made by DOL during Walsh’s tenure. Among those moves will be the Biden administration’s handling of the freight rail labor standoff last year, in which Su played a central role.

    A Defense Department spokesperson confirmed that the U.S. was prepositioning troops, but stopped short of saying they were heading to Djibouti.

    “The Department of Defense, through U.S. Africa Command, is monitoring the situation in Sudan and conducting prudent planning for various contingencies. As part of this, we are deploying additional capabilities nearby in the region for contingency purposes related to securing and potentially facilitating the departure of U.S. Embassy personnel from Sudan, if circumstances require it,” said DoD spokesperson Lt. Col. Garron Garn.

    Some in the administration are hoping to avoid scenes reminiscent of the evacuation from Kabul, Afghanistan, in 2021. The crush of thousands pleading to leave the city as the Taliban took control became a defining image of America’s withdrawal.

    Lawmakers, meanwhile, are worried about the safety of U.S. staffers in Khartoum.

    Sen. Tim Kaine (D-Va.), a member of the Senate Foreign Relations Committee, said worried senators took a detour to a Capitol briefing Thursday on the document leaks to ask about the safety of U.S. personnel in Khartoum. Declining to provide specifics because of the classified setting, Kaine said there was a plan in place to take care of them.

    “Arrangements have been made. They’re sheltering in place and currently all secure, all accounted for and in communication with them,” he said. “There’s a whole-of-government effort to figure out exactly how to make sure that they continue in safety. We’re very much on top of it.”

    Sen. Mitt Romney (R-Utah), also on the committee, added “I, of course, have concerns about our personnel there.” He declined to discuss specific plans.

    A military evacuation seems more likely by the hour.

    The airport, located in central Khartoum, is closed but would be inoperable even if it reopened due to damage from bombardment and fighting. The roughly 70 U.S. staff at the embassy have no options to leave Sudan on their own without immense risk to their safety. For the most part, U.S. diplomats in Sudan are unaccompanied, meaning they do not have their family with them at what’s considered a challenging post, a State Department official said.

    The American mission in the capital warned Thursday that “due to the uncertain security situation in Khartoum and closure of the airport, it is not currently safe to undertake a U.S. government-coordinated evacuation of private U.S. citizens.”

    Also on Wednesday, Molly Phee, the top State Department official for African affairs, told congressional staffers that it was too late to order a departure of the mission because of the deteriorating security situation that has already led to around 300 deaths and about 3,000 more wounded, two congressional aides said.

    Another U.S. official familiar with the planning said papers had been drawn up at the State Department for an evacuation order. The official added that State Department leadership held a call with embassy staff Thursday morning to discuss options, including a ground evacuation. But the assessment, per the official, was that travel by road was currently more dangerous than by air.

    A potential option would be to move the personnel to Wadi Seidna Air Base for an air evacuation. Dozens of Egyptian soldiers captured by the Rapid Support Forces paramilitary group were released this week and flew home from that base, which is 14 miles north of Khartoum.

    The United States was also in touch with other countries with embassies in the Sudanese capital about evacuation plans, a different U.S. official said.

    The State Department didn’t immediately respond to a request for comment.

    The Biden administration has faced similar situations multiple times since the chaotic Kabul evacuation.

    As the situation deteriorated in Ethiopia amid a major conflict, the State Department urged Americans to leave the country while preparing U.S. forces and diplomats for a potential full embassy closure that ultimately did not have to happen. (A partial drawdown of non-emergency embassy personnel was ordered.)

    The administration shut down the U.S. Embassy in Kyiv in the days before Russia launched a full-scale invasion of Ukraine. Within months it had reopened the embassy, though not at full staffing.

    The Biden administration in both cases said it would not stage another Kabul-style evacuation that involved people beyond U.S. government employees. To that end, it sent out warnings for weeks and months telling Americans to leave Ethiopia and Ukraine.

    The political situation in Sudan has been volatile for years, and the State Department has long urged Americans not to travel there. The last time a similar fight broke out in the region between two top leaders, 400,000 people died — and that was in South Sudan.

