    SRINAGAR: The District Legal Services Authority Budgam on Saturday directed Senior Superintendent of Police Budgam to lodge FIR against the persons who have uploaded the videos and pictures of the lady killed brutally in the district.

    The District Legal Service Authority (DLSA), District Court Complex Budgam in an order has directed Senior Superintendent of Police (SSP) Budgam to lodge FIR against the persons, who have uploaded and circulated the pictures and videos of victim.

    “It has been observed that the media and general public have been circulating the videos of the recent victim of Soibugh Budgam, who was murdered brutally. Moreover, the pictures of the victim and the videos of her autopsy have also been uploaded and circulated by a number of persons, thereby violating the right to privacy of the victim and her family. Such actions of the above persons and agencies are against law wherein the identity of the victim is revealed and even her private videos have been uploaded and circulated including the video of the autopsy of the deceased victim, which is punishable under law,” the order reads.

    It added that as such, the media and general public is informed  to stop revealing the identity of the victim and also circulating her pictures immediately, failing which, the violators shall be booked under law.

    “Hence, the SSP Budgam is directed to lodge FIR against the persons who have uploaded and circulated the pictures and videos of the victim,” it added.

    Further, Ld. Special Mobile magistrate Budgam is requested to direct the concerned social media agencies to remove the pictures and videos of the victim from all social media platforms and also block the accounts of such violators, it added. (KNO)

    The District Legal Service Authority (DLSA), District Court Complex Budgam in an order, a copy of which lies with the news agency—Kashmir News Observer (KNO) has directed Senior Superintendent of Police (SSP) Budgam to lodge FIR against the persons, who have uploaded and circulated the pictures and videos of victim.

    The former president of the Parliament, Laura Borràs, denied this Monday in the trial the crimes of corruption that are accused of her, assured that she has always acted within the law, dumped the blame on her subordinates and presented herself as a victim of ‘lawfare’ – ‘judicial war’ – and a “political persecution” for his status as an independentist leader. The hearing, in which Borràs faces six years in prison, has already entered its final phase.

    In her appearance before the Superior Court of Catalonia that is judging her, the defendant declared that she has been trying to link her to corruption for years. He even insinuated the existence of a black hand with the aim of attacking her, since the web portal of the Institution of Catalan Letters (ILC) for which she is prosecuted is not active and that extreme, in her eyes, does not allow her to defend herself against the accusations.

    «The works were called into question by police reports and this has had very serious consequences due to accusations of embezzlement and fraud (these crimes fell from the prosecution). If these websites hadn’t disappeared, you could see it and you wouldn’t have to explain yourself,” he said. Borràs got involved in the ‘estelada’ again, as a good part of the nationalist leaders do when they face a court. “I am being investigated for my political links,” he reiterated.

    Borràs assured that he has always acted within the law and that he has not violated the contracting law at any time. He denied the division of contracts, arguing that the works for the ILC web portal that he awarded to his friend Isaías Herrero were diverse and not only consisted of creating the page. And he dumped the responsibility on third parties; that is, in his subordinates in the body of the Generalitat that he directed.

    Specifically, he pointed to the administrator of the ILC, Assumpta Pagespetit, whom he said was the one who devised the contracts with Herrero. The files were ten, she said. And she stressed that they passed all the filters of the Administration, including those of the General Comptrollers of the Ministry of Culture.     Much of the judicial luck of Laura Borràs depends on the validity that the court grants to the evidence that incriminates her. The Prosecutor’s Office bases her accusation on some emails, between Borràs and Isaías Herrero. In them, the leader of Junts gave instructions to Herrero to prepare the aforementioned “comparsa” budgets in order to be able to award him allegedly divided contracts by finger. And the budgets that he presented, some real and others fictitious, also appeared in the emails.

