    Judge rejects ‘terrorism’ sentencing enhancement for leader of Jan. 6 tunnel confrontation

    McFadden’s swept away efforts by prosecutors to apply several enhancements to Judd’s sentence, most notably the so-called “terrorism” enhancement, for what Justice Department lawyers said was his intent to disrupt government functions with force. McFadden discarded their recommendations, noting that Judd didn’t appear to preplan his attack the way terrorists like those in a 2012 attack on a U.S. consulate in Benghazi, Libya, did.

    Rather, the judge said, Judd was “in some ways there at the behest of the president,” who had just minutes earlier urged his supporters to march on Congress and protest the certification of the election results.

    It’s the second time prosecutors have attempted to apply the terrorism enhancement to a Jan. 6 defendant — both times unsuccessfully — during the sentencing process. Assistant U.S. Attorney Ashley Akers emphasized that the government viewed Judd’s crime as “domestic terrorism” worthy of the enhancement, which would add significant time on to Judd’s recommended sentence.

    Invoking the terrorism enhancement can add about 15 years in prison to a defendant’s recommended sentence, set the minimum calculation at 17-and-a-half years, and also flip the person charged into the criminal-history category used for serial offenders.

    However, prosecutors asked for only a modest adjustment in Judd’s case because the 2 offenses he pled guilty to — assault on a police officer and obstructing an official proceeding — are not on a list Congress has established of crimes of terrorism.

    Still, McFadden declined to apply even that adjustment.

    The judge noted that in the other case where prosecutors sought the more serious enhancement — against Texas’ Guy Reffitt — prosecutors assembled an extraordinary roster of evidence showing that Reffitt planned his actions on Jan. 6, carried a firearm, was a member of a right wing militia group and threatened a witness afterward. In that case, U.S. District Court Judge Dabney Freidrich rejected the enhancement, sentencing Reffitt to 7.25 years in prison.

    McFadden used Monday’s sentencing hearing to strike another blow in a long-running critique of the Justice Department, which he has accused of treating Jan. 6 cases more harshly than rioters charged alongside the social justice protests in the summer of 2020. He said DOJ’s charging decisions in some of those cases cast doubt on Attorney General Merrick Garland’s vow for there “not to be one rule for Democrats and another for Republicans. One rule for friends, one rule for foes.”

    Prosecutors have rejected the claim, arguing that Jan. 6 and the concerted assault on the transfer of power stands in stark contrast to the summertime 2020 violence — and is often accompanied by far more compelling video evidence of the crimes. They also noted that in some of the 2020 violence — particularly in Portland, Oregon — federal prosecutors opted against charging defendants who were facing even harsher charges at the state level.

    McFadden, however, homed in on cases like the New York Police Department attorneys who threw Molotov cocktails in an empty NYPD police cruiser, whose sentence he said was relatively light compared to the steep penalties DOJ is seeking for some Jan. 6 offenders.

    Even after McFadden rejected DOJ’s harshest sentencing enhancements, McFadden decided to apply a so-called “downward variance” to Judd’s sentencing, below the recommended sentencing guidelines, which called for a minimum of 37 months incarceration.

    McFadden said he agreed with Judd’s contention that the object he threw at police was more akin to a sparkler than a firework that could have caused actual harm to police officers. Though McFadden said he believed Judd did intend to hurt people in the tunnel — noting that Judd himself fled after lobbing the object.

    Under a 2005 Supreme Court case, federal judges are free to sentence defendants outside of guidelines, but courts are required to calculate the recommended range before imposing a sentence.

    Judd briefly addressed the court, through tears, apologizing to police officers who defended the Capitol and to his family for causing them pain.

    SRINAGAR: A driver died after being hit by an iron road near an under-construction tunnel in the Sonamarg area of central Kashmir’s Ganderbal district on Tuesday.

    Reportedly, the driver was hit by an iron road while offloading iron from his truck near the under-construction tunnel which left him unconscious.

    The man was taken to the sub-district hospital Kangan where doctors declared him dead on arrival. He has been identified as Balvinder Singh

    Meanwhile, police have taken cognizance of the incident and have started further investigation.