    McCarthy is eyeing to pass his plan in the House next week, setting up a showdown with Democrats amid worries that the U.S. could default on its debt as early as June.

    The Republicans’ 300-page-plus bill amounts to a legislative wish list of measures that have no future in the Senate, whose Democratic leaders have joined Biden in refusing to negotiate policy changes as part of the debt ceiling. They argue that lawmakers should raise the borrowing cap — and avert global economic havoc — without conditions, as Congress repeatedly did under former President Donald Trump.

    Biden derided McCarthy’s plan during an appearance Wednesday in Maryland, and vowed to reject GOP demands that he roll back his administration’s accomplishments.

    “They’re in Congress threatening to undo all the stuff that you helped me get done,” Biden said during an appearance at a Maryland union hall. “You and the American people should know about the competing economic visions of the country that are at stake right now.”

    Rep. Jared Huffman (D-Calif.) likewise dismissed the Republican proposal. “It’s pathetic,” he said.

    The GOP bill would enact the party’s marquee energy bill, H.R.1 (218), which the House already passed last month. That bill includes an easing of permitting rules for new energy infrastructure and mining projects that Republicans say would promote economic growth, and which might find some appeal among Democrats.

    The Republican proposal also includes more partisan elements of their energy bill, which would mandate more oil and gas lease sales on federal lands, ease restrictions on natural gas exports, and repeal a fee that the IRA imposed on methane emissions from oil and gas operations.

    Republicans have lambasted the IRA’s clean energy incentives, saying they’re wasteful and distort markets.

    “These spending limits are not draconian,” McCarthy said in a Wednesday floor speech ahead of the bill release. “They are responsible. We’re going to save taxpayers money. It will end the green giveaways for companies that distort the market and waste taxpayers’ money.”

    Republicans are seeking to repeal the IRA’s zero-emission nuclear power production, clean hydrogen and sustainable aviation fuel tax credits. Their bill would also eliminate the law’s bonus provisions aimed at placing solar and wind facilities in low-income communities and that allow some entities to receive direct payments of the credits.

    “We have to create situations where traditional, reliable, resilient energy can compete in the marketplace,” Rep. Kelly Armstrong (R-N.D.) told POLITICO. “If that’s getting rid of some of the crazy renewable tax credits in the IRA, I am all for it.”

    Republicans are also proposing to modify several other existing tax credits under the law, including by reestablishing the previous investment and production tax credits for solar and wind that the IRA had extended and increased. The GOP would nix both the production and investments tax credits for green sources after 2024, as well as incentives for paying prevailing wage, using domestic content and placing facilities in communities historically dependent on fossil fuels.

    The proposal would eliminate changes to some tax credits that existed before Democrats’ IRA was enacted, including for carbon sequestration.

    And it would make major changes in the IRA’s electric vehicle tax credit, whose implementation by the Biden administration has taken bipartisan criticism. The GOP proposal would revive a prior $7,500 tax credit for qualifying electric vehicles, but would restore that tax break’s per-manufacturer limit of 200,000 vehicles. It would entirely repeal the IRA’s new incentives for critical battery minerals that are extracted from the U.S. or a close trading partner, and for batteries manufactured or assembled in North America.

    While some moderate Republicans called for party leaders to place a priority on policy measures that could draw bipartisan support — such as overhaul permitting rules — as part of the debt ceiling package, conservatives pushed for more partisan measures targeting Democrats’ climate law.

    But that could put some Republicans in a tricky spot, because many projects that could receive the IRA’s tax credits are set to be built in congressional districts represented by GOP lawmakers. Recent analysis from the American Clean Power Association found that there have been $150 billion in new clean power capital investments since the law’s August passage, including 46 utility-scale solar, battery and wind manufacturing facilities or facility expansions.

    Of the manufacturing announcements tracked by ACP where a congressional district was known, the majority of those facilities were in red districts.

    “There is a lot of stuff in the Inflation Reduction Act that should be repealed,” Rep. Jeff Duncan (R-S.C.) told POLITICO. “But there is some common sense stuff that was in there as well.”
