    “I’ve said it before and I’ll say it again so there is no confusion: Congress will not, under any circumstance, forfeit our constitutionally mandated oversight responsibility of all trade matters,” Rep. Adrian Smith (R-Neb.), chair of the House Ways and Means trade subcommittee, said in a statement Friday. “This is unacceptable and unconstitutional, and I intend to use every tool at my disposal to stop this blatant executive overreach.”

    According to a proposed rule the U.S. Treasury Department released Friday, the term “free trade agreement” as it applies to the Inflation Reduction Act includes deals in which the U.S. and other countries reduce, eliminate or refrain from imposing tariffs and export restrictions, and aim to raise standards in areas such as labor rights and environmental protection. That’s a broader definition than has traditionally been used.

    Under those criteria, a critical minerals agreement the Biden administration signed with Japan this week, as well as the one the U.S. and EU soon hope to sign, will qualify as “free trade agreements,” even though they have not received congressional approval. That would clear the way for electric vehicles made with minerals from Japanese and European companies to receive additional U.S. tax breaks.

    Members of Congress are likely to protest that interpretation in their comments to Treasury, and some have hinted they may take legal action or attempt to pass new legislation in response.

    In the U.S., the negative reaction wasn’t limited to one side of the aisle. Senate Finance Chair Ron Wyden (D-Ore.) said the administration has an obligation to obtain congressional consent on any critical minerals agreements.

    Rep. Earl Blumenauer (D-Ore.), the top Democrat on the Ways and Means trade subcommittee, said the proposed rule “contradicts congressional intent and adds to a troubling pattern of this Administration disregarding Congress’ constitutional role on international trade.” He added that he hopes the administration would “reconsider their course.”

    “The Administration is proposing more than guidance around a clean vehicle tax credit, it is redefining a Free Trade Agreement,” Blumenauer said.

    The tug of war between the White House and Congress over trade policy is not new, but it has become more acute under the Biden administration, said Kathleen Claussen, a Georgetown University law professor who specializes in international economic law. She anticipates the administration’s definition of “free trade agreement” could wind up in court.

    “At stake is the sort of future of how we think about what a trade agreement is,” said Claussen, a former associate general counsel at the Office of the U.S. Trade Representative. “It’s important for Congress to decide sooner rather than later where it is going to draw the line.”

    The Inflation Reduction Act — a crucial element of President Joe Biden’s climate agenda — provides a tax credit worth up to $7,500 for consumers who purchase electric vehicles produced in North America, which members of Congress who voted for the law say is critical to spurring the domestic clean tech manufacturing sector.

    “We intentionally structured tax credits to not just decarbonize the U.S. economy, but to erase the lead that China and other countries have in manufacturing green infrastructure,” Democratic Sens. Bob Casey and John Fetterman of Pennsylvania, Tammy Baldwin of Wisconsin and Sherrod Brown of Ohio wrote in a letter to the Treasury Department sent Thursday.

    To qualify for the full IRA tax credit, the vehicle must include a battery made with critical minerals from the U.S. or a “free trade agreement” partner.

    That creates a semantic imperative for the U.S. and EU to call any minerals deal a “free trade agreement,” even though such pacts would traditionally require the approval of Congress and, in the European Union, its member countries as well as the European Parliament.

    “This is procedurally just very, very complicated,” said one EU diplomat, speaking on the condition of anonymity to discuss ongoing deliberations. “We want to call it a non-binding instrument, but we have to think about the American domestic context as well. So, it’s better to call it an FTA-light.”

    The view from Washington

    American presidents have long negotiated “free trade agreements,” but the term is not technically defined in U.S. law. It is commonly understood to be a pact designed to lower tariffs and open foreign markets after winning the approval of Congress, a concept that has been forged through decades of practical experience.

    The Biden administration appears to be breaking from that tradition. While the Trump administration did not seek congressional approval for trade deals it brokered with China and Japan, stoking the ire of lawmakers, it did not attempt to define those pacts as equivalent to comprehensive free trade agreements.