    But the president’s visit Tuesday was particularly symbolic for the New York and New Jersey politicians in attendance who have witnessed the $16 billion endeavor suffer several delays over the years. Biden’s trip showed that after repeated setbacks, the critical infrastructure project finally has federal backing— even if it’s still years in the making.

    “All told, this is one of the biggest and most consequential projects in the country,” Biden said at an event in a 30-track rail yard in front of commuter trains emblazoned with the presidential seal. “But it’s going to take time. It’s a multibillion effort between the states and the federal government. But we finally have the money and we’re going to get it done, I promise you.”

    In 2009, officials did a ceremonial groundbreaking for a previous version of the tunnel project that was intended to alleviate commutes for the 200,000 passengers who relied on it everyday. The 10 miles of track stretching between Newark, New Jersey and New York Penn Station are a common source of delays and service meltdowns.

    Sen. Bob Menendez (D-N.J.) said he recalled the celebratory event that was over a decade ago “almost to the day.” Shortly after that, then-New Jersey Gov. Chris Christie pulled state funding for the project and workers who had started digging the tunnel entrance had to fill it back in.

    “Our journey since that press conference has been long and winding. But today it brings me immense pleasure to say we’re finally getting it done,” he said.

    The project was revived after Hurricane Sandy, which inundated the tunnel with seawater. Biden said signs of the damage remain.

    “Today over 10 years later there’s still remnants of seawater in the tunnel eating away at the concrete, the steel and the electrical components within the tunnel,” Biden said.

    New York Gov. Kathy Hochul said the storm underscored the need for the project, recalling how two hurricanes caused severe infrastructure damage when she first entered office.

    “You need to have the redundancy, backups to make sure this region is never ever paralyzed because that’s exactly what would happen,” she said.

    As elected leaders in New York and New Jersey tried to revive the tunnels after Christie killed them, they ran into opposition from then-President Donald Trump. Biden, a known Amtrak lover, made the project a priority when he entered office — approving a required environmental study that had languished.

    Senate Majority Leader Chuck Schumer, a major backer of the tunnel, also celebrated the significance of Biden’s visit after years of disappointment.

    “Finally, finally, finally, we can say Gateway will be built,” he said.

    The federal award will defray half the cost of building concrete casing on the far west side of Manhattan, preserving the right-of-way for future trains to enter New York Penn Station. Amtrak and other local partners in the project are expected to pay for the rest of the work.

    Construction is also underway on other components of the Gateway Program, including the planned replacement and expansion of the Portal North Bridge in New Jersey.

    Workers are expected to begin digging the actual tunnels in fall 2024. The entire project isn’t scheduled to be completed until 2038 and will cost more than initial estimates due to delays.

    Buttigieg said the project is long overdue, stating that “we cannot lead the world in this century if we depend on infrastructure from early in the last one.”

    New Jersey Gov. Phil Murphy echoed the point about the tunnel that was first opened in 1910.

    “One of these days we’ll get into the 21st [century], I hope sooner than later,” he said.

    “When we crossed Jawahar Tunnel, there was a huge crowd for my reception. But there was not a single police man to manage or control the crowd. My security guards advised me not to go ahead,” Rahul said addressing a press conference at Khanabal, Anantnag, as per news agency KNO. “It is very difficult for me to go against what my security guards advise me.”

    He said that he was hopeful that security arrangements would be elaborate for his future programs that includes his culmination rally at Pradesh Congress Committee (PCC) office in Srinagar where he is supposed to unfurl the tri-colour on January 30 and address a mega rally.

    Speaking on the occasion, senior Congress leader Jai Ram Ramesh said that Rahulw as supposed to walk 16 kms today but he could walk only 4 kms due to breach of security. He said that administration must ensure proper security for the Bharat Jodo Yatra in the days ahead especially when it reaches Srinagar.

    He said due to the wrong policies of BJP and RSS, India as a nation is falling apart and the Yatra is an effort to bring the folks together. Ramesh said that BJY has nothing to do with the election politics as of now. “We keep on stating that there are two ways: one that of BJP and RSS and another that of Congress which is the Gandhian way.”