    But Borràs’s defense assures that these tests are not valid, since in his opinion there has not been an adequate chain of custody of the computer material seized at Herrero’s home. According to the experts hired by the nationalist leader, the hard drives containing the emails that incriminate her were altered. Experts believe that their content changed during the investigation. The lawyer Gonzalo Boye considers for them that these tests are not valid in the trial. One of the defense experts is Emilio Hellín, a former leader of Fuerza Nueva, sentenced to 43 years in prison in 1982 for the murder of the Socialist Workers Party militant Yolanda González.

    The Civil Guard experts, on the other hand, denied this Monday that the computer files suffered any modification during their custody and in the different copies made during the investigation.

    SRINAGAR: The High Court of Jammu & Kashmir and Ladakh directed the authorities to proceed with the termination of a 18-20-week pregnancy of an alleged minor rape victim after having a fresh examination of the victim and after father of a minor gives “extra high risk consent.”

    The victim’s father had approached the court seeking termination of pregnancy of the minor. In the rape case, an FIR was registered at a police station in north Kashmir on February 14.

    According to report published by LiveLaw.in, Justice Javed Iqbal Wani on February 17 had directed a Medical Board of LD Hospital in Srinagar to ascertain as to whether the termination of pregnancy is advisable or not.

    Mohsin Qadiri, Sr. Additional Advocate General on Tuesday submitted a report addressed by the Head of Department, Gynaecology and Obstetrics, Government Medical College, Srinagar, to the Medical Superintendent, Government LD Hospital, Srinagar stating that the patient has a 19 weeks of pregnancy and runs a very high risk for MTP as it is a case of teenage pregnancy.

    The report further said that MTP could be undertaken subject to the “extra high risk consent given by guardians/parents.” In court, the father of the victim volunteered and agreed to extend the consent as solicited by the medical board.

    The court directed the authorities to proceed with the case of termination of pregnancy of the minor victim by the experts in the field after having a fresh examination of the victim.

    “In the event a final call is taken by the experts for termination of pregnancy of the minor victim, necessary measures shall also be taken in association with respondents 3 and 4 for the preservation of the DNA sample of the fetus. It is further directed that in case the process of termination of pregnancy is undertaken, the minor victim be provided all necessary medical facilities free of cost by the respondent 2,” LiveLaw.in quoted the court as having said.

    Bengaluru: Women and Child Development Minister Halappa Achar on Saturday visited the minor acid attack victim undergoing treatment at a hospital
    in Ramanagara district of Karnataka.

    The girl was attacked with chemical (thinner) by a man from Kanakapura on Friday evening.

    Consoling the girl and her mother, the minister assured them of stringent action against the accused as per law.

    While interacting with the media, Minister Achar said that acid had burnt the girl’s back, shoulders and eyes. He further said that the Government will have zero tolerance against such incidents.

    The accused has already been arrested and an FIR has been registered at the Kanakapura police station. He said that he has already discussed the matter with the District Superintendent of Police and suggested appropriate action.

    “This is a monstrous act and such incidents must not recur. As soon as I got information about the incident this morning, I put aside all the work and expressed my concern on behalf of the Government. The girl is responding to treatment and will be examined by a cornea specialist,” the Minister said, adding that the government will help in the treatment with specialist doctors.

    The acid attacker has been identified as Sumanth, a mechanic and a resident of Kurupete in Kanakapura. The incident had taken place near the Narayanappa Lake bypass road in Kanakapura on Friday.

    Preliminary investigations suggested that the accused had made a call to the victim and asked her to come. When she came, he professed his love to her. When she refused, the accused threw acid used for cleaning the vehicle engines on her face leaving the left side of the face, including the eye, damaged. The police suspect that the accused had used a chemical (thinner) for the attack.

    According to police, the two were in a relationship for a year. Recently, after a fight, the girl had severed all ties with him.

    The police had formed a special team to nab the accused who had disappeared after the incident.

    Kanakapura Town police have registered the case also under the Pocso Act and IPC Sections.

    New Delhi: Congress leader Rahul Gandhi slammed the BJP-led government on Friday for reducing the MGNREGA budget and alleged that the scheme, which was the foundation of India’s rural economy, is becoming a victim of the Centre’s repressive policies.