    USTR has inked sector-specific agreements in the past without seeking the approval of Congress. And the Treasury Department asserts it has the authority to designate a “free trade agreement” in the context of the Inflation Reduction Act because Congress did not define the term when it wrote the text. The definition Treasury released Friday is slated to take effect April 18.

    But this week, the U.S. Trade Representative’s office updated its online roster of U.S. free trade agreements to include a new category of deals. There are the “comprehensive free trade agreements” that already exist with 20 other countries, and then there is the new “agreement focusing on free trade in critical minerals” with Japan, which USTR signed earlier this week. Both are designated as “free trade agreements.”

    U.S. lawmakers on both sides of the aisle flatly condemned the pact with Japan, not only for the terms of the deal but for how the administration went about negotiating it.

    Senate Finance Chair Ron Wyden (D-Ore.) and House Ways and Means ranking member Richard Neal (D-Mass.), who also happens to have been U.S. Trade Representative Katherine Tai’s former boss when she was a congressional staffer, declared the agreement “unacceptable” in a joint statement.

    “It’s clear this agreement is one of convenience,” the two senior Democrats said. And they warned that Tai had exceeded the power given to her by Congress. “The administration does not have the authority to unilaterally enter into free trade agreements.”

    Wyden and Neal’s Republican counterparts, Sen. Mike Crapo (R-Idaho) and Rep. Jason Smith (R-Mo.), were also quick to skewer the deal. Smith offered perhaps the most colorful language, saying the administration is “distorting the plain text of U.S. law to write as many green corporate welfare checks as possible.”

    Meanwhile, Sen. Joe Manchin (D-W.Va.), one of the key negotiators on the IRA, threatened legal action over the Treasury Department’s interpretation of the electric vehicle tax credit on Wednesday. But he also suggested partners like Japan and the EU should qualify for the perks. His office declined to clarify his position.

    In response to lawmaker criticism over the process for finalizing a similar critical minerals deal with Japan, a USTR spokesperson pointed to Tai’s recent congressional testimony in which she said “further enhancements” would make it easier for congressional staff to review negotiating text, make text summaries available to the public and hold more meetings with the public.

    The view from Brussels

    In Brussels, four EU diplomats, who requested anonymity because they are not authorized to speak freely, told POLITICO they are increasingly nervous about the critical minerals negotiations because the legal format of the final deal remains unclear.

    The EU’s trade chief Valdis Dombrovskis said at an event earlier this week that “we are currently discussing with the U.S. the exact content and the potential legal procedures.”

    Two EU officials, who spoke to POLITICO on the condition of anonymity to discuss the unfinished deal, insist the European Commission needs to secure a mandate from member countries for any free trade agreement, even if it’s limited in scope. What’s more, such deals typically require the approval of the European Parliament and EU countries, a process that usually takes several months.

    Miriam García Ferrer, a spokesperson for the European Commission, declined to say whether the deal requires a mandate from EU countries. “This will be a specific and targeted arrangement to ensure that EU companies are treated the same way as the U.S. companies under the IRA,” García Ferrer said.

    Not all EU members share the same concerns about a mandate. Some EU countries in Brussels are keen to move quickly and avoid distractions that tend to arise in trade negotiations, saying it’s best to keep the end goal in sight of getting concessions from Washington on the Inflation Reduction Act.

    Three of the EU diplomats said it would make more sense to wait until the end of the negotiations to determine the legal process on the EU side. “It’s too soon to discuss this,” one diplomat said. “Let’s wait and see what the Commission actually comes up with.”

    Another diplomat added that “form should follow substance” and that most EU countries just want the European Commission to come up with a good result.

    SRINAGAR: Scores of vehicle owners on Thursday alleged that they are receiving the wrong e-challan of their vehicles and urged the authorities to look into the matter.

