    HC directs UP govt to amend rules to fill Class-III vacancies via UPSSSC

    Lucknow: The Allahabad High Court has directed the state government to ensure the selection of Class-lll posts in the legislative assembly and the legislative council is made through the Uttar Pradesh Subordinate Services Selection Commission (UPSSSC).

    The court’s Lucknow bench also asked the government to amend in rules within three months for this.

    Justice DK Singh passed the order recently while dismissing a writ petition by Sushil Kumar and others. The bench said the petitioners, who were appointed on contractual basis, should be allowed to work and be paid remuneration accordingly till regular selected candidates join through UPSSSC.

    The petitioners had challenged the selection of candidates in the legislative council in accordance with the advertisement issued in September 2020 for 99 posts of 11 cadres. They had alleged nepotism and favouritism in the selection process.

    Opposing their plea, the respondents’ counsel Gaurav Mehrotra argued that the court had dismissed a similar petition earlier and the petitioners were not able to establish any fault in the selection process.

    Mehrotra also said the petition was not maintainable on their behalf as they are unsuccessful candidates.

    Dismissing the petition, the bench observed, “It is required to note that appointments for a post in a public body must be fair and reasonable. Fairness and reasonableness must be ensured in entire process of selection.”

    “In view to maintain the public confidence in the recruitment process in the legislative assembly and legislative council in respect of Class-III posts, the recruitment should be in the hands of the specialised statutory recruitment body and not in the hands of a selection committee or a private agency,” the bench said.

    New Delhi: As the Supreme Court hears pleas seeking legal sanction for same sex marriages, Union Law Minister Kiren Rijiju on Wednesday said an important matter like the institution of marriage has to be decided by people of the country and that courts are not the forum to settle such issues.

    He, however, clarified that he does not want to make the matter a “government versus judiciary” issue. “It is not. Absolutely not,” the minister asserted.

    Responding to a question at Republic TV conclave, he said, “It is a matter which concerns every citizen of India. It is the question of people’s will. The will of the people is reflected in Parliament or in the legislature or assemblies…”

    Apparently referring to the Constitution bench of the top court hearing the matter, Rijiju said, “If five wise men decide something which is correct according to them — I cannot make any kind of adverse comments against them — But if people do not want it, you cannot impose things on the people…,”.

    Same-sex partners from around the country have approached the Supreme Court with a plea stating that same sex marriages should be legalised under the Special Marriage Act.

    The law minister further said that sensitive and important matters like institution of marriage have to be decided by the people of the country.

    The Supreme Court has the power to issue certain directions. Under Article 142, it can also make laws. If it feels some vacuum has to be filled, it can do so with certain provisions, he pointed out.

    “But when it comes to a matter which effects every citizen of the country, SC is not the forum to decide on behalf of the people of the country,” Rijiju added.

    The Centre on Wednesday requested the apex court to consider leaving questions raised in the pleas seeking legal sanction for same sex marriages to Parliament.

    Appearing for the Centre, Solicitor General Tushar Mehta told a five-judge constitution bench headed by Chief Justice D Y Chandrachud that the court is dealing with a “very complex subject”, which has a “profound social impact”.

    Cooch Behar: Senior TMC leader Abhishek Banerjee on Wednesday cautioned a section of party workers against using strong-arm tactics to manipulate public opinion on selecting candidates for the West Bengal panchayat polls during its mass outreach programme.

    His remarks came a day after the inaugural day of the much-touted mass outreach campaign was marred by ruckus as infighting within the TMC came out in the open over the secret ballot voting process as two groups came down to blows during the event.

    Banerjee, the TMC national general secretary, said those opposed to the programme, ‘Trinamool-ey Nabajowar’ (new wave in Trinamool), are free to leave the party.

    Miffed over the incident, Banerjee had said the secret voting process would be conducted again there on Wednesday and cautioned that if some people think they can hijack the process of candidate selection through muscle power, “They are living in a fool’s paradise.”

    While addressing a rally at Cooch Behar Dakshin constituency on the second day of his tour, he said, “If some people think that by multiple requests or by ensuring more votes through unfair means, they can secure their candidature, they are wrong,”

    Banerjee, considered number two in the TMC, said the campaign would empower people to choose their own candidates through a secret ballot, whom the party would give nominations in the panchayat polls.

    “Those unhappy with the programme are free to leave the party. We don’t want rotten elements in our party. One of the aims of this campaign is to cleanse the Panchayati Raj system,” he said.