    He also accused the government of misusing Aadhaar against the poor sections of the society by linking it to the scheme under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA).

    “MGNREGA is the foundation of India’s rural economy. A revolutionary policy that has supported countless families. The MGNREGA scheme, which is running the homes of crores of families, is becoming a victim of the repressive policies of the Centre,” Gandhi said in a Facebook post in Hindi while citing a news report.

    Congress president Mallikarjun Kharge also hit out at the Centre for “axing” the MGNREGA scheme, saying the poor will never forgive the Narendra Modi government.

    “Modi government’s axe is working on MGNREGA. A 33-per cent cut in the MGNREGA funds in the budget. The minister said MGNREGA is not a scheme to provide employment. States will have to pay 40 per cent money for the Centre’s 100 per cent work.

    “Narendra Modiji, don’t finish MGNREGA, the poor will not forgive,” Kharge said in a tweet in Hindi.

    Gandhi alleged that first the budget for the MGNREGA was cut and now, the linking of salaries with Aadhaar is being done, and said “both these are attacks on the income of the poor”.

    The Congress-led United Progressive Alliance (UPA) government’s vision for the Aadhaar card was to provide convenience, identity and economic security to people. But the present government is not only misusing this thinking, but also using it against the poor, the former Congress chief alleged.

    In his Facebook post, the Lok Sabha MP from Wayanad in Kerala said, “57 per cent of rural labourers will lose their daily wages if Aadhaar card is made mandatory for MGNREGA. They (government) do not have any policy to provide new employment. It has become the intention of this government only to take away the employment of people and create difficulties for the poor to get their rightful money.”

    “No new idea, no plan. Just one policy — torture the poor,” he added.

    New Delhi: The young woman, strangled by her boyfriend with a phone charging data cable after an argument over his marriage to another woman – slated for the same day – and her body stuffed into his dhaba’s fridge, was seen, in two CCTV cameras’ footage, entering her residence on February 9, just hours before she was killed,

    In the ghastly incident, similar to that of the Shraddha Walkar murder, Nikki Yadav, a resident of Haryana’s Jhajjar and presently residing at a rented accommodation in west Delhi was strangled by accused Sahil Gehlot, a resident of Mitraon village hours before his wedding to another woman fixed by his parents.

    The murder was committed near the Kashmiri Gate area and Gehlot, a B. Pharma graduate, then drove with the dead body all the way to his dhaba – a distance of around 36 km – where he stuffed her body in a refrigerator and went on with his wedding.

    Meanwhile, Nikki’s body was handed over to his family on Wednesday afternoon after an autopsy. Sources said that the report opined that she was strangled to death.

    According to police, on February 10, an input was received that a person named Sahil Gehlot had killed his girlfriend and married another girl on the day of murder.

    “A police team was formed and on checking, no case or complaint about any missing girl was found reported. The team reached Mitraon village in search of the accused Gehlot, but his mobile phone was found switched off and he was not present in his house. Intensive search was made in the village and nearby area,” Special Commissioner of Police, Crime, Ravindra Singh Yadav said.

    However, Gehlot was nabbed by police from Kair village crossing.

    “On interrogation, initially, the accused tried to mislead the police. But on sustained interrogation, he disclosed that he had killed his girlfriend, Nikki Yadav, in the intervening night of February 9 and 10 Feb and kept her dead body in a refrigerator at his dhaba in a vacant plot situated on the outskirts of village Mitraon,” Yadav said.

    Gehlot further disclosed that in 2018, he met the woman at a coaching centre in Uttam Nagar area of west Delhi where he had joined to prepare for SSC exams.

    “At that time, Nikki was also preparing for a medical entrance examination in Akash Institute at Uttam Nagar. Both used to travel to their respective institutes daily in the same bus, and they became friends, and later on fell in love,” said the Special CP.