    Many vehicle owners said that they are getting incorrect e-challan for a violation they never committed. “Even some E-Challans are being slapped on vehicles not present in the area,” they said.

    “I have received one such e-challan with Rs 1000 two days ago for my scooty,” said Dilawar Reshi, a resident of the Malbagh area of the city.

    He said that his scooty has been challaned for not wearing a seat belt which is unfair and at the time this challan was issued, my scooty was parked in the courtyard of his home.

    Similarly, Sameer Ahmad, a Bandipora resident complained that a few weeks ago his two-wheeler was blacklisted by the transport department for violating traffic rules in the Pappachan area.

    He said that the traffic violation was neither committed by him nor that he passed through that area at that time.

    Motorcycle owner, Afan Ahmad said that he has also received a similar e-challan stating that he had committed some traffic violations in Srinagar even though he was in his house at that time.

    To solve this problem, people are now demanding from the traffic police and transport department to make necessary improvements in the system and resolve this technical glitch.

    An official said that the wrong challan can be issued due to various reasons. “Tampering the number plates could make it harder for the system to read the number plate. Because of this, the system would read the number plate incorrectly and send the challan to the wrong person. Moreover, with damaged plates, worn-out plates, or because of incorrect number plates, the challan could be sent to the wrong person,” he said.

    Regional Transport Officer, Kashmir Syed Shahnawaz Bukhari, and IGP Traffic, Vikramjit Singh have assured that they will look into the matter. (KNO)

    Aurangabad: A mob of more than 500 persons allegedly attacked policemen in Aurangabad in Maharashtra after some youth belonging to Hindu and Muslim communities clashed among themselves, a senior official said on Thursday.

    The incident took place on Wednesday night in Kiradpura, which has a renowned Ram Temple. People belonging to both communities shouted slogans followed by stone pelting at each other.

    The trigger for the sudden violence is allegedly due to some miscreants playing loud music outside a mosque in Kiradpura, though officials have not commented on it so far.

    Soon, it turned more violent with around 20 vehicles, including some belonging to the police, in the vicinity allegedly being set ablaze by the rioters.

    Police teams were rushed there to combat the situation but even they were targeted by the stone pelters, and later an SRPF (State Reserve Police Force) team was also deployed there.

    At one point, the police resorted to mild caning and bursting teargas shells to control the rioters as additional forces rushed there.

    “We don’t know who the people, numbering 500 to 600, involved in the attack were. It started after some youth clashed. A combing operation is underway to nab them,” Police Commissioner Nikhil Gupta said.

    “The mob incident went on for almost an hour. The Ram Temple is safe. Around six to seven vehicles were damaged. No arrest has been made so far,” he added.

    There are no reports of any casualties in the incident that has left the minority-dominated city worried in the middle of the Holy Ramadan month of fasting.

    Politicians play blame game

    Shiv Sena (UBT)’s Leader of Opposition (Council) Ambadas Danve condemned the clashes and blamed the Bharatiya Janata Party and All India Majlis-E-Ittehadul Muslimeen for the disturbances.

    Condemning the developments, Sena (UBT) MP Sanjay Raut asked whether “these are the riots that are being feared” and said that “there is no home department in the state”.

    Sena (UBT) strongman from the city Chandrakant Khaire said “Fadnavis is the mastermind of the arson-rioting that rocked the world-famous tourist destination of Ajanta-Ellora Cave temples.

    On the other hand, the ruling Shiv Sena-BJP accused the Sena (UBT) of trying to play politics over last night’s rioting.

    Hitting back, Fadnavis said that some persons – whom he did not identify – are deliberately making vituperative statements in an attempt to aggravate the situation and appealed to them to refrain from doing so, as the city is peaceful now.

    AIMIM MP appeals for peace

    State President of AIMIM and MP Syed Imtiaz Jaleel called upon the government to launch a combing operation and weed out the culprits responsible for the night of disturbances.