    Hitting out at BJP legislators from Cooch Behar district for not fighting for people’s rights in the area, Banerjee said locals must gherao the houses of such public representatives and seek answers.

    “The BJP MLAs don’t fight for the rights of the people. They sport saffron tilak, wear a saffron scarf, enter the Assembly raising Jai Shri Ram slogans, and leave it shouting the same. People must gherao the houses of those who were elected from here as they have not worked for the people,” he said.

    Banerjee, the nephew of West Bengal Chief Minister Mamata Banerjee, said that in the next two months, he will be staying on the streets and travelling more than 3500 km – from Cooch Behar in the northern part of the state to Kakdwip in the southern.

    New Delhi: The Supreme Court on Wednesday held that practitioners of alternative systems of medicine such as Ayurveda are not entitled to equal pay with allopathic doctors as they not are involved in performing emergency duties and complicated surgeries.

    Setting aside a Gujarat High Court order, the top court said the emergency duty that allopathy doctors are capable of performing and the trauma care that they are able to provide cannot be performed by Ayurveda practitioners.

    It noted that even post-mortem or autopsy is not carried out by Ayurveda practitioners.

    The apex court was hearing a batch of appeals challenging a 2012 Gujarat High Court order which had held that Ayurveda practitioners are entitled to be treated at par with doctors with MBBS degrees.

    While recognising the importance of Ayurveda practitioners and the need to promote alternative or indigenous systems of medicine, the top court said that it cannot be oblivious of the fact that both categories of doctors are certainly not performing equal work to be entitled to equal pay.

    A bench of Justice V Ramasubramanian and Justice Pankaj Mithal said allopathy doctors are required to perform emergency duties and provide trauma care.

    “By the very nature of the science that they practise and with the advancement of science and modern medical technology, the emergency duty that allopathy doctors are capable of performing and the trauma care that they are capable of providing cannot be performed by Ayurveda doctors,” it said.

    The apex court said it is also not possible for Ayurveda practitioners to assist surgeons performing complicated surgeries while doctors with MBBS degrees can perform the task.

    “We shall not be understood to mean as though one system of medicine is superior to the other. It is not our mandate nor within our competence to assess the relative merits of these two systems of medical sciences. As a matter of fact, we are conscious that the history of Ayurveda dates back to several centuries.

    “We have no doubt that every alternative system of medicine may have its pride of place in history. But today, the practitioners of indigenous systems of medicine do not perform complicated surgical operations. A study of Ayurveda does not authorise them to perform these surgeries. Similarly, a post-mortem or autopsy is not carried out by/in the presence of Ayurveda doctors,” it said.

    The apex court said it is common knowledge that during out-patient days in general hospitals in cities or towns, doctors with MBBS degrees are made to attend to hundreds of patients, which is not the case for Ayurveda practitioners.

    “Therefore, even while recognising the importance of Ayurveda doctors and the need to promote alternative/indigenous systems of medicine, we cannot be oblivious of the fact that both categories of doctors are certainly not performing equal work to be entitled to equal pay,” it said.

    India is planning to link its power grid through undersea cables to the Kingdom of Saudi Arabia (KSA) and the United Arab Emirates (UAE), local media reported.

    India’s Ministry of Energy has circulated ministerial notes for inter-ministerial consultation to expand access to reliable energy and improve energy security in the country.

    The bilateral agreements will be signed with Saudi Arabia and the UAE for the mega projects, once the Cabinet approves the decision, Union Minister for Power and New and Renewable Energy Raj Kumar Singh told Mint.

    “The India-UAE agreement is in its final stages,” said the minister.

    In January 2023, India and the UAE announced plans to conduct a feasibility study for connecting their power grids via undersea cables as part of the One Sun, One World, One Grid initiative.

    On the other hand, the interconnection with Saudi Arabia is currently being reviewed, Singh stated.

    Kota: Police on Wednesday lodged a case after a video showed a group of people allegedly indulging in celebratory firing during Eid prayers at an eidgah in Sangod town here, an officer said.

    “Taking note of the video clip that went viral on social media, the police lodged a case against unidentified persons under relevant sections and began an investigation,” Kota (Rural) Superintendent of Police Kavendra Singh Sagar told reporters.

    In the 36-second video clip, three persons, each with a two-barrel gun sitting at separate places among the people offering namaz, were seen opening fire at intervals during the Eid prayers.