    “The duo started meeting before and after the coaching classes. In February 2018 the accused took admission in D. Pharma in Galgotia College at Greater Noida and she also took admission in the same college in BA (English Hons.). Thereafter, both of them started living together at Greater Noida in a rented house. They became very close to each other and also travelled to several places such as Manali, Rishikesh, Haridwar, Dehradun etc,” said the official.

    However, during Covid-19 pandemic lockdown, they returned to their homes and after the end of the lockdown, they again started living together in a rented house in Dwarka area.

    “The accused did not inform his family members about this relationship. His family was putting pressure on him to get married with some other girl and finally in December 2022, engagement and marriage of the accused with another girl were fixed for February 9 and 10,” the Special CP said.

    Gehlot did not inform Nikki about his engagement or marriage plans. “Somehow she came to know about this and confronted the accused and arguments started between the two. The accused strangulated the deceased with the help of a data cable of his mobile phone kept in his car. Thereafter, he went to the dhaba owned by him and put her dead body in a refrigerator,” he said, adding that Gehlot then went back to his home and solemnised his marriage with another woman.

    In a tweet, the former Congress chief said that at the age of nine, Devika Rotavan was injured in the 26/11 terror attack and then became a witness for ensuring justice for the country.

    Recently, she also participated in the Bharat Jodo Yatra, Gandhi said in a tweet in Hindi.

    “Honouring her patriotism, the government of Rajasthan is fulfilling his dream of having her own home. Proud of you, Devika!” he said.

    “The thing is, Sarge, she’s already made one allegation of rape tonight so there’s no way I’m going out on my own to her house. I’ve got my own safety to think about.” The detective’s words left me momentarily speechless. It was the early hours of a busy weekend, and I was the CID night sergeant on duty. A local woman had been out with a new boyfriend and allowed him to walk her home but not to enter her flat. He had pushed her inside and raped her, then left. She had called 999 and reported the rape and was waiting for a police response.

    All our uniformed colleagues were tied up with the usual, “night-time economy” domestic abuse incidents, mental health crises and custody duties that fill response officers’ night shifts. And I’d had the temerity to ask an experienced male detective to make contact with the woman, visit her to reassure her that she was now safe and to begin to record evidence in his notebook while a female colleague travelled from the other side of the county to assist with forensic evidence recovery.

    I’d like to tell you that his reaction was a one-off, from a lifetime ago – but it was 2015, a year or two into the post-Jimmy Savile scandal era of training courses that instructed us to believe the victim and move heaven and earth to secure convictions. This was another depressing example of police attitudes to rape and sexual assault that have been widespread throughout my career. A culture in which managers’ first questions were never “Is the victim OK”, or “What does she need from us?” All too often, the question was whether or not I thought the victim was lying, and whether I could find enough evidence to suggest she was not credible, and thus justify a decision to avoid wasting resources on yet another unsolvable crime.

    Cases that meet the unofficial credibility test and are deemed to be “proper” rapes get a huge amount of resources thrown at them, as there is a chance of a good “collar” and a great story to tell at the next promotion board. The other cases often don’t even get a detective appointed to investigate, just a keen young copper on secondment to a crime unit.

    When questions are asked about David Carrick and about Sarah Everard’s killer, and the many many other offenders who either never reach the national news or just get away with it, I don’t see a pattern of cover-up and deceit that many outside the service perceive – instead, I see a level of unprofessionalism and incompetence that’s normal for all victims. That’s the scandal.

    I was involved in a rape investigation in which a female senior investigating officer directed me to pursue a line of inquiry solely intended to undermine the victim’s first account so that we could close down the investigation before command had to divert significant resources to it.

    That was on Wednesday 17 January 2023; the day after the news of Carrick and his scores of crimes against women broke. And nobody batted an eyelid.

    I’m about to retire after decades in the force, and I’ve tried my best. I really have. I hope I made a difference for a few people, in spite of the broken system I work within. I know there are good people working here still and the culture is changing, but it is happening at a glacial pace. Best of luck to the next generation, I hope to God they do better than us.