    In videos circulating on social media, Jaleel said the Ram Temple is safe and appealed for peace. “I appeal to all my Hindu and Muslim brothers to maintain peace. This is a holy month for us as well as for Hindus. Let us celebrate our respectful festivals with peace and harmony.”

    “No Hindu inside the Ram Temple was hurt. The temple is completely safe. Please do not believe in fake news or videos. I also want the police to take stern action. We do not want an atmosphere of hate because of a few communal forces. They will not be dealt with the strictest punishment,” Jaleel said.

    Treasury Assistant Secretary for Tax Policy Lily Batchelder said the department will work with the private sector to ensure a “smooth transition” on which vehicles qualify for the incentives and for what amount.

    “The adoption of clean vehicles is central to reducing emissions in transportation while protecting Americans from the kinds of spikes in gas prices that we saw at the outset of Putin’s brutal invasion of Ukraine,” Batchelder said. “However, we can’t trade dependence on foreign oil for dependence on foreign batteries and our forthcoming guidance will strengthen our supply chain.”

    The Treasury Department released a white paper late last year signaling the U.S. could use expanded definitions for free trade agreements for imports of critical minerals during the tax credit rulemaking process.

    Manchin has repeatedly expressed outrage over the delay in guidelines for the law’s EV tax credits and has accused the administration of trying to undermine congressional intent.

    On Wednesday, Batchelder said China’s control over critical minerals processing globally underscores the need to strengthen U.S. supply chains “along with like-minded partners.” She pointed to recent, initial talks between President Joe Biden and European Commission President Ursula von der Leyen.

    Treasury’s actions “will advance economic security and stability by ensuring that the United States and allies and partners are not reliant on China for critical minerals in the decades to come,” she added.

    The department did not provide any specific details on the proposed rule for EVs beyond that it will be released next week.

    The Inflation Reduction Act included provisions aimed at lowering the cost for electric vehicles, while also increasing domestic manufacturing across clean energy technologies and components. Since the law’s enactment, companies have announced tens of billions of dollars in EV and battery manufacturing facilities.

    Islamabad: A Pakistan Tehreek-e-Insaf (PTI) leader and nine others were killed when the vehicle they were travelling came under attack in Khyber Pakhtunkhwa’s Abbottabad district, according to authorities.

    Confirming the incident which took place on Monday, Abbottabad District Police Officer (DPO) Umar Tufail told Dawn news that a rival group had opened fire on the vehicle near Havelian’s Langra village which caused the fuel tank to explode.

    He said that the vehicle caught fire and was completely destroyed, adding that 10 people, including PTI leader Atif Munsif Khan, died on the spot.

    The DPO told Dawn news that a heavy police contingent reached the spot and initiated a search operation for the perpetrators but an FIR was yet to be registered.

    Former Khyber Pakhtunkhwa chief minister Mahmood Khan strongly condemned the “attack” on Atif and said such an assault on a political leader was “very tragic”.

    Vehicles whose registration has been renewed (beyond 15 years) will also automatically be considered cancelled. All such old vehicles will have to be disposed of at a registered scrap centre.

    Vehicles of Central Government, Vehicles of State Governments, Vehicles of Union Territories, Vehicles of Corporations, Vehicles of State Transport, Vehicles of PSUs (Public Sector Undertakings) and Government Autonomous Institutions all vehicles older than 15 years will have to be scrapped. However, army vehicles are not included in this. This new order will be applicable from April 1, 2023.

    Significantly, in November last year, the Ministry of Road Transport had issued a draft, in which it was said that all 15-year-old vehicles of the Central and State Governments would have to be scrapped. It was said to apply this rule to the buses and vehicles of the Corporations and the Transport Department as well. Then the government had sought suggestions and objections on the draft in 30 days. Now the government is going to implement this rule.

    In November last, Union Minister Nitin Gadkari had said that government vehicles that are more than 15 years old will be converted into junk. The policy related to this has been sent to the states. He had said, ‘Signed a file under the guidance of Prime Minister Narendra Modi, under which all vehicles of the Government of India that are more than 15 years old will be turned into junk. I have also sent this policy to all the states, they should also adopt it.

    Ghaziabad: A youth was arrested after he took off his shirt and climbed on a car and performed stunts in Ghaziabad’s Muradnagar.

    The vehicle has also been seized.

    The incident took place on March 12. A video of his act also went viral on social media.

    According to police, the accused has been identified as Danish, a resident of Raoli Kalan village of the district.

    During patrolling, the police saw that the youth getting his video filmed while he performed the stunts, following which necessary action has been taken in the matter, said police.

    This is not the first such incident to occur in Ghaziabad, earlier too, police have arrested youths in such cases and seized their vehicles.

    SRINAGAR: The modern bullet and bomb-proof vehicle introduced by CRPF that was recently deployed during a gunfight between militants and army in the Awantipora area of Kashmir on Tuesday, came under spotlight after the photograph of one such vehicle during the operation was circulated on social media.

    The Hindustan Times reported, the CSRV or Critical Situation Response Vehicle can accommodate at least three commandos and be raised to reach the upper floors of a building while shielding them from the bullets, in counter insurgency operations in Jammu & Kashmir’s urban areas.

    Two CSRVs were designed and developed for counter-terror operations in urban or semi-urban areas during 2018-2020, The Hindustan Times reported.

    CRPF officers have two CSRVs and one of them was used in Pulwama as the two militants refused to surrender and continued to fire indiscriminately at forces.

    The hard armour at CSRV’s front can also be used to break walls and provide an entry into a building.

    CSRVs came under the spotlight after the photograph of one of them at the scene of Tuesday’s operation in JK’s Awantipora was circulated on social media.

    Pertinent to mention, the two militants Aqib Mushtaq Bhatt and Aijaz Ahmad Bhatt blamed for the killing of a Kashmiri Pandit days earlier were shot dead in the operation in Awantipora. An army man was also killed and another was injured in the operation.

    The two were hiding in a mosque and were also allegedly involved in the killing of two migrant workers last year.

    Srinagar, Mar 02: Central Reserve Police Force (CRPF) has inducted a bomb/bulletproof armoured vehicle also known as CSRV (critical situation response vehicle) to fight militancy in Kashmir.

    Officials told news agency—Kashmir News Observer (KNO), that bullet-proof vehicles, wall-through radars and drones are some of the new gadgets inducted by CRPF into its counter-insurgency operations in Kashmir.

    They said several of these hi-tech equipment were used in Pulwama encounter recently in which two militants were killed.

    Speaking exclusively to KNO, Alok Avasthy, Deputy Inspector General (DIG) Operations (CRPF) South Kashmir, said that to ensure the zero percent collateral damage and successful anti-militancy operations in the Kashmir, the CSR vehicle has been inducted in CRPF which has a space for four men including a Commander who directs his men to target the terrorists.

    He said that during encounters, they felt the need of a vehicle that would ensure zero casualities to the force and CSR is a best choice. “ This is a modern bullet and bomb-proof vehicle for room/house interventions during encounters in Kashmir Valley,” the DIG said. “This is a confidence booster for jawans as they know, bullet can’t hit them in this vehicle. This has helped to raise the morale of soldiers on ground.”

    He said that the vehicle acts as a force multiplier in situations like narrow lanes and by-lanes where you need a sort of intervene in a room or house where a terrorist is held up. “The vehicle can go high upto 50 feet and aim the target easily,” he said—(KNO)

    Srinagar, Mar 3: A leopard was killed after getting hit by an unknown vehicle in Achabal area of south Kashmir’s Anantnag district this evening, official sources said.

    They told GNS that the leopard got hit and died subsequently, while it was trying to cross the road at Mohripora village in Achabal Anantnag.

    A Wildlife Department official confirming the incident told GNS that they have lifted the carcass of the leopard from the site and will be buried as per departmental protocol. (GNS)
